Cuz I'm nervous. I've never been in this position before. It was 19-year-old McLain Fenneran who called police out to this empty parking lot at Shorter University in Rome. He said he's leaving the vehicle unattended. Fenneran hit a parked car after studying for a midterm and wanted to make an accident report. >> I did what I was taught. Keep going. Keep going. Keep going. But police started testing for alcohol and drugs. Yep, that's what I thought. A zero on the breathalyzer, but the kicker for the Shorter football team was charged with DUI, spent the night in jail. Based off the the accident that you had and and the field sobriety test that we did, I've got enough probable cause to believe that you're under the influence of something other than alcohol. So the officers decide the breath test isn't enough. They give him the roadside circus tests. Walk the line, stand on one leg, follow the magic pin. Never mind he's a college athlete. Apparently, he didn't perform to their satisfaction. Here's the part the police don't like to talk about. A study cited in the report found officers misidentified 49% of sober people as impaired using these tests, meaning FSTs fail almost half the time. So what do the officers do? They arrest him for DUI anyway, claiming he was under the influence of something other than alcohol. And guess what happened next? Independent toxicology tests come back completely clean. No alcohol, no illegal drugs, no prescription meds, just nothing.
