One evening, an officer witnessed a traffic collision unfold and immediately called other units to the scene. >> I have a feeling there is going to be a possibility at least you might want to check about driving on the car. Older people around the side, they're not injured, but these guys are driving a teeny little says maybe the driver doesn't have a license. >> Hello. Uh, yeah. >> All right. >> Yep. >> Which one of you guys was driving? >> The person in the vehicle was driving. >> Yes. She said she was a driver. >> Okay. >> Hello, I'm Officer Dean. I got a body camera on. All right. Can you tell me a little bit about what happened in this road right here? Okay. Did you run a stop sign? You know what happened? >> I didn't stop. >> All right. Did you have your driver's license on you? >> We're coming down. This coming straight down here. This one clear right through the stop sign. Okay. I'm 99% sure this one here was the driver cuz they're getting out. We're focused on the elderly people making sure. Now I got them saying this one was driving. I got them saying this one was driving. They definitely have been smoking car so we can figure out who the driver is. >> Do you guys have can car uh in cam? >> No, I don't have anything. She got out the driver's side of the car. I know that for a fact. I car around the corner. We went straight over. I went through these people. I see the look of terror on their face and I come out people coming out of this car when I know came out that side of the grass over there is who got on the driver's seat. So you might have some lying going on one you need to get everybody identified because it's crashed. Then we need to figure out who is the driver and then you need to figure out the DUI testing car. Okay, do your thing. What seems what happened here? >> The passengers in the vehicle confirmed that the 18-year-old suspect was driving at the time of the crash. They stated that as the car approached the intersection, she stopped partially past the stop sign. When the other teens in the vehicle urged her to move, she accelerated forward and the car was struck on the driver's side by the oncoming vehicle. Their accounts supported the explanation the 18-year-old suspect gave to police. it and everybody was saying everybody else was driving is what I got out of it. >> Why don't you ask Chad? He might have better >> Sounds good, sir. >> Better idea. >> You're saying you thought you saw her driving. >> This is the one that Amber and I are pretty sure we saw get out of the driver's seat cuz when the car it hit and it rolled it, it didn't even like were driving. It kind of rolled this way. >> Yeah. >> We went over here and they all kind of bail out. Bail out. So, and you saw her exit vehicle. She is on the driver's side 100%. I'm almost positive she's a driver's side. Yeah. Know her story is pretty much they were smoking in a park. She's saying she didn't know she had asthma. She didn't have a license. She's 16. Definitely wasn't driving, but she's alleged. She But there are cameras right there if we really want to get down to it. >> Who was driving? You you sure about that? >> Sure about what? >> What's she driving? >> Um, do you have an ID on you by chance? >> I don't know where it went. >> I think it's in the car, but I'm not going in the >> Do I I think I still have your ID, don't I? Am I took it? >> Okay. >> Which seat were you sitting in? >> See all the >> back? Which side? >> Behind the driver. >> Behind the driver. And you admit you were not driving. >> I I was not driving. Let's say cuz those cameras right here. We use these a lot. >> Okay. It can use them. It can go from there. I don't care. I want >> Which one was driving? >> Uh, it doesn't appear to be. >> You're on the purple hair. Where is >> she? >> All right. Um, can you tell me exactly what happened? >> We were at that park over there. We were driving down the street. We stopped in the middle kind of. >> We were about to turn. We didn't know which way to go. and allergy. Mia go and then last. >> Okay. So, who was driving? >> Allergies. >> Not that. >> So, you guys were coming down this road right here. Kind of went too far in the last parking lane and then either go and >> Okay. And then the Buick over there. >> Yes. >> Okay. Somebody talk to you yet? >> Yeah. Can you uh step by and talk to me real quick? and lost your bloom first. They were coming from this >> but you were driving. >> How old are you? >> No, it's fine. >> You're 18. All right. Were you guys So, I saw Jaden over there. Were you guys at park smoking? >> She's saying you guys were over there. You guys were smoking some. No big deal cuz the car smells like she smells like smoke. >> Um, do you need to go to the hospital? Oh, I'm just asking. >> All right. So, who was smoking? >> They were smoking. >> Who's Who is they? >> All three of them. >> Well, they're they're saying you were. >> Okay. >> Well, their words different. >> I know. They're just saying you were. They're saying she wasn't. You were. They're hard. >> All right. So, she's saying she wasn't driving. She was in the past the back seat behind the driver. That's where AC Wsley would have seen her exit vehicle. It sounds like we're getting Hersh on the phone right now. >> I'm leaning more towards her just based on her demeanor. >> We talk to mom yet. >> Rich is going to call me back here in just a second. Hold them up. She was telling me she was in the back seat behind the driver and she was saying she drove. It's her fault. Blah blah blah. This and that matches. She picked all three of them up from the park smoking. She hasn't smoked anything. She said all three of them smoke even though she's told me she hasn't smoked anything. She has asthma. So I'm lean more towards her. She's probably 55 for Candace at this time. Her eyes are very red. Could be from crying, could be from not, but they're very red and her very delayed speech. >> Okay. >> But, uh, does her hersa on the video? >> He's looking at it right now. He's blown up. He's an old >> worked out good. >> Yeah. Very well. So, who was the driver? >> I was. >> You are. Do you have your uh insurance and license? All right. Is that the registration? >> Yeah, >> I'll take that as well. Make it a little bit easier. >> So, this wasn't how you planned to send your >> Were you all in the vehicle? >> Yeah, we were driving around. We made a little hard stop >> driving this way. So I was coming up and getting going slow cuz I was turning into the church lot. >> Mhm. >> And whoever was driving that car, first thing I knew, they were right in front of me. I didn't have time to hit the brakes. I didn't have They were boom, they were right there. So just pulled right out in front of me. I t-boned them and uh all the glass on the car is >> okay. >> Leakage from the radiator. >> Okay. So, I think in that regard, I'm all right. >> Did you happen to see who was driving? >> I didn't see a thing. >> Did any of them get up and out of the car right away? >> Yeah, they they all got out and and I thought they were going to run. >> Okay. Yeah. So, none of you guys seen who like got out of the car or anything? >> No. All right. They all got out of the car. >> Or sorry, the driver's seat. >> What order they got out of the car? I don't know. Okay. >> But they all got out of the car and started to run that way. Right on. >> So, who's the other one we think is driving? girl in purple in the back seat. >> And what's her story? >> She is fully saying I was driving. It's my fault. I went to go pick these three up at the park. They were smoking and I didn't stop. The accident's my fault and she's take she's taking full blame. >> Okay. How old is she? >> 18. >> Does she have a license? >> That's what uh Dean is checking right now. >> Okay. All right. So, we believe that? >> Not fully. Well, this girl's pretty steadfast. She's not driving. She said, "Hurry up and get the tape so you can see who's driving." >> And which she said she was in that back seat behind driver's seat. So maybe >> It's possible. >> Yeah, it's possible. >> He got out on the driver's side. >> They all got out pretty fast. >> Yeah, they jumped up. They scattered. >> How long is it going to take Rich to pull that video, do you think? >> I don't know. So, he's to get his laptop. >> Stand with them real quick. We're going to search the vehicle. >> No, you don't. >> It smells like It smells oil. All right. We're going to have you search. You're You're gonna step out. >> Go get my mother. >> No, you're gonna step out. >> You're gonna step out. >> You are 18. >> Go get my mother. I don't care. Go get my mother. >> I'll wait until my mother is right here. >> Step out of here. >> I will wait until my mother is right here. >> I don't care. You want to come over here? >> And y'all not going to arrest me for sitting here waiting for my mother. She's right there. >> I don't know why. I don't know why you're making this difficult. Because I don't y'all, bro. Go tell my >> What have we ever done to you? >> I Nothing. >> Then what? Then what? >> You just I don't like your energy. You ought to be my personal business like that. >> So, we're investigating a crime. >> Okay. Get the crime. >> Step step out of the vehicle, please. >> Get my mother. >> I don't want to put me in handcuffs. All right. >> You're not going to cuz I did wrong. Get my mother. I can say that. Y'all can get my money. >> Sheldon. >> Hey. Good job. >> We are. >> Thank you, Jordan. I like >> Well, he doesn't really He's not even supposed to be here. He's his trainer. >> I like him. So, why don't you show me anything you find in this car? >> What? Why? I didn't even ask about that. Why are we already uh Why are we already making a defense? Is there anything in here we're going to find? >> I mean, >> I mean, is there anything here we should know about? >> Well, I'm on camera, so no. Hey y'all. What's up? >> Is there any like that? >> Well, I hopefully not. That That would be bad. Is there any guns? >> Oh, baby. You have to get out of the car. >> I know. I just wanted to be right here so I don't pull me ahead now. For what? >> Okay. Mia >> for improper back in. Is the car registered to you? >> No. Who's the car that's registered to you? To you. Are you okay with go it going to Joe's lot? >> What? >> Are you okay with it going to Joe's lot? >> No, I want it to be towed so I can get my car back. >> That's what I'm talking about. >> Joe's lot. Well, >> Joe's, not Jail's. >> Okay. >> Joe's towing. They'll take it to their lot. Call your insurance in the morning uh or tonight. Either way, let them know they're going to have their own set of questions and everything. They can send >> total. Yeah. With the airbag deployment, there's a good chance. >> So, I I don't get this car back. >> You'll still have like access to it and stuff, but there's a chance. Yeah, there's a chance you don't get the car back at the insurance >> stuff out of there because Joe's going to be a little >> Yeah, I'm getting my stuff. Absolutely. You get what you can get whatever stuff you want out. Well, when we're done. Hold on. >> Like when they're done. When they're done. >> Yeah. When we're done, you can take whatever you want out. >> Joe's on my days off. >> So, what what happens is once it hits our lot until you get a anything except medications. >> They're going to give me [ __ ] 15 charges for dumb [ __ ] >> What What charges are a rolling train? $350. >> Never said we were charging you with anything like that. >> Right now, you have run in the stop sign. That's it. >> Like, so just calm down right now. Like just >> what he was explaining was if you refuse to get out of the car at that point you're resisting obstructing which is a criminal charge which then you do go into criminal resist >> he's telling you he's telling you to get out of the car when we have >> understand the law the more you run your mouth anything they can charge you with less believe they're going to do it >> I'm going to become a cop that's good but that that's not today like right here and right now just cooperate >> and keep your promise you can think whatever you want you have to keep the promise to yourself okay >> if you would like I can explain it to Yeah. >> No. No. >> Okay. >> Found a little. >> When was the last time you smoked? >> Going to ask you any questions that I don't have the answer. >> Do not walk up to the car. This is where you're going to hang up. Turn around. >> Yep. >> STOP DOING ME. >> What happened? >> Stop. I got >> I DON'T BELIEVE THIS. BILL, BACK UP. >> BACK UP FOR ME. >> PLEASE STOP IT. >> PUT YOUR HEAD BEHIND YOUR BACK. >> She's now going. >> Godamn. Don't touch me. >> You're not doing that. I don't give a but this is not except you tried to kick me ass and no one did it YOU spit I swear to God do not get into the ring >> she's getting spit hood in the car >> I'm a little kid BRO she's kick me >> I don't Stop. Stop. Stop. >> STOP TOUCH ME LIKE THAT. >> THIS IS NOT OKAY. >> Hey everyone, it's Trent, prior deputy sheriff, patrol sergeant, and K9 handler. When it comes to these types of incidents, it's actually fairly common for somebody to lie about who was driving, especially if there were multiple people in a car and the driver was possibly impaired and maybe one of their friends wants to try to protect them from a potential DUI charge. In this case, yes, the passengers did yell at the driver to move forward into an intersection when there was clearly a vehicle approaching her location. However, she was still the driver and she was in care custody and control of that vehicle. So, that liability is still going to fall back on her. And just because these officers didn't arrest the suspect for driving under the influence of you can still definitely get a DUI charge for being under the influence of however it's a little bit more challenging to facilitate those tests because unlike standard alcohol DUIs there is no breathalyzer for THC and blood and urine tests are not ideal either because unlike alcohol can stay in somebody's system for multiple weeks or even longer. But that's why DUIs are a little bit more challenging to not only arrest for, but to secure a conviction when it comes time to go to court. >> She faces multiple charges, including aggravated battery to a peace officer, resisting arrest, and unlawful transportation of but remains innocent until proven guilty in a court of law.
