Do you understand me? >> Okay. AND THEN I'M GOING TO FILE A complaint against you. >> Your camera. >> Go get your camera. Yes. I'm allowing you to do that. But you cannot walk in my house. >> There you go. >> Okay. Bye. I had three cops on me and I'm 15 years old cuz you guys intruded my house. >> It's cuz your attitude. >> So you were the one driving up and down the street on the motorcycle? >> Uh I was on my gas bicycle. >> Okay. That's gas powered vehicle. You have to have a driver's license. >> Um, no you don't. Yes, you do. >> Not when it's 50 cc and you have a permit for it. >> So, so >> we're out here trying to talk to dad and he keeps saying nothing happened. Nothing happened. And his hands kind of came down low and I was worried about the gun. So, and then he starts turn around to run back in. I said, "Uh-uh." So, I grabbed his coll. I went in, grabbed his collar and he would not come back out. He fought us the whole time. >> I'm standing next to my car. So, I'm going to go talk to over here. beat you up. >> Can I go around him? >> Yeah, go ahead. >> Please don't walk up behind me. Okay. >> Um, I asked him. So, >> did they threaten to like beat Did he threaten to beat us up or anything? >> Yes. >> What did he What did he >> He goes He goes, "That bike is illegal." I said, "No, it's not. It's a 50 cc bicycle and I have a permit for it." >> And he said, "Get out of the way." He was on his little road bike. He said, "Get out of the way. I'm going to beat your ass." >> So, I don't if you guys want to believe him and we have two witnesses. He has zero. >> Okay, calm down. >> Calm down. Calm down. No, I'm pissed off cuz you guys just came in our house. >> But we tried to come here to ask a question and figure out what's going on because what we got told is a gun was involved in this incident. So, we're going to take this little >> No. No gun was involved. Not at all. >> We don't know that. >> We don't know that when we get here. >> That's what that's what I'm saying. >> I understand. Yes, I totally understand that. But you can't just tackle. >> When he's told to stop, he has to stop. >> And if he doesn't, we can get physical. >> Okay. >> But you can't just come in the house and control the situation. >> Do you have a search warrant? We don't need a circle. >> You do. >> You might want to go to school and learn the law before you want to try. No, you don't. >> We're not. >> No, you don't. >> Okay. Please don't talk to me. So, um, get out. >> Too bad. >> Okay. >> This is my case. >> So, I'll talk to you as much as I want to talk to you. I'm not going to respond to you. >> You don't have to respond to me, but I can talk to you. >> Have a good day. >> Okay. >> So, told you get out of the way or was going to >> kick your ass, beat your ass, whatever it was. >> Then why? >> Beat my ass. And I rode my bicycle back here. He ran back with me. I closed the garage and I told my dad. Okay. >> My dad was like, "Who is this? I I'm if if anything goes farther, I'm going to have to call the police." He He walks outside to see where the guy is. >> Your dad wants >> And the guy comes out and he steps and he like, >> for instance, he walks and he goes like this. He walks right here in front of his face. >> So right here or down there? >> No, no, right down there at the corner where you guys were parked down there. >> And he walks up right to his face like this. >> And he said, "Step back because you're violating my like his personal space." one and two, if he steps one more close or he touches him, he he has the right to defend himself, >> and that is easily the right to defend himself. So, there's no reason why he says a gun is involved. >> It wasn't him that said it. He doesn't even know about this. This was a completely other parties that were watching the whole thing happen. >> There was no gun involved. >> There was no gun involved. >> Okay. Well, I'm just telling you what we were told. And it was tucked in his back waistband/pocket and they seen him as he was walking away. >> So, that's So, I'm just telling you, we can only go off the information we're provided. I understand that. >> Okay. So, >> but we have two witnesses that were literally like on site and we're telling you the truth and he's telling you the truth. So, >> but no one's talked to us yet and that's where we're trying to get to. >> I understand that. >> Okay. All right. >> Really care what their story is. I believe our independent witness and and given their demeanor. >> The question is, you know, I want to talk to him to see if there's any threat with the gun, but he would have mentioned that. I bet >> she said she didn't see it until he was walking back over here. >> But he said he saw it, too. >> Oh, no. No. No. >> Okay. She didn't say anything about it. And I didn't want to I didn't want to suggest it. I just wanted what did you see? And that's what he told me and that's what she told. No, he didn't. >> Okay. >> Well, if he didn't threaten anyone with it, there's no >> No, it was just a concern for me to Oh, no. Absolutely. >> But I don't think there's any reason to try to write a warrant to get in the house. We'll identify him through him. I'll just do TLO or whatever. >> Okay. >> And then the friend, I've got his information, their statements. I couldn't care less because they're not cooperative. I'll just refer to the juvenile courts if they want to screen it for charges. Great. And if they don't >> rallying the motorcycles or whatever. >> Yeah. >> All right. >> I mean, I doubt that goes anywhere, but you know. >> And now you guys are here coming in the house and I don't know why he's detained. I don't know why he's getting arrested. >> Well, that's I'm not going to get into that and talk to you about that. It's >> Well, you can cuz he's my dad and it was on my property, but >> Okay. Well, it's not your property. It's your dad's. But we're not going to get in that cave. >> Actually, technically it is cuz I'm underneath his guardian. So, okay. But we're not going to get into that. Okay. >> I'm just trying to find out where you know what we're trying to get situated >> is what took place between >> you guys being >> Okay. And I'm filing a >> what's caught on him because he touched me when I did not. >> Okay. You want Do you want to have a like a actual conversation? >> Where where is he going >> to Summit County Jail? >> Okay. >> Okay. I'm more than willing to talk to you, but I'm not going to play the stupid games. Okay. >> You kind of are cuz >> Okay, we're done. >> Okay. Okay. Can I have the case number right now? >> Huh? >> Can I have uh where? >> You didn't give it to your dad. >> No, no, right now. I need it here. >> Okay. Tell you what, >> all I would have done is talk to everybody and it he says she said I would have written it up and said, "Here's the report." >> That works. >> And then he does this garbage. >> So, I'm going to arrest him for uh failure to obey a lawful command, resisting uh disorderly back. >> Yeah, disorders. That's good cuz it got her attention, too. >> Yeah. >> All right. Well, let's bring him to the end of the street. We'll keep these two here and then I'll question him and then medical can check him out. >> Okay, >> you can go in the house. You can do whatever. But we're done with you guys. >> You guys aren't being cooperative. We'll leave it at that. >> We're being cooperative. We just told you. >> We're not. You're just being mouthy. >> Where's >> You're just being mauy. >> So, I haven't seen either of them. I don't know what they look like. >> Yeah. >> Or anything like that. Okay. But just so you guys are aware, just if it's motorized and you go on public roads, you have to have abide by the same rules. >> Yeah. And I have and I you don't have to have a license cuz I have a permit and you're legally allowed to drive a 50 cc bicycle. >> That's what I'm saying. So So >> not everybody I have my permit too. >> No, no, that's what I'm saying. So just make sure exercise caution. So if there and then if the other there is a motorcycle a dirt bike or whatever that's also been ridden now in the past whatever >> there has been a motorcycle ridden in the past but it has a license plate and it's legal. >> Okay. So >> okay I'm not arguing with you gay. >> I'm not I'm not >> the attitude. >> There's no attitude. I'm talking normal exactly how to help you. >> So all I'm saying is just if you get in a confront whatever then they can complain. If it's legal they can call the cops and let us come deal with it. just like there's no point to go and get in confrontation with them and then it turns into something bigger. >> Okay. >> And it it simply could have been just, you know, I don't know if there's an issue going on with neighbors and like with um your dad and that guy. I I don't know what's going I don't know. >> This is the first confrontate the first time we've ever seen him, met him, heard of him, >> looked at him like and the first thing I hear is him saying that bicycle is illegal. It's a 50 cc and I have a permit for it. And I told him that and he goes he goes well move out of the way. I'm going to beat your ass. So, that's the first confrontation we had. And all of a sudden, he's [clears throat] calling or I don't know if it's per exactly him. You don't have to tell me, but saying that there's a gun involved. >> Okay. It I'll take it wasn't him. So, okay. >> Did he call? He called about something probably, right? >> About the bikes and stuff and whatnot. Yeah, >> probably. Yes. But it's legal. >> But it was a nud was there was other people that were just kind of watching cuz they heard the commotion and then they just seen it tucked in the back waistband as you guys were walking back to the house. >> Okay. >> Okay. I'm just saying that's what that's what we're told. Okay. >> Yeah. And can you tell me why he tackled him into the house? Why he tackled him? >> No one got tackled. He was told to stop. >> I saw him with his arm behind his back and twisted all around saying come outside. >> That's not tackling. Okay. >> And I heard that something that there was big smacks and stuff like that. So >> you can >> Yeah, I No, but >> I'm still talking. Can you please not interrupt me? Um, so I was I heard all this stuff and then all of a sudden you guys are in the house. Did he allow you guys to come in the house? >> Okay. I'm not going to get into that with you, >> okay? Cuz you cuz you know that you guys came in illegally >> because he was told to stop when he was outside and he once he flees from us and he's told to stop, that is not obeying a lawful command by an officer. That's all we're going to get. We're done with it. Okay, >> we're not going to talk about that. But if you have any questions about your motorcycles or the bike with the engine, >> then I can more than happy to answer those. >> Okay. I have a question. Where is he going? And >> so if there's if there's something wrong, if there's something medical wise, then obviously medical's going to check him out, make sure he's okay. Once that's all said and done, I'm not the arresting officer. I'm not the one that's dealing that. So I But it's either would be if he has medical, he's he would go to the hospital to get medical care. >> Well, yeah, he has a severely severe back. >> Okay. >> Issue. So >> So if there's something there that then medical care is going to take precedence over everything. >> Okay. >> Okay. Otherwise, he may with if the officers place him under arrest, then he'd be go to would go to Summit County jail. >> Okay. >> Okay. And is he going is he just being detained or is he going for years? Like I I can't. >> So So So what end? >> Is he giving me a phone call when he gets there? >> Yeah, he he'll get a chance to make a phone call and regardless of hospital, whatever. So Okay, >> I'm not talking to you. You're required by law. >> Jack, let me explain something to you. >> I'm not talking to you, >> Jack. The reason we're here is because of you racing your motorcycle or your gas powered bike or whatever >> that has that I have a permit for. >> Okay. >> So I don't know why you're here. And you're here. are here because he told me because someone called the cops saying that there was a gun involved. So you don't have to lie because I know that guy. >> No, we found out there was a gun involved later. >> No, when someone called you he told me you guys came here for that. I have it on video. You I don't care. You guys can say whatever. >> Have a nice day, right? >> Okay, you too. Failure for identification when my dad literally said his name's Jack Franch. Okay, good job, big man. Look at this [ __ ] just for some dude saying that they my dad had a gun. Saying my dad had a gun. One, he has a concealed carry permit. And two, we have five cops pulling up to the house. A fire truck and an ambulance for no reason. He got tased three times in the stomach for no reason. This cop is intruding our property for no reason. He's coming in and tasing him. He's arresting him for resisting arrest in his own house. And he ca both officers proctor and other officer with no hair the other with white hair walked in tased him three times and came in the house without a search warrant and he never stepped outside cuz I watched him. >> I wasn't I wasn't it was anybody >> Jack is everything good in the house? >> Yeah. >> Did they go in the house? >> No. He just came in to grab his thing and then I took him right out. >> Okay. Nobody's in the house. All right. Make sure everything's secured in the hall. >> The front door's locked. Everything's locked. So, >> I got the key. >> And Dad, I have it on video. Yeah, he was never he was never at the front door. >> I know he was never on tape. >> Yeah. >> Dad, would you like shoes? >> I would love shoes, but I don't know. These guys are probably >> All right. You want to go grab some shoes? The man in custody is Michael Francheek. He is a 56-year-old male from Park City, Utah. He was charged with failure to disclose identity, interfering with and arresting police officer, and disorderly conduct. He was booked at the Summit County Jail and had an unknown bond. On September 29th, 2019 in Park City, Utah, officers responded to a neighborhood dispute, but the situation escalated fast. Body cam footage shows officers entering Michael's home without a warrant, leading to a heated confrontation and ultimately his arrest. But the arrest wasn't the end of it. Afterward, Michael filed a federal civil rights lawsuit seeking over $1.1 million in damages, alleging unconstitutional entry, excessive force, and violation of the First Amendment, Fourth Amendment, and 14th Amendment rights, including the treatment of his teenage son, who was recording the encounter. He also requested a public apology from the officers involved. This quickly launched an internal investigation into the police department which found that officer Rodriguez violated the police recording policy, violated prisoner management policy for basically locking Michael in a hot car with no AC after he had been tased. Violation of dependent children care where he failed to contact a responsible adult after a stressful scene where the parent was arrested. improper report preparation for falsifying and excluding key details from the police report and other numerous violations. Sergeant Thor was also found to have similar violations, especially regarding to police recording policy, prisoner management, and dependent children care. As a result of this incident, the entire Park City Police Department was required to undergo additional First Amendment training specifically related to citizens recording police and constitutional limits on police authority. Multiple news outlets as well as Michael himself state that Officer Rodriguez and Sergeant Thor were fired after failing to complete the corrective actions tied to the policy violations. But the Park City Police, however, dispute that claim, saying discipline was handled internally. Either way, the internal investigation confirmed serious violations, mandatory retraining, and discipline that basically shook the department. As far as the lawsuit Michael filed, that case was stayed by the court while related criminal matters were resolved and never really resulted in a public verdict or reported settlement. But years later in 2025, his son Jack Francek filed a new civil rights lawsuit against the same officers and Park City, pursuing his own claims from that encounter. That case is still very active today, but with no final ruling or payout reported. The legal fight over this body cam incident is far from over, and the footage remains a clear reminder of the questions around police authority, accountability, and constitutional rights.
