What's going on? >> He went in for a handshake and wound up in handcuffs. >> I need you to put your hand back. >> For what? >> You got a warrant. >> For what? >> Ah, yes. Another day in America. Another innocent man arrested for crimes he didn't commit. Don't worry, though. Police had warrants. You know, those magical pieces of paper that make accountability disappear. This Florida man thought he was meeting police to clear things up. Instead, he was arrested in a parking lot with his 5-year-old son watching. But relax, the system worked eventually. Finn Blue lies, baby. Police say this man committed fraud at Universal Orlando Hotels. Problem is, he was 70 mi away at work when the crimes happened. He had time cards. Surveillance footage showed a different guy, different build, different tattoos, different human being, but police said close enough. And by close enough, I mean not even remotely the same person. Now, here's where it gets good. The arrest was based on warrants, which means someone wrote an affidavit, a judge signed it, and nobody, not one adult in the room, bothered to confirm the identity. This is the law enforcement equivalent of trust me bro. >> Innocent arrested for a crime he says he didn't commit. And west investigates uncovered the receipts proving it. >> Our own Justin Sheerer did weeks of digging to help a local man get his life back. >> What's going on? >> He went in for a handshake and wound up in handcuffs. >> I need you to put your hand back. >> For what? >> You got a warrant. >> For what? >> I'll tell you. Bo Burgess was shocked as a Valuchia sheriff's deputy arrested him in early August. >> What's going on, bud? >> You want to come out here and talk to your dad? >> His 5-year-old son was with him in the backseat of his SUV in a Home Depot parking lot. >> So, you got some some sort of fraud warrant. >> And I was like, "Hey, you know, at first I thought he was joking. I was like, "Hey, man." >> Orange County court records revealed Burgess had two arrest warrants for fraud and theft charges at two Universal Orlando Resort hotels. This Orlando police affidavit says a person in June checked into rooms with invalid credit cards at Endless Summer Surfside Resort and Cabana Bay Resort. That approximately $4,46.98 was charged to both resort rooms and was never paid for by the subject. >> Why would I go to a hotel and stay at a hotel and running up credit cards where, you know, I got kids. I can't even, like I said, I could barely go to the gas station. The affidavit says the subject checked into Cabana Bay Resort on June 16th. Burgess maintains he was nearly 70 miles away working at Everglades Boats in Edgewater. He says the company terminated him after his arrest, but HR provided Burgess his time card showing he clocked in at 4:57 p.m. on Monday, June 16th and punched out at 3:35 a.m. the next day. >> I'm innocent, man. I didn't do this. >> So why did police believe he did? They say the same man who checked into Cabana Bay Resort on June 16th checked in again on June 22nd, but this time the man got a trespass order from Orlando police. >> Um, so basically it's going to be a trespass from all Universal Studios properties. >> West two investigates obtained this body camera video nearly 2 months after requesting it. >> Police say they believe the man this video was Bo Burgess giving a fake name and ID to police. What was >> your name? By >> yours, >> we are not showing his face, but the man being banned is clearly not Burgess. >> You can see he has no tattoos on his legs, while Burgess showed us his. His time card also shows he went to work on June 22nd, the same day as the trespassing incident. >> Police didn't verify employment records, didn't reconcile surveillance footage, didn't stop and ask, "Hey, are we arresting the wrong guy?" No, they arrested him in public with his child present because once you slap cuffs on someone, you've officially stopped caring if you're right. Then prosecutors take one look at the case and say, "Yeah, no. Charges dropped." Not because the guy is lucky, but because the case was trash. They cite a law enforcement related issue. Translation: Police screwed this up. I'm just so mind blown that that it it that they didn't do no kind of investigation and just charged it because they they it it looks sort of like me. >> The arrest warrant affidavit says police identify Burgess using law enforcement resources. >> In an email to West to investigates, Orlando police chief Eric Smith's chief of staff said facial recognition was not used. He also said because it's an active criminal case, police are limited on what else they can say. >> The truth is the truth. You know, it's got to come out. >> On the same day West two investigates received that body camera video in December from the city of Orlando, the state attorney's office filed a no information notice in the case against Bo Burgess. Prosecutors are declining to file charges because they say the evidence received is insufficient to prove beyond a reasonable doubt due to a law enforcement related issue. What was your reaction the day when you saw that filing? >> Told you so. >> Burgess says he felt hopeless before he shared the story of his wrongful arrest with Westu investigates. >> Before I spoke to you, I could I didn't know what to do. I've called everybody and I just got the phone slammed on me. >> Here's the part police never explain. Charges dropped doesn't mean arrest erased. The mugsh shot still exists. The job damage is done. The trauma doesn't magically disappear. But hey, the officers went home safe. That's what matters. This wasn't just embarrassing. Arresting someone without probable cause violates the Fourth Amendment. Period. And no, honest mistake isn't a constitutional exemption. Qualified immunity might protect them. Accountability rarely does. This didn't happen because of a rogue cop. It happened because the system rewards speed over accuracy, arrests over truth, and silence over accountability. If this can happen to him, it can happen to you. Thin blue lies, baby. Hey, if you're still here, that tells me two things. One, you actually care about accountability. and two, YouTube hasn't scared you off yet. So, here's the deal. If you've ever wondered what to say, what not to say, or how police actually play these encounters, I put together a full know your rights police encounters PDF. This isn't motivational fluff. It's practical. It's blunt, and it's written for real people who don't want to accidentally talk themselves into cuffs. You'll find it along with everything else I'm working on. The link is on your screen right now. If you got value out of this video, do the YouTube things. Like it, share it, subscribe. That's how this channel keeps exposing nonsense without corporate filters. And if you want to support the work directly, grab the PDF, share it with someone who needs it, or just keep watching. Either way, appreciate you being here. Fin Blue Lies, baby.
