painkillers as well that's prescribed to you when was the last time you took those BL BL BL BL BL perfect on June 27th 2023 officers from the Port Police Department received a call about a young blonde female who crashed her car into a tree the caller reported that the car was completely total officers quickly responded to the scene yeah I just came I'm half asleep I don't yeah whose vehicle is this hers I just parked right here but who who's driving this no I'm I'm driving that no she's driving that I just came to try and save her but are are you friends with her yeah there there's no saving that y'all might need a tow truck or what's going on you have a license on you I don't have a license yet you don't have a license what's going on today I was driving home I was kind of drunk I was trying to drive home my apartment is right there right where and I turn the corner right there behind um those to [Music] okay all right you have a you don't have a license at all no I'm going to what's that I've been taking classes to okay you weren't here during the crash she called you afterward what's your name are you the owner of the vehicle no it's not boyfriend your boyfriends mhm upon arrival an officer asked about the vehicle and a half asleep individual responded with confusion when asked who was driving the person stated that an attempt was made to save the driver another individual confirmed that no saving was possible and mentioned the need for a tow truck the officer then requested a license but the driver admitted to not having one only taking classes to obtain it what's your first name j what j j a n j a n i c e your middle name a a what's your last name f a u l k f u sorry f u f a u l f a u i n sorry you have to speak up f f a u l k i n e r I lost control you just lost control okay did you hit this pole or did you just hit are I looks like she coming probably coming around this corner 11 you want us to get holdan for that you might how about you step back you have insurance for your uh car I can go in there and get it if you rather we go step in my squad okay you have any weapons on you how come you don't have a license now I going to have you face sought clarification on whether a license existed and the driver confirmed having none the officer asked for identification and the driver attempted to spell out a name struggling through the process the officer inquired about insurance and the driver offered to retrieve it from the vehicle before proceeding the officer ensured that no weapons were present I mean that's what you have for if it's weed I mean if it's you know yeah I mean I would ask her there's you know I mean those are those are prescription painkillers but if she said she was drinking I she also took your car is total it's getting towed or impounded yeah it's total trash is that your boyfriend yeah you can tell him um you have no I can't find the insurance in there okay does he have is he able to send you a copy I have no idea what you're saying I said we didn't have insurance you don't have insurance okay when's the you mind hanging up the phone when's the last time you had a drink like 20 minutes what 20 minutes 20 how much you had to drink tonight were you taking those painkillers as well that's prescribed to you yeah when's the last time you took those I don't know any other like illegal substances have you been smoking or doing any other drugs no no yeah would you like to take some tests to see how intoxicated you are yeah you can okay okay we're going to go there and do them in the parking lot okay the way you go it is that if she's over the legal limit you're fine so you mean just do run it like normal pbti um data master and if fit under but that's I mean that's clearly you know what I mean okay so then if you run her through that DBT or data master and it shows that she's under O8 I would ask for a yearing sample because it's going to be a mixture of alcohol so I can do it so I can ask for uh so she doesn't she blows the BBT and it's under I can silver just and and I do with the data Master just go right to your own you well if you if you PBT and it's under then I would skip the datus master and I would request a he okay you know what I mean because it's going to be a mixture of both so do you mind just writing down what her prescription is in there I will okay all right JN I'm going to have you step out okay let's leave your phone in here too okay get when and get out have you ever conducted fsss before I you come over here you have any injuries on you at all you need medical attention at all okay all right have you step up here a little further okay the driver's phone conversation was interrupted and questioning about alcohol consumption began the driver admitted to drinking about 20 minutes prior the officer asked about prescription painkillers which were confirmed to have been taken the officer clarified that driving under the influence of prescription drugs was still illegal a field sobriety test was initiated first a horizontal gaze test was conducted with the officer checking for any diagnosed eye conditions all right before we start do you have anything wrong with your eyes that's going to prevent you from taking this test any contacts or anything I need to know about your eyes at all no okay so the first test we're going to conduct is the horizontal gaze and stagnis test okay do you have a pre-ignition like a diagnose if already nagus in your eyes a doctor would have told you like you have nagus in your eyes okay keep your head still and follow the stimulus which will be my finger with your eyes only do not move your head keep looking at the stimulus until the test is over you understand these instructions okay keep watching my finger okay perfect all right you can go ahead relax okay the next test we're going to be perform is the walk and turn test you have anything that's going to prevent you from walking in a uh a straight line at all any other injuries to your legs your back anything that's going to prevent you from walking no okay see this uh area ahead of you would you say this is a suitable testing surface it's flat um you have any discrepancies with this you think you can perform this test here okay all right so I want you to can you imagine a line right in front of you can you imagine a straight line right here almost even this tire track if you can see that that skid mark almost okay so I'm going to you place your left foot on the line like this your left foot Perfect all right I'm going to have you place your right foot on the line ahead of your left foot with your heel of your right foot against your left foot just like this I'm going to have you place your arms out your side maintain this position until I've completed the instructions do not start to walk until I told you that do so you understand these in instructions okay when I tell you to start take nine Heel To Toe steps on the line turn and take nine heels of steps back I'm going to demonstrate by taking three steps just like this one two 3 when you turn keep your foot in front of the line and turn by taking a series of small steps just like this all right when you're walking and then keep stacking back one two three all right while you're walking keep your arms at your side watch your feet at all times and count your steps aloud once you start walking do not stop until you've completed you understand these instructions yeah after completing the test the officer moved on to a walk and turn test the driver confirmed no injuries that would prevent walking in a straight line the officer provided detailed instructions demonstrating how to place One Foot In Front of the other and complete the turn correctly do you understand my instructions so far when I tell you the start I want you to raise your right or left foot approximately 6 in off the ground keeping your raised foot parallel to the ground just like this all right while holding this position count out loud to the following manner 1001 1002 13 do you understand these instructions you may begin all may stop yeah Janice would you like to submit to a PBT a perity breath test just to see how much alcohol is on your breath okay all right going have you step back here okay this back to the squad again all right you can go ahead and have a seat you're over double the legal limit the drive okay afterward a preliminary breath test was offered and the driver agreed the officer provided instructions on how to blow properly into the device the test results showed a reading of 0.185 comma more than 12 twice the legal limit of 0.08 after the result the officer informed the driver of being under arrest for operating while intoxicated I'm going to have you hang up the phone okay at this time you're going to be under arrest for ow I going to have you step out have you ever been arrested before for ow yeah how long ag ag was that 18 you're 18 jail and would see a judge in about 2 and 1/2 hours during transport the officer asked where the driver had been earlier but the response was slurred and difficult to understand upon arrival at the jail the officer prepared for the next steps the driver expressed confusion about having already completed a breath test and the officer explained that the previous test was a preliminary one the time is 0551 a.m. all right so before uh you tape a data Master if you want are you willing to supply a sample of your breath through the data master I so you you did a PBT which is a plary breath test this is the data master so this is what I'm um uh requesting a a sample of your breath for if you wish it's up to you but before that um I'm going to allow you to make a phone call to uh to seek legal aid for 80420 so you can call someone if you want seeking legal guidance on how you should go about this if you wish attorney what's that I an attorney you eventually will you can call an attorney if you want right now or someone if that's that's what I'm asking you can you can make that phone call in a reasonable amount of time right now if you wish I don't I don't appoint one to you right that's up to the courts right there you okay but right now I'm just giving you the option to make a phone call if you wish to seek legal aid is that something you want to do right now you want to invoke not making a phone call okay all right so not having the W to make a phone call okay I can make a um phone call to someone pick me up after court yeah right you'll get you'll get a phone call the jaill will let you write down a phone number if you want and you can call someone once you get booked if that's something you're wanting all right if you don't want to make a phone call now um I'm going to request a sample of your breath are you wanting to submit to to that yeah okay right now I asked you if you wanted to seek legal aid and you said no um if you're wanting to make a phone call afterwards after all this right you can you're just going to have to write down the phone number uh the jail staff will let you write that down okay see if I can get on my phone no you can't like just play on your phone or make text okay I can't call some nope I asked you if you wanted to call someone and you said no and I gave you a couple chances um which I thought was reasonable most people just allow say one and no but you said no a couple times I definitely wanted to C somebody I misunderstood yep and are you just wanting the call to like get you out of jail like to bond you out or something or pick you up yeah and you can do that once you get inside the jail okay they'll allow you to they'll WR they'll allow you to um that's what you were saying yeah they'll allow you to write down a phone number right they're not like complete [ __ ] um here know so they'll let you write down a phone number you'll make a call I told your boyfriend too um that you'll see a judge this morning and you most likely will get out so he knows at least how long have you and your boyfriend been together and two and a half years you guys live together we live too f live together anymore yeah I get that what I had to kick his ass out am I just cry or something like you know yeah you're quiet I can't hear I'm half I'm half deaf so plus you're you're you're super slurred right I'm having a hard time understanding that I'm really not SL I'm just like cry all right have you ever in one of these before okay so it's just like a balloon I want you to blow nice and long and steady the officer reassured me that a phone number could be written down and used once booked into jail the officer then asked for a signature to confirm consent to the breath test after signing the driver was given papers including including a temporary driver's license right can I just get a signature from you though um so you having been read that you can sented the breath so I checked that for you I'm just going to have you sign right there in that box all right you want to write a phone number down [Applause] quick is that your boyfriend M all right there's that all right that's your I'll give
