Can you do me a favor? Can you back this up so we can see if you need a tow? So, if you choose not to, then I have to make the determination whether I believe that you are under the influence. Open your eyes. >> I'm actually taking dance lessons right now for a for a >> What would you do if an officer gave you one last chance before making an arrest? Most people think they know the answer, but when the moment actually comes, things can get very different. >> Excuse me. I need to move my >> Well, once you're inside, please. >> down. You're a narcissist because nobody understands what the [ __ ] you are doing. I'm from California. We don't do things like this out here. Get off of me. Don't kick him. GET OFF OF ME. >> [screaming] >> AT FIRST, this looks like a normal traffic stop, but within minutes, it turns into an arrest, a struggle, and several serious charges. What's up, everybody? Welcome [snorts] back to today's video. Today, we're looking at a DUI stop that quickly goes off the rails. An officer gives a woman multiple chances to cooperate and clearly explains her options, but as the situation continues, the encounter becomes even more serious. What starts as a routine investigation soon turns into an arrest, and things only get worse from there. Stay until the end to see the moment officers decide talking is no longer enough to take action. Now, let's just jump straight into it. >> right? Unfortunately, what took place, the accident, right? Multiple witnesses saying that you ran the red light. It was sustained red for a little Driving on the wrong side of the road, he must not know that. Um >> That's not >> So, like I was saying, my apologies. So, multiple witnesses, right? There was four that stated that you ran the red light. It was sustained red for a little while. And then, while we're here, right, I'm observing as well as other officers are observing multiple different things, okay? You're not able to stand very well. There is an unfortunate odor of an alcoholic beverage which believe to be emanating from your person. So, I want to ask, do you have anything to drink today? >> I just want to go home. >> Totally understand that. Um so, unfortunately being that we have concerns, myself and other officers, I'm going to ask if you want to conduct standardized field sobriety exercises to dispel them. >> Um you said or you can just call me a cab. >> So, I can't drive you home at this point, right? Because of I have the concerns. So, it's it's totally up to you. There's some balance exercises, right? NHTSA says that they are standardized. It would be three of them and I'd like to know if you wanted to dispel those concerns by taking those exercises or conducting them. Or not. I would allow you to take your shoes off cuz I understand they are heels, not easy. But, it's it's your choice. >> So, what happens if I don't? >> So, if you choose not to, then I have to make the determination whether I believe that you are under the influence. And at that point I would go forward that way. And if you choose to, then you could dispel those concerns. It's It's your opportunity to dispel any concern that I may have. >> Okay. What would you um What would you tell your wife? I'm not going to give you that that advice. >> I apologize. I know it's something that you're looking for, but I I can't give you that advice. It's It's It's up to you whether you would like to take them or not. It's totally up to you. >> I think in in my opinion, um I'm going to have to call somebody anyway. >> So, it's it's it's It's not really how that's going to work. So, this is what we're going to do, okay? It's going to be a yes or no. Would you like to take the standardized field sobriety exercises to dispel my concern? Yes, you would like to. Is that Was that your answer? Yes? It's yes or no. I'm >> Yeah, I just I I don't want to be in trouble. >> Have you noticed how the officer is not forcing a decision or telling her what to do? He's just simply explaining the options in front of her. And that's what most people miss about these tests. They give someone an opportunity to address impairment concerns before an arrest decision is made. Her hesitation suggests she understands just how serious the situation's become. And [music] honestly, this is another reminder that having money and having class are not always the same thing. >> I understand that. So, you're If you're saying yes, we'll walk right up here where it's a little bit flat and level and we'll just do three balance exercises. >> Okay. >> Is that how you'd like to do? >> I think so. >> All right. >> I'm not going to sleep. >> I'm not going to have you hold your phone. I'll I'll have my partner hold it. Um so, if you give me a second, I just got to get a piece of paper to conduct those exercises and I'll be right back. Never mind. All right. Let's take a walk up here, okay? So, other than being in an accident, are you sick or injured? >> No. >> No? >> Not at all. >> Are you diabetic? >> Um no. >> Do you take insulin? >> No. >> Are you under the care of a doctor? >> Yes. >> And without giving me any sort of medical for anything specific or just normal routine stuff? >> Uh antidepressants. >> Okay. If you want, cuz I'm going to ask you to stand with your feet together. If you would like to take those off so that you can balance better, it's totally up to you. It's Okay. Do you have anything wrong with your eyes? >> Uh well, I'm nearsighted and farsighted. I wear glasses. >> No worries. And then, do you wear contacts or glasses traditionally? All right, that's fine. Can you just stand with your feet together for me, hands at your side? >> Yes, sir. >> All right. Remain like that. We will not let you fall. Is that the best you can do? >> nervous. >> That's okay. The best you can do. Is that okay? >> Yes. >> All right. Can you see this blue light right here? >> Yes, sir. >> All right. With [snorts] your eyes and your eyes only, I want you to follow this blue light and do not move your head. >> Okay. >> Okay? >> Okay. >> Ready? >> Yes. >> Keep following the blue light. You're doing good. >> Yes, sir. >> Right here. Yeah. Keep that head straight. Look at this blue light, okay? >> Well, I um I'm actually taking dance lessons right now for a um for uh Dancing Under the Stars. >> Very cool. >> And um uh the uh in uh Claremont, anyway. >> No problem. Let's keep them hands at your side. >> Yeah. >> All right. Blue light right here. We'll pick up right where we left off, okay? Eyes in your eyes only. Do not move your head. >> Yes, sir. Sorry. Sorry. Sorry. >> All right. It's okay. >> Okay. >> It's all right. >> I'm sorry. >> No problem. Other than the medications that you're prescribed, do you by chance take anything else today? >> Uh no. >> And those medications, do they say that you should or should not drink alcohol with them? >> They say that you should not. >> Okay. Now, every medical question serves a purpose, right? The officer's trying to rule out other possible explanations for impaired behavior before moving forward. And notice how patient he remains throughout the entire interaction. Like even when she gets distracted or [music] she goes off on a tangent, but he keeps bringing the conversation back to the instructions. Now, that consistency matters because field sobriety tests only have value when they're administered consistently. Watching the interaction almost feels like this is not her first experience with alcohol-related situations. >> Do you know when the last time you took the medications were? >> Uh yeah, this morning. >> This morning? Okay. Do you know about roughly what time? >> Um it would have been like 7:00 when I get up. >> Okay. All right. So, this next one I'm going to have you take not now, but I'm going to have you walk nine steps and nine steps back. I need you to take your right foot, place it in front of your left foot so that your right heel is touching your left toe. Just do it as best as possible so that you can balance and pay attention to the instructions for the exercises. Is that good? >> Yes. >> All right. So, with your right foot in front of your left foot, heel touching toe, hands at your side, I'm going to have you take nine heel touching toe steps forward, series of small steps to turn around, nine heel touching toe steps back. The entire time your hands are at your side, you're going to look at your feet, and you're going to count each step out loud. Now, I'm >> [music] >> Ma'am, you're ready to move on to the next exercise. You did That was good. Good job. All right. We'll just We'll just spin and go this way, then. So, for this one, I'm going to have you take your feet, place them together, and put your hands at your side. All right, ma'am, that's good. >> No. No, it's not. >> Well, you You reached the the elapsed time that I needed you to do the exercise. >> Wait, you just need to relax for like 3 seconds. Ready? 1 2 >> Awesome. Ma'am, do me a favor, turn around. Please put your hands behind your back. >> 1 2 >> Please Ma'am, please Hey. Hey. Here's the deal. Here's the deal. I'm going to put handcuffs on you. You need to Ma'am. Ma'am, put your arms behind your back. >> Now, a lot of people think that field sobriety exercises are simple pass or fail [music] tests. That's not really how officers use them. They're just one piece of a much bigger picture that includes the driver's behavior, statements, physical signs, and uh the overall circumstances. What stands out here is how the officer handles the interaction, right? Even when conversation becomes difficult, he stays calm, professional, and focused on the process. Now, that approach often says as much about the encounter as the test itself. >> You >> You're okay. >> You asked me to do. >> You're okay. >> Do you guys know who I am? >> We're good. >> No, ma'am. Roll onto your side, please. >> Um Excuse me, I need to move my >> Roll onto your side, please. >> Okay. >> Thank you. >> Now, let's get you up. Are you hurt? We're going to stand up on three, ready? 1 2 3. Good. We're going to head over to this police car here, okay? >> Okay. >> You have a little bit there. Walk over here. >> No. >> Ma'am, come on, ma'am. >> my purse. >> We will get your purse. We will get your purse. Come on. >> I'm I'm going to get your purse personally. Go take a seat in the car. I'm going to show you your purse, and then we're going to move on with this. But, I'm going to get your purse. Go ahead and walk to the car. >> Come ma'am. >> Come on, ma'am. >> All right. Ma'am, we're just going to have to drag you in. Now, what do you want to do? >> me to get your purse? Be an adult and get in the car. >> You be a [ __ ] black man and >> Be an adult and get in the car. >> You son of a [ __ ] >> All right, hey. >> What the >> Please sit in the car. >> I'm from California. You people >> Please sit in the car. >> [ __ ] >> Here you go. >> I need you to call my husband right now. >> All right, please sit in the car. >> No, you need to take this off. >> ma'am. You're under arrest. Hey, ma'am. >> Hey, let me >> Yeah, go on the other side. Go on the other side. >> Get in the car. >> Here's cuz she's Keep the dress keep coming up, so >> Stay there. Don't move. >> Why are you doing this? Why are you doing this? >> Yeah, we'll >> Cuz you guys are [ __ ] >> We're going >> You guys you're No, you're making up words for yourself because nobody understands what the [ __ ] you are doing. I'm from California. We don't do things like this out here. You people are Trouble one? Literally, this is painful. I will not [ __ ] run away, but you need to like lose them this [ __ ] >> This is something people often misunderstand. Once you're under arrest, compliance is no longer optional. The situation escalated to the point where restraint tools were needed to safely manage her behavior. Now, the focus is on control for everyone involved, including the officers and the individual being arrested. >> Like you were [ __ ] paying attention. >> You don't kick stop. >> You don't kick stop. You guys were all talking. >> So, put your foot back in. >> No, if you want you take this off of me. So >> I would like for you to take these off of my [ __ ] arms. >> Okay. So, can you say please? >> Could you please pay attention? I was literally knocking nicely. >> it done or not? >> Yes. >> So, where When am I going to hear please? >> Are you being serious right now? >> I don't have to do [ __ ] right now. Do you want them or not? >> No, you don't. You don't. >> Okay, so they'll stay like that until you decide to calm down. >> are the same thing. >> You want to say please or calm yourself down, take some deep breaths. It is what it is right now. But, if that's how you want to act, then we're not changing them. We're not changing them for somebody who's being combative. Exactly. So, >> I am. >> All right. They're going to stay like that until you decide to relax a little, and then I'll adjust them. They're very loose. So, what is What is your complaint? >> [ __ ] hurts. >> Well, don't move around in them. >> Okay, well, yeah. Um yeah, I don't want the handcuffs on >> have two hundred I weigh 265 pounds. I got two fingers through. >> I know everybody in the Chamber of Commerce. I know everybody in the [ __ ] Chamber >> I got two fingers on that one, too. >> Everybody, everybody is on this Anybody? I know. Because I'm part of the Chamber of Commerce. So, you are going to get up the butt. >> For what? >> For being a dick. >> For making a an arrest? >> For being a dick. >> Hey, so the cuffs I can put two fingers through. >> RIGHT NOW. YOU'RE BEING A DICK RIGHT NOW with cuffs. >> If I'm being a dick, what are you being? >> I'm not You're not the one in trouble. >> I know I'm not the one in trouble. So, if you don't want to talk, don't talk. But, your cuffs are fine and you're going to get You're going to get checked out. We're going to handle business and we're going to move on. And you can do whatever you need to do after that about this. But, kicking like a child is not going to help. >> Yeah. Well, maybe you could Let these go. I >> No, they're not coming off. >> Okay. Well, I'm 6 miles from my [ __ ] house. >> All right. >> I can walk there. >> Ma'am, get out of the car. Ma'am. Ma'am. >> to hurt yourself doing that. Stop. >> Ma'am, stop. >> to work. >> Get the cuffs >> off >> No, the one that's Watch your head. Watch your head. >> You need to take off >> Adrian, watch your head. >> Thank you. >> You need to take these cuffs off >> Get them off the ground, Adrian. Thank you. >> of my feet. >> No, it's on top of the car. I'll get them. >> Just let me go. >> Have you noticed that this discussion's no longer about whether she's under arrest? That decision's already been made, right? Once probable cause [music] is established, the process moves forward, no matter who someone knows. At this point, it feels like she's still behaving like a 21-year-old in her mind, like not fully processing the reality of the situation at hand. >> [ __ ] you. >> Ma'am, relax. >> [ __ ] you. >> MA'AM. >> [ __ ] YOU. >> [screaming] >> 54 >> GET OFF OF ME, YOU stupid [ __ ] [ __ ] You [ __ ] >> Ma'am, sit up. Ma'am, sit up. >> No. >> Oh, let's do it that way. >> No, I'm not. >> Yep. Nicole, can you put >> No, we don't. >> No, ma'am, we don't. Get in the car. >> [ __ ] you. [ __ ] you. >> Get in the car. >> No. You. >> Get in the car. >> You. [ __ ] you. [ __ ] you. >> You close yours on the same time. >> You. >> Whenever you're ready. What side do you want on? I don't care. I was going to use seat belt. >> Jason, I'm going to have those things for the legs that can't move in there. >> Are you loving your life right now? How about having, you know, hanging out with these two? >> He's a [ __ ] hero. He's a [ __ ] hero for [ __ ] being here. You guys are the worst. >> Is the AC on for you? >> Yeah, turn it up higher. >> Yeah, I can feel it. This is not speeding up the process. >> Why are you doing this? Why? >> Why did you do this? That's my question to you. >> No. Why are you doing this? >> I'm not doing anything. >> I'm from California. I moved here 4 years ago. >> Okay. >> I will never understand the blatant racism that exists here. Excuse me. And we'll get off. >> Off. OFF. OFF. >> HEY. >> GET OFF OF ME. GET off of me. Don't kick him. GET OFF OF ME. GET OFF. GET OFF. >> ONCE A SUBJECT REACHES THIS level of agitation, officers are no longer debating the arrest. They're focused on managing behavior and preventing further resistance. At this point, whatever someone believes about themselves or how important they [music] think they are does not change the situation. The process continues and everything is now being recorded and observed as it reveals. >> You can knock it off. Do you think I don't know who you are? >> Oh man, I wish I was >> Why did you send me in here? >> You just sent me in here. >> What? >> Hey, can you open the door? >> First of all No, you won't, [ __ ] No. No, you won't, [ __ ] >> Just stay in the car, ma'am. >> In the car? >> Adrian, just don't let her get to the work phone behind you. >> Yeah, I got it. >> Thank you. You're saying that doesn't hurt my feelings. >> Well, you don't hurt my feelings, either. >> I'm not trying to. I'm trying to get you to calm down. >> Just relax. >> Okay, well, yeah, I'd get calmed down if I had this off of my face and had my [ __ ] ARMS TO MYSELF. >> I'LL MAKE YOU a deal. This will come off if you get yourself calm. >> That's a good deal. >> me Give me a minute of you calm and I will take this off. You have to take off everything. >> We're not taking off the handcuffs. They can't come off. >> Okay, well, see you then. >> You want to grab my towel which is in the where the shotgun holder is? >> Mhm. >> Yep. All mine? >> Yeah. >> From a law enforcement perspective, officers may sometimes allow small comforts or adjustments, but [music] only when they don't interfere with safety, security, or maintaining custody. The suspect was arrested for driving under the influence, DUI, battery on a law enforcement officer, and resisting arrest. She also received separate traffic citations related to her involvement in the accident. Now, if you were in the officer's position, at what point would you have decided that talking was no longer working and that an arrest was necessary?
