Let's go. >> I didn't even resist. >> Yeah, let's go. >> Okay. >> Great, now see? I didn't even resist. >> I'll explain it to you, okay? >> I didn't resist. >> No, I know. Let me explain it to you real quick. >> Okay. >> All right. You stood there. You told >> officer, I didn't do nothing. >> Are you going to let me talk or not? >> Yes, sir. >> Okay. You stood there. You told us how many times you've been arrested for resisting an officer. Okay. You started stepping up in the other officer's face. >> Yes, I'm talking to the officer, sir. >> You can take him. Listen to him while you take a seat now. >> So, you started stepping up into his space. >> Yes, sir. >> Screaming, yelling at him. Threatening to fight us, okay? >> threatening. >> So, I stepped up. And then, what did you do? You turned around to me and start threatening me again, saying you're going to beat my ass for stepping up on you, okay? So, then I stepped back and I said, "Hey, if you step up on me, >> we're going to have an issue. And guess what? You stepped up on me. Put your hands in your pockets." And I said, "Get your hands out of your pockets." >> The only thing I had in my pockets was my >> It doesn't matter. I don't know what you got in your pocket. So, I said, "Get your hands out of your pocket." And guess what? You didn't get your hands out of your pockets. You continued to look at me in a menacing manner after already telling me that you were going to fight us and that you've been arrested for resisting several times. So, guess what? That made me in fear of receiving a battery. >> I'm sorry. >> All right. Does that make sense to you? Do you think that's reasonable for me to believe I'm going to get battered? >> yes, sir. Okay. >> So, that's why we're at where we're at right now. >> But, I didn't >> I understand you didn't have any I I understand now that you didn't have a weapon on you, okay? >> I don't have a weapon. >> I understand. >> And you know, I wouldn't do that anything like that. I'm not that nature. But, I just put I got $500 yesterday out of Rila House. >> I understand that. >> I'm I'm trying to make it here. >> And I know everybody's going through some But, guess what? We got to stay safe. And when you're standing there threatening us, we don't know if you have a weapon. >> I'm not You look You know >> So, that's that's where we're at right now. >> Dude, officer, man, you know, like I've been >> I understand, but unfortunately, that's where we're at now. >> So, I got to go to jail? >> Yeah. Yeah. Have a seat. I'll be back in a minute. >> Have a seat. Thank you. >> Stevie, do you want Ashley to have your wallet or do you want your wallet? >> I want my wallet. >> You want it? >> All right. Take a seat. Have a seat, please. >> So, I'm going to jail? >> Yep. >> Yeah. >> For what? >> You just told me you were going to assault a police officer. Put your feet in. Put your feet in, boys. >> I'm like, yeah, yeah, I will put them >> Eventually. >> I mean, you disagree, right? I mean, what the [ __ ] did I do? I didn't even go lunging over there. So, officer, I didn't >> I'll go over there. Stevie, you came to the police department here and listen 100 times we told you what to do. You threatened us >> I didn't do anything to you. >> with physical harm, and then you kept saying about how much that you How many charges of assault on a police officer after you put your hands in your pocket. That's We don't know what's in Is there a knife? Is there a gun? Is there a blade? We know that after the fact. You didn't listen. So, your charges are aggravated aggravated assault and resisting. There you go. >> What What is aggravated assault? I didn't even exist. >> Take Take a seat, Stevie. Okay? It's very simple. You just All you need to do is just listen. >> What did I resist? >> You 100% did. You did not listen to any of our commands. >> I resisted. >> I didn't say you resisted. You just said you resisted. >> I I resisted putting my hands out of my pocket, but I didn't have my hands out. >> You just said you resisted to take your hands out of your pockets. >> No. >> That's what you just said, Stevie. >> No, I said I resisted the [ __ ] taking my hands out of my pocket. >> I I understand that you're saying that you just didn't >> don't have nothing in my pocket. >> I understand that. We know that after the fact. You need to listen when we tell you things. Not the 10th time. Not the 12th time. The first time. That's it. It's very simple. >> But I didn't get that. >> You didn't get the opportunity to to comply with the orders. >> only got two I only got two commands. >> You only got two commands? So, like the nine body cameras and the interior cameras of the Bloomington Police Department aren't going to show anything different? >> No. >> That's interesting. Take your hands out of your pocket. >> Okay. >> Okay. Sit down. >> You know what I'm saying, bro? >> How much How much have you had to drink? >> Should be honest? >> Yeah. Cuz you're really tuned up. >> I'm really tense, bro. >> Really what? >> You know what I'm saying? I'm on probation. >> You're on probation? Okay. >> Nelson. You got me under arrest for what? >> What? >> You got me under arrest for what? >> Dude, you're hammered. Yeah, you are. >> Might be the best of hidden. Nelson. Nelson. >> Yes. >> I've been drinking, bro. I can't drink in front of my room. And I got another lawsuit against the Bloomington Police Department cuz I I've already got a half a million dollars from Flint, Michigan. Because you came in arresting me for no reason. Now, I got to go to court and now I got to I'm going to get you. What's your name? Nelson? >> Nelson. >> You know, you I'm going to You violated my constitutional rights. >> How's that? >> First of all, do you want to know? My hands are behind my back. First of all, I want that. I'm recording. My hands are behind my back. First of all, you guys arrested me for no reason. >> I only you what you were arrested for. >> Huh? >> We told you what you were arrested for. >> You're arrested for uh aggressive behavior, more or less. Right? Am I right or wrong? >> I don't know, Steve. >> You don't know. So, therefore, you don't know. You know, your superior is going to be going to be going to be in court. >> I'll plead the fifth. >> And the fourth amendment. The third, fourth, and fifth amendment. Because now I'm going to get more money. >> Okay. >> You think I'm lying? >> No, I don't think you're lying, Steve. >> Yeah, take them pieces off. This cop Hey, go. Go. >> You can't leave it. You just have to go through that door. >> You're right. >> I'll be here. >> Hey everyone, it's Trent, part of the [ __ ] Sheriff Patrol Sergeant and K9 Handler. So, this suspect was in the lobby of the police department to complete his offender registration because that's where that registration occurs. And the suspect yelling about his constitutional rights is completely inconsequential and not relevant to the situation. These officers are still there in the lawful course of their duties to investigate a disturbance and determine if a crime had been committed or not. Officer safety and overall scene safety is always going to be a priority. So, when law enforcement has to deal with an overly aggressive, hostile individual like this, it's bragging about prior instances where he had to resist law enforcement, showing those pre-fight indicators, that becomes an immediate officer safety issue and technically a crime. You do not need to physically touch an officer in order to get charged with assault on a cop. And a person's hands are incredibly dangerous. That's why it's standard protocol when cops are speaking to somebody that is detained while they're investigating a crime. They're always instructed to remove their hands from their pockets. And less-than-lethal force, like the Taser in this situation, is generally used as a tool to gain compliance immediately and ideally prevent the situation from potentially turning worse in terms of injury. >> The man was charged with aggravated assault on a peace officer and resisting arrest. But he remains innocent until proven guilty in a court of law.
