Getting drunk and fighting with your spouse is already bad enough, but doing it in front of your children makes this whole thing even worse. >> Do you understand me? >> Stop yelling at your >> I've been trying to go home for the last hour. >> Ma'am. >> Because >> Ma'am. >> He put me in a chokehold. >> Ma'am. >> Let's let's be honest. >> Ma'am. >> That's the only thing I care about. Care about you. I don't care about him. >> I care >> I care about my goddamn kids and that's it. >> Then start acting like >> I'm telling my kids bye. >> Shannon, don't do that. >> You're not going to shove me to the ground. >> Go this way, buddy. Go. >> my child. >> way. >> I'm telling him goodbye. >> Hey guys, on the April 12th, 2025, officers responded to a disturbance at a beach after a husband and a wife started arguing over their children and where they should stay. The argument was getting more heated. The kids were getting caught in the middle and the officers were just trying to keep everyone safe and make sure that nobody got behind the wheel. Well, let's see how this family argument played out and why police [music] eventually had to step in and MAKE AN ARREST. >> WOULD YOU ALLOW YOUR WIFE TO GET INTO A VEHICLE if she drank almost an entire bottle of tequila? Would you allow your wife to get in a vehicle and drive your children home or would you take her keys as well when he is that messed up? >> Ma'am. >> Would you? >> What's up? What's up? >> the problem. My husband is wasted. He drove his truck from way down there to down here. I took the keys from him. >> And you have the keys? >> Yes, because he's wasted. >> Sweet. Is that him over there with the kids? >> I'm going to get my Uber and take take my kids home. >> Okay, hang out right here. Let me talk to him. What's his name? >> Chris. >> Chris. >> That's all I want. >> Have you been drinking? >> Uh that's why I'm not driving. >> So you're not You don't need to drive either. Okay. >> I'm not driving. I have an Uber coming. He needs to call himself an Uber and he needs to Uber home. >> Hey buddy. >> He needs to Uber home. >> Just relax for one second. >> I'm leaving with my kids. >> I get it. Just >> I'm leaving with my kids. He's too wasted. I'm not doing this anymore. >> your kids. I'm not doing anything more. I've been trying to get him for the last hour and a half to leave. Let's go get in the car, please. Get in the Uber. Can you get my youngest child so I can go home with them, please? While he gets an Uber, I don't want to cuz I have my truck keys and he's not leaving in this truck. I need my youngest child to go home. We're on the books. >> Will you Will you tell me what why you can't Uh earlier >> So y'all y'all have both been drinking. Neither one of you need to drive. Y'all need to either get into an Uber together or separate Ubers and go home. And most importantly, when you get these kids home someplace safe >> Understood. She has my belongings. When I say that >> Y'all are married but >> Yeah, yeah, yeah. All right. Well, then I guess this is a waste of time. >> Okay. I just want to make sure these kids are taken care of. >> for sure, dude. >> For sure. Then tell her to get the So Let's Let's let them go. Are y'all Y'all need to ride separately? >> I didn't I didn't I dude, I'm not even trying to be near this Hey, ask I hate to even involve this. Ask whoever has been around the whole time. Bella left right here. You over there. >> I need to get another one. Can you cancel the ride? >> Does she not want to get y'all a >> She doesn't want to give me a ride cuz he She says that they don't have clothes on and I don't have pants on. >> The officer's basically trying to stop one bad decision from turning into three bad decisions. His wife took the keys, which honestly might be the smartest move anyone's made here. Now everyone's just trying to figure out who's taking who home. At least the officer keeps the main priority clear. Like get the kids somewhere safe and make sure these two don't drive. >> So she doesn't want to give them rides. So I'm going to I'm asking her to cancel the ride so I can get a new one. But I can't get a new one until she cancels it. But she won't cancel the ride. >> Why not? >> Big ask her. >> She's canceling the ride. I need you to calm down for your kids. >> said I'll do it on my own time. >> Stop yelling. >> I've been trying to go home for the last hour. I've been trying to get home for the last hour. I've been trying to get home for the last hour. I've been dealing with this for the last hour. >> So, I'm not taking some of my rate crazy woman home. It's far away. I drove all the way here, so I have to cancel, but I can cancel. >> Can you cancel for us so she can get the next one? >> going to do it after I've waited because I don't get paid if I don't wait till the time is up. She can cancel it now. >> Okay. >> She said in my own time >> Okay. You can You can cancel it, too. You can cancel it, too. >> And it's part of me when I cancel it, so no, she needs to cancel it. >> Then you can wait. Those are your Those are your options. You can cancel it, or you can wait until she cancels it. Those are your options. God almighty. Who is Who is he? Is he a friend? >> I think he's just a bystander. >> Okay. Did you see him hitting each other or anything like that? I just got to ask. >> I was uh I parked down there, walking this way to do some fishing. >> Okay. >> Come by. I didn't see anything. She was screeching. >> Get your hands off me. I looked. Nobody was touching each other. And he has been this for 30 minutes. Like ridiculously. The kids are just in the Just so sad, you know. So sad. I mean, quite frankly, he doesn't seem all that drunk. To me, in my opinion. Like He was talking to me. I didn't talk I didn't engage with him. I just stood here. This was just you know, make sure nothing silly happens, but uh you know, if If she's obnoxiously belligerent. >> You're ready to go home. We're not. >> And she is Yeah, but they didn't touch each other. He walked away for a few minutes, you know. She just kept going and going and going and screaming at me out of, you know, I didn't say nothing to her. And then but she says he's drunk. >> Honestly, with the kids watching all of this, the adults need to calm down, lower their voices, and focus on getting everyone home safely. The kids are the ones stuck watching all this chaos. Well, they deserve better than being caught in the middle of an adult argument like this. >> She took his keys. I guess he tried to get them back. And then that's when she started screeching about getting your hands off of me. You know, a little kid in the blue shirt and the blue pants, you know, he was like The dad asked did I choke mommy? And kids said, "No." So. But this is this is a bad situation for kids. This is a terrible environment for these kids. Uh I think we both had quite a few. She's she's on like another level. >> The The whole thing is is he needs to get himself an Uber ride home. You're not because you have not picked up the phone once >> Where's Where's Where's your phone, sir? >> You have not even attempted to call a ride. That is the whole argument. No, that is not what happened. >> Okay. >> That is not what happened, sweetheart, by any means. >> Here's the thing. Neither one of y'all appear to be too intoxicated to watch your kids. You both seem to be at the point where you don't need to drive. >> I'm not driving, but I can watch my children. >> That's what I never said you did. That's what I just said. I said y'all are both good to watch the kids. My question is Y'all Y'all going to keep arguing and bickering in front of them? >> He needs to get himself a ride home, and he needs to give me my kids so I can get them home. They've been trying to leave for hours but they will he wants to stay and that's the problem. You're not getting your keys when you're this drunk to drive because I know you and you will drive home. >> No, there's not but I can't make him give them to you so >> He will drive home drunk, too. >> And that's that's probably why it's best they stay where they're at. >> And that's why they need to stay in my pocket. I don't have a license. I'm not dumb enough to drive. I'm not drunk. >> Basically a waste of time. >> I'm literally just asking him to give me my kids. >> Okay. >> Being drunk doesn't automatically mean a parent loses custody [music] of their children. But officers can still look at the children's safety and whether a parent is able to care for them properly. Driving while drunk is a separate issue and officers [music] can take steps to stop someone from getting behind the wheel. >> It looks like she's canceled. Is it is Okay, awesome. Awesome. That's fine. Let's focus on that then. >> I'm trying to get him to give me my youngest child. That's the problem. Mom, she doesn't want to give me my youngest child to take him home. >> Hey, hey, hey, hey. Are y'all married? >> Yes. >> OKAY. >> IT DOESN'T MATTER. YOU'RE TOO DRUNK TO BE OUT HERE with him right now. >> Hey, then also hey. >> And you're going to try to drive drunk later and that's not you're not doing that with my kids. And I'm going to give them to you before I [ __ ] leave. >> Okay. Let's get the vehicle in route. Let's get Let's try to That's fine. Okay. That's fine. Does it say anything about how long? >> Uh please and thank you. >> Locating the driver. >> Okay. Awesome. >> Like I said, it took me 30 minutes to get that right. >> Please and thank you. >> It literally took me 30 minutes to get that right. >> Okay. Ma'am. >> Because he put me in a chokehold. >> Ma'am. >> Let's Let's be honest. He put me in a chokehold. >> Ma'am. >> Um can I go get something to drink? >> Go get something to drink. Quit engaging her. Quit just just do it for me, for them. Okay. >> Bryson, stay on the road, go this way, please. >> For them, cuz they don't need to see this right now. That's That's all I care about. Y'all can bicker and spat all day long. I don't care. They don't need to see this. >> And you're right. >> Okay. Y'all have both been drinking a little bit. Doesn't matter who's been drinking more or whatever. >> Yeah, you're right, 100%. >> Y'all have both been drinking. Bad decision to come out here and y'all both get drunk with the kids out here. That That's not a great decision. >> it's all right. You're >> But y'all done with that? Let's take care of these two young men and make sure they get home safe. >> Yes, sir. >> That's all we need to worry about right now. Y'all can deal with y'all's marital problems tomorrow when y'all sober up. >> Sure. >> Okay? >> Sure. You have my word. >> What What is getting And you like I said, you you get you go up and then you you come back down with me and that's great. We need not to make her go back up. Cuz she's not being quite as reasonable right now. She keeps going raising up. Okay? Are you going to let the kids go with her if they're willing to go? What >> If they want to go, absolutely. >> And honestly, the sad part is that those kids may remember moments like this from their childhood for a very long time. They should not have to watch adults behave like this. She really needs to think about how her actions affect her children. >> If they don't want to go, then absolutely >> And I'm not going to make I'm not going to force either one of these kids to do anything they don't want to do. Y'all are still married. Y'all have 100% custody of each of these kids. I'm not going to make anybody do anything. But the thing is is if Uber gets here and she's willing to get into it, I would much rather them get in the car with her and go home than them be stuck out here with you. >> see what you're saying, but I understand the other side of the coin is that then what happens when they get home? >> Do you have a reason to believe they're in any kind of danger with her right now other than her being She's She's agitated, but she's not violent. >> Okay. All right. Understood. Understood. I'm not throwing I'm not throwing stones here. Understood. Um so with that said, if If they want to go, I would absolutely let them go. But if they don't, then absolutely not. Do you want to go with your mom? Just saying. The only way I'm going to be comfortable with that is if I see you get on the phone right now and get somebody in route and route to come get the two of y'all. >> Well, dude, the whole reason what we were over there on the other side, we came over here to look for shark teeth. So, that's why she's pissy is because we came over here and she was ready to go home. She was passed out drunk on the beach. Passed out on that You know, when then when we were >> So, what So, what I'm hearing from you is you're not going home yet. >> Well, dude, and and I'm not drinking anymore at all, whatsoever, at all, dude. Like, I mean, I have nothing in You can, you know, the whole deal, dude. >> Okay. >> There's nothing And And also, too, I I can go home if it's necessary, but I mean, we were looking for shark teeth, man. >> 15 minutes. >> 15 minutes? >> Well, hey, dude, if you just >> No. We're going to make things easy or 15 minutes. >> I will probably wait and walk down the beach and do what we were trying to do to get >> My son is going home with me. >> He is allowed to to take that kid if he wants to. >> There is a No. No, he's going to be out here all night. He's been drinking. He needs to go home with a safe adult that's going to get him fed and get him clothes and get him >> He's not capable of that right now. >> He's not. No, he's not. No, he's not. No, he's not. >> There's nothing I've been talking to him for the past 10 minutes. There's nothing that he's done that makes me feel like he's incapable of that. >> He doesn't do a [ __ ] thing but drink and go to bed. >> I'll be honest with you, based on what we're seeing here, I would have left the kids with their dad, too. He seems like the more stable parent at the moment. And the kids crying to stay with their dad really says a lot about how they're feeling. Like, he may need to seriously think about what's best for the children and their safety. You know, this whole situation is It's just sad. >> That's all he does. >> Okay. >> It's always me taking care of everything. No, my son needs to go home with me. My son needs to get a meal. My son needs to get clothes, and my son needs to get ready for bed soon. He's not staying with a drunk adult on the beach. >> You are also a drunk adult on the beach, right? >> I'm not I also took a 2 and 1/2 hour nap before we even got in this vehicle. I work night shifts at the hospital. I had eight couple shots, and I took a nap on the beach. No, I am fully coherent >> The only THING >> GOING ON AROUND me besides this man trying to come up with every excuse to why he's correct and why he's not in the wrong. >> I'm not arguing whether >> got behind the wheel in the first place and drove. That's where I took the keys. >> Okay. >> Now, he's jeopardizing my child's danger. >> Ma'am, the only thing that I'm going to enforce is he's not driving this vehicle. If he wants to go walk away, and he wants the kid to go with him, and the kid wants to go with him, that can happen. >> My son needs to go home with me. He has no clothes. He has no shoes. He has nothing for when it starts to get cold out. >> And he is capable of bringing the kid home. >> not going to be capable of driving. >> No, he's not, but he can call an Uber just like you are. >> And it's taking How long have you seen me trying to get an Uber over an hour almost now? >> Mhm. >> So, you're going to have my son sit in the COLD FOR AN HOUR WHILE HE'S naked almost to wait for an Uber, right? Does he not have any clothes in this truck? >> No. >> Okay. >> He does not. He has nothing in this truck. >> He's asking you to stop yelling. >> He needs to get some warm clothes and a belly full of food and go to bed. We've been out here since 8:00 a.m. It is time for my son to get home and get some clothes on, take a shower, and get some food in his belly. Is that too much to ask? >> It's not too much to ask, but it's not anything I can make happen. She seems more focused on proving that she's right [music] than on what's best for the kids. Well, the police are not marriage referees. They're there to deal with the situation and keep everyone safe. And when she says, "My son." Ma'am, it's both of your kids. This should be about keeping them safe, not winning an argument. >> He's not taking my son. Period. I don't care what happens. Take me to jail right this second if it if if it's going to be an issue because he's not taking my son. Period. My son needs clothes. The sun's going down. The temperature's about to drop. This morning around 8:00, 9:00 a.m., I took also a 2 and 1/2 hour nap because I work at a hospital. Knowing I got to go to hospital because a mother is irate. She's wasted, too. That's >> Ma'am. If you could calm down for a second. He's calm. And we can get all four of y'all in a single Uber and send y'all home. That's all >> He's not getting my Uber. He can order his own god damn >> He can take the kid in a different Uber. >> He's not taking my kid. I will go to jail behind >> And then he's going to take both of your kids. And that's all we're trying to do. >> will be on the way to get him real quick. >> No, she Your mom doesn't have custody of your kids. >> Okay, so y'all would rather allow a drunk [ __ ] father to keep custody of the >> having this argument. I'm not having this argument with you again. >> y'all though. That's y'all. Y'ALL WOULD RATHER LET A DRUNKEN DAD keep custody >> The only person who has been belligerent since I've been out here is >> [ __ ] that y'all DON'T GIVE TWO FLYING >> I do. >> The you don't. >> That's the only thing I care about. I don't care I don't care don't care about him. I don't care about the two of you. >> I DON'T CARE ABOUT MY god damn kids and that's it. >> Then start acting like it. >> I [ __ ] do. Why do you think I'm fighting it so god damn hard? If I didn't care, I would have already been gone. If I didn't care, I would have left him with that kid and I would have been gone. Two hours ago when this started. >> The only thing I've seen since I've been out here is these two kids get upset about your behavior. >> Well, guess what? Maybe their dad shouldn't be a drunken piece of and snatch the kids. Not only that, drive from Fort Pickens drunk down here where I have to snatch the keys out because I'm scared. For my safety, my child's safety. That's wild. >> You need >> That's >> yelling at me. >> That's wild. That's wild. My point, why is he not in trouble for drinking and driving? That's wild. Because they didn't catch him in the act. Love Florida, right? Breathalyze him. He drove from Fort Pickens down here. Hey, my Uber's coming this way. I need my son. >> An important question here is whether the officers actually saw her driving while impaired. You know, someone can report suspected DUI, but police still need evidence to show that the person was driving drunk. Well, that could include witnesses, videos, statements, or you know, other facts from the scene. And an officer cannot automatically arrest someone for DUI just because another person claims they drove drunk. And seriously, she never stops talking. Like what an exhausting person to deal with. Under public safety statutes and operating [music] under the influence prosecution rules, third-party accusations of drunk driving without officer observation shift the legal focus directly onto public endangerment and disorderly conduct. Under statutory criminal procedure codes and public order standards, appellate courts to draw strict legal boundary between unobserved traffic offenses and public breach of peace. In landmark public order proceedings, individuals arrested during domestic arguments in public places contended that unverified drunk driving allegations could not justify an arrest or that public intoxication alone was not a crime. However, appellate courts firmly clarified this distinction under state disorderly intoxication statutes. The judges ruled that while officers cannot charge a suspect with DUI based solely on a spouse's verbal accusation without independent physical or video evidence of [music] vehicle operation, creating a loud, disruptive, and unsafe scene in a public recreational area satisfies all statutory elements of disorderly intoxication. Furthermore, courts established that officers hold full legal authority to intervene, secure the immediate welfare of minor children, and arrest an uncooperative intoxicated parent to eliminate public endangerment. >> Okay. So, can we take a separate Uber to the same spot? >> I do. >> With no clothes. >> If we weren't doing this right now, we'd be walking down the beach and be on the way home. Where do you guys live? >> Huh? >> Where do you guys live? >> I live on Highway 29 and uh >> I see kids walking around here at midnight all the time. >> Interstate and 29. >> And it's And it's uh children of that age wearing the exact same thing he's doing. >> So, can you call me >> So, I'm from up north. So, I'm not >> You and him can ride in a separate Uber home. >> Certainly. I thought that was already established, but certainly, yeah. Yes, sir. >> get Can you get on that? >> It is mandatory. >> Is it mandatory? >> No, I'm We were looking for shark teeth. >> You okay with him riding in the car in the front seat? >> front seat and he's not going to talk to me and he's not going to >> Here's the thing, if you keep talking like that, that Uber's not going to let you in the car. >> I'll just take another >> I'll I'll change my attitude with Uber. Okay. Listen to me. I'll just take the keys. It'll be easier. I didn't drive here. YOU DID. WHO DROVE HERE? Who drove here? Okay. Anyway, I think he passed that sobriety test to be completely honest with you. So, anyway, so It'll all be good. WE DID DRINK. POTENTIALLY UBER NUMBER TWO. Crazy thing, man. That's a crazy thing. That's my Uber. Can I take my son and leave? Are you coming? No, I'm not I'm not going at all. No, no, absolutely not. I'm not going. This one? Lady, please just stop talking. For the love of your kids, just calm down and stop making things worse. You know, at this point it feels like this was less about the kids and more about trying to control the situation. Well, the children should have been the main priority from the beginning. All right, I'm going to turn around and come on that side. Okay, sounds good. No, he's calling a separate Uber for the psycho peace. >> It don't matter. He's My son's going with me. I don't trust him. >> I can't wait till the day somebody snatches your ass up and sends you to jail, dude. You're You're You're insane. Insane. So, either take this Uber >> I'm taking my Uber. I don't need you to tell me to take my Uber. I'm taking my Uber. My son has no shoes. He has no shirt. The temperature is dropping. It took me an hour to get this Uber. This truck is locked up. Why would y'all allow him to stay out here with no food, no drink, no shoes, no nothing? >> Basically, because it's a civil matter and what you're doing right now is being an [ __ ] making a fool of yourself. >> Everyone's going home. He's just taking a separate Uber with that kid. >> Okay, so with that kid needs to go in my That kid needs to go in my Uber. You can't tell me. No. You can't Do not push your >> You're going to go to jail. Stop. >> I'm walking with my kid and his I'M TELLING MY KID BYE. >> SHANNON, don't do this. >> You're not going to shove me to THE GROUND. I'M NOT TAKING my child. I'M TELLING HIM GOODBYE. >> GO THAT WAY. >> SO, I CAN'T TELL MY KIDS GOODBYE? >> The one you're going to jail for is disorderly intox. >> That's fine. That's fine. >> Go this way, buddy. >> You can stop being rough with me. And nobody's Hey, nobody Hey, nobody Hey, nobody I don't care. >> You don't [ __ ] listen. >> 28, we got one in custody. >> Bye, Mommy. >> Do what you guys want to do. >> Go. Push that way. >> So, you're going to arrest me for asking to tell my kid goodbye? >> Nope, I'm arresting you for disorderly intox. >> Okay, now I told you all I want to do is tell my kid goodbye. >> You're here screaming, hollering >> to do tell MY KIDS GOODBYE. I CAN'T EVEN TELL MY KIDS GOODBYE. >> The way she reacts to being arrested makes it seem like she's more focused on herself than on the kids being with their dad. Honestly, it's hard to watch, you know, after all that arguing and chaos, I can understand why some viewers were relieved to see the situation finally end with an arrest. >> You're causing a public disturbance and I have told you several times >> No, you didn't. You told me once. >> Nope. >> No, it was no several nothing. There was no several nothing. You can give my son his cell phone. That's in your hand. Yeah, and you can take my cell phone with you. >> Stop. >> That one's his. That one's mine. Yeah. >> Stop. >> Which car are we going to? Cuz there's nobody nobody ain't nobody Nope, I'm not I'm not You can stop pulling up on my arm like that. Nobody's resisting. You can stop picking me up. I'm 5 ft I'm 5 ft nothing. Stop picking me up. I'm not resisting. I laid down on the front of the car. You can unclip it. I did everything you asked me to do. You can stop treating me like I'm resisting cuz I'm not. >> being a public nuisance. >> Well, maybe you should tell him let me TELL MY KIDS WHAT CAN YOU TAKE MY HUSBAND AND MY KIDS HOME? THANK YOU. YOU CAN TAKE THEM HOME. THANK YOU. Ain't nobody resisted. No reason to pull up on me that way, bro. You've been [ __ ] WRONG THIS WHOLE GODDAMN TIME. Too tight, dude. And can you get the hair out of my mouth and please? There's a way too tight. I can't even turn my hands. I can't turn it. It hurts. Can you stop turning my hand? >> You're not supposed to turn your hand. >> Well, MAYBE I SHOULD HAVE PUT MY HANDS IN THE PRAYING POSITION like I'm supposed to instead of backwards like that before you got them too tight. Here. nobody resisted anything. I >> Stop turning your hand. >> Thank you. As I should be, not backwards. >> You mean arrested before? >> Yes. >> For this? >> No. >> What you mean arrested for? >> A fight. That's still too tight. >> It's not too tight. >> Yes, it is. >> I can fit two of my fingers. >> Oh, and now she's trying to negotiate the handcuffs like they were in Uber cancellation. At some point, arguing with every single instruction is probably not helping her situation. The officers are trying to get her under control, but she's just still trying to debate every little thing. I mean, just stop talking and cooperate already. The woman was booked into the county jail and charged with disorderly intoxication. This charge can apply when someone is intoxicated in public and their behavior becomes disruptive, unsafe, or meets the specific requirements of the state's law. Being drunk alone doesn't automatically mean someone is guilty of disorderly intoxication. Well, the surrounding behavior and circumstances matter. The possible DUI issue is also important. Right, a person cannot automatically be charged with DUI simply because someone claims that they drove while drunk. Investigators may need evidence showing that the person actually drove and was impaired. Well, that evidence could include witness statements, video, physical evidence, or the officer's observations. Well, the biggest lesson here is that children should never have to become part of an adult argument. Once emotions and alcohol are involved, continuing to yell, argue, or fight can make the situation much worse. The safest choice is to separate, make sure the children are safe, and deal with the relationship or custody disagreements later through the proper legal process. Well, what do you think? Did the mother make the situation worse by continuing to argue in front of the children.
