on February 11th 2024 officers from the monoman Falls Police Department responded to the report of a vehicle that drove off of the roadway um do you want to work a second o I try it and see done for he said he had some drinks earlier I it's up to you it's my area I'll take it or if you want another practice round you can take another practice round doesn't matter when did he say he last drank he said a couple hours ago he said he dropped a friend off and I don't smell anything yet think we might it might be past that window too I I agree watch let's chat with him try to get some more info about like what time he dropped his friend often Hey sir about how long ago did you drop off your friend You Remember by chance I've been here for around an hour or so okay um I could just check my car locks I call him at 30 309 we're still at Toppers okay so I would say around 330 around around 3:30 okay and you've been how long have you been sitting here roughly I'll say about an hour hour and a half you've been trying to get someone to come and help you with the car or anything or just yeah I called a whole bunch of places to help toe okay and things of that nature and my mom is on the way to come pick me up and say you okay ARP coming do you have do you have any uh any thoughts to how you may have gotten down here with the vehicle I know what happened when I wasn't B it I just I'm pretty sure well I I'm pretty sure I fell asleep while I was driving okay and when I turned well it was a curb I don't know why I was coming this way cuz I was coming from Glendale Greenfield whatever whichever one it is and I don't know why I was on Flint Drive whatever I don't know if I mixed my exit or not but I remember just I was listening to music and once I after I crash I listen to my songs and I don't remember the song playing before the song played I remember the song right before that one so I'm pretty sure I fell asleep right before okay in the closet did you not get enough sleep during previous day or I mean did you get adequate sleep do you think you think you're just sleep deprived or I mean it's 4:00 in the morning I would have been sleep by now if I Dr my phone off all right and where were you just hanging out your friend's house you said or we out all right so did you did you have a couple of drinks earlier in the day or earlier in the evening yeah but I took them home and everything I was okay what were you drinking um tequila tequila two vodka lemonades earlier two just like are we talking short ones or like tall ones vodka lemonades short on Singles okay on what time do you think you stoed drinking if you can remember I say midnight Midnight probably earlier that yeah okay okay I'm it's are you injured at all no it's not alcohol related my water bottle put water in here you can smell this things of that nature it's not not saying I don't believe you just P AA in there just check it and see if you're injured at all do you want to be checked out Med we got medical here in case you want to be checked out for anything you sure fine okay all right why just hang tight sir he said no medical no medical and he said he last drank around like between 11:30 and midnight okay you Show Me's been drinking Show Me's been drinking water I'm not even really picking up a sense it's very very faint he's answering all questions he doesn't me he seems like he's clear minded but his eyes don't look like they're bloodshot how's it going all right well he said no to Medical he said he's fine okay talk to him like verify he doesn't want but he clearly jumped the curb hit a tree and he said he fell asleep he been here for a little bit so no he lives down the road a couple minutes yeah so I mean he seems 100% with it how you feel he say last rank around like 11:30 midnight so I stopped and he said well I drop his pH off at 3:30 in the morning MH they were at Toppers before that there's something I'm smelling something but it's I smell cologne that's the thing I I don't know what it is I'm smelling it could be colog that's my thing is like his eyes don't look GL glossy at all his eyes don't look bloodshot his eyes just tired that's why I think I might just call ster on this one and be like there's a lot of unknowns on this one that it's hard to prove yeah his car's [ __ ] but yeah gave me the same answer Paul I'm just going to it's Toppers we were there for like 45 minutes to hour I dropped him off at home in Greenfield green Deale one them ever far from here 20 minutes from here after I dropped him off I was on the way home I'm literally 5 minutes away from my house and I know I pretty sure I fell asleep I don't know why I am in here but I I fell asleep and I woke up and I had to Swerve it was a curve whatever then I hit a tree okay all right and then at any time did you think the dial 911 call and say hey I just ran off the roadway or anything like that or uh 911 went on my watch or whatever but I called my mom first cuz I didn't think I I didn't hit my head I wasn't injured or anything like that so I was just crawling my initial thought was just to try to try to drive off of the w b but I'm stuck so then my mom has AAA so I called her try to do AAA and then I called a whole bunch of other toe places try to get out of there spot okay okay what time did you call your mom at does it say on your phone yes I called a whole bunch of people um first time I called my mom was 354 I called my girlfriend at 332 and 352 and that's after or before you crash after I crash so um I'm pretty sure I called my girlfriend at 352 so I'm Prett sure that's when I crash and I my mom after she okay all right hang tight a second yeah even his he said he called his girlfriend after he crashed and that's at little after like 3:30ish so he's been waiting trying to get someone to come help him uh here's a car here it might be his mom who knows what did uh what boss say are you seeing anything I don't clearly me pretty sure fell asleep Joe see over here hul can make contact with him um Sarah said he admitted the drink in he did so car was running yeah okay let me see who this is he said he had two VOD kill lemonades and stopped it around midnight okay well I'll run him through fields and we'll just go from there I mean if he's not impaired anymore then he's not impared anymore you know what I mean mhm Toppers once we got the Toppers we ordered food there I drove from Water Street to Toppers after Toppers we sat at Toppers ate the food we were there for like an hour and hour and a half my friend St like 10 15 is from Toppers he stays in Greenfield green Deale whatever past West Milwaukee M Parkway or whatever on CL Spring Avenue I don't know the exact street I dropped him off over there that's like 20 25 minutes from here I was on the way here I stay on 97 and get hope I don't know what happened between uh what happened between the Good Hope exit and the what call like that little area there I am on this specific path whever I was just following GPS after I remember I was supposed to take a turn or whatever and then I remember like looking up and I was have to swerve and I this okay and you were so you were the only one in the car at that point okay so yeah you're the one driving okay okay all right just hang out with officer hall for a sec I just got to talk with officer [Applause] Snider oh so yes no kind of tricky how was it tricky what did you have in the eyes I know for had two clues in the eyes okay it was hard to tell with the the 45 okay would anything like with contacts disrupt anything with that at all no okay can you smell on now faintly I say and all that he might still ask you the same thing I said the walk turn this and he stopped looking at his feet a couple of times not a clue true so you had lack of smooth Pursuit it and you also had maximum deviation maximum deviation it was it was hard for me to pick up so I I have four of those six so with regards to that yeah okay and then the one leg or sorry the walking turn walk turn all over the and then he just walked backward mhm so this is yeah this is where you just this is where you just got to make a decision do you feel that his ability to operate a motor vehicles in par taking the totality of everything and the fact that this vehicle is but so I'm not talking about the totality I'm talking about right now def Fields with them based off what you saw I think you fa fields so you feel comfortable with taking him into custody fori M okay what's what's your conclusion you feel the same h i mean I saw the same thing that you saw I didn't see onset but just because you don't see it doesn't mean it's not there so if you want to ask him to check his eyes again really quick if you want to check you want to check for onset really quick again but we I saw it I saw lack of smooth Pursuit I saw maximum deviation so if you want to check for onset but realistically we need four out of six yeah so just cuz you didn't see it it doesn't mean it's not there so basically like I said you have lack of smooth Pursuit you have maximum deviation his walk and turn wasn't anywhere near close to how you instructed it to him so yeah I mean I sawell those same Clues and yeah you need four out of six and the eyes don't lie so which is what I go by okay so if you feel that you have enough to take them in the custody let's do it okay so yeah he confirmed he said he last drank at midnight said he has not drank anything since midnight and then he admitted that he was the one driving the vehicle at the time of it so H PBT or anything El uh hul last him I think he said no okay so all right all right so we'll ask again if he wants to do a PBT and if not then we'll do our thing all right sir he said no no okay all right so uh it's based on the fact that you ad made of drinking and uh going through the field standard field testing um I believe that you are impaired you the car see how easy that is can you adjust my my handcuffs once you get over here cuz my wrist really hurt and as you can see my wrists AR in the way that they were was going cuz you guys have been pulling me for 10 5 minutes how however long it's been hello again okay so update for you so like I said earlier when I talked to you when you pulled up he did admit to drinking earlier um he's been completely Cooperative up until the last few minutes um officer Snider ran him through some field sobriety testing for opting while intoxicated there was enough Clues there that we believe he was impaired still uh we asked him to do a PBT which is non evidentiary it's just to see if what we saw is really what it is or not he refused to do the PBT which is fine it's his right to do so um SNY plac him under arrest So currently he's under arrest for ow first um so we basically bring him back to the PD fingerprints photographs we see if he wants to do the intoximeter which is the evidentiary machine um if he says yes to that then we'll get a true value of what it is um and because this is a first defense it's a municipal ticket basically ow ticket at the end of all of it um I'm assuming he'll probably want to call you it takes about an hour hour and a half to do paperwork stuff like that um if you want he can call you or he can call anybody else if you would like a okay so that's kind of where we're at which one station uh monomin Falls Police Department off Pilgrim Pilgrim and Appleton you know where that's at okay um yeah he was very compliant until I think he knew he was under arrest and that's but he's okay yes he is okay yep he did medical came and asked him if he needed any assistance he didn't hit himself um doesn't appear to be any kind of head injury nothing like that he didn't throw up in the car or nothing like that so um I what's that I talk okay yeah yeah yeah he said he had called you so and he had been sitting here for a little bit when I guess an employee in the area saw the car called us so yeah cuz he was an employee here before oh really oh maybe that's why he ended cuz he wasn't sure why he ended up coming down this way he just he said he fell asleep which we believe but there's more involved you know than just falling asleep so um aside from that though that we'll have to get the car tow so we're going to call for a toe oh already did how long do they say how long it's going to be they said an hour to okay I'll check with the boss we may have you call back to insurance and have you cancel um it is off the roadway right now but generally when you call through Insurance they'll say an hour maybe two hours and that's hopefully they show up in that time we call for tother here within 20 to 30 minutes that way we can get it off it would still go through insurance or triaa or however you AA yeah however you do that that'll be up to you later U basically our tow truck comes they take the vehicle take it back to their lot and then if you do insurance or whatever the case may be handle it that way so I'm assuming he does have vehicle insurance do we know hope so yeah so it's still if it's an insurance thing it still goes through Insurance it just is through our toe company instead of waiting for whoever comes out you know this AAA like I just my son's car broke down a couple weeks ago they gave us like a three-hour window which was so we went home had pretty much had dinner and then had come back with the toe so um yeah so that's pretty much where we're at with all of that so um we'll figure out who's going to do the vehicle stuff I'll let you know um if you want to pull up closer I guess you can I mean um I don't know if officer Snider will allow you to talk to him before we go back to the PD I hope so yeah and I I don't see why not but it's his investigation it be up to him so but if you want to you kind of pull up parallel to the driveway and we kind of go from there so she's hoping to he's sticking a spit off the car I really don't want to use Force on your son he's requesting to see you he just talks and sense into him he's under arrest you you can pull up a little closer so you don't got to walk so yeah like I said he was cooperative up until the handcuffs came out and that's when he just was much less cooperative and refusing to get in the car and trying to be as polight as we can so but yeah if you wanted to pull up kind of where his car is just on that side of the road and go over and talk some sense into them like this so yeah Tad is stubborn it happens so but all right to to get my prescription and my contacts they literally told me to get my pup pupils dilated and stuff like that or whatever and they said that my eyesight my eyes aren't right as far as the right to left whatever he asked me I get my P di I should look back into that y y y so then I complied with all the sobriety test stuff he told me that I he asked if if he said it was um not mandatory that I get the sobriety test the breath and then I said no because I think I did well enough in the regular test which was the eyes and the walking to be able to be okay then after that I asked for you to come over here and they said no your mother would be able to come over here after you compli get in a car you put handcuffs on you and get in the backseat and we'll put you and we will let the windows down then after that I got into the car and said okay I was walking towards the car said okay can you bring my mother over here so I can talk to her so you can see everything that was going on they did not allow that happened um I got I was starting to get in the car and then I asked to for you to be able to come over here and then they told me that no you will not be able to come over here and then after that I start by put my foot was right here or whatever and I was I said no I will get back in after what's called he said no that is not the case we no one told you that not happened and then I looked dead into the eye I said to what's call cuz the supervisor which is the the guy back here talking to the D with the hat on him he said no that is not uh that is not whatever whatever it's called the um regulations rules regulations y y y he said no that's not how to go and I look back into his eyes right here right behind you this guy this ballhead guy right here I asked him I said so tell me did you or one of your one of three people that was next to you did one of you guys not tell me that once I comply to everything and get in the car you will have my mother come over here talk to me R the window down so she can come talk to me didn't answer the question at all didn't answer it and so I said I start I I resisted I put my foot right here or whatever and then they stop comply comply comply yelling me I got one person lifting my leg up I got him opening the door over here pulling me look look how my wrist are in the handcuffs look how my wrist are my [ __ ] wrist hurt I'm F to [ __ ] cry all right so right now we do have transfer back to the PD ultimately I'm asking you to have put his foot in the car one of them put one of them is grabbing me from this end he finally somewhat gets it in I have this foot out here they can't what call it this dude he said okay I'm going to I'm going to okay whatever he closed the door open door his bag starts grabbing me again from that way then after they realize they still can't get me in because I have two legs it's whatam call right there I understand how that Whatchamacallit then they comply and say okay we're going to bring your mother over here we're going to bring your mother over here why is this so difficult why are you resisting y yada y it's okay I'm already going to jail I'm already cuffed I know but still calm down I'm already cuffed I mean there's nothing I could do in this situation to make them unrest me anything like that I'm not drunk on you I'm not drunk at all Cal down mom how the [ __ ] am I'm I'm sorry for cussing at you I'm sorry M how am I supposed to cut calm down I literally feel like I proved to him that I'm not whatam call it we do need I said that I won't go to the balizer because I feel like I have complied enough to do that and then once he said roll the window down for you okay that's one thank you I'll correct the window for him do you have your ID on you so I can get that from you and a phone number and then so Sergeant stare she said she called for a toe already she said she called for a toe already do we want to wait for her toe or like an ETA on that they I don't know how long it's been since I've I thought I think she's said a little more than an hour but minutes I can one of you guys my hand let me just get a quick phone number from you real quick just a quick so reference a drink of water so and bring it back like you said there's an intoximeter the official test we can't have any fluids no Foods no nothing up until that's done so as soon as that's done we'll get him some water and quench his thirst if that's what's going on um but so because because of the testing because the investigation we can't give him anything to drink so I know he's asked but unfortunately we just can't do that right now so um and then we just verify street is good for the address on your ID look how my hands I understand but you gave us a problem already so we're not going to take him off CU you literally lied to me okay and you we're not argu you you not look my I see how it is but they not going listen to me I'm coming I'm coming I'm coming here I know tell them to cancel because it's a police investigation um we're not we're not we looked in the car there's nothing in there I he's got his water bottle there's no containers nothing like that so we're not concerned anything like that um but because it's on private property it's off the roadway that's why we have our toe come out they'll be here probably within 20 to 30 minutes um they'll come out as best they can pull it out without making more damage um he's kind of down in there pretty good um aside from that yeah it's a municipal traffic ticket in the state of Wisconsin your first one's just a silly little traffic ticket so um I think that's about it you can you'd like to go home so no I'm going to the station okay so it takes about an hour hour and a half like I said i'mot no problem photos fingerprints if he wants to make a statement anything like that you can come back get you warmed up cuz I know it's cold out yeah it's it's very cold out here um yeah so and that's just like I said he pass anything so at this point he won't be unarrested so if he does the intoximeter and he blows under the charges still go through he's still picture has been taken he's been finger printed correct so that makes no sense if he's not drunk and he's so you well this is just so that's just our booking process because he is he shouldn't have been booked but he is cuz he's under arrest I know but he shouldn't have been you can start it up and warm it up if you need to so you shouldn't have been arrested because not well so but that's the issue so based on the testing the field sobriety test and you know the eyes the walking the one leg stand all that kind of stuff there was enough Clues there to make us believe that he's under the influence so and he admitted to drinking just a matter of a few hours ago um at least what he told us so that's and then we offered the PBT which is a breathalizer here it's non evidentiary and I let him know that like we can't use it against him in court um it just kind of helps us just not justify but determine if he is intoxicated or is he just cold is he just nervous that kind of stuff he refused and at that point the the decision was to place him under arrest and bring him back so and like I said the booking process is just because he's formally placed under arrest for ow first booking process comes with the photos the fingerprints all that so shows that he's not Dr M with they so he'll get he'll get a court date and if he is under the legal limit then the judge will decide if they want to go beyond that he may not get an o I first he may still get so we'll say he blows like a 0.04 so it's under the legal limit so he may get a citation for uh operating with a prohibited alcohol concentration so instead of the ow so that's kind of how that works if you want to close that put the window down yeah no if you want to put the window I just want to make sure you're clear on what's going on and then I'm going to stay here with the car um and then obviously there is a crash so I got to write a crash your rept as well so but uh I think that's about it um you you want to close that I know you're cold I know you're cold there we go you can put it down a little bit if you want to stay um yeah so that's pretty much where we're at that if you want to call the uh whoever you yeah call them let them know the police are going to do the tow that they can cancel um and then the police department so we don't really have anywhere in there to you to sit but if you're comfortable sitting in your car and then we'll give him plenty of opportuni to make phone calls to you or whatever the case may be and if you're in the parking lot we can always come out and talk to you that kind of thing so okay you got any
