 Why not?
This is an emergency.
 Okay.
Hurry.
Is the truck ride to you or for a
company?
 Company. Company. Okay.
Uh, do you have any updated insurance?
Yeah, it's in there.
I think there's
 Oh, expired.
 Another
one.
 This one?
 That one? That's updated.
[Applause]
This one just expired. And
I see it. Just making sure I don't lose
any paperwork on you. All righty. Sit
tight. I'll be right back with you.
The driver, a 69year-old man named
Robert, had an open case out of Dne

be operating a motor vehicle without a
valid license, as well as having a 02

Do you have your driver's license on
you?
 Me?
 Yeah. I don't have a driver's
license.
 You don't have a driver's
license? Okay.
 What's your name?
 Thomas.
Yeah. I haven't drove a car in 5 years.
Okay.
Yeah. I don't even go near driving
or anything. Okay.
 I have no night

your dog there.

and step back with me, please?
I'll go to the front of my car.
Step right right here. Right in the
shower. I got a car coming. All right.
So, do we have any open cases that are
bond conditions?
No.
 Go ahead.
 Oh, I
do. I do have a bond
condition. I got to go to a free
trial. That's on the 26th.
Okay.
Do you have an open Dane County case?
Yes.
Are you supposed to be driving with
that Dane County case?
No.
 Okay.
I had an emergency thing with
this.
I know that, but you know, with
open cases and stuff like that. Okay.
Pretty close to home.
 I know you are.
No. Was there any drinking at all? Did
I?
 No.
 No. Who was
drinking? I smelled something when I
came up there. Anyone drinking tonight?
Not here.
 Go ahead.
I'll take a second. Possible 55.
What am I smelling from you?
I don't know. I had to use some starting
fluid.
No. Yeah,
that's not what I would be
smelling right now. Okay.
 Well, I can
show you that.
 Okay. I'm getting smells
off you. I'm
Your speech is slurred. You know, you're
not supposed to be
driving. If that's
I'm really um
Do you have an ID in that truck?
No.
Is that another one of your conditions?
Yeah.
Okay. So, be honest with me. And you
drinking today.
I had one a lot earlier.
How long ago was a lot earlier?
Uh about 2 hours.
 2 hours.
 Yeah.
 And you
know you have a threshold. You have a
lower threshold.
Probably. I got cancer.
 You got cancer?
Mhm. And that's why you drink or
 Yeah,
kind
of. You know, I got this thing that's
going on.
 Okay.
 I got a hernia here.
Okay.
 Oh,
just leave it for right now.
We'll get it. We'll get it.
Okay. So,
would you be willing to do
standardized field sobriety testing for
me?
I I
really I don't know what to say. It's
okay. Yes.
 Sure.
 Okay.
You know, I was not driving erratic or
anything.
Right. But you were driving. I
have the smells coming off you.
 That's
what you say.
Okay. What did you have to
drink?
 I had a beer.
 A beer?
 Yeah.
 Okay.
Yeah.
So, I'll ask again. Are you
willing to do standardized fields
variety testing?
What does that entail? If I
I got three tests. Would you be willing
to do one?
I could do a couple, I suppose.
 A
couple?
Yeah. I don't know what it
entails. It's been I've been in prison
for 6 years, you know.
 Okay. When did
you get out?
 17 or wait
20 22.
 22.
Okay.
Okay. All right. Sir, is that a yes or a
no?
I get arrested either way.
 I'm just
asking. Are you willing to do standby?
 I
mean, one day. I mean,
well, I told you what I have all so far.
So,
 yeah.
Are you willing or no?
I could, but I'm just a little bit
scared because I was down there waiting
for this guy. He had an accident.
 Okay.
And I went down there and I was sitting
waiting for him for an hour and a half.
Okay.
And I sat there and I did drink a
beer.
 Okay.
So, where do I go with this? You know,
it's up to you. Are you willing to do my
tests or no?
No.
No. How about a PPT just to see
where you're at?
 Sure.
 Sure.
 Yeah.
 Okay.
I'll have you have a seat on my bumper
then.
 Okay.
 Okay.
Okay. You know those are blinking now.
The left one is because you got your
blinker on.
 Both of them are.
All right. Have you done a PBT before?
Yeah.
All right. Big breath and blow
through the straw until it's told to
stop. Okay.
And blow blow blow blow blow blow

So, who's coming for the truck and
trailer?
 Yeah. Um, Jason.
 Jason? Yeah.
Okay.

 Okay, just so I
know who is going to take your

back with you.
Hello. He refused my
fields. Okay.
 Um got a 0.93 093
PBT. Um it sounds like he's not supposed
to be in contact with him.
 Yeah.
 Uh we
got to get a hold of probation. See if
they got a place to hold then. Yeah.
Um, are you searching the vehicle? Do
you believe there's um
stuff in the vehicle for to prove his
impairment?
 It might be.
 Yeah. So,
 um,
do you want to
 passengers got issue
cooking?
 Okay.
Do you want to pull him
out then and get him in yours?
 Yep.
And then we'll have to get on call for
P&B for both of them then.
Good.
All right.
 Oh. Oh my god.
 I'll have you
place your phone up here.
 Okay.
 And then
I'll have you step out.
Okay. I have neuropathy, so my feet
don't work too good. Okay,
we'll get those. We'll get those. We'll
get those. You don't have to worry about
them right now. I'll have you step back
in front of my squad.
 Walk back. Okay.
Have you had anything to drink tonight?
No. No.
All right, I'll have you just stay in
the gravel. I know those are bright.
 All
right,
I got to turn this way.
 Nope.
Okay. Is that Oh,
 all right. Are we
supposed to have any contact with him
through your provision?
Well, yes, but I work for his company,
so it's kind of a a shady territory.
Okay. Okay. What does your agent say
about that though?
Well, actually, I'm not sure at this
point.
 Okay.
 Yeah. In the beginning, it
was all But then I said, "Well, I work
up here in Partyville on occasions, so I
I generally don't have contact with them
cuz I just go do a job, do this, do
that."
 Yeah. So, I don't know how that's
going to fly. Yeah.
 Okay. I'll have you
keep your hands out of your pocket. Oh,
I'm sorry. So, yeah, that's why I came
today to help with this car.
 Okay.
 Under
the company. Yeah. So,
 Okay.
 Do you have
any weapons on you?
 No.
 Would you allow
us to search you real quick? Just
 Oh,
sure. Yep.
Yeah. I never carry any kind of weapons.
No knives? No. Nothing?
 No.
 Needles?
Sometimes I have a little 2-in pocket
knife, but
not today.
 Not today.
What kind of job are you guys doing? You
said you just do it.
 He's he runs a
concrete business.
 Okay.
 And uh yeah,
it's on the truck. It's printed on the
thing through his uh
 the guy that owns
the truck and all that. It's a company
truck, whatever. And today Oh, hey, can
you come help me get this car? He does
body work.
 Okay.
 Yeah. So, we went down
to Madison, pick up his car, smash up
the front end. It's like $4,000. Sure.
Said, "What is this?"
Seeds or something.
What the heck? Oh, that's from a
sandwich I had.
The uh a donut. You got
to get the plastic to pick the donut up.
Yeah. You just throw it back in your
pocket.
 Okay.
What I'm going to have you do is I'm
just going to have you walk back this
way. I'm just going to have you take a
seat in my car and then we'll come get
you out in just a second. Okay.
 Okay.
Yeah. There's a guy coming to get the
truck. Is there anything in the car that
we should know about?
 Not that I know
of.
 No. Not you know.
No. Got those.
 There's your bottles
right here.
 And beer roies.
 These are
open.
 Open.
Both of them or just one? I think both
of them
are. Okay.
And one missing.

Two ultras.
 Ultras.
All righty. I got some stuff to read to
you. Okay.
All right. So, this is called
informing the accused. Okay. Under
Wisconsin's implied consent law, will
you submit submit to an evidentary
criminal test of your blood?
Wow, that's a lot of information. So
uh without knowing the concept of all
that I
think I will refuse.
 You're refusing.
Okay. All right.
 Um that means that the
consequences
are revoking my license which is able to
be reinstated.
But
um I refuse.
 Okay. All right. Sit down.
That's a no.
 He said no.
I don't know what this is.
We had this was folded in this Robert's
concrete thing razor and it's got it
might be crack or it might just I don't
know.
 Okay.
It's just kind of weird that
you got a razor and you got like white
powdery [ __ ] on a tray.
 Yep.
 It's not
testing for that.
 Okay.
I'm try cocaine real quick.
 Okay.
