const if we could do WebEx from Logan. I'm from Austin. >> Okay. >> So, it'll pick a Monday. Um, if you give me just like five seconds. >> Sure. And there's we've got some limitations because we've got some Monday holidays that hit in January. So, I I've got January 5, February 2nd, and then March 2nd. It's the first Monday of each of those months or when my WebEx day falls. >> And what time would that be, your honor? >> 10 am. >> 10 am. >> The worst the worst choice would be the 5th, just because there there are a lot of things that I've noticed that day is uh is very full. >> Okay, >> let's do February 2nd, your honor. >> Okay, February 2nd, 10 a.m. Um M. Mr. Call, anything else from the state on this matter? >> No, your >> Okay, Mr. Mr. Hull Brook, anything else you wish to address on this matter? >> I don't, your honor. >> All right. Thank you, sir. Have a nice day. Miss Gman, stay in touch with Mr. Hullbrook. Okay, ma'am. >> You got it, your honor. Thank you. >> Thank you. Have a nice day. >> You as well. >> All right. We're still waiting for the jail to get logged on. Do we have We have some folks that are here in person. If you're going to be asking for an attorney, you need to fill out an affidavit. Um, Miss, are you ready? >> Come on up, ma'am. Right to the podium. And she's been given that information. >> Sure. >> Did I say your name properly, ma'am? >> Yes, you did. >> Okay. This is a 25 case 622. Um, you have the right to be represented by an attorney in this matter, ma'am. Just taking a look at your affidavit to see if you meet the guidelines. looking to see some of the things that I've been charged with. And that wasn't me that grabbed anybody by the neck. It was I'm the one that got grabbed by the neck. >> Okay. I I I certainly understand. I'm not in a position to resolve any sort of factual disputes that might exist. Um, >> are you responsible for anyone other than yourself financially? >> No. Two 16year-old Chihuahua. That counts. That's kind of expensive right now. Let's see. Um, your your income, you it probably doesn't feel this way. I'm I'm going to tell you something you probably weren't expecting to hear today. You you earn too much income for me to appoint someone to represent you. Based on the information that I'm looking at, you're you're rate of pay now. I I may Is your job full-time? >> Yes. >> Okay. um at that rate full-time your income exceeds the guidelines for having someone appointed to represent you. So what that means is you you would need to retain someone to represent you. That can take some time. It's like it's like hiring anybody else or any other service. You're going to want to talk to a few people. Um they don't all charge the same thing. Um there are several local are public defenders. Some of them take on private cases and they're here all the time. So there may be some savings in what they would charge you because they're likely already going to be here uh to to handle other matters. So it's it's very convenient for them. But you're welcome to retain whomever you'd like. We're mid December right now. Um it may take some time to figure out whom it is you would like to have represent you. If I were to set a hearing, say [clears throat and snorts] uh first week of March, give you give you till the first week of March to have that sorted out so that that attorney could appear with you at that March hearing. Would that be enough time? >> Sure. >> Any objection from the state to uh having a March 3rd hearing? >> No, your honor, but we are requesting a no contact order with the victim or minor. Not not a pre-trial protect >> just a no contact order. Is there any reason you need to have contact with Rebecca while this case is pending? >> Absolutely not. I haven't. >> Okay. I would like the same as well. >> Sure. As a condition of uh you're remaining out of custody on this case, the court's going to require you have no contact with with her. All right. And the whatever attorney you hire, make sure you tell them the date. The date will be March 3. And you can tell me whether it's better for you for the hearing to be in the morning or the afternoon, 9 or 1:30. What's better? Um 9:30. >> 9 in the morning. Yeah. 9. Okay. 9 in the morning then is when the hearing will be held. So when whomever you hire, give them that date and time. If that date and time is a problem on their calendar, they will know what to do to get a new date and time. Just stay in touch with the attorney. >> Okay. >> Okay. Um do you have any other questions? >> I don't. Who do I go about or how do I go about getting the the public? I can I can give you a sheet that has contact information for the attorneys that are here all the time. You're welcome to call any one of those attorneys that are on that list, okay? And uh and talk to them. Um the the ones that are in district court all the time are Mr. Tanner, uh Miss Caldwell, and Mr. Morris. There are some others that work on city contracts, but those are the ones that are here in district court all the time. Okay. >> Okay. All right. Thank you, ma'am. >> Thank you. Okay. Is 31 an hour full time? [snorts] That's eight hours every Okay, looks like looks like we've got the jails logged on now. Maybe they're just that window. I don't know how long that window's been popped up. >> Well, we are ready, your honor. >> Okay. Um, go ahead and you can bring me whomever you'd like to start with. >> Okay, we have uh Cordova, Jackie. >> Okay, this is a 25k case sending 619, state of Utah, state of Utah versus Jackie Dean Cordova. Uh, good morning, Mr. Cordova. >> There's there's an information that's been filed that alleges a single charge. It's a thirdderee felony aggravated assault is what's been filed. That document lists your birth date as January 3rd, 66. Is that a correct birth date? >> Yes. >> All right, sir. You have the right to be represented by an attorney based on the information that I have available. You meet the guidelines. I can appoint an attorney to represent you. Do you have any other cases that are pending right now, sir? >> Yes. >> Who represents you on your other matters? [snorts] Twilla here. >> Yeah, >> Mrs. Caldwell. >> Miss Caldwell does. Um, Mr. Clay would make sense, I think, that Miss Caldwell will be appointed. >> Agreed. >> All right. Um, we'll appoint Miss Caldwell to represent you on this matter. Do you have an upcoming hearing on your other case? >> No, it's the first time. >> All right. Would you like my soonest available date? >> Yes. >> Okay. That'll be December 22 at 10:00 a.m. >> Um, >> all right. Do you have any other questions, Mr. >> Yes. Could I get a a bail on that? >> Let's talk about that. Mr. Kle, what's the current status? >> So, no bail judge based on a a request by the state. You can see the state's uh uh request in the information. >> Let me take Let me take a look at that. I don't believe that's to be true. I think I I'm not at flight risk. I do have >> Hold up, M. Hold up, Mr. Cordova. I I'll I'll give you a chance in just a second. [snorts] Okay. All right, sir. I' I've reviewed the probable cause statement and the information that was uh submitted in support of the no bail warrant. I'm not going to change your custody status. I'm not going to set a bail. I believe that information justifies a novail uh setting at this point in time. Miss Caldwell, after you speak to her, if she wishes to readress your custody status, she can do so at your next hearing on the 22nd. Okay. >> Thank you, sir. [snorts] >> Thank you. All right. Hello, sir. Help me with your name. >> Christopher Pro. >> Christopher Pro. All right. Mr. Pro, you're here for what's called an initial appearance. Is your correct date of birth October 12th, 82? It >> is. >> Okay. Have you had a chance to see the charges that have been filed? have >> you [clears throat] have okay you have the right to be represented by an attorney. You can hire one of your own choice at any point in time in this process that you wish to do so based on the information that I have available. It appears you meet the guidelines to have an attorney appointed to represent you free of charge. Do you intend to hire someone or would you like me to appoint someone? >> Appoint someone for now. >> Okay. All right. Your attorney will be Mr. Morris will be appointed to represent you. His contact information is available there at the jail. Although he won't know much about this case until he sees copies of the reports, he will he would be able to answer general questions about the process. I'm going to take a I'm going to take a look at uh the information that was filed and then we're going to talk about your custody status. Okay. >> So, give me just a moment. I was just going to say I'd like to invoke my right to a speedy trial and get this process underway and do a um do a uh um sorry uh probable cause sorry Mr. Petro, those things that you're talking about, whether a person actually says it or not, I automatically do those things that you're talking about. >> Okay. >> Awesome. >> Right. As to as to custody status, what would the state like the court to know? >> State would ask that it remain the same. Judge, the state has the information that's in the probable cause statement. Um, furthermore, the the defendant has a massive criminal. >> Is it Is it no bail? >> Yes. >> Okay. I I just I wasn't seeing that determination. I see information that would be in support of that position, sir. When it comes to addressing your bail, you've got one chance to do it. It would make sense that uh you allow Mr. you allow Mr. Morris to assist you in that so you have the best chance at making the strongest argument you can or or you allow him to speak with the state to see if there are some conditions that can be negotiated that would allow for a potential release with some conditions. So, what I'm going to do is I'm going to set your next hearing for the 22nd of December. That's the soonest date that I can give you and I'll I'll consider your custody status further on that date. For now, you're going to be held without bail. >> Okay. Do you have any other questions, Mr. Petro? >> No. >> All right. Thank you, sir. Ma'am, what's your name? >> Hunt. >> Could you say it one more time, please? I The audio didn't work. Your >> honor, it's Tiffany Hunt. >> Miss Hunt. Okay. Thank you, ma'am. This is an initial appearance on a 25 case that ends with the number 691. Miss Hunt, have you had a chance to see the charges that have been filed? >> Yes, I have. >> Okay. That document listing those charges has a birth date for you of June 21, 1979. Is that an accurate birth date? >> Yes, your honor. >> Okay. Ma'am, you have the right to be represented by an attorney in this case. You can hire one of your choosing at any point in time that you wish. Based on the information that I have available, it appears you meet the guidelines to have an attorney appointed to represent you free of charge. Would you like me to go ahead and appoint someone today? >> Yes, please, your honor. >> Okay. Your attorney will be >> I I'm considering hiring counsel, but >> Okay. >> I'm not sure how to get it. >> You can It's tough from being in jail to make all that happen. I understand that. I'm going to appoint Mr. Morris to represent you. His contact information is available there at the jail as did custody status in the present bail setting. Um I'm going to hear from the state first, ma'am, and then I may have some questions for you. Okay. Currently no bail. We would request that it remain no bail. As you can see from the facts, there's a knife involved um significant threats, physical violence. Uh the victim has reached out to our victim's coordinator and said she's fearful for her life. And we have a pre-trial protective wear request to uh to be granted right now. Okay. If you could present that. >> And the victim is Karen Kypers. >> Okay. All right. Um, Miss Hunt, is there any reason that you would need to have contact with Miss Kypers while this case is pending? >> She's my co-inhabitant. She's also the grandmother of my two twin babies. Um, >> I I did not pull a knife. I moved >> Hold up, hold up, hold up. I don't want you to I I don't want you to talk about the case right now because everything you're saying has been recorded. I just appointed an attorney to represent you and I want you I definitely I definitely want you to talk with that attorney about what happened. >> My wallet, my money, my my vehicle, everything is in that home. >> Um I can't do anything without the ability to have my money. I know that um >> that there arrange arrangements arrangements arrangements can be made for return of items such as those >> for the time being based on the facts that I reviewed in the in the uh in the probable cause >> for a bail because I would love to be able to get out and get some mental health treatment. I believe um I believe that a lot comes from my my history of abuse and I need to get into some mental health. I'm aware of that and [snorts] I would never hurt the grandmother of my my babies. It was an instinct and I I feel bad that I did that and >> but I I don't feel I threatened her life. I feel like I was protecting my children [snorts] and I am asking for a bell or a release which I do know that there is a restraining order and I can't talk to my children and I can't talk to her which I've done on a daily basis for the last couple years and so it's really hard for me because I don't have any other support in Utah right now. >> I do have a place I can go stay. I have some fleeing friends that won't be involved in any drug use that I can reach out to as soon as I have my phone and all that that have allowed me to stay with them prior. >> Okay. >> So I can get into the mental health that I need. I don't believe it's productive for me to be here. But you are the judge and I trust your opinion. [snorts] >> Okay. >> I've been clean. I've been when I came into the jail, I was clean. I I didn't know that it was a mental health issue, not a violent issue. Thank you for that additional information, Miss Hunt. What I'm going to do, I'm going to sign the requested pre-trial protective order. You're to have no contact with Miss Kypers while this matter is pending. Okay? >> I have children. I know. >> I'm I'm not going to adjust your custody status today. I'm going to let Mr. Morris, after he has a chance to speak with you and has a chance to review the reports and and uh speak with opposing counsel, he can address your custody status when I see you on the 22nd at 10:00 a.m. Okay. >> Thank you, your honor. >> Okay. You're going to be presented with a copy of this pre-trial protective order so that you can see exactly what it says. And there there's some spots for you to sign acknowledging that you're aware of the order and that uh you're not allowed to possess u weapons or firearms while this while this order is in place. You understand that? >> Yes. >> Okay. I'll see you on the 22nd. You can call Mr. Morris and you can if there's information that you think he needs to have about the case, you can you can provide it to him. He may he may speak to you over the phone. He may come visit you at the jail. I'm not sure what he will do between now and the 22nd. Okay. >> Thank you. Thank you. >> Thank you. >> All right. Ma'am, help me with your name. >> Yeah. Tender Pure Pure Well, Judge. >> All right. You're Miss Pure Wall. Ma'am. >> Yes. >> All right. U ma'am, you're here for what's called the initial appearance this morning. Are you able to see other computer screens that are part of this hearing? >> Yes. >> Okay. There's a window uh with the with the gentleman. Uh the window if if it shows the names, that's Mr. Batista. There's another window. That's Miss Chrisman. Um good to see you each this morning, council. Ma'am, you're here for what's called an initial appearance this morning. >> Yes. >> Based on the information that I have available, it appears you may meet the guidelines to have an attorney appointed to represent you. You do have the right to hire your own attorney if that is your desire. Would you like me to appoint someone to represent you or do you wish to hire your own attorney? >> You can. I'm sorry I couldn't hear you. >> So you can hide. My English is not good. So you can hide for me, please. >> Okay. I'm going to appoint an attorney. Do you would you like an interpreter at future hearings, ma'am? >> Yes. >> Okay. Um and the what what language should we have? >> Punjabi. >> Okay. We will request an interpreter to be present at future hearings. Um, Mr. Batista, Miss Chrisman, I I imagine you may have anticipated based on the nature of the charges that if once there was a finding of indigency that you in fact might be appointed on this case. Is that what's been arranged through the IDC? >> That is correct, your honor. Good morning. The IDC did contact me yesterday. I am pre-contracted with them as uh rule qualified. >> Okay. All right. Um, in terms of scheduling, I've lost your audio, Mr. Batista. I'm sorry, your honor. >> Oh, I lost your audio temporarily. >> Sorry. Um, as I was indicating, I was contacted by the IDC as being pre-contracted with him uh under Roy uh for and qualified for Roy. They asked if I was available and had the resources. I indicated I would accept an appointment if offered. And I've asked Miss Chrisman uh who's been an attorney for some time to assist me if we are appointed. >> Okay. All right. Then given that representation, I'm going to appoint Mr. Batista and Miss Chrisman as council on this case to represent Miss Purewall. In terms of scheduling, um, I have WebEx availability. I think council may be familiar with how my calendar works. There's WebEx availability on Monday, the lawn, the week of lawnmotion. That would be at 10:00 a.m. In person is also on Monday at 1:30 for folks who are incarcerated. So I you tell me the month and I can tell you what days are available and we'll schedule in a way that makes sense. >> Your honor be just to make sure we keep track of this case. I was thinking it might be best if we came back. I know the January 5 fifth date is is really crowded, but just to keep track to make sure we're on track with discovering all this, it might make sense to come back on that January 5th. >> Would you would you like WebEx or in person? The WebEx is probably going to be the more crowded portion of the calendar. or the in person might be a little easier. >> Let's do the afternoon. I think in future hearings we might request WebEx to save the taxpayers money. Sure. >> But never because it's the first one and make sure we get everything in line with interpreter. It might be best for that afternoon calendar. >> I think that's I think that's a good idea. We'll set this for a scheduling conference on January 5th at 1:30. We will request an interpreter. That's an in-person hearing here at the Twilla County Courthouse. And anything else that needs to be addressed from the defense side? >> Two things, your honor. Um, one, I will file a Roy declaration and then a proposed finding his facts and conclusions of law for appointment. And then a question for Mr. Kle. Uh, if it would be easier if we dropped off a hard drive for discovery instead of having it sent uh online. >> Um, that would be up to you. I know that my assistant's been working on sending it to you via Google Drives. If you would if you would like to um just have it transferred over onto a hard drive, we will accommodate that. >> I will drop one off. That's that's easier just in case if there's corruption in the downloading. >> Fantastic. Nope, that works for us. >> And judge, just to let Miss Purel know, we're we're arranging to come see you either Friday or Monday with a couple of the other team members. Okay. So, hang in there. We'll see you Friday or Monday. >> Thank you. >> All right. All right. Um, >> thank thank you councel. Miss Miss Purewell, do you have any other questions right now? >> No, sir. Thank you. >> All right. Thank you, ma'am. Thank you, council. >> Thank you, Judge. >> All right. Uh, >> all right. That's all your honor. >> All right. Thank Thank you at the jail. Have a nice day. You, too. Um, Ruben
