Mexico Union nor Mar 46 on January 7 2024 officers observed a vehicle being driven recklessly along the road without its headlights turned on a hazardous situation that quickly caught their attention the lack of headlights combined with the reckless driving presented an immediate threat to the safety of the driver and others on the road you know you're driving no headlights I'm no I'm sorry you didn't know that no okay do you have your driver's license ma'am where you headed tonight who are you headed to tonight man' I'll give this one back to you is this your car um I'm just going back yeah okay I'll look at your registration in insurance I'm sorry I cut you off you said you're going where perfect um I'm just going back home nice coming from where I do have a cold right now I'm sorry oh okay do you have your insurance card too I don't know any reason um is it like a physical card yeah little paper copy it should say your insurance policy things like that I'm not sure that and then I'll have you step out you can come with me right back here how's your night good so far so good I guess right over here please so I was behind you I I saw you turn onto Indian School upon approaching the vehicle the officers observed that the driver was a female following protocol they began their investigation by engaging in conversation with her starting with routine questions about her license identity and other essential documentation the female driver compiled promptly and courteously providing all the necessary documents in an organized and respectful manner and you had no lights on I'm sorry what's going on with that um I can't really tell when my lights are on sometimes I can't see at night very well I do wear contacts these are colored contacts I can tell yeah okay um they're also like prescription colored contacts okay um and you just didn't know your lights weren't off no I didn't okay where you headed to you said home yeah and coming from where I was at the gas station gas I was getting some Android pods the V pod little nicotine type thing yeah okay um so it's super unusual to be driving at night with no lights especially if you have bad Vision yeah I know okay and you said your car is insured and all that yes it is so like I said it's super unusual that you're you're driving at night without lights okay um have you guys alcohol tonight um I did a little bit okay the reason I asked that question was right when I walked up that car door you rolled it down I can smell it okay what did you consume tonight um it was vodka okay how much vodka would you say about three to four shots three to four shots yeah okay about how long over what course of time did you have those three to four shots um I going say about 30 to 40 d minutes ago okay so three to four shots were they Shooters did you drink out of a bottle um shooters shooters yeah okay all right um like I said it's super unusually be driving no lights I'm just going to check you to make sure you're right finger did you need to Cuff recognizing the scent as a possible indication of alcohol consumption they decided to further investigate whether the driver was under the influence once she was out of the vehicle the officers asked her directly if she had been drinking without attempting to conceal the truth the female driver openly admitted that she was intoxicated confirming the officer's suspicions to ensure the driver's safety and determine her level of impairment the officers asked her about any medical conditions that could impact her ability to perform certain tests or affect the results after confirming that she was medically fit and did not have any health conditions that might interfere the officers informed her that they would be conducting a series of sobriety tests their goal was to establish through observable evidence whether her physical and cognitive functions were impaired due to alcohol consumption yeah sorry I thought I had sneeze okay everything okay okay just behind it you're going to do a series of small steps keeping your lead foot planted you will then continue back facing the opposite direction nine more Heel To Toe steps 1 2 3 when I instruct you to start this test you're going to keep your arms by your side at all times you're going to look down at each step counting each step out loud and once you start you won't stop until you're done okay do you have any questions no sir you understand this test yes all right whenever you're ready Next Step will be step one go ahead and begin following the hgn test the officers proceeded with additional field sobriety tests to assess her physical coordination and balance they explained each test to the female driver ensuring she understood the instructions before beginning the first of these was the walk and turn test which requires the individual to take a specific number of Heel To Toe steps in a straight line then turn on one foot and return in the same manner offline offl arms perfect man face me this next test you're going to choose a leg of your choice okay it can be your left it could be your right whichever leg you choose you're going to raise it above the ground your leg's going to be straight your foot's going to be parallel with the ground just like that Arms by your side you look down at the tip of your toe and you'll count 1000s until I tell you to stop watch me 1,1 100002 13 whichever leg you choose I want you to raise that foot about 6 in off the ground parallel do you understand and left or right either or okay do you understand my instructions yes do you want to keep keep these shoes on for this test or do you want to take them off I'll take them off okay do you have any other questions ma'am go ahead and begin 10012 134567 2008 keep going 10090 2011 2012 I did have um like Cofe medication and stuff because I haven't been feeling good so I had um like it starts with the a I don't know okay you can put your shoes back on okay okay I um I did take like maintain her balance repeatedly putting her foot down for support her inability to complete this test without stumbling further indicated that her motor skills and coordination were impaired after observing her performance in each of these tests the officers concluded that she was indeed driving under the influence each failed test provided clear and observable evidence of her impairment reinforcing their initial suspicions based on the smell of alcohol and her admission of intoxication thank you have a seat listen to me I'm about to tell you something a you're under arrest for driving the influence of intoxicating alcohol and or drugs the New Mexico implied consent act requires you to submit to a breath test to determine the alcohol content of your blood after you take our test you have the right to choose an additional independent test if you choose to take this additional independent test you have the right to a reasonable opportunity to arrange for a physician a licensed nurse or laboratory technician or technologist who is employed by a hospital or physician of your own choice to perform an additional chemical test the cost of this additional test will be paid for by the law enforcement agency do you agree to take our test yes okay sit back for me our seat open another container nothing of value One open liquor container and one two three four five six approached her and maintaining a professional and calm demeanor informed her that she was under arrest for driving Under the Influence they placed her in handcuffs which she accepted without resistance continuing to cooperate fully with the officers throughout the arrest process once she was secured they escorted her to their patrol vehicle ensuring her safety as she was guided into the back seat after confirming that she was properly seated and comfortable they began the journey to the police station for further processing um to get some Android pots like nitin mhm but she has some Li on her and to a couple shots and I was going back home so okay yeah there's a lot of shots in your car that's why I say that oh yeah she but yeah she got on her shot she drove too yeah she do drive and driving under the influence during the proceedings the court revealed viewed evidence including the results of her sobriety tests and her admission of intoxication this evidence along with
