I don't have to do that if I didn't do anything wrong. >> Are you a sovereign citizen now? >> Huh? What do you mean a sovereign citizen? No, I'm an American citizen. >> Okay. >> One that fought for this country. Okay. >> So, yeah, I don't have to do anything that I feel is unlawful to me. Okay. Sir, >> I didn't do anything wrong. >> You feel it's unlawful. Doesn't mean that it's unlawful. >> What do you mean? The guy handed me a cigarette. That's That's lawful. That's it. >> Yeah, I know. Get a tow truck out here for this. >> I'd like to I'd like to find that bag, but we're going to take him stripping, but I have the toward. I hate to have it the toyard get it and then they find it. You know what I'm saying? That door over there. >> What started out as a routine Saturday at Portin Car Wash turned into a highstakes legal battle. Police claim an off-duty officer witnessed a hand-to-hand trade involving a large white baggie. Jason, the driver, insisted he was just receiving a cigarette from a coworker. The result? Jason [music] was forcibly ripped from his truck and taken into custody. For the next 40 minutes or so, officers meticulously searched every inch of the vehicle, checking under the seats, in the truck bed, and even behind the wheels. They found some cash and a few pills, but the substantial white baggie that triggered the stop didn't exist and it was never found. So, was this a false arrest? Here's where the law gets a little complicated. For a vehicle search, police need probable cause. They argued that the offduty officer's eyewitness account was enough. But Jason's defense argued that since the baggie was never found, the entire stop was just a fishing expedition. However, the discovery of the outstanding warrants changed everything. Under the attenuation doctrine, those warrants often make an arrest legal, even if the initial reason for the stop was flawed. But Jason was not about to stay quiet about this. He quickly filed a lawsuit and took his fight all the way to the Michigan Court of Appeals. He argued his Fourth Amendment rights were violated by an illegal search. But in the official 2025 ruling, the judges ultimately sided with the police. The court ruled that the pre-existing warrants gave officers the legal authority to arrest him, effectively curing any issues with the initial stop at the car wash. The man in custody is Jason KD. He is a 34 year old man located in Port Heron, Michigan. He was charged with resisting and obstructing a police officer, which is a felony. He was also charged with various outstanding warrants, including unpaid child support and failure to appear, which is a misdemeanor. He was booked at the St. Claire County Intervention and Training Center and his bond amount was a staggering $58,000. So, what do you think? Was this justice or a violation of rights?
