Give me your driver's license or this
window is going to get busted in. Get
out of the vehicle now.
>> Look at my eyes.
>> Are you surprised at what happened? Are
you a toddler? How do you want me to
count to three?
>> You are not a goddamn constitutional
right. I didn't do anything wrong. I was
traveling.
Welcome back to the Van Valian channel,
guys. Today we have yet another Tik
Tok/YouTube lawyer finding out the
hardware laws apply to her following a
traffic stop for driving erratically and
for nearly colliding headon with a
police officer's squad car. Grab the
popcorn for this one.
>> Yes, sir.
>> Hey, you can roll the window down for
me?
>> No.
>> Okay. Well, then you need to step out of
the vehicle.
>> No, I don't.
>> Yes, this is a traffic stop.
>> For what? For what crime?
>> For multiple different IBC violations.
If you roll your window down so we can
talk. I'm officer from a call.
Bloomington police. I'm wearing a body
camera. Okay. There's several reasons
why I'm stopping you. Number one, you
have a front license plate on your
vehicle. Number two, you failed the
signal 100 ft prior to your turn. Number
three, when you turned off of Morris,
right in front of my squad car. No, I
don't have to repeat it for you on your
camera. Okay? I'm repeating it on my
time. You can't even figure out your
camera right now. When you're more
interested in getting your phone to work
to record a video to post on Tik Tok
instead of addressing the reason for the
stop, you can be certain you're dealing
with a special kind of stupid.
>> You went over the middle line. Okay.
Give me your license and your insurance,
please.
>> 25. I'll take the return. She's refusing
to get out of the vehicle and refusing
to provide ID.
>> I have a right.
>> Give me your driver's license.
>> You don't need to tap.
>> Give me your driver's license or this
window's going to get busted in. That's
what's going to happen. Would you just
tell me what was going to happen?
>> I said if you don't listen and give me
your driver's license
>> and step out of the vehicle, the
window's going to get busted in.
Absolutely. Pennsylvania vers Mens is a
Supreme Court case that requires you to
exit the vehicle when demanded. And I'm
demanding it. Get out of the vehicle.
Get out of the vehicle.
>> Yeah, she's definitely got that. I'm a
complete [ __ ] and a danger to myself
and other road users. Please break my
window. Look about her.
>> You going to give me your license?
>> My license?
No. Give me your license. Okay, we're
going to play this difficult. All right,
guys. She is refusing to get out of the
vehicle and won't roll her window down,
so we're going to bust it. You going to
get out of the vehicle?
>> Are you going to get out of the vehicle?
>> Get out of the vehicle.
>> I haven't done it yet.
>> You're under arrest for obstructing. Get
out of the vehicle. Are you going to get
out or do you want your window busted?
You're trying to make a big scene and
it's your fault for not exiting the
vehicle. in the car.
>> You're in a car and you've made multiple
IBC violations and now you're not
identifying yourself with a driver's
license and you're not providing
insurance and you're not stepping out of
the vehicle.
>> I will give you my
>> Get out of the vehicle now.
>> And now for arguably one of the best, if
not the best window busts of the year.
We don't get to see from the inside, but
if we did, it would look a little bit
like this.
Show me your [ __ ] head. What the
>> ready?
>> Explain.
>> Nothing in my car.
>> Okay, get out of your vehicle.
>> This is your last warning. Get out of
the vehicle or I'm going to break the
window.
>> You are bullying me.
>> Get out of the vehicle or I'm going to
break the window.
>> Get out of the vehicle.
Go ahead.
>> Get out of the vehicle.
>> Get out of the vehicle. I warned you
when I was I warned you.
>> Get out of the vehicle.
>> What the?
>> Put your hands behind your back.
>> What the?
>> Of course you've got glass in your eye.
You ignored 11 chances to get out of
your vehicle. But hey, at least you're
not eating it like our soft seat friend
in Georgia. So, you know, swings and
roundabouts.
>> Are you surprised at what happened? I
warned you when I was going to break the
window.
>> You're a bully.
>> I warned you when the window was going
to break and I told you what would
happen if you didn't get out of the
vehicle. You've been told everything
that was going to happen from the very
beginning. No, no, no. You are on a
traffic stop. You are required to give
your driver's license.
>> You are required to give your driver's
license. Do you understand that?
>> You are.
>> No, I'm not.
>> You haven't even identified yourself.
>> What you're doing is illegal.
>> Okay. Yeah. I'm not sure the woman face
down in the asphalt right now for
refusing to comply with lawful orders
and who goes on to end the night with a
slew of charges, one of them a DUI, is
in a position to accuse anyone of
anything right now, least of all illegal
behavior. But, you know, please don't
let all that and your insufferable
nature stop you from trying.
>> I have nothing on me. I haven't done
anything wrong.
>> Are you going to stand up?
>> What the
>> Okay, go and step back here. You are
under arrest. Are you kidding me?
>> No.
>> I didn't do anything wrong.
>> Okay, I'm going to stand right here. I'm
going to check your pockets.
>> I don't have pockets.
>> You do. You're Why are your pants not
even Get back here. Where are you going?
You are in custody. You are under arrest
>> for what crime?
>> For obstructing at the very least
>> and probably DUI.
>> Get your hands off
>> and now resisting. You're adding
charges. Knock it off.
>> Get your hands off me.
>> Absolutely adding charges.
>> Get your hands off me. No, you're in
custody. That's not how this works. You
couldn't listen to simple commands
earlier and now here we are.
>> Ah, yes, officer. But she's got an
excuse for what my wife describes as
unladylike and what most of us call
illegal behavior. It's called the effing
godamn constitution.
>> Cuz I should submit to a man, right?
>> I don't care if it's a guy or a girl
officer telling the rest of you to
listen.
>> I didn't have You didn't have to pull in
my car like that and bust my window out.
>> Ma'am, how many opportunities did you
want me to give you? Are you a toddler?
How do you want me to count to three? I
told you like what, 12 times?
>> How many times did I tell you what was
going to happen? Was it a surprise to
you?
>> A toddler?
>> Yes. You can't listen to simple
instructions.
>> How many times did your mommy hurt you?
>> Okay, that's a nice comeback for a
toddler having a tantrum. Thank you for
proving the officer's point. But that's
a question you need to ask yourself
because like the officer said, you're
the one who finds simple instructions
difficult to follow.
>> How much have you had to drink tonight?
After you busted out my window and
drugged me out my car and threw me on
the ground.
>> Yes.
>> What he's asking is how many alcoholic
beverages have you consumed tonight?
>> After you drugged me out of my car and
busted out my window that's illegal.
>> I'm pretty sure that's illegal before
that.
>> Do you have any eye problems or
abnormalities? Any eye problems or
abnormalities? Okay.
>> Yeah. With people who have power issues.
>> Okay.
>> Yeah. I'm not sure the person behaving
like they're above the law is in a
position to accuse anyone of having
power issues. But again, please don't
let a little thing like hypocrisy stop
you from trying.
>> I don't think she's willing to do it.
>> Really?
>> [ __ ] you.
>> You're taking away all of my rights.
>> You're in custody right now.
>> You're taking away my rights.
>> Stop.
>> Somebody I have a bully me. Bully me.
Nobody's trying to bully you. You keep
walking away and telling us what we're
going to do. That's not how this works.
>> Stop groping me.
>> Nobody's groping you. Holding you by
your bystander.
>> You don't have a right.
>> You are under arrest and you keep
resisting and walking away.
>> What am I under arrest for?
>> Why am I under arrest for? That
statement just about says it all,
really, doesn't it?
>> Number one, resisting. Number two,
obstructing. Okay. And you've got a slew
of traffic charges on top of that. No, I
don't.
>> You do?
>> Where?
>> Citations. I'm going to write them here
in a minute.
>> Show me.
>> I will show you every single one. It's
going to write them now.
>> How much have you had to drink tonight?
>> You want to write them now? I have
nothing. You have pulled me over
illegally. Get off of me.
>> Turn around.
>> Get youring hands off of me.
>> Cuz every time I let go of you, you just
try walking away.
>> Get your hands off of me.
>> Stop.
>> Lady, you're old enough to know that
that's not how any of this works. But I
guess YouTube and worst of all, Tik Tok
happened and now everybody's a legal
genius.
>> I'm pulling me some more. You pieces of
[ __ ]
>> I didn't think you guys were that bad.
>> All you have to do is get out of the
vehicle. Why are you making it so
difficult?
>> I didn't have to get out of the vehicle.
You did.
>> I have a right. It's called a
constitutional right.
>> Okay. What right do you think you have
that means that you can disobey a police
officer on a traffic stop? Where's your
peace officer? Sir, you are not a
goddamn constitutional right. I didn't
do anything wrong. I was traveling.
>> This police officer is not a goddamn
constitutional right. You heard whatever
that's supposed to mean here first,
folks. Oh, and of course, she was just
traveling because that automatically
means she can get into a car and drive
however she wants.
>> Okay. And immediately when I walk up
there, you won't roll your window down
and you won't give me your
>> I have to comply to you.
>> That's fine. But then I can tell you to
get out of the vehicle. Yeah, but you
didn't have to bust my window open
either.
>> I I did because you wouldn't get out.
>> Throw me on the ground.
>> And you wouldn't ID yourself.
>> I don't have You're required to do both
of those things.
>> I have a constitutional right, mother.
>> I'm going to let you know your rights,
okay? You have the right to remain
silent.
>> I'm sir, you need to get the out of my
face.
>> Listen to me. You have the right to
remain silent. You don't have to talk to
me.
>> Nothing in my face.
>> Anything that you say or do can and will
be used against you in the court of law
or the proceedings. You have the right
to talk to an attorney before I ask you
any questions. And I have it with you
during questioning. If you can't afford
to hire an attorney, one will be
appointed to represent you before
questioning if you wish.
>> You took my phone.
>> Welcome to the consequences of your
actions. Now, if you're capable, and I'm
not holding out much hope, learn from
them. I have the privilege of access to
my phone day and night because I'm not
stupid enough to put myself in
situations where I can get arrested.
>> You can decide at any time to exercise
these rights
>> or not make any statements. You
understand your rights. open in my eyes.
>> Do you understand your rights?
>> Nope.
>> What part of that do you not understand?
>> I understand that you violated the [ __ ]
out of my rights.
>> Okay. Do you understand your rights,
though?
>> Nope.
>> So, you don't understand your rights,
but you understand that we violated your
rights. Is that what you're telling me?
>> Nope. I do not understand my rights.
>> Okay.
>> Get out of my face.
>> Okay. I do not understand my rights is
the most accurate statement to come out
of her mouth tonight. Unfortunately, it
came as a childish response to being
outed as a hypocrite. Anyway, now she
claims she needs psychological
treatment, which I don't disagree with.
We just disagree on the reasons.
>> Okay. So, you're fine then. You're
you're denying any medical treatment.
>> No, I want medical treatment. I also
want psychological treatment.
>> What for?
>> For you. Get out of my face. Shove that
light in my face again. You pulled in my
car and busted my window open.
Who'd have thought listening to the
advice of a bunch of Tik Tok lawyers can
end with a window bust face down in the
asphalt and a pair of silver bracelets?
All right, Diana, I feel like you're
under the influence of alcohol, so I'd
like to do some field sobriety tests to
make sure that you're safe to drive. Are
you willing to do those tests?
>> I I am willing to have you leave me the
alone.
>> Okay. Well, unfortunately, that's that's
an option like this.
>> Okay. So, what do you think should have
happened? You you said, "Oh, I don't
want to identify myself." And we should
have just said, "Okay, have a nice day."
>> I don't have a right to. I don't have to
identify myself. I know the
Constitution.
>> Why do you think that you don't have to
identify yourself?
>> Because I don't have to. Because it's
called the Constitution.
>> I'm sorry to break this to you, but the
Constitution is not a get out of jail
free card you can wave in front of the
police to avoid being held accountable
for your actions.
>> Okay. Well, you almost hit my squad car.
You don't have a front license plate.
You were weaving back and forth in your
lane and you failed the signal 100 ft
prior to your turn. So those are those
are all the
>> my window busted.
>> No, I didn't want to do that. I didn't
want to do that. That's why I kept
asking you to get out of the vehicle,
but you wouldn't. What am I supposed to
do? Your level of cooperation is going
to impact how quickly you know that
everybody can leave right now. This is
ridiculous.
>> This is ridiculous.
>> Completely agree. Your actions have been
ridiculous. But I would also like to add
potentially dangerous, unhinged, and
entitled to that list. Leave your
adjectives to describe the actions of
this woman in the comments.
>> Why would youing bust my window open?
I'm sorry. You have a mommy wound.
>> I want a lawyer.
>> These are Bloomington paramedics.
They're going to take a look at you real
quick.
>> Pushing the window open. This is
[ __ ]
>> Get the off me.
>> Get off of me. you. I have a right to
tell you to get your hands off of me.
No, I don't have a misunderstanding if
you let me the go and leave me alone.
>> All right, so we are going to go to
apartment.
I don't care. You guys over dramatically
obtained. Can you Can you let me out of
the car so I can go inside and continue
to holler this?
>> No, we're not going inside. I've got
some paperwork to read to you. That
sounds like a personal problem to me.
You're going to let me the out of this
car.
>> Okay, first of all, I agree with you for
the second time in this video. The
charges the officer is about to try to
read to you are a personal problem, but
more for you than him. Enjoy. Secondly,
I don't think you're in a position to
accuse anyone of being over dramatic
after this little performance.
>> Says subsequent to an offense for
driving.
>> Why would you do this to somebody who
has no offenses? Just because you don't
have any criminal history doesn't mean
that you like get to get off scot-free
if you break the law. You're driving
intoxicated and you resist it.
>> Law when you broke my window. You broke
my window.
>> No, I broke a window. I didn't break the
law.
>> I'm going to read this.
>> Hiding anything.
>> I'm not asking you.
>> I'm not at the jail. Get me out of here.
>> I'm going to read this.
>> No. No. There is glass in my ass. There
really is.
Let me pull over and read you something
and not take you to the jail. Nope. I
have my rights and I want a lawyer. No.
>> I don't give a You busted a window and
you violated the [ __ ] out of me. I want
a lawyer.
>> Are you going to provide a breath
sample?
>> No, sir.
>> Will you whip that up and do a refusal
for me? Yeah, we're going to just lock
her up because she does a refusal after
you just harassed me, busted out my
window, threw me out my car.
>> No, don't worry. Don't worry. I'm about
to have a lawsuit on your ass.
>> I would like for the older gentleman to
take me to go and urinate.
>> And I'm not hitting on him. It's because
he probably has more respect than you
young bucks.
>> Am I the older gentleman?
>> You are.
>> I think you are, Serge.
Before I get out of here,
>> we got to take Got to arrest you. No.
>> Yeah, he does. There's no changing it.
Okay. You're the the choice that you
have right now is to provide him with a
breast sample and face a 6 month
suspension on your license or to refuse
to do that, then it's going to be you're
going to be faced in 12 months. Okay.
>> But then you guys won't [ __ ] take and
beat her and abuse her to [ __ ] prison
or jail. Okay guys, so that slew of
charges the officer tried to read to her
was surprise surprise DUI, improper lane
usage, no front registration plate,
failure to signal within 100 ft of a
turn, failure to display a driver's
license, and finally resisting a peace
officer. Right, thank you so much for
