urine and your driving PES have been previously suspended been previously fined under for statute 327 35215 as a result of a prior refusal to submit to lawful test if your breath you earn the blood as required under chapter 316 or 327 of Florida statute you commanding a misdemeanor in the first degree to punish provided in for statute 77542 or 77543 in addition any other penalties provided by law refusing to submit to bir urine test is admissible in evidence in any criminal proceeding if you are a commercial dver license holder we driving a commercial motor vehicle your refusal to submit the testing will result in the disqualification of a CDL for a period of one year in the case of the first refusal or if your CDL was previously disqualified as a result of refusal to submit to such to any such lawful test you refusal result in a permanent disqualification of CDL so what all that says is if you refuse to do the breath test your driver's license is going to be suspended for one year
