on May 9th 2024 a law enforcement officer was conducting routine Patrol duties when he observed a vehicle driving recklessly on the road the vehicle was speeding excessively and weaving in and out of lanes showing clear signs of dangerous driving hello hi how you doing I'm good I'm Officer United State Police hey I stopped you for two reasons one you're going 81 and a 65 and then two you're all over the road can't keep your Ling what's going on nothing I just left my U wedding party uhhuh but I just was fine I I didn't think that I was okay forbing but like honestly my car like the the stirs it's like [ __ ] up on the right side but it's just did I see your driver's license man I don't have my driver's license but you can look me up Lauren gri Lauren griggle Lauren griggle yes I have my license but like um I don't have my license on me it's okay yeah do me a favor Lauren un seat belt and then turn the car off and then step out for me yeah of course as the vehicle came to a stop the officer approached the driver's side of the vehicle the driver a female appeared disoriented and showed signs of impairment Her speech was slurred and her movements were unsteady these initial signs prompted the officer to suspect that the driver may be under the influence of alcohol or drugs and he immediately began an investigation into her condition where do you work San I at San die Casino okay come on step on out how old are you I'm 22 okay come over here all right let's stand around my light yeah do you want me can I take off my shoes cuz they're kind of like look this way look at me are kind of like uncomfortable okay just give me a second hold on yeah once the female driver was safely positioned on the side of the road the officer explained that he would be conducting a series of field sobriety tests to assess her level of impairment the female driver agreed to participate in these tests which were designed to determine whether she was under the influence of alcohol or another substance that impaired her ability to drive safely do you have any head injuries no you have any problem I just have like um migraines I the the lights kind of hurt my eyes that's only it what about do you have any problems walking in a straight line no I just have so when was the last time you drank I haven't drink today you haven't drink anything okay all right so put your feet together hands to your side okay for this test you're going to follow the tip of my finger when I tell you to do so okay don't move your head during this test okay do you understand yes sir okay you one more time okay okay don't move your head remember that during the test the officer asks the driver to follow a stimulus such as a pen or flashlight with their eyes as it moves from side to side the officer looks for involuntary jerking movements of the eyes known as nagus which is a common sign of impairment in this case the female driver exhibited distinct signs of nagas okay B all right what's your social 552 yes 29 Go sir all right so you have no problems walking balancing or turning correct no I just have my my back is a scoliosis but like I'm okay okay and you so you're you're after completing the hgn test the officer proceeded to the next field sobriety test the walk and turn test this test requires the driver to walk a straight line Heel To Toe in a specific pattern after reaching a designated point the driver must turn around and walk back in the same manner why does why why can you explain why there's an water of alcohol coming from your breath but it's from your breath from my breath m i I wouldn't understand because I promise I I swear like I I I was supposed to drive my friend home but she actually got a ride so like we were fine so I didn't have to drive her home and I I live way on the 998th and like Rio Bravo so like I'm far from here okay plant your left foot just like you have it put your right foot in front heel touching toe touching keep your hands at your side like this right right here touch your side okay do not move from this position Lauren do not start from this position on we're going to have to imagine a lineon in front of you okay we can do this line can you imagine that straight line in front of you yeah that line is about the width of your foot 3 to 4 in wide okay on that line Lauren you're going to take nine steps nine every step will be Heel To Toe every step you will be looking down at your feet you will be looking down at your feet while you're walking okay your hands will remain at your side at all times and every step you take you will count out loud so that I can hear you I'm going to show you how it's going to look so just stand in that position no stay in that position you're right here yeah keep your hands test she struggled significantly she was unable to maintain her balance stumbling and swaying as she attempted to walk in a straight line two 3 okay it is very important learn that once you start walking on this imaginary line you do not stop walking until you're done with the entire test okay yeah okay yeah do you have any questions no I was just like concerned about that little roach but I lift one leg off the ground and hold it for a specified amount of time while counting in thousands the purpose of the test is to assess the driver's ability to balance on one leg M I'm going to move them a little to the side stay right there yeah put your your feet together hands to your side okay Lauren this is going to be the one leg stand I'm going to show you and I'm going explain it okay you're going to pick the foot that you want for this test it doesn't matter which foot it is you're going to elevate that foot approximately 6 in off the ground six your foot will be parallel to the ground your hands will remain at your side like you have them right here right here yeah and your legs will be straight during this test okay make sure when you lift up that foot you're looking down at it with your eyes and you're counting an increments of thousands th1 th2 th3 okay I'm going to show you you can pick whatever foot you want but just stay just like that I'll show you I'll tell you Lauren okay put your shoes back on again the female driver struggled to complete the test she was unable to count properly showing further signs of impairment the failure to pass this test confirmed the officer's suspicion that she was driving under the influence of alcohol at this point the officer had gathered enough evidence to make an arrest the female driver had failed multiple field sobriety tests and her behavior including her unsteady movements and slurred speech further suggested that she was intoxicated Lauren walk to the front of my car please and just face my car this car right here yeah just look at my look look at my bright lights all right Lauren Place sh be on your back Lauren so this time you're being placed under arrest for driving under the influence of an good temp car stop King 30 or left temp he handcuffed the female driver and escorted her to the patrol vehicle once the female driver was safely secured in the patrol vehicle the officer continued his investigation by questioning the female driver further however at this point the woman began to become argumentative she repeatedly asked why she was being subjected to such an investigation and voiced her displeasure with the situation all right so this is your cell phone right yes you can put it you can put it right here I have to take it up front um your purse so I can put it in your trunk because if I take that they're not going to accept that and I don't want you to lose that on your purse it's a nice purse I just don't understand like what I did wrong oh there's going to be a report associated with this all right um I don't think you're safe to drive and that's based on what I do but like go ahead okay that's all I have that's that's all huh that's all for what just that's all you have for what just for why I'm getting arrested there's a lot of reasons why but there will be a report that you can read as to why I did this okay what's your last name ernandes nandes ernandes behavior became increasingly combative and she refused to calm down despite the officer's requests the officer recognized ing that the situation could escalate further if not handled appropriately decided to transport the female driver to the police station for further processing me I'm about to tell you something important yes go ahead you're being placed under arrest or driving under the influence of an intoxic ground or drug the new Mexican black cons requires you to submit to a bread test to determine the alcohol con of your blood after you take our test you have the right to J an additional pendent test if you choose to take to take this additional test you if you take this if you good Lord if you choose to take this additional independent test you have the right to reasonable opportunity to arrange for a physician a licensed Source laboratory technician or technologist who is employed by a hospital physician of your own choice to perform this additional chemical test the cost of this test will be paid for by the law enforcement agency the New Mexico State Police Lauren do you agree to take our test and what I'm asking for is a breath test Hernandez yes or no no because okay I cannot force you to take our test but if you refuse you will lose your New Mexico driver's license or non-resident non-resident operating pish for one year if you are convicted in court of driving while under the influence you may also receive a greater sentence because you refuse to be tested do you understand the consequences yes knowing your consequences ma'am do you agree to take a bread test Hernandez I'm just I need a yes or no I'll let you think about it but those are the consequences you can submit to a bread test or you cannot okay like I was the one that was going to what I'm saying I understand he hoped that the calm environment at the station would allow for a more thorough investigation and ensure that the situation could be managed more effectively despite her continued resistance and argumentative Behavior the officer proceeded with transporting the driver to the police station I don't I don't understand why like I what I did wrong because I clearly like I I know what I I know my rights I I I understand I to I'm not going to disrespect youate that so promise I'm going to just let you think about what I just read you I'm not going to persuade you any other way it's up to you okay my cousin is a lawyer so I don't I don't want to like I I will breathalyze if it has to come to that but but personally like I'm not I'm not doing nothing wrong like I'm can pee in like about 25 minutes I can't live my legs up can I just get my legs out please upon arrival at the police station the officer administered a breathalyzer test to determine the female driver's blood alcohol content BAC the breathalyzer test showed that her BAC was significantly over the legal limit which confirmed that she had been driving under the influence of alcohol come on there going to be a red chair you're going to sit on it right sir you remember what I read to you at the office you want me to read it to you again no I don't want to you're you're not going to provide a bread sample no okay so again I'm going to read it to you again you said no but I'm going to still read it to you uh listen to me I'm about to tell you something important you're under arrest for driving into the influence of an intoxicated ground or drug the new Mexican PL C requires you to submit to a bread test to determine the alcoh con of your blood after you take our test you have the right to choose an additional impendent test if you choose to take this additional independent test you have the right to a reasonable opportunity to range for a physici a licensed nurse or laboratory technician or technologist who is employed by a hospital physician of your own choice to perform this additional chemical test the cost of this test will be paid for by the New Mexico State Police Lauren do you agree to take our test I need a verbal yes or no no I canot force you to take our test but if you refuse you will lose your New Mexico driver license or non-resident operating privilege for one year if you are convicted in court of driveing well under the influence you may also receive a greater sentence because you refuse to be tested do you understand the consequences yeah knowing your consequences I'm going ask you one more time cuz that's what this think makes want makes me do do you agree to be tested no so I do consider your actions to be a refusal to be tested record of the traffic stop the field sobriety tests and the breathalyzer results once the paperwork was completed the female driver was placed in a jail cell to [ __ ] someone to pick her done yes you you will have access to your cell phone problem for as long long as it takes me to complete the paperwork um half an hour maybe do I have um there's no bail in the state of New Mexico you you will have to see a judge the judge will release you I have to stay here no I'll take you to the jail in jail with a bunch of [ __ ] crackhead no but you perise because you're going to go in and out right away right now more than likely with someone yes with who hold on let me finish this convicting the D is crazy cuz I'm not doing [ __ ] now I would I would breath you I promise I but like I'm not but
