driving erratically and failing to stay within its Lane suspecting that the driver might be impaired or otherwise unsafe the officer initiated a traffic stop be a black golf C occupied by two fill the signal hello hello how's it going tonight good how are you good so you know that thing has blinkers right yeah we just figured that out and they're so dang loud after it's quiet residential area people don't want to hear that mess they are very loud but you still got to use them okay and there's a line painted on the street at the stop signs you have stop okay I got you all right you got your driver license with you sure during the investigation the officer detected a strong odor of alcohol on the female driver's breath when questioned about her sobriety the female responded by laughing at the officer's inquiry this reaction prompted the officer to further investigate as the smell of alcohol and her response raised concerns about her potential impairment I don't know how to put this thing in like Parks so I'm just going to make I don't think I'm moving but push if you push that yeah see where it says the p yeah got there you go perfect gotcha all right do you guys live here or you visiting we're visiting excellent home in the morning all right how much have you had to drink tonight me yes I had a glass of wine about 5 four hours ago okay and nothing since in nope okay where's my driver's license oh I don't know okay hold on you got to find it yeah I can't get on the plane without that let's see hold on so just so you know you can't have an open container of alcohol and a golf cart telling you what's okay I that's what he's telling you do that right now that's out just like a car you can get a ticket same with the seat belts there's seat belts on golf carts you have to use them they should tell us that kind of stuff when I didn't know that where is my driver's license your driver's license like where's my phone oh hang on hang on hang on sorry perfect thank God you're killing me okay so here's the deal okay is I can smell alcohol coming from your breath I'm con list talking to her okay so I'm concerned that you may be operating a motor vehicle well under the influence of alcohol so I'm going to ask you if you'll consent to doing Fields brat exercises to dispel my suspicion of that sure I had a stroke recently so if you see me wobbling initially the female driver denied being drunk however when the officer instructed her to exit the car and step onto the road she complied this action was part of the officer's process to further assess her condition and perform variety tests given the suspicion of her driving Under the Influence that's what it is okay no worries so I got a couple questions we're going to go over that stuff real quick I'm going to have you step away from the golf cart we'll go up on the sidewalk here real quick okay it's all right you don't have any weapons on you correct no I know your p hold on I told you I had a start I don't have a lot of no I understand I'm going to ask you some questions about that because you're not free to leave right now and because I'm going to ask you some questions I'm going to advise you your okay so you have the right to remain silent do you understand your rights yes I do okay perfect so you said you had a stroke how long ago did you have a stroke 2 and a half years 2 and 1 half years okay and what did that look like for you what do you mean were you hospitalized for yes I was for how long um at least a week and a half and I had rehab after that okay how long was your rehab maybe four five six weeks okay do you know what part of your brain stroke was in yeah the left side that's all I know okay any other medical problems uh diabetes is it you have diabetes okay how do you manage your diabetes insulin okay what kind of insulin do you take uh I take a pill every day I don't know I don't know what it's all it's insulin pill okay that's not insulin then so yeah and I take a shot once a week oh you do take a shot once a week okay so that's not how diabetes works if you're insulin dependent well I mean well type two diabetes take take medicine two times yeah yep why would you tell someone to shut she isn't doing because she is interfering with the traffic stop so she go to ja had I'm also a paramedic I've been for years but uh that's is type two diabetes and I take medicine once a week yep I mean a shot once a week and then medicine met foran that's of every day okay what kind of insulin do you take if you're telling me you take a shot it's uh it's the new shot that just came out I don't even know the name of it um I want say why [ __ ] but I'm not sure that's positive cuz it's a pet pie yep so it's not a straight insulin shot okay gotcha okay now we're on the same page understand all right any any other uh medical conditions no okay any uh medications that you take on a regular basis uh I take um vitamin d i take that I take um Aderall once a day in the morning okay and high blood pressure medication you know what is to it there's a um what's the name of that medicine that I take for blood pressure I I don't know I we just got blood pressure blood pressure medicine all right so everything well controlled yes all right do you know what your last A1C was um seven or eight excellent all right and any physical limitations no okay no problems with your knees hips shoulders just they'll have Bal because of a Stoke that's it okay the officer asked the female driver if she had any medical conditions that might affect her ability to perform field sobriety tests after confirming that she did not the officer informed her that they would conduct several tests to determine her level of intoxication and is it all on your left side or on your right side okay right sided but it's not a um it's not like a terrible it's just a little bit of okay perfect and you last uh when was your last drink you said I don't know maybe like 12:00 I don't know I I had a drink but I just been uh I was spping on it the whole time okay what kind of what kind of drink was it Gray Goose pineapple and orange juice okay and 12 a.m. like 12 dark time okay without looking at a watch do you know what time it is now probably like 320 okay but my guess you are real close 310 311 there you go and do you know what date it is today yes July 16th okay and where are you ahead of right now back to our hotel at Pasa Maria Solomon Street I believe the name I don't how to Marina cast Marina okay do you know where you're going right now cast Marina is that where you're going yeah we're going 3 minutes from there you're just going kind of a weird way get I went away the GPS I mean on my phone told me to go all right gotcha it said 4 minutes from there to here okay that's been about a minute so okay um any problems with your eyes at all no have you ever been told by a doctor that you have nagas no I've been told that I have um pseudo tumer cerebra which is where your um retina swells up so much that you could detach that's what I have all right gotcha which what caused the stroke okay oh I'm sorry to hear that yeah all right I'm going to have you stand with your feet together arms down by your side I got to roll my pants like that cuz they're really long oh okay now feet together arms down by your side just like you're doing so I'm going to have you look at the tip of my pen can you see the tip of my pen yes ma'am so I'm going to have you follow the tip of my pen with just your eyes and don't move your head do you understand y okay this also affects the stroke just so you know that makes me dizzy okay not because else but because almost done okay one more time okay all right I'm going to do one more this time I'm going to go up and down instead of side to side okay okay this one's going to feel kind of weird it's going to feel like you're trying to look at your eyebrows and it's not going to work okay all right arms on by requested that the female performed the horizontal gaze nagus test after administering the hgn test the officer asked the female to perform a series of other field sobriety tests including the walk turn test and the one leg stand test oh that's much better hang on I'm done again okay no worries okay that's a much bigger sidewalk over there where over here I'll have you go towards that officer yes ma'am all right right about here okay here yep so I don't have a lot of space I'm going to I'm going to demonstrate this way you're going to go the nice long way where it's nice and flat and free of debring okay remember I said balance is my issue because of a stroke nothing yes ma'am but go ahead okay so this is called the excuse me walking turn when you're doing this I'm sorry when you're performed the field sobriety tests but failed them significantly indicating impairment after her poor performance on the tests she admitted to drinking two to three beers that night reinforcing the suspicion that she was driving under the influence the officer promptly arrested the female driver meanwhile the passenger attempted to Escape From The Scene the officer quickly apprehended the passenger as well but she began to resist arrest complicating the situation further here hold on let me let me restart okay okay you want to try the other foot let me do on this one this is okay hessie um 104 thank you her driver's license is suspended out of Georgia according to com okay well that's probably why she lied about it then did you know your license was suspended no I did okay I didn't know either yeah no I did not know okay I know before but interesting to find out okay I'll see if I can I'll see if I can see I don't know if I can see in Georgia so I'll check for though okay um you've been Cooperative I don't have any concerns about you but if I take the handcuffs off you're not going to punch me in the face right no all right hey will you take mine off too she punch the T pun the only thing that I'm going to ask of you is when I take these handcuffs off I want you to put I'm going to start with your right hand I want you to put it on top of your head I'm going to take the left one off put it on top of your head then you can have a SE all right okay are you going to provide a breath sample no I think I I mean do I need to call my lawyer I so you're not entitled to a lawyer right now okay but you gave me you read me my right so does that mean I have to entitle to a lawyer not right at this moment no so this is the administrative side of the law um regarding a driver's license I just need a yes or no if you will provide a breath sample um no not at this time no reason for it I will read you another thing here in just a minute and then I'll ask you again okay all right but I can't answer this question without asking my lawyer so I'm confused about that again this is the administrative side of the law and you're not entitled to a lawyer but if I answer the question is incorrect what happens then there is no incorrect correct answer but I'll read you something here after arresting both the driver and the passenger the police placed them in the patrol car and transported them to the police station for further investigation at the station the driver cooperated fully providing detailed information about her actions and the incident this isn't very long just listen to it if you have if you have questions at the end um that's fine um just wait till we're wait till I'm done otherwise I'll lose my spot and you're just going to have to look any talk okay you me read it myself nope uh all right so I officer Joshua hessie of the kws police department if you failed to submit to the test that I have requested of you you're privileged to committing a misdemeanor refusal to submit to the test that I have requested of you is admissible as evidence in any criminal proceeding okay that's called the implied consent warning do you understand what I just read to you I do okay so it's saying if you refuse to provide a breast sample your driver's license will be suspended for at least one year and up to 18 months if there's been a previous refusal okay I need to ask my L about this all right do you still refuse to submit to the test knowing that your driving privileges will be suspended in ACC in accordance with Florida state law I mean I'm going to tell you I don't I can't answer that question without asking somebody what the legal part of this is okay that's I can't so I can't say yes or no okay so um I'm going to mark you as you are refusing I will give you one final opportunity because I have to set up the machine and like I said you're not entitled to a lawyer right now so you can make a final law then why don't I why don't I have to stay here because again this is civil this part is civil there's still there's two sides of the law civil crial anymore because if I do that then what happens I'm telling you if you don't provide a breast sample your driver's license will be suspended for a year okay um I hear what you're saying but I need to ask my lawyer what that means for me because I know I just need that out okay so like I said impairment that I see it could be from alcohol could be from drugs could be medically induced um things like that so we have uh people that have been specifically trained to recognize if something is impairment based on alcohol drugs or if it's a medical um condition like you were saying okay um if we can get one of those people to come down it's not anybody that you saw tonight it's nobody that's working right now and participating an evaluation with them it is basically some of the same things the exercises that we did but you get to do it in a much more controlled environment flat floor nice light and then they do a few extra ones they check blood pressures and things like that it's another it's another opportunity for you to prove your innocence is that some is that something that you would participate in or not so that that says that I'm under the legal limit yes ma'am what is there a need for me to do that you can either do it or not you're you're being lodged at the jail either way and why is that if I'm under the legal limit because again IR arrest based on impairment so I saw impairment I cannot uh say if that impairment is due to a medical condition or due to drugs and alcohol is out of control you know what no there's no need for that I'm not impaired I haven't done anything and I've been very cooperative and followed all of your tests and under legal limit so and I cooperated with you there so I'm there's nothing for me to be I haven't done anything all right understand despite the driver's breathalyzer reading being below the legal limit she was charged with driving under the influence and fraud impersonation the passenger faced charges for resisting arrest the driver's behavior and additional evidence led to the DUI charge while the passenger's actions
