driving recklessly exhibiting signs of overs speeding recognizing the potential danger posed by the vehicle the officer activated their lights and initiated a traffic stop this decision was crucial as reckless driving not only endangers the driver but also poses significant risks to other Road users so I'm trying to come home I really am okay so home can as you said right yes please so to sou first that the driver a female exhibited signs of intoxication these signs included slurred speech unsteady movements and a generally disoriented demeanor understanding the seriousness of the situation the officer began a thorough investigation the female driver was questioned about her actions but she firmly denied being under the influence of alcohol despite the apparent evidence to the contrary this denial is not uncommon in such scenarios as individuals often struggle to accept their impaired State uh you know what though I shouldn't implicate myself that's called lawyer um I will not answer had drink earlier you don't want to talk about how much watch 3 hours ago the officer informed her that they would conduct a series of field sobriety tests which are designed to gauge a driver's physical and mental abilities the first test administered was the horizontal gaze nagus test during this test the officer instructed the female driver to follow the tip of a pen with her eyes without moving her head the hgn test is effective in detecting alcohol impairment because it examines how well the eyes can track a moving object subject the officer observed that the driver exhibited significant signs of impairment during this test including an inability to smoothly track the pen and the presence of involuntary jerking of the eyes Sor I should have just Li well I mean you're it's Law Enforcement Agency New Mexico City police this consistent failure across multiple sobriety tests provided the officer with ample evidence to conclude that the female driver was indeed driving under the influ uence of alcohol recognizing the severity of the situation and the potential danger the driver posed to herself and others on the road the officer proceeded with the arrest as the officer placed the female driver in the back of the patrol vehicle she repeatedly pleaded for leniency asking to be let go do you agree to take our test no I cannot force you to take our test but if you refuse you will lose your New Mexico driver's license or non-resident operating privilege for one year if you are convicted in court of driving wall under the influence you may also receive a greater sentence because you refuse to be tested do you understand I want to see it again I'm sorry okay I'm going to I'm going to read you the consequences again I'm sorry I'm not an auditory learner look I cannot force you to take our tests but if you refuse you will lose on your New Mexico driver's license that's okay or non resident operating privilege meaning your can's license for one year if you are convicted in court of driving under the influence cour you may also receive a greater sentence because you refuse to be tested do you understand yes okay so knowing this do you now agree to be tested no okay so your actions are a refusal just know you will be charged for aggravated DWI because you refus to be tested all right I need to see your mouth make sure there's nothing in there uh the restroom and get some water and a phone call if you want to after that we're going to go up to the Detention Center which is the Metropolitan Detention Center you're going to be there till the so again you're going to be releasing okay okay so right now I'm your actions are a refusal once we get to the office you can either change or not and we'll go from there okay do do blood test H blood
