5 6 7 8 9 9 right M on May 26th 2023 the police officer observed a vehicle driving recklessly swerving between lanes without control the erratic driving raised immediate concern prompting the officer to follow the vehicle unfortunately before the officer could intervene the female driver collided with another vehicle called causing a tragic crash they driving and they're yelling who who who else was in the car it was me and her and then my two friends too they were in the passenger side and they were just like oh [ __ ] and I was like I'm so sorry like where you guys coming from we're at kenan's earlier okay uh the two guys were in the car where did they go I have no idea okay you know their names though right yeah okay all right uh you driver's license registration and the vehicle insurance yeah all right want me to try what's that want me to try to trayard yeah get the uh information if you can from the truck upon arriving at the scene the officer immediately began the investigation by questioning the suspect involved in the crash during the inquiry the officer observed signs of intoxication in one of the female drivers prompting further questioning and a sobriety test it was soon confirmed that the the woman was under the influence of alcohol do you have uh you have their phone numbers I don't know try to find the information try to get the guy information for the truck right here told me try to go find oh go find him okay go find him we need information is this your car yeah okay you have the registration that goes with it should be a red or blue piece of paper so is that your truck yes sir cool you got your license yeah now you see the registration insurance from yours have your license yes thank you I'm giving you all of this that's when the officer specifically requested the female driver's registration and license she promptly provided all the necessary documents without hesitation this Cooperative Behavior was noted by the officer who meticulously documented all the details provided after confirming that one one of the females was not involved in drugs or any illegal substances the officer decided she was free to leave your license on does any of you guys need medical you guys okay no we're good fine what happened to the front of this car why is it all black yeah that's a whole different it shot the spring right out the front end4 5801 yeah they just St ke and they said the two friends that they don't they know but they don't know left the car okay you have a New Jersey deal or a uh I do um it's New Jersey that name same name yes okay all right sounds good just sit tight just sit tight with this other officer here for me okay all good thank you the park car yeah I am yeah we are so that you're the owner of the blue pickup do you want to do you have that private property you want to put that on or do you want us to tow it or use a toe of your own um so I don't think I could drive it wow clearly I mean look my driveway is right here we just parked there cuz we were unloading well so we'll just get a toad off the street then just so it doesn't doesn't damage the concrete or the asphal we'll just use one of our toads on our rotation yeah understood all right um let me just get some personal items yeah no problem you got time who was driving I was you were you all right I'm fine yeah are you hurt at all ma'am are you hurt no okay we're just worried about her tire that was all that tire yeah yeah it's is it her car yeah okay that's old situation with her ex-boyfriend what's that the paint or whatever that is that she had situation with her ex-boyfriend R is that uh is a paint yeah yeah it was a whole situation where nobody knew the situation yeah so the cops were like oh you don't have like this for like four like since December honestly it sucks where do you live Williamstown New Jersey okay are are they aware of this yeah we recorded it we didn't have cameras which sucks at the house it's yeah it's t I think I don't know it sucks um they got both your IDs yes they do they have yours too ma'am yeah okay but you're the registered owner yeah okay cool all right and you don't know the two that ran no we yeah we don't know them personally at all yeah you guys down just for the weekend or the summer or yeah I have a house down here with my family okay in the crest uh like the middle of Wildwood okay yeah gotcha straight in the Middle where were you guys headed we were just picking up friends that was it did you already pick up the friends or did you you were on your way to pick up the friends we had them and then they were like oh we're going to go cuz our house is like down the street right here on this road2 however the officer still took precautions by carefully observing Ving her physical appearance and noting any signs of impairment from her breath this thorough examination was to ensure that no signs of intoxication or suspicious Behavior were overlooked satisfied that she was sober and not under the influence of any substances the officer allowed her to go confident that she was not a risk to herself or others on the road how much alcohol did you have uh I had like two drinks okay not a pair though no no what did you already did you and stop me if you've already told somebody else this but what caused this crash was it a distraction on your phone was it tiredness or just just normal like I was driving my mom was calling me my grandma was calling me I was going home with her uhuh Jobing off friends okay that was all all right so you just didn't say it essentially just driving all said you received the phone call is that it was yeah I was I was calling my mom yeah do you have the call log you show I was trying to you were oh so you were calling your mom I I was trying call my mom my grand mom cuz that's where I was going you're coming home yeah okay just call my friend last call was CC it's my friend can I see if we could just see the time that way I mean it was 12 something thing that was 3 hours ago so that proba wasn't the posos of the crash no it wasn't no so when the officer asked you what the cause of the crash was you said it was the phone call what no I was saying I was trying to call somebody who were you trying to call my mother but you never got a chance to place the call no I wasn't didn't try like I was trying to call my mom okay at what point did you pick up the phone to try to call your mom well I was trying to call her and then I was trying to so you were trying to call her so in what way if you could describe to me how you were trying to call her yeah so I was talking to her and I was like oh I have to call my mom we're going to go home now cuz my mom were down the street and she was like okay so I was typing in my mom's phone number MH and then as you were making the turn H yeah what happened with the front of this thing again somebody said to have was like 4 months ago like literally DEC like after after Christmas someone poured black black paint I I wish we could find them unfortunately that was so long ago yeah yeah three months ago where were you trying to get to you were trying to get just up the street yeah were the guys that were with you going to the same place well they live up here I was making a right and then my house is like down couple blocks what street is your house on it's on Spicer so I'm like just couple blocks down all right so you said you were coming here to pick up friends I was dropping off friends yeah so you were dropping them off at their place on Stockton yeah and then I'm I'm do you have these friends phone numbers no I don't I don't I mean like I met them like couple months ago how did you get in contact with them to get together tonight I just met them tonight like I I knew I know of them but I saw them tonight here so you saw them at like a bar or something or you saw them yeah okay I got you but I haven't seen them where do you think they be they're going right now we do need their information for I have no idea is that you have an Instagram you can DM them or something that you can say hey we just need your information can come back is it possible you can call them cuz God forbid like I don't have their numbers they're not in trouble at all they just trying to figure out no yeah of course yeah yeah God forbid they're hurt or something we need to document their injuries on our accident report and we also need to document where they're sitting it's very specific what's what's their first names come on [ __ ] I don't even know swear to God like we're not I would tell them right away the officer having confirmed suspicions that the female driver was intoxicated questioned her directly about whether she had been drinking the female admitted to consuming two beers that evening acknowledging this the officer explained the need to conduct a few sobriety tests to assess her level of intoxication accurately J I think the same is it's for same does he have a mustache yeah facial hair yeah for the one blue and pink shirt you don't know the other one you know there's two of them right you said yeah there's two yeah and you don't know the other person's name it was friend okay did they say they live down here like all year round or was it just like here right they're like down the street they dead I knew the one guy cuz he used to work with my friends but that's better where did they work at like the salty mermaid Sal made the one but the other one was just staying with yeah we just like meeting all you don't know any last names or the names of his friend or we close of them you just know that his first name it's a friend of a friend yeah is it definitely Justin it should be right just I don't with s s s yeah I think yeah you have them as like Facebook friends or Instagram friends or something I know friend of a friend okay I know him what time did you guys get to 12:30 yeah 12:31 was it busy not wasn't like mandatory or like yeah I mean a DNA test in that case probably isn't going to uncover anything cuz if he's just dumping it on the car not going to leave fingerprints or there was like shoe marks so you know but this is like a to totally different thing sucks yeah it was honestly like dewy before like it's like definitely tar or something M but it sucks um I have to pay like a $500 deductible that just for that yeah and the insurance fix it but um what year is this just for right now we have to run you through some tests okay just want to make sure you're not impaired you can drop your purse out if you want on your phone the officer then proceeded with the standardized field sobriety tests to determine whether her alcohol consumption had impaired her ability to drive safely ensuring a fair and thorough assessment the officer began by Cal explaining the horizontal gaze nagus test to the female driver ensuring she understood the procedure all right so the first first T we're going to just check your eyes Okay um going to check your eyes please Mo you have any glasses or anything contacts no no all right keep your head still follow the stimulus which is going to be my pen and you're with your eyes and your eyes only don't move your head okay do not move your head and you understand these instructions so do you see the see the tip of my pen yep all right just follow follow the tip of my pen with your eyes and your eyes open okay I'll see it that start is so okay yep okay just with your head just with your eyes your yeah I mean a DNA test in thate probably it was Hest like it's like definitely hard I have to $500 yep keep watching you're fine keep going my pen what still see my pen yes all right we got two more to go okay all right so I know we're going to try to get this get this over all right for the next test is going to be the walking turn test okay all right so when I explain this I want we're going to put you into a starting position I want to keep you in that starting position um till I'm done with the instructions you understand that yeah all right so with your right foot think of an imaginary line from here down okay put your right foot on that line okay with your left foot touching your heel all right right in front of it so am I allowed to take my shoes off yeah you can yeah go ah okay cuz yeah it's fine there flip-flops in there annoying my apologies put okay so put your left foot on the line left yep left foot on the line with your right foot in front with your right heel touching your left toe keep your hands down by your side okay just like that I want you to stay in that position till I'm done explaining the instructions do you understand yeah all right do not start till I tell you to do what I tell you to begin take nine heel to St steps on the line turn around keeping one foot on the line and return nine Heel To Toe steps I'm going to demonstrate three okay just for demonstration purpose so you have your right foot yep or sorry right foot with your left foot you're going to go one two three and then you're going to do series of small steps keeping this foot on that line turning around and doing nine heel just to the steps back okay keep your foot on that just like that okay do you understand that yes I'm just pry it's okay on the N step keep the front foot on the line don't start TI don't yep you're fine keep the front on the nine step keep the front foot on the line and turn by taking several small steps with the other foot just like how I demonstrated okay okay M while walking watch your feet at all times keep your arms at your side count steps out loud and once you begin do not stop until the test is completed okay do you understand these instructions I great okay all right you may begin the steps so right front yep just do nine heel to steps like just like I I demonstrated counting out loud one 2 3 4 5 6 7 8 9 nine right mhm yeah that's it with the series of small steps turn around and there n he to steps back one two 3 4 5 6 7 8 9 10 okay all right now the last now the last test is going to be the one leg stand okay the officer detailed how the test would work emphasizing that it was designed to check for involuntary eye movements that often indicate intoxication once the instructions were clear the officer asked the female to follow a single point with her eyes as it moved horizontally after completing the hgn test the officer proceeded with additional field sobriety tests to further assess the female driver's level of intoxication now I want to keep your hands down by your side stand with your heels T heels together and hands down by your side like I said all right mhm do not begin the test until I tell you to okay when I tell you to I want to raise one leg of either leg your left or right approximately 6 in off the ground flip parallel to the ground you don't have to start now until I tell you to I want you to raise one leg either leg approximately 6 in off the ground foot parallel to the ground keeping both legs straight and your eyes on the elevated foot while holding that position count out loud 1,1 1,2 13 and so forth until told stop till I told you to stop do you understand these instructions I want your eyes down that raised foot and I want you to count loud 1,1 1,002 13 until I tell you till I tell you to stop okay just give me a second all right you me again 1001 1002 1003 1004 1005 1006 17 1008 1009 10010 keep going mhm 10012 2013 2014 2015 2016 2017 2018 201920 keep going 2021 102223 1024 oh you can stop when did you how how much did you to drink I had two drinks two drinks you're impaired okay you're going to be under arrest for driving well intoxicated Okay so by my tests that I just explained and done you failed so therefore we're going to take you back we're going to put ask though by the failure of the test that you have just performed what did I fail though you failed your eyes for a i Agnes the walking turn and the one leg stand I felt all three yes okay all right so place your hands around your back can I ask Al how I failed all three it'll be in the report okay your hands again um well looks like they're arresting her for DWI um so we'll have to uh have someone else get give you a ride so one of us one if you have do you have money for a cab or something we can call like call you a c um where should I go yeah see a question yeah how did i s all three like I said it'll be in the report and it'll explain that you'll have the report once it's once it's done okay okay all intoxicated the officer placed her under arrest she was handcuffed and carefully escorted to the patrol vehicle where she was secured in the back seat the officer then transported her to the police station for further investigation and processing you don't need any these cards or anything like that n all right okay well it's it's all going to come back with the anyway so she's going to be with that and for the motor vehicle accident as well okay um I'm going to give you a card with a case number um you can access your report by just calling that phone number asking for records they'll uh they'll be able to either email or you can come pick it up at station however you like okay um toe should be about 10 minutes out okay you still have my license and registration yeah officer does yes okay all right thank so we're going to take you back to the station where we're going to put you on the ALCO Tex Alco test box where which allows us to um pretty much figure out what your BAC or blood alcohol level is like your uh pretty much your breath can me once we get once we get into the uh the room okay just watch youread walk right y I got [Applause] you go down this Hall way put your this real quick this the NJ attorney general standard statement for motor vehicle operators please okay look you've been arrested for driving while intoxic the law requires you justement samples of your bre for the purpose of testing to determine alcohol contact a record of the taking of the breast samples include the test results will be made upon your request a copy of that record will be made available to you after you provide samples of your breath for testing you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath blood or urine for independent testing if you refuse to provide samples of your breath you'll be issued a separate summons for refusal the court may find you guilty of both refusal and driving while intoxicated if the court finds you guilty or refusal you'll be subject to various penalties including license revocation of up to 20 years a f up to $2,000 installation of ignition and referral to anx these penalties may include an additional addition to penalties imposed by the court for any other offenses of which you are found guilty you have no legal right to have an attorney physician or anyone else present for the purpose of the taking of the breast samples you have no legal right to refuse to give or delay giving samples of your breath any response from you that is ambiguous or conditional in any respect to my request that you provide bre samples will be treated as a refusal to submit breath testing if even if you're agree to take the test but then do not follow my instructions do not properly perform the test or do not provide sis breast sample I will charge you with the refusal to submit breath testing I repeat the law requires you to submit samples of your breath for testing will you submit the samples of your breath you got to yes or no yes just have to pay okay yeah give me a second fure out stand by with real quick just give me a second I got take off all my later in the court the female driver faced multiple charges including driving Under the Influence driving an unre registered vehicle failure to possess an insurance card reckless driving
