kid and told me, "Come on, get your chicken [ __ ] [ __ ] ass and get the hell out of here." I'm like, "That's why I'm getting all my [ __ ] out of here." So then it comes a screaming match between me and him right there. I come on in. I go over there by him and he's like, "Look, you need to get the out of here." I'm like, "I'm getting my family the out of here." >> Okay. So then I turn like this. That's when he grabs that thing and bam on the side of my head, hits me, takes me to the floor. >> I got blood over here. >> All right, they're here now. >> Okay, I'm assuming this all started This all started with going in there with a coffee. >> He didn't even get >> I didn't even get in there while the grandkids. >> Okay, >> they're seven and nine. >> So, this is between a employee and >> I did. Okay. >> And him. >> You understand? There's cameras and stuff here. I just want to Okay. I just want to It verifies both sides. >> Okay. I only call it the bit end of it. Can you explain what's going on? >> Sure. >> That individual over there who's the clerk or whatever you want to call him. >> Sure. >> Came around the desk. I've got two kids already in there. I'm bringing a cup of coffee to get up to this point. And that's when he starts saying, "Hey, hey, hey." And I'm just like, "What?" He's like, "You can't be taking that in there." I'm like, "That's cool. Whatever." Okay. comes around the corner and he's like, "I'm talking to you." So then this escalates. I'm just like, "Hey man, I ain't going in there to spill my cup of coffee, man. I just poured this. So why don't you just calm down? I got my kids in there." So that's when he starts elevating his voice. >> I start from our room down the hall screaming at him. >> Okay. And you're >> That's my wife. >> Okay. >> We're at 108 105. I was in my bedroom and I was just trying to come get my stuff and he was like I mean I'm trying not to get hit you know he's still trying to grab that box and he's trying to still swing at him and where you know I'm like enough over a cup of coffee like enough I don't give a >> Okay. >> And so he is ID with you. >> You got your ID with you by chance or is it in your room? >> So she's with you as well? >> That's our daughter. >> Daughter. Okay. >> We got our daughter, our son, and our two grand. >> We have two rooms. Okay. What are you guys here for, if you don't mind me asking? >> We just brought the grandkids to swim. They had no school today, so we surprised them last night. >> Okay. >> Yeah. >> And he did that. Give me that back. >> So, he grabbed a pot, right? Or >> he grabbed this. >> This is off the counter for the Kleenex. >> Okay. >> And he got >> And that was up there. >> Yeah. He just got it and just bam. And then we went to the floor right there. >> Okay. Did it cause you pain when it happened? It didn't cause me comfort. >> Okay. It sounds >> It's assault, man. >> Okay. Did it cause you pain? >> Yes. >> Okay. On a scale of 1 to 10, it sounds dumb, but that's how we kind of gauge. 10 being the most pain you ever been in, what would it >> hit me straight in the ear. So, I'd say it give me a straight eight, nine. >> Okay. >> I mean, it it wasn't like on the side of the head or the back of the head. It was like right in the ear. >> Okay. And what pain level are you at right now? >> Right now, my my adrenaline's going through the roof. I haven't calmed down yet. >> Is the pain still? >> Yeah, it's still it's still there. >> Okay. Still at 8 n right now. I'm at a five. >> Okay. Didn't give him permission to do it. >> No. >> I just don't understand how you can eat one thing on the other side. It says that, but it also says no. It says hospitality and welcome and you're not being very hospital. Like I'm sorry. >> And he was peeking in the door to look at the kids though. Well, two guys, two hot heads did not mix, >> right? >> After you drank your coffee. >> Okay. What do you like done? >> What's that? >> What would you like done? >> I want to press charges. >> Okay. >> I want to press charges. That's >> And how late you are you guys paid? >> We were He told us to get the out now. So that's why we're all in our >> in the truck. We were all >> sleep >> doing what he was saying for us to do. >> Okay. >> When he was >> We weren't planning on leaving. Check out was at 11:00. Told the >> You guys spent the night last night? >> Yes. I told him we can swim until 10:30 and then we'll pack up and leave. >> Okay. >> And while we were packing up was we kept running his mouth and I >> and the work last night >> it it started over here the argument >> right >> you transitioned over here. I told >> and then that's when they could hear us arguing down the hallway. >> Okay. >> And then when that's when he kept just saying then get the out. Get the out. >> All right. >> Okay. >> All right. If you can fill out the top part of the form and then the bottom part only write what you witness and or heard visually witnessed and heard >> I'll uh give you no worries. >> Sorry. >> So if you weren't here for the whole thing, you know, at some point >> just right away >> what whatever you heard and saw not hear say from them. >> Okay, that's great. If you guys need a second page, there's some uh additional forms here. Just try to write as uh neat as possible. What I'd ask um I'm not concerned about spelling and grammar. >> So, read it. So, >> so was he out here first or he when this first kicked off when he comes with the coffee, he come from his room? >> Yeah. the barely go. Wait, no, that's him leaving >> when the hell. >> That's just why I tell him that you can't bring. >> Okay. >> And at this point, he's just agreeing or what's he saying? >> No, he's mad. >> He's okay. He sets it down. And then I told him, now I'm explaining to him that I can't let you do it and tell everybody else they can't have the >> sure stuff in there. I said it's a policy like >> Mhm. >> Was anybody else other than him over here could see this or no? Okay. I can't see. >> They were the last two are just taking a drive over by Chelse for a second. We can. >> So, at this point, is he saying anything or is he just in agreement with leaving or >> Yeah, he said he was leaving. I don't know what I I don't remember what I was looking up here at this time. >> Okay. And that's I didn't know if you were checking him out or what's happening. >> No, I think he was just waiting for the kids. >> Okay. And at that point, he had gone in and yelled at the kids already or >> Yeah, he went and told him >> cuz I thought that's what I saw. Okay. >> Yeah. And then or going to the room. >> Okay. >> He starts saying more stuff and I go down there. >> Okay. and tell him. >> So, what kind of stuff? When you say he's saying stuff, what's he saying? >> Well, he's like, "This piece of shit." He's yelling at them all, "Tell us, we got to get out of here." >> And I was like, "Uh, this all this stuff." I'm like, "Get out." >> Mhm. >> And, uh, let's see. >> Okay. So, now they're leaving. >> No, that's where he goes out. And I went out and told him he had to get out of here. Like, don't come back. >> Yep. And >> can you make that one bigger again or the whole thing? Okay. All right. >> Now that I got >> Okay. >> I just got to remember the time that way if it does mess up right back to it. Oh. >> And you can see I'm running from the truck. It came running back in. I didn't throw any punches at him. I just grabbed his arms and pinned him. >> Mhm. >> And told me I needed to calm down. What's he saying at this point or what's happening? >> He's saying um well at first if I would have let go of his arms he was trying to hit me >> but I was he was saying let me go. I'm like not until you're calm down. Like I'm not going to let go of you and have you start punching me. And then I did. >> So I got up >> 907 >> and they're still getting stuff out of their room at this point. >> Yeah. Confirming 2190 Spain. Where did you grab the Kleenex box from? Where was there? >> On the desk, but I grabbed it and like when like rush and grab a hold of him, it might have hit him, but I didn't. >> He's trying to take it and say he's taking it. I mean, you can't take the ship from the hotel with you. >> Yeah, but he's telling me I didn't threaten you. >> Did you hit him with it? >> I didn't hit him. hit him with it in my hands. I was grabbing him >> and it might have caught him, but I didn't like smack him with it. And then we both went down. You see him immediately after that like I had like when he rushed at me, we were immediately >> on the ground. >> So, what's the conversation at this point? What are you guys saying? >> I'm telling him to get out. >> Okay. >> Oh, no, no, no, no. here. He's saying that um he's telling whoever this is >> that it's all because he was drinking a coffee and I was pointing at the door saying, "No, it's because you can't have drinks and and film the pool and that's I said that's what it's over." >> Yep. >> And at this point, did they say, "Hey, we're calling police." Or how did how did you think you guys were ending things? >> Oh, he said he was calling the police and I was like, "Go ahead." Okay. >> Like you've been down here threatening me for 20 minutes. I said, "Then you ran from the parking lot back in and rushed me at the desk." >> So there was no altercation up until he came rushing back in there. >> Yeah, >> that's the only verbal. >> That was the only physical altercation. >> That's not what he's >> We watched the whole video up to this point. So yeah, >> but from here on out it's >> Yep. And I think I remember this from the last time I got video from you, but this is the only angle you have at the front, right? Yeah. Okay. That's what I thought. And so for the rest of this, you guys just stay separate. >> This is all that is from here on until the sheriff is I stay behind the desk in the back. >> Okay. I think we're probably good then. I mean eventually probably want a copy of this again, but for right now I think we're good. >> Okay. I'll uh get a copy of it. >> Yeah. I was going to say no rush. Are they still down there or Okay. >> I know you're doing a written statement. Um, I just want to confirm everything that's being said and stuff. Walk me through the beginning of you coming down here to What time did the kids come down here to the pool? >> Well, we all came down for breakfast right at 7:00. >> Okay. >> So, I'd say after 7 probably about 7:30, maybe 7:40, something like that. >> The kids went back. That's when we all went back and then that's when me and he that's when we all went inside the pool. Okay. >> Then we came back on out >> and >> at what time? >> Huh? >> At what time? >> Within that same hour. Within within the hour. So within 7 to 8:00. >> Okay. >> Really keep in time. >> The kids stayed in there. >> No, they came out out with us. >> Okay. >> And then they wanted to go back in. >> Okay. >> So then I'm like, "Okay, all right. They're going to go back in. I'm getting me a cup of coffee while I sit over there." What time was that at then? >> Within that same hour within 7 to 8:00 all this transpired. >> Okay. >> We're at 10:15. >> Wait. >> Yeah. >> Uh we left then we came back. That's right. We went to Walmart. >> Okay. >> Came back and then they wanted to jump into the pool. >> Okay. >> You know, and I didn't want to go into the pool, so I was going to sit over here and drink coffee, but that's not what happened. >> Okay. >> So, you got the coffee after coming back from Walmart. after we came back from Walmart. Yes. That's when that's when we all went to the room and then >> Yep. >> they took off the clothes and go I kind of came out just like this. I wasn't going to go back. >> So everybody was in the pool already at that point. >> They were kids. >> I didn't even get a chance to go in yet. >> And you were where? >> I was in the room. >> Okay. And you were in the your room as well. >> Okay. And then you the kids jump in the pool. >> Kids jumped in ahead of me. I didn't, you know, I'm going in there to say, "Hey, you know, I'm going out here," you know, but never, never even got into the pool. >> Never even got past the door. >> Okay. >> Cuz we were already in a screaming match. And I'm sure >> So, you had the coffee already. >> I already had my coffee. >> Okay. >> And that's when he started lipping up about not going in there. And I'm like, I'm not going to spill my coffee. Well, if I got to let you, I got to let everyone else. I'm like, we're literally the only ones here. >> So, >> that's that's when we started up and he was like, well, I can't have you. I was just like, I don't need you in my face. And then it just took off from there. >> What did you do with the coffee? >> I didn't do nothing with the coffee. I set it down over there and then I started drinking it. Um >> the kids were still in there. >> Yep. >> Okay. Um what happened after that? >> Then me and him kept kept arguing. Then he tried to justify why he was yelling at me. And I was just like at that time it seemed like we were trying to talk it out. >> Yeah. >> Okay. And from there, uh, they went right back to the screaming match and he he was like, "Get your [ __ ] and get the out." So then that's when I started family. All right, let's go. We got to go. And while we're going in and out, that's when he starts lipping off again. So then >> So then I kind of I came right back in right after he did and I went right back by that uh the edge of the deal there. >> Okay. the edge of the >> That's where that >> metal clip cames from. That >> uh >> why' you go approach him behind the desk? >> Cuz he's calling me a punk ass. And I was just like, "You're not going to be talking to me like this in front of my family." >> They were trying to leave. >> So then I turned to the left and that's when he clocked me with the right ear, man. Bam. Then he jumped on me and we went to the floor. >> Okay. So that's a little bit different than when you originally told me. You said you came back over here. He followed you over to this area, >> right? He also followed me out. >> Okay. But that's when the altercation I mean this is actually happened a lot longer than uh short like yeah I'll get rid of the coffee half hour following us. >> He had this condensed down to like a couple minute thing. Like he said fine I'll put the coffee down. He confronts him over there. >> No. >> Okay. This and I only saw a very short portion of the the video. >> I didn't throw the coffee on him. I didn't. >> Yep. >> I was drinking. >> Okay. And uh everything else that transpired is basically on paper what the cameras are going to show. >> So So the cameras show the what I did see when I walked up there as you pulling up your sleeve in a aggressive manner and he's retreating back towards the counter area or he's standing behind the counter area. I mean >> the metal box at someone >> but he didn't throw the metal box. He picked it up with his hand and Chuck kept it right there as he hit me with it. >> Okay. So, >> I didn't pick up nothing to hit him with at all. I didn't even punch him, push him, pinch him, >> and I got hit with that. >> And and the camera doesn't show everything. I'll be honest with you. >> You know, and there's >> I didn't on the floor. He didn't throw a punch. >> I didn't throw a punch. Right. >> Does he have any marks on him? >> You know what? That's not always just because you don't have marks on you like >> but I didn't understand. I mean I'm taking business law right now. So I'm kind of confused how this escalates that he could just be physically assaulted because he pushes arms up and we are pay customers. You get to throw threats at people. That's just as bad as him telling, you know. >> So our our choices are both people are arrested for disorderly conduct and potentially bad. He started it by screaming at him, calling him a Did you hear that? Right down the hall. This whole This whole place could hear us. >> Okay. Sir, I apologize if you already told this to the captain, but while this was happening, what were you saying back? >> I was telling him basically, >> sir, can you just go your office world? >> Basically replying to anything he was saying at me. >> Okay. >> So, what specifically? What were you saying to him? Like you said he called you a punk ass or whatever. What were you saying back? >> Oh, what the did I say? >> I said a lot that man. >> Yeah, I did tell him that. Um, >> I told him we're trying to leave. That's what I heard. I was like, what do you mean we're trying to leave? We're going swimming. >> We did tell each other shut up a few times cuz we're going back and forth, you know. Um, I did tell him to shut the up, fat man. And we're leaving. And a between here and there, like I said, it was a verbal verbal argument until it turned into physical. >> And I understand people say stuff they don't mean when they're arguing, but like did you make comments at any point about that you were going to attack him or do anything to him or in response to anything he said to you? No. So, you never threatened him at any point or said you were going to harm him or >> threaten him with my family here? You >> I'm just asking. I'm asking. >> I'm just saying. I'm just replying. Okay. So, >> I'm not going to start [ __ ] with my family here. >> You know, if anything, I explain what happened. It's not like I'm drinking. It's not like I'm drunk. >> I'm not saying you aren't. >> You know, I know you're not, but I'm I'm getting kind of worked up over here because I just got hit in the ear, you know, and I'm not over that yet. You know, it's like, >> right, we're going off here stories that we're not going to walk his. We're not going to walk his. The end result is still like he still got assaulted. He's not assaulted. We're not going off a complete hearsay. There's video a good portion of it. So the hearsay is the the verbal end of it. >> Does the video have him hitting him? >> Does the video show him going outside? >> I mean, there's a lot of things in question here. >> Mhm. >> You know, there's a camera right there to show where the argument is. There's a camera right out there that shows him coming right out over there and antagonizing just like I said he was. >> Mhm. And he says the reason that he was following you is cuz he kept telling you to leave and that you weren't leaving. So >> how can I leave if I've got to bring all my stuff back out? >> This is what we're getting at is there's >> And that's exactly what I telling him. We're trying to leave. >> We have all our babies in our hands. We have kids in >> I literally got my kids in my hands. I literally got my bags in my hands and he's still yippy yapping about me getting the out of here. We haven't even gone over there to pay the bill yet, >> right? >> You know, and I'm just like, so then I was just like, call the cops. I'm not I'm not going to deal with this. This is this is crap. >> Mhm. >> I think it's safe to say that it could have been handled better by both parties today. Um because his side of things is that you were saying things to him that led him to believe he was being threatened. That you were saying you [music] were going to kick his ass. Um amongst other things. And I know you said you weren't going to start stuff with your family, but at this point it's just the two of you. And like we said, it's hard to talk with two officers. >> Just let me let me explain. Okay, this is why I'm saying this is difficult because there is no audio. We're all in agreement about that. >> Oh, there's no audio on the cameras. >> No. >> Cover that. So, we can see things, but we can't hear anything. That's why we're trying to figure out, like we said, it's he said, he said, you're saying one thing, he's saying another thing as to what was said between you. So, he's saying he was fearful that he was about to be beat up because, and this I can see at the very end, you take your stuff out with the kids, you come back in, you walk around the counter, and he's saying that prior to this, you had threatened to kick his ass. You walk around the counter, you pull your sleeves up like you're getting ready to fight. That's on the camera. >> What's also on the camera is me turning away. >> Okay? And that's the part we don't see because right in the very corner there's a dead zone on the camera. So we can see you come around the counter. We can see him backing up. >> Right. Right. >> Okay. >> And that's when he comes. Does it show him come toward me? Does it show him grab? >> And he says the reason in he says he wasn't grabbing that to strike you with it. He was grabbing it to defend himself if you were continuing to come at him. So he says he grabs that. He says you came at him and he grabbed you and put you down because he didn't want you to attack him cuz you were continuing to come like behind the >> behind the desk. He came on out from behind the desk and attacked me. We ended up by the trash can. >> Yep. I agree. And I've seen all that. I'm not arguing any of that. I'm just explaining to you what we have right now. Okay. And that's why I'm saying I think, you know, everybody probably said a bunch of things they probably shouldn't have. I agree this was not handled well by anybody, but this is where we're at at the moment. So that's why Captain Petri explained to you at this point, both of you probably made some choices that could have been handled better. I agree. He's a professional. He's supposed to be representing this place. there were things he should have probably done differently. By the same token, um, from what he's saying, you were antagonizing things by making comments back to him. Like I said, I agree. Everybody probably could have handled things a little bit differently. But where we're at right now is based upon how things were handled by both. It's disorderly conduct for both or everybody just kind of goes their separate ways today. We'll have everything documented, but at this point, you said things to antagonize things. He said things to antagonize things. Yes, he came. He put you down. Um, but what he's saying is that he was asking you to leave and that you weren't leaving. So, I'm just explaining the information we have to go on. >> If if you if he wants something done, what we can do, we'll do a report on it, send it up to the district attorney's office. Our our choices are referring it to district attorney's office. They make the ultimate say. They take our reports, your statements, the video, and put it all together and ultimately determine if there's probable cause to show that there's this orderly conduct. Or they can up it. They can override us and say there's battery, that he didn't act in self-defense. Okay. What I saw in the video and what his statements are is consistent with somebody that's getting ready to fight. I've done this job now 16 years that, you know, the average person doesn't pull up their sleeves if they're not showing an aggression aggressive manner. So, our choices are if you want something done, I'm willing to do it. I'll do a report up on it. We refer up to the district attorney's office, but both people are going to be referred for disorderly conduct. You're not going to be allowed to come back to this facility. Well, the case is pending. Okay. You'll be put out on a what we call a signature bond. The other choice is if you still want something done but don't want to deal with the criminal end of it, we can give disorderly conduct citations. A municipal citation doesn't go on a criminal record. Or our third option is and I'll give him the same options as well of we'll take the statements, we'll still do a report on it and uh you guys go your separate ways. You're ultimately a victim and a suspect in the case is what I'm saying. >> We we can't shake a magical ball and be here and stuff. We don't we can't go back in time and insert audio in it. But what you both are saying, we piece the stuff together and it's consistent with what probably both of you are saying. And that's why we came to the conclusion that both of you guys are at fault. >> Okay. Okay. So, we can go ahead and continue this, right? I mean, you said I could go ahead and uh continue your instatement if you want something incriminal done or municipal done or just a report. Minimally, there's going to be a report on it. >> Okay. >> Well, I don't want him to let it get away with it. No. >> Yep. And you have that right. that you want citation issued or criminal charges, whatever. I don't want him doing this to somebody else and thinking that this is cool cuz I ain't cool, >> you know. I understanded that me going my own way and him going his own way is the easiest way to go through this. >> I don't care about the easy way. I'm doing what's justified and what the victims in this one done. >> So, I'm not here to swipe because no matter what, it's another paragraph in my report of saying based on your statements and stuff, we determine it. Yes, there is disorderly conduct. Could I say just cuz you want nothing done and he wants nothing done, I could still issue disorderly conduct. We got called here. I came lights and siren. both pulled from a training to come here for something that either he could have contacted us much sooner and said like, "Hey, we have a disgruntled person here." Or you could have taken your stuff and like screw this business. I'm not coming back ever again. Like over coffee, >> but there's a lot more swearing. There's a lot more swearing going on. There's a lot more squaring off and stuff. We're >> so >> we had more than one trip worth of stuff. >> So it wasn't like we were trying to keep coming back to fight with him. We were coming back to get the rest of our stuff. >> I get that. But again, at some point when shut your mouth and >> agreed >> and >> but as a worker I've been told that I mean worked at best so I mean I've worked at weddings you just keep your mouth you know you do if you have a problem you call the cops you are not the police you are not you know you are not security you are not any of it I I mean I guess I don't understand cuz last time we had a worker here who was sitting here on his phone playing with the fireplace we had nothing but great times and you know great time but you know like I just I don't understand is that what you you want it referred Sure. Okay. I'll grab You go with that. >> Did you get pictures, too? >> Yeah. Well, I got to grab a form. >> So, that means he's getting arrested, too. >> So, what that means is, so I from my understanding, that's what we all just agreed to is that nobody's getting arrested today. You guys are going to leave. He's going to stay working here. We're going to refer it to the district attorney. So, what that means is, like we said, we do our reports. We send everything. you send your statements >> and then they decide >> and they [music] decide if it meets the criminal element that they want anybody charged, nobody charged. Like he said, greater charges than disorderly conduct. Um, but at the end of the day, it'll be everybody goes their separate ways. We do a report. We let them decide if it meets a criminal statute or not. >> It's really unfortunate that there's no audio on any of, you know, just even not necessarily this, but transactions. I've never heard of a tele. And I think it's interesting that he made sure to keep going back to that point over in that area that because that's where you can't get the cameras. I mean >> like what cuz when I came out I didn't hear what >> when I came out he kept going right there where the cameras were. Like he kept yelling at him to keep coming back to that spot. He was well aware there was and I would have known if I would have that's just interesting that you had said well we can't see that. Well that's interesting cuz he kept yelling him bring him right back there and when he kept going you know it was just >> interesting. I just give that to him. >> Yeah. >> Thanks. All right. Um, so I don't know how much that you caught up on some of them. >> Well, I don't really want to close here. You just want to sit back here. Yeah. Yeah. >> Um, so this is for you. So, like I said, I don't know how much he caught, but basically I I think everyone's in agreement. You know, things could have been handled differently by everybody today. Yeah. Um, I'm he probably should have shut his mouth a lot sooner and stopped, you know, the things he was saying. >> Um, by the same token, I would just caution you in the future, call law enforcement sooner so you're not finding yourself in this situation. You know, as soon as you say, "Hey, get out of here." And he's [ __ ] around and not leaving. Call right away. Hey, I've got a patron here who I told to leave. He's refusing to leave. He's verbally aggressive with me. Cuz you're covering your ass then. Okay. >> Sure. Um because right now and this is the predicament we're in is like I said before it's ultimately he said he said he's saying he never threatened you never said anything >> you can see in the video the how he came at me. >> Absolutely. And that's what I'm saying and that's what we were telling him is you know you can see that somebody doesn't come around and pull their sleeves up like that >> and then rush me and see jump away [clears throat] from him. So >> um and so that's what I said like you know he obviously could have made a lot of different choices. Just educational information for you in the future I would call as as soon as you have somebody being like that. Yeah. >> Um because you're protecting yourself and so you don't find yourself in this situation in the future. >> Yeah. I've never I mean I've worked at hotels for 10 years. I've never had something like that happen where somebody actually >> Yeah. >> Like I've had people say threatening things to me, but I've never had anybody actually like rush at me like they were going to hit me. >> Mhm. Um so what we're going to do, and I'm going to I'll leave it with you before I go. I'm going to give you a statement form if you want just to write down everything. Obviously, you've told me everything, but if you want to write a written statement as well. >> I mean, I don't want to press charges on them. Okay. He is adamant that he feels that something should be done. So what we explained is that we're not making any like in-person arrests today because basically like I said both of you could have made different choices, better choices on how this was handled. So we don't feel it rises to the level where anybody needs to be like taken to jail or arrested. So what we're doing >> is we're writing up basically our reports of what you said, what he said. They did written statements. Um he does have some blood on his ear. It looks like he probably where caught him or whatever when we put him down. Um, so we're just going to compile everything, send it to the district attorney's office, let them decide if they feel it meets any kind of statute for one, both, either nobody to be charged and let them decide. >> Um, because like I said, myself, the other officer, we don't feel it rises to a level where we're arresting anybody today. >> Okay. >> He is adamant that he feels something should be done. Um, so any reason I believe that hearing the wild things he was saying, how he was making it like I was the one aggressing at him and he was just being like, "Oh, we're just trying to leave." >> I never I've never I don't think I've said punk ass in 25 years. >> Sure. >> And yes, he's very >> stuff to like, you know, get the bug out of here cuz he was getting aggressive. But punk ass. >> There you go. >> Yeah. Um, but so like I said, so in this case, it's kind of tricky because he's saying you did this, but we're also saying, you know, >> you're kind of a suspect and a victim at this point. >> Yeah. So this is the case number four. So like [clears throat] I said, we're not going to, you know, obviously I'd still like to get the video of this cuz it helps with your side of things, right? It shows >> that he had one of them drives with you. >> I don't have one on me. No, we actually had a train we got pulled away from. So um I wasn't uh prepared to go, but >> I'll know I'll be here till 7:00 tonight. Okay. If I don't know how late you're >> I'll run back and grab it and I can bring it in. >> I mean, no rush for it, but if you want and I'll also be here 7 to 3 the next Okay. >> the rest of the week. >> Okay, perfect. I'm here in the next two days. >> So, if you want to drop it off within I can um >> I can save it there for you. >> Um so, like I said, we're just going to compile all the reports. We'll send it up. Um what the DA have to say if there's something, nothing, you know, what have you. But, um that's kind of how we're going to leave things today. They're finishing up their statements and then they'll get out of here. Okay. >> So, questions from you on any of it or >> No, no, >> I'll take the I guess the state. >> I'll get the statement form. Like I said, it's just you're and then, you know, do it, you know, now, 2 hours from now when you have time. >> Well, when if if it I can probably fill it out later today and then when you drop that drive on me, I can >> And that's what I'm saying. You know, give yourself a minute to, you know, process it so you're writing everything accurately and cuz I can tell you're still kind of >> jacked up and rightly so. Yeah. >> So, let me grab that saving form for you. I'll be right back. All right. Here's this. Um, fill it out. If you run out of room, feel free. Just go on the back, add another piece, whatever. >> All right. And then I I'll probably fill it out. I'm here before 7:00. I'll probably fill out tonight. And then within the next couple days, drop that. >> I'll drop it out. Yeah. We'll see how today goes. It might be today. Otherwise, um, I'm only here till 2 today. So, maybe today. Otherwise, for sure. I'm on 6:00 tomorrow. So, at some point tomorrow, I'll get >> at 7 tomorrow. So, anytime then. Then I'll get it back to you. >> Yeah. Obviously, we're going to stick around till they get out of here. But, yeah, for sure. >> All right. And then yeah, if you got any questions, like I said, the case number's on there. Give us a call. >> I got your card. I think it's still >> still floating around. There you go. That's me. All right. >> All right. Thank you. >> Thank you. >> So, this is the victim information packet. >> Um, my information is up on top. Our officer ticking in. One of us will have the original report. One of us will have a supplemental report because we didn't get exact information. We exchanged it. She watched a video. Um, the date, time, our case number if you need a copy of the report. and then the victim witnesses services. But if you receive something from the district attorney's office would be um if they file criminal complaints, there's times where they ultimately recommend to us that we issue ordinance citations based on the severity of it. Um I'm going to snap a picture with your consent of your ear and then the object that you were struck with. >> Did he cut your hand, too, or is that just from wiping your ear? Uh >> it might be just from wiping my ear. I'm not sure, but >> Or do you prefer? >> No, I got cut. >> Okay. Or do you prefer citations being issued? >> Um, explain the difference. >> So, a citation is a fine. You ultimately are at fault. That's why I'm going. >> I mean, there's We definitely could have got contacted much sooner in this situation, either by you or by him >> or both. You know, it's doesn't just cuz somebody says we get plenty of times somebody I'm calling the cops. We never get called >> and a half hour later things have escalated to the point where now we have to make our arrest >> and just cuz you know you said it, he could have contacted us as well. Um the the ordinance citation is one step lower before criminal. So you wouldn't get jail time out of it. You wouldn't get probation out of it. You'd pay a fine if found guilty of it. >> If I'm found guilty of it. >> Correct. >> But what about with the rest of him? I mean the fact that I could even leave without not getting hit by him trying to be all documented. It's all documented. That's again why he's it's why again I'm not saying that he's solely at fault. No, I'm I'm not saying he is. And I'm not I'm sorry if my tone is coming off. I'm just asking. This is I'm asking because I'm you know, he's not even wanting to leave if I can't even walk out the door without him swinging and making it seem like he's going to hit my dad while I'm trying to walk out. And even as we're trying, you know, >> again, and I'm not here to to pick sides. >> The facts are the what we are seeing on video. The comments are >> says, "Oh, leave." But you're not letting us leave. You're not I couldn't walk out that you that door is right there. So, I was trying to leave and he's still trying to scuffle with the paper even if I wasn't Just bring it down a little closer. But >> your dad clearly approaches him in an aggressive manner. >> I get that. >> That's on video. That's not >> If he's not letting me leave, how are we leaving? >> And that's what caused us things to get physical, >> right? >> You know, and again, somebody's coming at me. >> You're leaving. He's in your way. >> Huh? >> I mean, no, that was what 10:00. >> Oh, sorry. >> It's 10:30 now, but it's not Okay. Location. >> So, >> so by the municipal citation would not require you come to court if you don't want to. You still have the right to appear at court. But again, if found guilty, it would not have a criminal effect on you. Um, and there would be no jail time or probation time imposed to be a fine only. That'd be the same for him. So if he gets a fine, you get a fine is what he's saying. Or we just let the DA look at it and decide if >> I should let the DA figure it out then. I mean I've already >> Right. >> You already got my statements. You got their statements. You got the camera. >> So I'm not trying to do a mug shot on you or anything, but I'm just going to get your face so I can say this is the person I took a picture of. Okay. >> Okay. Uh, do you mind standing up just uh and then your I don't know if I have any more. I didn't get to check it out. I just know that there was blood coming down. >> Okay. Do >> you have all your stuff in the vehicle though? >> Yeah, I do. >> Okay. Do you need to check out? >> Okay. So, that's all done. >> It's all done. We were trying to get all this stuff during this >> and then we sat here patiently waiting for you guys to arrive cuz it already transpired and kids are already inside the truck waiting for us >> and they're in a vehicle right now. >> How old are they? >> Seven and N. >> Seven and N. >> And then our son is 22. Just let me Did they witness the physical altercation or were they out? >> Yes, it was my grandson when I went over there to check on him, he just said, "I'm sorry. I didn't help grandpa. I should have kicked him. He was hurting grandpa." >> What's your kid's name is? Okay. Sig bond right away or >> Sorry. I was under the impression you were just doing referrals. >> Okay, that's fine. >> That was the conversation we had. >> Yeah. Yeah, it was. I just want to make sure. do not come back here. Well, this case is pending until you hear from the district attorney's office or us. >> Come back after. >> Um there's, like I said, there is a possibility where they review it and say issue municipal citations. Um sometimes they say no. Um they don't give us any recommendation. We have the discretion and if they don't do criminal charges, give a ordinance citation. Um this is the first time I've ever seen anybody get assaulted and somebody not get arrested. Usually when I when I usually start something like this, I'm going to jail if I start it, you know. >> Have you been Not that it's relevant. Have you been arrested before? >> Oh, yeah. >> Okay. So, >> I can take you to jail. I can take you to jail if you want to. >> And then he's going to go too. I'm not here to play sides. Like I told you multiple times. >> No, he said he didn't give a >> What's that? >> He said multiple times he didn't give a about >> Okay. So, while this case is pending, I'll make a clear um don't come back here unless you get permission from the owner and um because we could issue a signature bond right now saying that you can't have contact with him or this property, just do the mature thing and not come back here until I mean, if you guys are that disgruntled over the place, talk to the owner. But that's how you >> get information from them to file a complaint with their process. >> You can go online and find that all. So, >> sounds great. >> You have any questions for me? >> Yeah, we're all packed up to go. >> All right. Thank you. >> I will be looking over here. >> Hi. >> How are you? >> Uh, not too bad. >> All right. >> So, uh, Dea filled me in on what happened today. >> Okay. Um, so it's the same guy that's calling, it sounds like. >> Yeah. >> Okay. >> When when they hung up, I >> Okay. >> looked up the number. >> How many times has he called? >> Well, they called a little earlier. Oh, and unfortunately the caller ID didn't pick it up because it was on that phone. >> Okay. >> And then I answered this phone too quick before >> Okay. it uh got it. But I knew it was them because they said, nobody ever calls and asks this. They called and said that can you was the late one of the ladies saying, um, I just I want I want your owner's contact information. >> Okay. >> I was like, well, I can't give you his contact information, but you can give me the note or the message and I'll pass it on to him. Nope. And it hung up on me. >> Okay. And then this one came through and I waited for the it to show up on the phone and I answered it >> and they hung [clears throat] up on me. >> Okay. >> And then I searched Oh, a few guys. Um I searched up the their reservation and the the phone number on the reservation is >> it's the same one. >> 025 here. When you look over here. >> Yeah. >> 0258. Okay. So, can I just >> Can I just grab a photo of that? >> That's screen right there. >> And I've already spoken with the owner. >> Okay. >> And told them what went on this morning. >> Mhm. >> Um >> they've been trespassed, right? >> As far as I know, cuz I told the the police this morning, I told them this morning before the policeman got before it even went down. I said, >> "You're not allowed to come back here." >> Okay. And then um I believe the police I don't know everything that they the police talked to him about this morning. Um I'm assuming they told him not to come back. >> Okay. I I believe they did. That's why I asked. >> Yeah. But yeah, they haven't come back here or anything, but like now like just calling up like >> Okay. >> Stop. >> Yeah. I just want to document it because they're sitting, you know, they're trying to like they were trying to do this morning with the police trying a dude was trying to play the victim >> that >> um you know that he was, you know, Mr. Innocent and I just went off the deep end on him. >> Okay. >> So like why are you calling me like at work now and hanging up on me? >> Okay. Yeah. And I mean they can look up a corporate number or whatever. Correct. >> Yeah. They can call Best Western if they want to speak [clears throat] to I'm not going to give the owner's personal Absolutely. >> And um I didn't even tell them though on the phone like when I answered >> that I knew it was them, >> right? >> Like I was just like, "Oh, no. I can >> I can take the note." >> Okay. >> But um [clears throat] yeah, I just, you know, they're trying to play Mr. Victim. >> Okay. Yeah. All right. I can give him a call and tell him to cut it out. And uh do you have the like corporate number or whatever that I'll just give them that and tell them to call. >> I have a corporate number, but they can go like bestwestern.com probably and get the like I don't have a >> like I have a reservations number. >> Okay. >> But I don't have like >> Right. So any number that you have would come directly here. >> Yeah. Okay. >> So if they want I mean they can look it up on bestwestern.com or they can just wait because the >> the owner knows about it already. I've already spoken with them about it and the there's >> they wrote their little statements this morning. >> Okay. >> Um I don't know if you need the case number or anything. >> I I have it. I can look it up. Yeah. >> Um >> so >> but [snorts] I just don't I don't want them to keep calling and bugging. >> Okay. >> Cuz I leave it seven. I don't want them calling and bugging the >> Okay. I will >> I will give them a call and have a conversation with them. >> Hello. >> Hi, this is Officer Comey Chilton Police Department. Is this >> Yes. >> Hi. I'm calling you because it sounds like uh the Best Western got a couple phone calls from you in the last hour or so. >> Yes. I called around 2:30. We were hoping the person from this morning would be gone. We asked if we could get the manager or owner's information. >> Okay. >> And he said no, but he could pass on whatever we want to tell him, and I said, "No, thank you." So then I waited till 4 to see if the night shift person would be on and we got the same call or the same person answered. So, >> okay. So um >> because we called corporate >> okay >> to try to ask >> um and they said we have to ask the local hotel that they could not give us that information. >> Okay. So you like you tried calling the it was like a 1-800 >> um let me look see what's what it was here 528 1238 >> yes >> okay and they weren't able to like do anything to put you in contact with that or instructions on how to >> she said the lady that answered said you know that because the police were involved that we have to either go through the police, an attorney, or just let it go. And I'm like, well, it would be nice to be able to speak with the owner or the manager. >> Okay, >> that's what I'm asking for. And I said, you can't give me that information, their contact information. And she said, no, not once the police are involved. >> Okay. Um, so it sounds like the owner is aware of uh what occurred and will try to reach out to you on this phone number. >> So, he has been made aware of what what happened. >> So, he should be reach I would assume would be reaching out to you regarding it. So, >> um >> Okay. >> I Okay. So, it was just the two times that you called. >> Yes. Once around 2:30 and once around 4. >> Okay. So, I I just want to make sure that you guys don't have any intention of like continually calling and hanging up and stuff or anything like that. >> No. The reason I >> we just trying to get the manager's information. >> Okay. The reason that I um bring that up is because it's happened before and um people get cited then for harassment or unlawful use of telephone if they do that. >> Right. >> So um but yeah, like you said, it just sounded like it was a two times >> contact information trying to get a hold of someone different than the guy that we >> Okay. >> You know, so someone holds them accountable because the officers that responded didn't. So >> Okay. Well, I that'll be up to you guys if someone gets whatever happens as far as enforcement action or whatever. I wasn't there investigating it. Um it sounds like both my chief and captain were. So, um >> and they were more worried about the training they were missing than actually arresting him for >> Okay. Well, >> what is that? >> I'm I wasn't there. Didn't investigate it. So, I'm not going to get into it about that. Um, >> so I but the owner has is aware of what occurred and will uh contact you. >> Okay. >> Okay. Sounds good. >> All right. Thank you very much. Yep. Hi. >> Hello. >> Hello. >> Hi. >> So, it's one for each of you. >> Okay. >> Um right here. >> Okay. Hello. >> Hello. >> So, what was he charged with? >> Disorderly conduct. >> Oh, the same thing. >> Same thing. >> It's like, dude, just pay the fine. >> Yeah, he's fighting it. So, there it would be our city attorney is requesting that both of you come as witnesses. >> Okay. >> Um for his trial that he has for it. >> Okay. >> Uh date and time are the ones in bold. >> Okay. >> Um yeah, if you have any questions, he would be the attorney handling it. So, Men Law Firm, it's in out of Chilton. >> Okay. Um, yeah. Any questions? Otherwise, just make sure you're there that date and time. Okay, >> sounds good. >> All right. >> I don't know what there was really to dispute. [laughter] >> There was two people that didn't get along. And hey, >> and that's what he said. He's like, "Just pay the fine. Just >> Yep. I know. >> Should have be different." >> Yeah. Two adults that weren't acting like adults that just >> they rubbed each other the wrong way. But I'll tell you what, man. I I I own it, >> right? I own it and say, "Yeah, I was a participant." He was. So, >> yeah. Well, unfortunately, he's not there. So, now we got to Everybody's got to go through the rigomearroll and >> uh myself and the other officer will be there as well. So, we will see you then. Thank you guys. >> Thank you. >> Danny and the hotel employee were both found guilty for disorderly conduct. Danny was required to pay a $232 fine and the hotel employee was required to pay a $299 fine.
