GET OUT OF MY BROTHER'S HOUSE BEFORE I CALL LAWYER. SIR, DON'T GRAB YOUR HANDS. WELL, YOU GUYS WERE JUST IN THERE WITHOUT HIS PERMISSION AFTER WE TOLD YOU not to be in there. Don't put me in handcuffs cuz y'all DON'T WANT ME TELLING MY BROTHER THAT Y'ALL DON'T HAVE THE RIGHT TO GO INTO HIS HOUSE. >> BROTHER GOT KILLED because y'all WANT TO PROTECT ME. >> THAT'S IT. >> MATTHEW. >> YES, SIR. >> Officer Austin, what's going on? >> So, my bag got stolen today. Okay. >> I wouldn't really care for it except there's like there's military documents in there that I need. >> So, it got pinged at this house right here. I knocked on both the doors and they said they don't want anything but I was hoping it was at this house right here. I mean, it's kind of bugged around, but her and I drove here and it's been tried to ping it and play a sound and I can't. It's not in the grass. I can't ping it. Can >> you just show me the ping again? Just kind of where it's usually it's right there, but before it was right over here. So, it's kind of been jumping back and forth. I don't know if somebody's moving it around. >> What kind of iPad is it? >> It's a backpack. >> Oh, backpack. >> It's like a black military like combat bag. >> Okay. >> So, what's in it that you're cracking? >> Air tag. So, I don't know. You know what air tag is, right? >> What's your name, man? >> Was it Mario? >> Mario. So, you got the backpack here or >> I actually don't. I told him that I do have neighbors and he told me that he talked to them. >> Have a what? >> That I have neighbors and he told me that he talked to them. >> Okay. These neighbors over here. >> Okay. >> Or these ones? I don't know. He just he came to this house. >> Oh, yeah. The the air tag is going right here. >> But at this address, it can be because there's literally there's nothing here. Anybody else home that I can talk to that might be involved with taking a backpack or anything like that? >> Uh, like I like I said, the neighbors, any [ __ ] anybody else in this area? I'm the only one here I know what is in this house and there's definitely no backpack in here. What's going on? What's going on? I just want to know what's going on cuz I drove by and I see y'all searching through my brother's trash can. So, I'm just wondering what's going on here. Well, someone's got to let me know what's going on. >> You live here? >> I come here often and I drove by and see you guys searching my brother's garbage can. So, I am just wondering what's going on. And there's cars out here. >> You don't live here. You don't need to know right now. >> Actually, I do. Mario, let me talk. >> I actually been asking all the time since I pulled up here. So, yeah. Go ahead. Thank you. >> So, he had a bag stolen from his car last night. Had an Air Tag in it. Air Tag places it somewhere between these two houses. So, >> you know who lives in the other houses? >> We're talking with them right now. We're going to go next door. But the Air Tag shows that right here. >> That's fine. But don't go searching through my brother's garbage can for [ __ ] Y'all don't have the right to do that. And y'all know better than that cuz y'all are police officers. >> Don't do no [ __ ] like that. Authority to do it. >> Straight up. >> We have the authority search. >> No, you don't. Now, without my brother's permission, you don't. That's illegal. I can't even search my neighbor's garbage can. So, I know you can't search my brother's garbage can. Don't do Don't do nothing like that without his permission. Thank you. step right now. We'll talk about that later. >> Stay out here. >> I don't smell weed. My brother don't smoke weed. DID Y'ALL CHECK THE NEIGHBOR'S HOUSE IF Y'ALL SMELL WEED? >> NO, SIR. Y'all don't have the right to do that. There is no sending weed in this HOUSE. DO Y'ALL WANT TO COME AND SMELL? >> Do y'all want to come and smell? >> We're recording right now. >> Does someone else want to come and smell? My brother don't smoke weed, SO IT DON'T SMELL like weed in here. >> STAY OUT OF >> GET OUT OF MY BROTHER'S HOUSE BEFORE I CALL. SIR, DON'T >> BREATH. >> Put your hands behind your back. >> Okay, that's fine. >> Stay out, please. >> They don't have the right to do this. No, Mario's house. It don't smell like weed in there. No. >> Stay out of it now, Justin. Just go. Go back in the car. Go back in the car. Ask me to get right back out. >> Cuz that's some weird ass [ __ ] They just do in this place and go search. >> They don't Y'all don't have the right to search the car. Have a seat. >> I will. >> Y'all don't got to grab me up like that. >> Y'all do NOT HAVE THE RIGHT, MARIO. TELL THEM THAT THEY DON'T HAVE THE RIGHT TO GO IN YOUR HOUSE AND NOT to go IN YOUR HOUSE AND I WILL search for it. >> Have the right. Tell them right now. Just don't be mad. Just tell them have the right to go in my house without search. Tell them that, Mario. Tell them that. Tell them they do not have the right to go into your house without A SEARCH WARRANT, MARIO. IF THEY HAD THE RIGHT, THEY would already BE SEARCHING. >> WE CANNOT let you back in the house RIGHT NOW. >> THAT'S FINE, MARIO. But tell them, Mario. >> He said, >> "Listen, shut up and listen, boy." >> Shut up. >> TELL THEM THEY DO NOT HAVE THE right to search the house without a search warrant. And they need to wait in the house. >> Well, you guys were JUST IN THERE WITHOUT HIS PERMISSION AFTER WE TOLD YOU NOT to be in there. Stop breaking laws and this will be a lot simpler if y'all leave. This [ __ ] will be solved way simpler without y'all here. Y'all searching ain't got no reason to be searching. Check the bathroom right? >> That's what we're trying to do. Check the bathroom trying to take ADVANTAGE OF SOMEBODY THAT DON'T EVEN KNOW HOW TO do the point. But right now we're waiting on another officer because things are kicking off way too much. Ma'am not know what y'all really is talking about. Y'all doing too much. >> I done I done work with elderly people that's kind of just like them. So y'all cannot do that to him. >> Mario, just sit down. Sit down. These know the law. They know better. I shouldn't have to tell them that. And then they put me in handcuffs because I told them right. Like I shouldn't even have to say that to y'all. Is y'all body cameras on? >> Listen. I really need to sweep to make sure ain't no humans in this. >> Mario, we don't even got to say nothing else. As long as you know step out of Mario step out of your house. >> MARIO, THEY GO >> the police. >> Mario. >> Mario. CUZ YOU SEE THEY TRYING TO TAKE ME TO JAIL BECAUSE THEY MARIO, THEY CAN'T GET INTO YOUR HOUSE. >> THE ONLY REASON THEY'RE IN THERE IS BECAUSE you told them to go in the bathroom. >> I swear to God, Mario, you tell them to get out the house. They can't go in there. They're taking me. >> Stop resisting. >> I go in YOUR HOUSE. >> STOP. I GOT TO STOP. STAY BACK. >> I'M just saying. Just get back. >> I know. I know. >> Why you got to be so aggressive on her though? >> I don't know what's going on. >> Now is the time where you're under arrest. You're going to get searched. >> That's fine. But under arrest. >> Stop moving. SIR 1 2 3. WHAT AM I under arrest? >> Stop moving. >> Are you going to stop? >> Right now is resisting. That's what YOU'RE UNDER ARREST FOR. >> YEAH, because I'm not homing. I'm just talking. So, I'm just asking you what I'm >> asked you to come over to the car. What am I being arrested for? Why am I in handcuffs? Any one of y'all going to tell me that? >> The backpacking question. You're not allowed back inside. >> If you're going to interfere with an investigation, you are going to identify. >> That's the thing. I'm just recording. You're protracted from our ability to conduct this investigation. >> He has mental problems. I'm trying to let y'all know >> cuz now isn't the time to talk. Y'all leave the >> No, I'M LOOKING THE has the right to talk. >> Sit down, please. >> Y'all put me in handcuffs cuz y'all DON'T WANT ME TELLING MY BROTHER THAT Y'ALL DON'T HAVE THE RIGHT TO GO INTO HIS HOUSE WITHOUT A SEARCH WARRANT. >> BROTHER GOT KILLED BECAUSE Y'ALL WANT TO PROTECT THE CITY. >> That's it. >> I'm going to get in the car, bro. Please leave me alone, bro. Real talk. Get away from me, bro. Why did you get by me? >> We got called by this gentleman here because his backpack was taken out of his car. It had an Air Tag in it. They put it between these two houses. >> Um, it's a black military style backpack with Molly and all that. >> Why am I in the >> While Officer Car was talking with you, you smell the odor of weed coming from the house? I smell it, too. >> What am I being arrested for? >> I was resisting. >> Why am I in a handcuff? >> Why am I in handcuffs? >> Cuz you're not listening. >> I'm yelling. I don't have to listen to y'all. >> Yes, you do. woman. >> You do have to listen to us. >> Now, because of the way everything kind of kicked off with your sister and all that, that's why we have all these officers here now. >> Okay. >> So, right now, he's Officer Carr is going to apply for a search warrant for the house and we were just securing the house, make sure nobody else is in here for our safety, and we'll go from there. >> I CAN YELL IF I WANT TO. Y'ALL WEREN'T LISTENING when my brother said not to go in his house for a don't even KNOW HOW MANY TIMES MY BROTHER DID TOLD Y'ALL NOT TO GO IN HIS HOUSE. >> YOU HAVE A RIGHT TO FREEZE THE SCENE. WE'RE NOT >> THAT'S FINE. That's fine. But y'all got to tell me what I'm in handcuffs for. >> You're in handcuffs cuz you're not listening AND YOU'RE >> I DON'T have I'm listening. Y'all wasn't trying to listen to me. Y'all trying to shut me up. Soon as I get a here that know a little bit about the law, they want to put me incuffs. This [ __ ] is crazy, dude. I drive by and these mothering my brother's garbage can. I pull in. >> Why y'all searching my brother's garbage can? I asked that at least four times. Neither one of the officers wanted to respond to me. So then I get to asking my brother what's going on. Then I start asking the other people who called the police what's going on. They get to telling me what's going on. Now he wants to butt in and tell me what's going on, but never finish the story. Stay away from me. I don't feel safe. >> Okay. Well, we can stand where we want to work. Stand up on me. And you pretty aggressive. No, cuz your sister kept pulling away from me. >> I don't want to talk to you. Can you please give him a wife? >> Smells like weed in there. >> Can I get somebody else? I don't like your attitude because at the end of the day, that's kind of >> No, no. You're going to talk to me right now. What's your last name? >> Why is he talking to me? >> Because I'm tired of you guys not listening when I give you orders. >> Guys, what do you mean? >> You and your sister. I'm going to help you. Let me just >> Yeah, you can handle it. Jesus Christ. >> Car reeks of weed. We're going to let him leave. >> I think I mean, if the car reeks like weed, we got to search the car. Um, >> do we want to just pull him out then? Detain him cuz he's not going to come out very nicely. >> Oh, yeah. >> If he doesn't want to come out nicely, he can go for obstruction as well. >> Yeah. So, we'll pull him out, detain him. >> Still trying to figure out what is going on. >> So, yeah, if you just step out, that's fine. You want to shut your car off so THE BATTERY DOESN'T >> HELLO. Y'ALL DON'T HAVE THE RIGHT TO SEARCH MY CAR. >> UM, you and I can hand out hang out over here if you want. >> I'm going to ask you not to go talk to her, though, if you DON'T MIND. >> OKAY. NO, HE IS NOT SUPPOSED TO BE IN MY CAR. YOU DO NOT HAVE THE [screaming] RIGHT TO SEARCH MY CAR. ON MY SON. I WILL BE PRESSING CHARGES. THAT'S ON MY SON. Like this [ __ ] is irritating. Sitting here going through every thing in my car. Like y'all clearly want to find something. And if it reeks of marijuana, what exactly are y'all looking for? 300 pounds of weed or what? Cuz the way y'all searching this is like y'all looking for a El Chapo stash. >> Mario, let me explain to you what's going on. Okay, I know there's a lot going on here. I throw it up here. Okay, the hair tag is popping here. All right, open the door. Smells like weed. Okay, that gives me the right by law. Secure the residence for the application of a search warrant, which I will be doing. So, the residence is secured. [music] Okay, in that tary detective sweep, we located our backpack. you said wasn't. Okay. Obviously, that's an issue we'll address when we get [music] obviously probably been doing some things that you're not supposed to be doing. Okay. Part of how we approach this type of issue now is I can absolutely continue to proceed and apply for that search warrant. And if the judge approves it, I'm going to search this residence. The alternative to that is with your consent, I can also search this residence. Obviously, we know we're going to find a backpack. Mainly what we're here for. I probably could have avoided if you would have just turned that over to the England. Um, but now we've gone obviously a little bit too far. Is that your sister there? That I'm a little bit too vocal about things even though we were 100% within our right. So, with that being said, I'm going to ask you, will you give us consent to search your building here? >> Um, it just I don't care if you're going to search it. Just please do not mess. >> We're not going to help it. >> Is there any weed in there that we need to be concerned about? >> I have bags of clothes. Okay. I need to do laundry. >> Okay. I'm I'm not concerned about laundry or anything like that, but you give us consent to search your residence here. Actually, I don't. Can I Is there a way that cuz responsible a responsible person? Can we I would rather wait until we get word from the judge. >> You know, >> that's fine. That's fine. At this point, I'm going to place you under arrest for a stop at this point. >> There's nothing else that can happen after this. >> Right now, >> I'll be applying for that search warrant. If the judge approves it, I'll be um searching residence. I'm so tired of treating me like this, dude. I try so hard to be a good person. I do my best. I swear to God, dude. I stay sharing post on Facebook about the [ __ ] officers in this city do good. I don't even share bad [ __ ] about the police, bro. I swear to God, I don't, dude. I swear to God, I never do no [ __ ] like that. But, bro, I swear I can't do this [ __ ] no more because what the don't deserve to be treated like this, dude. >> Any questions what you're being arrested for right now? Right now it's stopped. Okay. You got the backpack in there. >> Okay. >> You got him here. >> Okay. Yep. I got him. >> Okay. He's all set. >> Do you have a job? >> How much cash is here? >> Should be like 600. >> $600. >> Yeah. Okay. You have the right to remain silent. Anything you say can and will be used against you in the court of law. Having those rights in mind, do you wish to talk to me? >> I I don't know. This is my first time. >> Okay. I I'll tell you what. I I'll ask you questions. If you don't want to answer them, you don't got to answer them. You can remain silent anytime you want. Okay? So, if at any point you want to not talk to me or not answer questions, just say that. >> Fair enough. I don't want to answer any questions right now. >> You don't want to answer questions right now? >> No. >> Okay. Um, so at this point, you are going to go to jail for theft. Uh, you have the the backpack of the individual that's reporting it stolen. And so you're going to go to jail for theft. Okay. I'm going to be applying for that search warrant. If the judge approves it, I'm going to be searching your residence. >> Okay. So, in the protective suite, Ross finds the backpack that we're looking for in this guy's apartment. So, he's going to jail. >> I'd like to call your son school cuz you are going to jail is my understanding. >> For what? >> Obstruction. >> What obstruction? What was the obstruction? >> Well, I'm not going to get into that with you right now. >> I need to understand because the charge doesn't make sense. I run a whole business. This is crazy, dude. Like, this is so crazy, dude. I run a whole business, dude. I have my son. >> Okay. Well, I've explained to you what I can. >> Okay. I know your job is done with your It's not your job to be nice to me anymore. Have a good day. I know you don't GIVE A I TRIED SO HARD [screaming] FOR NOTHING FOR NOTHING, DUDE. >> Mario doesn't want doesn't want us uh searching the residence, so Garrett's going to go apply for a search warrant. Okay. >> I'm going to hang out here. >> You're going to secure the scene. >> All right. So, a large majority of the property from your backpack was just located on Cleveland. They'll be back at the police department uh at some point today. >> No way. like a large majority >> the paper some paperwork some uh >> is it like wait so like okay >> I I wasn't given >> scattered or is it like still in the actual >> um it sounds like a majority of it was scattered but but hear me out hear me out there's another side to this so while checking the residence to make sure nobody else was in there you found your backpack so >> what happened to coffee and the bag's gone an air tag. This has an air tag. This can't have an air tag. >> Understandable. But uh >> Yeah. So, no matter what, I'm like, "Okay." So, I'm going to put this one. It pops up here. And I'm like, "Dude, like if you just give it back to me, I I won't push charges, but if you don't find something, I have to push charges." >> So, yeah. I mean, absolutely, you can. Um in terms of the property, so we're currently applying for a search warrant for the house. So, we have to wait for that to get your bag. So, um, the property that Officer Brit Kusky found will be brought up to the PD um, some point. I would say come back this afternoon and we should have all of that taken care of for you. All right. We're working on helping you get out of here. It's just there's a lot of moving parts going on right now and it's going to take a few more minutes. Okay. >> Yeah, no worries. Yeah, I don't have all day. It's okay. >> All right. Thank you. >> Uh, if you want, since the bag is in there, I give you permission to go in there, look at my bag if you want to search. I don't have permission to go into the residence right now. >> Oh, you don't? Okay. >> That's That's the issue we're running into. >> All right. No worries. >> A few hours later, the Wasua Police Department got their search warrant from the judge and started searching Mario's home for the stolen backpack. They quickly located the backpack in the bathroom, as well as other drug paraphernalia, both of which were used against Mario as evidence. The man in custody goes by the name of Mario, but his last name and age were redacted. But we do know the arrest happened in Wasua, Wisconsin, and he was charged with felony receiving stolen property, concealing stolen property, and possession of drug paraphernalia. Mario's sister was also in custody, but her name and age are completely unknown. She was charged with felony battery or threat against law enforcement officer, but this was dismissed. She was also charged with disorderly conduct. She was ordered to pay a $50 fine plus court fees for a total of $300. Overall, this November 8th day of 2022, the Wasaw police responded to a 9/11 call after a man reported his black military backpack was stolen from his vehicle. The backpack contained military documents, banking information, and personal notes, and it had an Apple Air Tag inside of it. The Air Tag led officers straight to a home in Wasau. Police contacted a man named Mario who denied knowing anything about the backpack. But when officers searched the trash cans outside, they found credit cards and items tied to the victim, giving them probable cause. Officers also smelled the odor of marijuana coming from inside the home, which allowed them to secure the house to prevent evidence destruction while they applied for a search warrant. Once the warrant was approved and executed, police quickly found the backpack inside the residence, confirming the theft. >> Please like and subscribe for more videos. [music] [music] Going for good.
