Oh, that's why I know you're not supposed to chew, but stop. Stop hurting me. Stop hurting me. >> You are resisting. I'll hit you with I will hit you with another charge right now. I'm going to hit you with another charge. I'm going to do it. >> Hello everyone. Welcome back to the channel. Today we've got a body cam case that started with a domestic disturbance call. Officers arrived at an apartment in Pensacola, Florida after a man reported that his girlfriend had beat him up. But when officers started asking questions, things got even more complicated. And once the officers started looking at what happened, that night went from a simple argument to an arrest, a battery charge, and a guilty plea. Watch the video to see what actually happened. >> So, she's like grabbing on me, punching on me. I mean, she's scratched the crap out of me. >> Yeah. >> She's heavily intoxicated. >> Where is she now? >> She's in that top right apartment. She doesn't >> All right, hold on 1 second. Let me Okay. Um she's up in to that top right apartment right there. She's extremely signal 21, and he has bruises all over his arms, and dispatch did say they heard Were they on the phone when that happened? >> And dispatch was on the phone with her. >> Yeah, I I saw that, too. >> What were you guys arguing about? >> She gets irate. She You won't be able to talk to her. You won't be able to reason with her. She won't listen to you. She just >> What's going on? >> Once she's had a few shots. Today I know was because I left last night, but I was trying to protect everybody. >> Right. >> Last night it was because her brother fell off the wagon. He's lost his job. It's making her drink. This is probably call number five for y'all. She was Baker Acted a month and a half 2 months ago, um and they let her out, and then she was doing good because her brother started doing good. Well, her brother fell off the wagon again, and called her while he was up his kids driving and saying like I don't feel right, something's different and triggered her. >> Is she going to try to be violent with us? >> No, so she's actually very scared of y'all. She's going to She will They She can vouch for this. She is going to flip the whole story. >> She's She's She's traumatized. >> She She She's afraid of y'all. She's She's afraid of y'all. That's why she actually ran over there. >> All right, just hang out right here, okay? Don't go anywhere. >> When officers respond to an alleged assault involving someone who may be intoxicated, they have to think about immediate safety while also looking at any reported injuries or other evidence. Previous calls can give them some context, but each situation still has to be judged based on what happened that time. >> Hello. What's the deal today? >> Sure, yeah. We're trying to figure out what's going on. >> As I have been uh Claire bird sitting on my back porch and this small child running up screaming yelling banging on my other neighbor's uh door, which I've never seen before. And she was like sitting there, you know, she's obviously upset. I can hear somebody on the phone down below and I asked if she was okay. She said she wasn't, so I told her to come around here and I've been trying to talk to her to see if she's okay, if she was hurt, if she'd been, you know, what was going on. She was visibly distraught with the man who was on the phone. And it seems they live together. I've never seen them in 2 years. I've lived here 5 years. That's why I'm I'm like I've never you know, this isn't like oh they do this every couple of months or something. So it's very alarming to see this girl running around you know, screaming in the middle of the afternoon. So I just got her some water, some tissue. >> Is she up there now? >> Yeah, she is. She's sitting inside just trying to cool I was just trying to get her to cool down, calm down. >> Can we come in there and talk to her if you don't mind me? We need her to come out. We need to talk to her. It's not a It's not a question. We're just >> My I have two boys. My two sons are in there. >> Okay. >> What are they like 13 and 11? >> I got you. We'll we'll come to the door and uh just I mean we got to talk with her. >> you. I'm just trying to tell you where you know, and I asked tried to ask him. He's like, "She's an alcoholic." I'm like, "No, but what happened? Like why is she running around?" >> I got you, but that's what we're here to figure that out. >> So we have to talk to her. Yeah, so let's uh just you know, so I have her I tried to get her to calm down. She's really upset cuz she's just getting >> Okay. Okay. >> We want to find out what happened. >> Clara, can you come talk to us, please? Hey. Hello, Clara. How are you? >> Hey. How are you? >> Um so hey, obviously we're here for a We can we can You want to shut it or leave it open? You can shut it. It's fine. >> I'm scared. >> We're Obviously we're here for a reason, so tell tell us what happened, okay? >> Tell me it's sex. I'm being sexy. >> All right, hey. I'm going to read you something really quick. >> Can you ask him? >> No, I know. I just got to read you something really quick for us to talk, okay? >> What if I want to just want to go home? >> Well, right now we got to talk. >> Can he be there? >> Huh? >> Can he be there? >> He's just around the corner, okay? >> speak to him. Can he be here? >> But he is he's still on the property, okay? >> here? >> No, listen listen listen. >> Officers first needed to figure out what happened and make sure that everyone was safe, and judging by how quickly she said that they had just started fighting, people, this conversation was about to get very interesting. Apparently the peaceful afternoon had already been canceled. >> So look, you have the right to remain silent. Do you Do you your rights? >> No. >> Okay. All right, Clara, right? >> Yes, but I go by middle name Grace. >> You go by Grace? Okay, Grace. So, listen. >> I'm sorry. >> We're here for a reason. I get that, but listen, you got to talk to us first, okay? >> even going anywhere. >> I get it. So, tell We're here for a reason, okay? >> Tell me what happened. >> I just was arguing with him. And I was drinking a lot, but I didn't drive. I didn't go anywhere. >> Okay. >> And I just go to my neighbor. >> What for? >> Um I'm really sorry for that y'all were involved. Um but we were just arguing just because I was involved with y'all in the past. And I learned from that. And I'm trying to get better at that. And I've reached out to people that love me today. And I am getting better. And I just I want to just be able to go home at this point. >> Okay. >> And everyone will tell you that. Like I just want to go home at this point. Like I want to get better. I want to have the opportunity to get better. And I do have to work tomorrow. Like I have like I want to live. Like I want to be able to do that. Like I want to be able to go to work. And he gave me his He gave me my clothes because he knows I want to go to work. And everything. Like I'm I'm sorry that y'all were called. I'm very apologetic about that because y'all were um burdened from stuff that you had to do. And I'm sorry about >> it I'll stop it right there. Listen, so it's our job to respond out here. It's not You don't have to be sorry. What we're trying to do is figure out what happened. So, look, I'm going to be I'm going to be I'm going to be honest with you. He has bruises all over him. >> So do I. >> On the phone, they heard they heard a slap, okay? >> So do I. >> So So, listen. Did you hit him? >> He hit me. We both have that. >> Did you hit him first? >> No, it's just under Baker Act. Like the police did that to me. >> No, today. Today. >> Today, we didn't touch each other. >> So, he has bruises on him for no reason. >> I have bruises on me, too. >> at me. >> I'm being serious. I have bruises on me, too. You can look. >> Where? >> On my arms, my legs, everywhere. You can look. >> Okay. >> I promise. >> So, something got bad enough for us to be here. >> He just wanted to call, and I'm sorry, and I just want to go to bed. That's all. >> No, that's what >> Honestly, she was selling the I've learned my lessons speech pretty well, but unfortunately for Grace, apologizing for causing a disturbance wasn't enough to make the possible assault disappear. Now, the officers had to slow things down, look at the evidence, and figure out who actually did what. >> Well, that's not happening until you tell me what really happened. >> That's what's really happening. I came home from work. >> You ran over here all the way upset. 10 and 1/2 shift, I came back >> I already talked to him. >> No, I got upset, so I started drinking. And I just started getting upset because he back tracked me in the first place for no reason. Like >> So, did that make you mad and you lost your temper? Did you lose your temper? >> Yes, ma'am. >> Okay. And then >> never hit him, ever. Never. >> But I >> his car, but I never hit him. >> Look at me. There's bruises all over him. Something physical happened. >> So, you're going to say you never hit him, but there's bruises all over everybody. >> on me, too. >> I Can you show me? Can you show me? >> Like it's on my arms. Um I would have to [ __ ] like take my clothes off to show y'all, like >> Can I see the other arm? >> Um >> I'll put this back on the car for you, okay? >> Thank you. >> I got you. >> I have to remember where it is. It's like over my arms. >> You said you have bruises from the cops? >> Yeah. Not from him. Not from the cops. Not from him. He's very supportive. That's why I can go to sleep. No, it's It's this arm. It's this It's this other arm. It's this arm. >> What? >> From the cops from being sent to a big big disaster hospital. They put their arms on me. That's the arm. The bruise right there. I didn't do anything. I didn't do that. That was the from the cops. I didn't do that. >> Yeah, that's what I'm saying. So >> you can ask him. >> No, no, no. I'm not I'm not saying that didn't happen. What I'm saying is that those bruises are not from today. Those bruises are not from today. >> today. >> You're right. >> Got you. >> But his are >> His are from today, okay? That's what we're saying. >> I didn't do anything to him. I didn't touch him. I promise. I didn't touch him. I just want to go to bed so I can work tomorrow. My job is on the line for my mental health and I just want to go to work tomorrow. I have not touched him. He's like 6'2. Like I'm not touching him. I promise. I'm a woman. Like I'm not touching him. >> Turn around. >> Can I have my vape, please? >> Yeah. >> I'm not saying I didn't talk to him. >> The I just want to go to bed plan, yeah, that's officially being canceled. Officers can look at whether injuries appear recent or whether they match a timeline being reported. And, you know, they may also document injuries and get statements from both people before deciding what action to be taken. >> Can I talk to him or have him write my name, please? Please? I'm not doing anything. I've been in my own house in my own neighborhood. I'm not on drugs and everything. Please, let me talk to him or have him write my name, please. I'm not with you or anything. Can I talk to someone? Can I talk to >> We will in just a minute, okay? We'll let you talk to him. >> Okay. >> We're talking. >> He wants to talk to me. I'm literally not doing anything. I'm not doing anything, ma'am. Where Where I going? >> You're going to jail. >> For what? >> For battery. Hey, come on. >> battery? Have you asked him? They're taking me to jail. My foot my feet hurt. I'm not trying to do anything. I'm running a wall. They're taking me to jail. How does that mean be with you? You chose this by calling them. They won't talk to you. I'm going to jail. >> My babe. >> Which one? >> I can't do anything. >> is it? >> My babe. >> This one? >> That's all one. >> Either one. >> Just >> One's Good. All right, come on. >> can you tell people >> let me go home. They won't let me go home. >> I'm going to put this her phone in the bag and then grab that one. Okay. >> Like what he says make it different? >> Well, he already told us everything, okay? >> He told me. >> He told me. >> me, too. >> Hold on one second. I'm going to talk with them really quick. Watch your foot. So, she's going to go to jail. She'll have first appearance, okay? She'll see a judge and then they'll set it there. >> But that's not going to happen till Monday. I can't Can I can we just take her to the drunk tank and force her to go to court and get help? >> I think this hopefully this is an eye-opener for her. >> I want to go to work tomorrow. I want to go to bed. Please. >> That she can't do this to you and she needs to clean up her act, okay? All right, put your arms out like this. A little closer. Can you flip your hands around? >> I want to go home and go to go home and go to bed. I've done nothing. We were just in a fight, like that's all. Like I don't want to have to go. Like I can go to bed. >> All right, and hey, so just so I have to go back over it one more time. Were you guys inside the apartment? You guys start verbally arguing, she's very very drunk upset, verbally arguing and then it turns physical? >> Battery can involve unwanted physical contact or force, depending on the state and the specific law. A police may make an arrest when they have enough evidence or probable cause. You know, heavy alcohol use can also affect judgement, make emotions stronger, and make it harder for someone to control their anger or remember exactly what happened. And under Florida domestic violence statutes, responding Escambia County deputies are legally required to identify [music] and arrest the primary aggressor once physical battery evidence is established. Under Florida domestic violence laws and police response protocols, deputies responding to a domestic disturbance are legally required to evaluate the [music] entire scene to identify the primary aggressor. Florida courts and statutory guidelines establish that officers must evaluate visible marks, injuries, timeline consistency, and scene dynamics rather than simply relying on who called 911 or whether both parties were drinking. The law dictates that once [music] deputies observe physical injuries or establish credible statements confirming non-consensual [music] physical contact, they possess mandatory probable cause to execute an arrest regardless if whether the suspect apologizes, blames alcohol, or demands to go to bed. >> It's she started making threats, so I called her aunt, and then she got physical on the phone with her. >> What kind of threats did she make? >> That she wanted to beat my ass. >> I want to go to bed, please. I want to go to bed with my cat. I'm in my own house, like Please, I'm God, please. >> That was quote, like she said that? >> Yeah. >> She said, "I want to beat your ass." >> Yeah. >> Okay. And then >> to make anything up. >> No, no, no, no. So, that's what she said. And then so you called her family? >> Yes, because her fam- I called her aunt. She only has her brother, her aunt, and a half brother. That's all she has. >> Mhm. >> Uh and I called them so that hopefully she would usually when she gets in front of other people she changes and starts being calm, but she started grabbing on me and scratching and on the phone with them. >> I just want to go to my own bed, please. He's on pressing charges on me, please. Let him open the door for me. And no one does this to me. I just want to go home. I want to go to my own bed and go to sleep. And go to work tomorrow. Like that's it. >> Did she actually hit you? >> She slapped me in the face on the phone with the dispatcher. I don't know if I have any marks. >> So you already said that. Yeah, let me get a picture of that, too. Okay. And so when you were on the phone with dispatch, she slapped you. Okay. Then what happened after that? >> Um, she I I went to the door because I knew she was going to go lock the door and yell and have people in it. I went to the door and I was I just stood in front of the door, held the door. I already knew she was going to lock the door again. She did it last time. And then she started scratching me and >> Where at? >> Huh? >> Where'd she start scratching you? >> Okay. Right there. >> Right on this, but she didn't go through the clothes. >> Please. Please. I'm begging you. I'm begging you. Please don't do this. Please. >> So I grabbed her and I was and I I told the dispatcher I was like, "I have her in my arms. I'm just holding her so she stops." And then I let her go because she doesn't have underwear on and she flipped out into the street to street view. So I let her go and then she just took off running. >> I can't wipe my nose. I wasn't crazy. I can't even wipe my nose. I can't wipe my nose. >> What a pathetic mess. That guy seriously needs to get as far away from her as possible. Honestly, stop drinking and you might make better decisions. The way she acted when she was drunk It just I feel like completely out of control. >> I want to go home. Will you ask him? Can you ask him? I don't >> So, do you swear and affirm everything you told me was true? >> Yes, I >> Okay. All right, so we're going to give you some paperwork and then she's going to go and then she'll go to first appearance. The judge will set her bond. >> Please, I want to go home. Please. I want to go home. Please. I want to go >> Even though she's a female, if the roles were reversed >> I know. I have >> It's still the same thing. Okay? So, it's not right and she does need to get help. Did we search her? >> She had >> I'll search her. >> Please, if he wants me to go home, can you ask him? Can you ask him if he wants me to go home? Can you ask him if he wants me to go home? Can you ask him if he wants me to go home? Be home. Please. Can you ask him? >> I don't I don't know what you mean, but >> I did nothing wrong. I'm at my own house. Can I please go to my own home? Can you ask him? >> You are arrested. You are not going home right now. >> I already told you. >> For what? >> I told you. >> For what? >> I told you for battery. >> For battery on who? >> On him. >> I didn't do anything to him. Ask him. >> Go ahead. >> Please ask him. He won't tell you get from me. Ask him. Please ask him. >> He just told me two different times the same thing. >> He won't tell you. Please ask him. Please ask him. >> I already did and he told me you did. >> Please tell him. Please. Tell him. >> I don't want to argue. I'm not I I do not want to argue with you. >> Please give me an opportunity to go home to my own lease. Please ask him. If he says I can go home, then why can't I go home? Ask him. >> It's not happening. I'm sorry. >> For what? >> I already told you. >> For what? Why can't you ask him? Can you please ask him? Can you ask him? Can I sleep in my neighbor's place? time since I've been sleeping in my bed. Please. Why are you even talking to me? I can't sleep in my bed. Please. Oh, oh, my nose, please. Help me. It hurts. My cuffs hurt. My mouth hurts from my nose hurting. Like, I don't need to go anywhere. You can ask him. I don't need to go anywhere. You can ask him. I know he would say differently. You can ask him. I know he doesn't want me to leave. Please ask him. My wrists hurt. >> This young lady definitely needed to face some serious consequences. Ma'am, this wasn't a customer service desk where asking for a different representative was going to change the decision. The officers were there to handle the situation, not take requests for a replacement. >> My [ __ ] nose hurts. Please help me. >> Real quick, guys. >> Look at me. It's not just this. >> Listen, I got to search you really quick, okay? >> Okay. Search me. It's not >> Can you get my phone for me? >> I swear my phone's right here. >> I got you. >> I can't even sleep in my own bed. I'm not going anywhere. Please help me. Thank you. >> All right, turn around for me. Okay, can you spread your feet for me? Is there anything on you that's going to poke or stick me? >> No. >> Okay. >> It's not just this. I swear I sleep in my own bed. >> Okay. Nothing up here, right? >> No. I just want to I can't even breathe. >> All right, you can put your feet back together. All right, hop back in for me. Yeah, you're good. >> Okay. >> Thank you. >> Did he say anything? >> Huh? >> Can I have my vape, please? >> We can't We can't take the vape to the jail. They the jail won't >> What am I going to jail for? >> I told you you're going for battery. >> Did he say that? >> Well, yes. He told me the story twice. >> Why do I have the stuff on me, too? >> That's not I mean, that's probably because he was defending himself and you guys were >> the case. I promise you. You are not No one's talking to me about this. >> I tried to talk to you. You told me nothing happened. >> Because I just want to go to bed. Like I don't I don't want to get him in trouble. I don't care about that. I just want to go to bed. >> What is a good phone number for you? 352 >> I need him. I need Please. My My nose is itching. Please. >> 352 >> I need to see him or do something before I leave. Please. I'm begging you. Have some empathy, please. >> I've been more than nice to you. >> I've done nothing, either. Like I've done nothing. >> Swing your feet in for me. >> Please. >> Don't do that. Please, swing your feet in. >> Please, can I talk to him? >> He's already gone. >> Can I talk to >> He already left. >> Can I talk to him? >> He already left. Swing your feet in. >> something? >> Swing your feet in. >> Can you scratch Can you scratch my nose? Can you scratch my >> No, I cannot scratch your nose. >> You have gloves on. Please. >> I'm I'm not >> Before someone enters a jail, officers commonly search them for weapons, drugs, or other prohibited items to keep everyone in sight safe, right? It's a routine part of the booking process, not something they get to negotiate away. >> Please, swing your feet in. >> Can you scratch my nose? That's how he does, too. >> Okay. Lean back. >> No one touches me. Like Do I have to go to court for this? >> Yes, you will have to go to court. >> For what? I don't care. Like I don't care about him getting in trouble for hurting me. I don't care. >> Okay. >> But like, can you scratch my nose, please? >> You got snot. >> Can you scratch my nose, please? >> We're not We're not doing that. We are not doing that. >> I'm just asking you to scratch my nose, officer. Please. >> Aura. Aura. >> Please, help. >> That's why I know you're not telling the truth. >> Stop hurting me. Stop hurting me. >> You are resisting. I'll hit you with a I will hit you with another charge right now if you do not stop. >> My hands are on my back. My hands are behind my back. >> Move your foot. >> I'm not even touching you. >> your foot where I cannot shut the door. >> I'm not even moving my legs. I'm not even moving my legs. >> Laura. >> He's not He wants you to stop. That's all I'm trying >> not to hurt you right now. I'm not even purposely trying not to hurt you. I'm going to hit you with another charge. I'm going to do it. Move. >> Stop pushing me. >> PUT YOUR LEG >> STOP hurting me. >> Okay. >> Stop hurting me. >> I Do you want me to slam your foot in the door? >> I want to talk to >> Okay. You're getting hit with another charge. You're 100% getting hit with a >> Please hurt Please move my hair against my face, PLEASE. PLEASE MOVE MY HAIR AGAINST MY FACE, PLEASE. Please stop hurting me. Please for WHAT ARE YOU DOING? >> MOVE YOUR LEG. >> WHAT ARE YOU DOING? STOP. WHAT ARE YOU DOING? I'M NOT DOING ANYTHING. >> MOVE. STOP. SHE will not stop putting her foot >> moving anything. >> I'm trying not to hurt her or slam her foot in the door. What? >> I can't do anything. >> Move her Hold her leg right there. >> I'm not doing anything. >> Stop. You're going to get an EXTRA CHARGE. JUST STOP. >> ANYTHING. I'M NOT DOING ANYTHING. I'M NOT DOING ANYTHING. >> WHAT crazy behavior. Girl seriously needs to stay away from alcohol, and that guy needs to run and run fast. You know, she's seeming determined to put all the blame on him and get him in trouble instead. Well, this whole situation was just toxic, you know, and completely out of control. If alcohol brings out this kind of behavior, it's definitely time to make some serious changes, ma'am. >> What is that girl What are you doing? What I doing? >> She's not She's getting hit with resisting, too. Forget that. >> Okay. >> Do you want to follow me to the jail? >> No, I'm not worried about her. I just didn't want to hurt her. I wanted you to hold her while I shut the door. I don't want to slam the I don't want to slam the door on her foot. >> You good? >> Yeah. >> All right. >> I'm fine. >> I have PTSD from here, bro. >> Oh, that's where this was? >> Yeah. >> I got you. Well, thank you. >> Get out. >> I just didn't want to slam her foot in the door. >> I know, you're fine. I'll take that freaking that freaking >> All right, you good? I'm gone. >> Yeah, thank you. >> Where am I going? >> To jail. >> For what? >> I've already told you. >> I didn't even hit anyone. >> Okay. >> To jail for what? I didn't do anything. I wasn't even around him when I got arrested. I'm not even going to be able to go home to my cat. I want to say goodbye to my cat. It's my house, too. Right? Say goodbye to my cat, please. Can you say goodbye to my cat? I'll be on my best behavior. Can you not say goodbye to my cat, please? Can you please say goodbye to my cat? No, right? I'm so freaking mean. I didn't even do anything. You have no reason to do a fight or have no reason to act like [music] that. Nothing. >> Arguing about what she was being arrested for wasn't going to change what had already happened. I hope the guy was able to leave her, man. She seemed dangerous and definitely not in a good way. If you wanted to go home, she should have just gone home instead of putting her hands on him. She wants to say goodbye to her cat? I guarantee that cat is hiding somewhere right now trying to avoid her crazy behavior. Clara Byrd, 22, was transported to the [music] Escambia County Jail and booked for battery and resisting an officer. Court records show that she later reached a plea agreement with the state. The resisting charge was dropped and she pleaded guilty to battering her boyfriend. There were no available records showing what punishment she received [music] in this case. Now, what makes this case even more concerning is that court records reportedly show another domestic violence charge about a year later involving a different boyfriend. That does not automatically tell us everything about her behavior, but repeated incidents can be a warning sign [music] that, you know, the same unhealthy pattern may be happening again. There's also an important lesson here about alcohol and aggressive behavior. You know, alcohol does not make someone hurt another person. But it can lower [music] their self-control, affect their judgment and, you know, make already strong emotions harder to manage. When drinking repeatedly ends with fighting, threats, or violence, that's a serious problem and should not be ignored. Blaming the other person can also keep a bad situation going. You know, if someone always believes that everyone else is responsible for their actions, they may never stop and ask what they need to change. Real change starts when a person takes responsibility for what they did instead of looking for someone else to blame. And for someone on the receiving end of repeated violence, the safest choice may be to create distance and get help. Nobody should have to stay in a relationship where arguments regularly turn physical. You know, a toxic relationship can become more dangerous when alcohol, anger, and, you know, poor self-control are added to the mix. In this case, what started as a domestic disturbance ended with an arrest and a guilty plea. And if the later charge is accurate, it appears the problems did not simply disappear after that night. At the end of the day, saying sorry after someone gets hurt is not enough if the same behavior keeps happening. The real solution is taking responsibility, getting help when needed, and making sure that nobody else becomes the ex-victim.
