Based on those messages, how long Mr. Kingston had been speaking to his friend, I believe the name is Kale, correct? >> Yes. >> His friend Kale um that day before meeting up with the alleged victim? >> Uh I I believe they started talking in the morning. It was my understanding that Mr. or the alleged or the defendant was down here for a golf trip, and so they had communicated days before and days after, but it was pretty much throughout the day just hit and miss kind of communications between the two of them. >> Okay. The the uh messages about cracking her, meaning the alleged victim, uh was that throughout the day or was that focused at a particular time of day? >> It It was They had originally planned It appeared that they were planning on having a double date with the alleged victim and and one of her friends. And so those plans kind of started to fall apart, but him talking to his friend more about going over to uh to the alleged victim's house was more so later on in the evening. >> Okay. And you took the the term crack to mean what at that time? >> Sex. >> Sex, sexual intercourse? >> Sexual intercourse, yes. >> The other message you received um from Mr. Kingston's phone was a message going out to someone? >> Correct. >> Going out to who? >> To the alleged victim's Snapchat account. >> Okay. Do you have a copy of that message? >> I believe I have it within my report. I don't have a a a lone copy, but >> Do you want a nice color copy? >> We can submit it later. >> Would you read that statement from Mr. Kingston to the alleged victim? >> Yes, it says, excuse me, "I didn't take advantage of you and I didn't think anything was casual. You told me before and then you said yes, or else I would never have done that because I just don't do that with anybody TBH. I wouldn't ever do that to someone unless they agreed and you did. I'm sorry that I took that from you. It was late and I shouldn't have ever gone over there in the first place because I regret doing it to. I'm sorry." >> Okay. Uh and what did you take from that statement uh to further your investigation? >> Um so the the particular part of the message that that stood out to me was uh where he mentions, excuse me, or where he says, "You told me before and then you said yes, or else I would have never done that." >> So what did you take from that? >> To me that indicated that she had told him something before, had set some type of boundaries, and maybe she changed her mind in the moment, um but there was something that was set up or said prior to them meeting that >> And in the in the alleged victim's forensic interview, she said that she had communicated before that she was not going to have sex. >> Correct. >> Anything else in that statement that stood out to you? >> Uh just just the fact um that he appeared very apologetic in in the message. >> Um, what is the date that that was sent? >> Uh, so I don't have the exact date. The way that the Cellebrite is the software used, uh, for the extraction, uh, and it only gave me the creation date, which was the 2nd of February, which I believe would have been the creation of that message thread, there, the start of their communication. >> But you don't have the specific date of when that was sent. >> No, I do not. >> At some point you, uh, arranged for an interview with Mr. Kingston. >> Yes, I did. >> And where did that occur? >> Uh, up in, uh, Mr. Petro's office up in around Salt Lake, or Orem, I believe. >> Okay. Mr. Petro was Mr. Kingston's attorney at the time. >> Yes. >> Okay. Um, and you met with, uh, Mr. Kingston, Mr. Petro, who else? >> Uh, and Detective Pace Truman was with me, yes. >> Um, what did Mr. Kingston say about that night when he went over to the alleged victim's house? >> Uh, he had just said that, uh, they had agreed to to get together, um, that they had sexual intercourse, and that it was all consensual. >> Okay. Um, did you confront Mr. Kingston with the messages that he had with his friend Kale about that? >> Yes, I did. >> And what did you confront him with? >> Uh, >> Uh specifically I just asked him about the phrases that were used as we talked before the word cracked and then and we asked him what that meant to him and he said that it was sex. >> Okay. Sexual intercourse. >> Sexual intercourse, yes. >> So he clarified to you that sex means sexual intercourse. >> Yes. Well, that that cracked Yeah, cracked means yeah, sexual intercourse. >> Did Mr. Kingston say whether or not his intention going over there was to have sexual intercourse? >> Uh he told me that his intent was not to have sexual intercourse. >> Okay. In his messages to his friend Kale, did he indicate or make statements that led you to believe that in fact he was specifically going over there to crack the alleged victim. >> Yeah, it's it seemed that uh that's what they were talking about was uh Kale had said or well, are you going to go over? And he says, I don't know. Um and then I believe at one point Kale asks or makes a comment that that the defendant is getting horny and he says, yeah, I am. Um and then they kind of discuss, well, are you really going to go over? And then he says, I'm 5 minutes from the house. >> Okay. >> That's good.
