a significant dispute between a couple the argument had become intense prompting a call for law enforcement to step in a Stuffle earlier chck freaked out on me my exgirlfriend what's a what's her name Maggie or Margaret Davis she uh I was given her a ride to the pound to go check with her dogter was in the town she started screaming at me and freaking out of me and I told her she's not going to be doing that you know you we can talk but we're not going to be like that she got mad and matter finally tried to thre me with her gun and I told her don't don't do that [ __ ] you know that's not cool I'll drop you off right here and then she proceeded to punch me fall me I mean I got mark from my arms white Mark where she did she was wearing a white white like tank top white feeder looking thing in there black short shorts I dropped off right at the bridge on Garden what kind of shoes do she have I couldn't tell you honestly dude I don't remember I think they're slides white slides white and black I don't know 17 10 can you uh detain her please like I said I just barely picked her up we've been fighting and we broke up and she wanted to ride in the town to go see if her dog was there cuz she's been freaking out for like a week about it and I tried to give her ride over there and this is what I end UPA Z can you the tainer please okay so you're giving her a ride and then we started talking about everything and she started getting mad and arguing screaming I called her screaming and to calm down you know we don't have to scream at each other we can talk yeah and that just seemed to get her more irritated more irritated she kept telling me to shut up and just you know what I mean listen and I told her I'm not going to be talking to you like a dog talk to me for not at all and that's when she started getting all violent we got there and I thought she was going to calm down some went in and she didn't when she came back out she walked right past my truck and she call me freaking out anding oh I left her and all this [ __ ] and I pulled up over there picked her up and she started the same [ __ ] again and then proceed to all this happen upon arrival at the scene the officer encountered the male victim who was present at the apartment the officer began the investigation by speaking with him to gather his account of the dispute and any relevant details about the incident the male victim provided a thorough account of the incident detailing every small aspect of what occurred he openly confessed the events that led to the dispute explaining the initial trigger and how the argument escalated she almost made me wreck twice so I finally pulled the truck over and dropped her off there Garden I was driving when she was hitting like I don't know what else to do you know I didn't I didn't touch her I didn't put my hands on her I just tried to protect myself and get us somewhere I could drop her off and just you know so when you guys were in the car she just started heating you or what yeah yeah she like literally just came over like that and started hitting me while I was driving I put my hands up she hit me with her phone and I got the phone one point out of her hand and told her cut [ __ ] or was going I'm not doing this [ __ ] I didn't try to take her phone or nothing like that hit me with it you know what I mean it was a weapon and I just [ __ ] finally got away from her and she finally stopped for that second I gave back to her she started H me again so I pull over right there on G let her out cuz she was reaching for her gun again and tell me she so she reached for her gun did she point at you at all yeah yeah more than once she point it at you more than once yeah more than once she pulled it out of the bag and point said I so and I I I told her do it then I'm not playing your [ __ ] no more I'm not doing this [ __ ] I ain't scared of you how many times would you say she did it at [Applause] least uh you have your idea with you yeah you doing okay yeah I'm okay okay were you involved in a domestic just a little bit ago yeah actually I was um he tried to take my phone and ship from me and whenever I reached for my purse after he he spit blood in my face and what's Your Name Margaret Michelle Davis St it's going to be and this isn't the first time he's put hands on me either okay do you have any weapons and any of your backpacks I do have my okay do me a favor just put your bags down for me okay you need my ID yes please okay can you said it's in that backpack there yes sir okay it's a turquoise 9 mil it's it is fully loaded but I have not taken it out I have not used it I carry it with me especially when I'm walking okay well that's fine just leave it in there okay okay no problem not a problem at all let me just move it over here a little further okay yes sir go for it I have no problem with that whatsoever um I was going to ask for my bait but given the seriousness of the situation and concerns for everyone's safety the officer after collecting complete information from the male victim proceeded to investigate the female involved when the officers began questioning the female she was initially occupied with using her mobile phone and did not immediately provide information which where is your V at you give I honestly don't know which one it is in I think it's in that one there hey Margaret what's a good phone number for you my aunt is on her way over here where's your uh Tiffany uh Tiffany sub Village super time if you can start another unit that's why WI aille you want me to call you back you want toone last of Davis first to Margaret yeah I'm just tired all right Margaret go ahead and put your hands behind your back for me okay right now you're not under arrest you're just being detained okay so you get to hang up your phone oh heard that okay like I said you're not in any trouble right now you're just being detained okay just because of allegations that are brought up against you yes sir but before we ask you before we ask you anything we will Rize you and we'll go from there okay like I said as of right now you're just being detained you're not under arrest okay you're matching the description that's why I stopped that with you we're wanting to get your side of the story okay but since the allegations that were brought up against you we are detaining you and we will read your rights doesn't mean you're under arrest we're just trying to get your side of the story now okay but before we do that we do got a mirand before we ask you questions okay okay all officer explained that they needed to hear her side of the story to complete the investigation the female admitted that she acted in self-defense claiming that the man had beaten her prompting her actions throughout the questioning she continued to present varying accounts to protect herself from potential charges so I'm just going to read them to you one more time okay I mean it's been a while and I just showed up from other house okay so you have the right to remain silent anything you can say will be used against you in the court of law you have the right to talk to a lawyer and have him present before during or after being questioned you cannot afford to hire a lawyer one will be be appointed to represent you at no expense do you understand your rights yes understanding your rights are you willing to talk to me yes okay so what basically I just want to hear your side of the story what happened can I can I stand up these ants are kind of starting to bite me I'm sorry yes please recklessly which I told him several times already before when I'm in the vehicle with you it's not just your life taking that you're taking into your hands it's my own and he just had a really bad wck the other day heading into Texas because he was doing the same thing being on his phone and everything but I told him you know if you keep your [ __ ] up I'm going to tell your Grandpa especially about you having a methampetamine spom like I have no problem going down with your grandparents like you need to chill your [ __ ] out I got to the pound and I got out went in and whenever I came out he was gone and so I started walking down the M maffi down to over here by that red trailer um on garden and he came hunk in the horn he laid on the horn and roll the window down told me to get the in the truck I got in told him just to take me home that I didn't want to go anywhere else just take me straight home and he started he grabbed my bag from my lap and ripped it away from me and whenever I went to R it back from him I told him give me my bag reached for it and pulled it away from him he said I broke his finger he came from this side of my face open hand not like backhanded but open hand push my glasses from backwards to forward broke my glasses after e with him trying to spot me saying I broke his finger and then I I hit him I did hit him after he slapped me which whenever I went and hit him he grabbed my thumb with his mouth and bit and Tred to bite it off and I ended up slapping him with this hand told him to let go after obtaining a comprehensive account of the situation the officer repeatedly asked her whether she had slapped the man the female admitted to slapping the man multiple times claiming it was in selfdefense and he spit in my face and I opened the door and he took my phone from me when I open the door you said you slapped him back whenever he was biting me I slapped him to get him to let go and so he started bleeding right after he in the mouth yeah but I'm pretty sure it was more my blood than anything what were you bed his my thumb was being bitten in his mouth like there's bite marks on my thumb but I wasn't bleeding at all from anything I told them I was like you're going to buy me a new pair of glasses and whatever else but whenever I slapped him he released my thumb I turned to open the door cuz I told him to pull over and let me out and I opened the door and kept it open down to over here and I told him let me out he grabbed my phone I grabbed my phone from him and whenever he finally pulled over which was a good 3 minutes me telling him to let him stop the vehicle and let me out that way I could go and have my aunt come pick me up and so I can get away from him and after that I called her and I told her I was a the I need you to come get me and told her that I was attacked and everything and I didn't know at the time I had blood on my face from him spitting on me but he did spit and whenever I took a picture to show my AA yeah there was dry blood and I was like you said you had punched him you told me close fish right yes that's when he started to bleed him that's whenever he caught my thumb and was biting I don't know if the blood was necessarily from him or me okay in his mouth so then you punch him with your fist closed and then after the fact he was biting you then you slapped him with your other arm yes you get him to stop biting well see cuz this hand I had surgery on Carle tunnel so my fist doesn't really close up like it's supposed to and I had grab my bag yes I did cuz I asked you earlier you said you just no I said no I said I punched him I said I did punch him but he was biting me and I slapped him to get him to release my thumb so my question is did anything else happen after that no I left live you didn't do anything else to him no I got out of the vehicle and I told him that I was going to make a police report how come you didn't call us because I I wanted to get off the street I had people honking at me and trying to pick me up so I I just wanted it off the street and honestly this shit's embarrassing I'm not trying to be rude or disrespectful but it's really embarass standing on the side of the road and booty shorts and yeah a bunch of Cs here's the thing right um that I'm trying to figure out so you're saying you slapped them and then now you're saying that you did no I'm saying I did both you're not listening and you're tusting my words no listen listen I'm not done talking okay cuz when I first asked you he told me that you slapped him and I asked you punch him he said no you slapped him I told you I but listen listen to me okay now my other question is did you ever scratch them not that I'm aware of no are you sure not that I'm aware of her to be honest I you didn't grab him by the throat at all or try to grab him by the throat no no I didn't try to grab him by the throat at all I was trying to get my bag RI my bag away from his arm and he said I had broke his finger whenever I took my bag out of his hand and then that's whenever he came and had pulled forward from backwards to forward smacked my glasses off my face cuz he was slapping me or he tried to slap me slap my glasses off my face and I came back hit him and whenever I went to hit him he got my thumb in his mouth and was biting and I told him to let go and Dro my phone and slapped him did you ever bite him no I did not I did not bite him you didn't bite him at all no sir I have not bitten him okay did you ever pull out your gun at him no sir I did not didn't no sir at all at all at all he has seen it he knows I do have one I do carry one for my own protection but no he is I did not pull my gun at any point why would he told me that he pulled that you pulled it on him like two or three times whenever I got in the truck I didn't pull it out two or three times despite this confession when the officer sought additional details about the incident and her actions she was unwilling to provide further information or clarify her statements her reluctance to cooperate fully complicated the investigation as the officers needed a complete understanding of the situation to make an informed judgment and ensure proper handling of the case whenever I got in the truck my bag had thrown my notebook my penss on the floorboard and my gun was falling out of my bag when I picked it up I put it straight in my bag and zip my bag up I never pulled my gun on him all righty so this is what's going to happen right so I'm taking your bag okay unless you give me permission to to search you can search it to search yeah you can search it I mean I don't care I mean I I know that it's in there it is fully loaded there is one in the chamber but I it's in a holster a black holster it never left holster have on there it's a 9 9 mm it's got a 10 bullet mag with the One in the Chamber is there anything else other in the gun um to be honest I just grabbed that bag whenever I left the house but do you have anything like magazines any other weapons in there no sir I might have some tools that I use for my nails and stuff or my weed pipe but other than that I don't believe I have anything so this is what's going to happen okay I'll be straight forward with me you're going to be under arrest for battery on the household member and aggravate assault on a household member okay just it is what it is all right with in that purse the purse in the bag you give me permission to search them but for right now what we're going to do is I'm going to take you to my unit you're going to sit there can I come onom real quick I'll give I'll give let's handle this first and I myom my doesn't have my mom's phone number okay and I promise you we'll allow her to call your mom and do what you need to do okay you've been very Cooperative with us and I appreciate that right now basically you're saying one thing he's saying another he's got battery signs on him you got battery signs on you we documenting okay but going to I haven't seen him but of course bit me and spit blood on me man I'm trying to explain to you I'm trying to explain to you my officer I haven't seen him personally but my officer said that he was pretty battered he had bite marks on him scratch marks on his neck okay he is more battered than you I him so here's here also the other thing is that he called us that's the reason why we responded out here why where is this V cuz I haven't B him all that will be in the report okay this doesn't mean ma'am this doesn't mean that you're guilty anything like that okay that's now up to the district attorney's office your lawyer and and the judge okay but unfortunately this is the way that it's going today okay I didn't didn't no I myom
