for driving while intoxicated okay New Jersey statute 39450 the law requires you to submit samples of your breath for the purpose of testing to determine your alcohol content a record of the taking of the breast samples include the test results will be made upon your request a copy of that will be of that record will be made available to you after You' provided samples of your breath for testing you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath blood or urine to do some independent testing if you refuse here's the key part if you refuse to provide samples as your breath you will be issued a separate summons for the refusal a court may find you guilty on both the refusal and driving while intoxicated the court is one in charge of choosing that Su that that uh yeah it's called a per se law do you know what per means means on its face means on its face on face yep what does that mean it means if you refuse you're found guilty for both so I'm found guilty regardless of a jury or not no there's no jury involved so I can't find any way to defend myself the way to defend yourself is if you think you're not intoxicated you give the breast samples and if you're not intoxicated then you're good to go what if I don't want to give you my breath samples then you refuse and then you're found guilty for both both I just explained that but let me finish there's more if a court finds you guilty for the refusal you will be subject to various penalties including licensed revocation for up to 20 years fine of $2,000 installation of ignition interlock and a referral to an intoxicated driving Resource Center these penalties may be in addition to penalties imposed by the court for any other offense of which you are found guilty you have no legal right to an attorney physician or anyone else present for the purpose of taking the breast samples that's not fair or just That's the Law you have no legal right to uh refuse to give or delay giving samples of your breath any response from you that is ambiguous or conditional in any respect to my request that you provide breast samples will be treated as a refusal to submit breath testing even if you let me finish even if you agree to take the test but you do not follow my instructions do not properly perform the test or do not provide sufficient press samples I will charge you with the refusal for breath testing I repeat the law requires you to submit these samples of your breath for testing will you will you submit the samples of your breath
