my registration in here, which you never asked for. >> I don't need it. You're free to go. >> I got two kids. I NEED SOMEBODY TO COME GET MY KID. YOU'RE SCARING MY KID. >> YOU'RE SCARING your kid. >> No, you are. >> All right, everybody. Welcome back. We got another video. This one's from Body Cam Watch. The worst thing you could say to a cop. Now, I've had some people say some awful things, so let's see what this is. Haven't seen it. >> You arrested me for >> Get out OF THE CAR. >> WHAT ARE YOU ARRESTING ME FOR? >> GET OUT OF THE CAR. >> WHAT ARE YOU ARRESTING me for? >> On March. Good preview. >> 25. An officer was conducting speed enforcement using an unmarked Dodge Durango. >> Hi there. You're doing almost 60 mph. >> I can see my speed limit here. I was going 35. The speed limit is 45. I know I wasn't going no 60. I can see my speed limit. It tells me the speed limit right there. >> Well, you were passing every car. >> I was going 35. It's a big SUV. It's a hot. It goes pretty fast for the speed. >> Do you have your driver's license on you, miss? >> Yes, I do. First of all, what she said makes no sense. Just because the big vehicle is bigger doesn't mean it 35 is faster for that vehicle than it is for every other vehicle. Um, and I love it how people always argue and they're like, I wasn't going that fast. You're It's right here on the radar. You understand that when you're passing many cars, >> I can What I'm telling you is I can see my speed limit. It tells me the speed limit right there. 45. I was going 35. >> I understand that. Do you understand that I'm a trained motor cop? I do this for a living. >> Something to show me what I was going 60. >> Yes, you were passing all the cars. >> You have something to show me. >> My radar showed you at 57 mph and you're passing all the cars, >> sir. I know what I was doing. >> Did you know that you were passing all the cars? >> 35. There was no cars on the road. It was just me and you. >> You are. Are you Have you been drinking, >> sir? Go run my lights and get out my face, please. Go ahead. Bye. I'm trying to have been drinking. That's a That's a racial slur right there because how how do >> It's not racial. I I just knock it off. It's a n It's a common question on a traffic stop when somebody is uh when they're showing exhibiting driving behavior that is consistent with possibly being under the influence. It is a normal question. Has nothing to do with race. I look like I've been drinking cuz I'm telling you what I was going >> cuz you're doing 35. >> You want to do a breathalyzer or not? >> Okay. >> A check of the vehicle's temp tag would show that the vehicle had been issued a permanent plate in Florida. Once that's done, the temp tag is immediately invalidated. >> Okay. So, the temporary license plate is expired today and is no longer assigned. You have a new license plate assigned to the vehicle. >> 30 days to get a new license. Do you pull my license plate back? >> No. This license plate's no longer assigned to this. >> A temporary plate is issued for 30 days. A permanent plate may be issued at any time during the 30 days or even after. However, once a metal plate is issued, the temporary plate becomes invalid in our database. Okay. >> Vehicle with a new license plate assigned to it. >> Okay. Well, I haven't picked it up yet. That one hasn't expired yet. So, you keep my license plate back today. So, I still got six days to go get it. So, I would like for you to put that back. >> No, that's not how it works. >> In the state of Florida, you have up to six more days to drive with a expired license plate temporary. So, I need you to put that back before I be suing you. >> You can sue me. >> Okay. I need you to put that back. >> When I run the license plate, it's no longer assigned to the vehicle. >> It is assigned to the vehicle. So, I need you to go put that break. Do you need to see my registration? >> No, I don't. Okay. I have 30 days to get a tip. This is just expired today. >> Yes. >> So, I have six more days to get my license plate. >> Yes, I do. >> We're not going to argue on the side of the road so I can get hit by a car while you're talking to my car. >> No, I need that one back. >> You need to go get it. >> Exactly. So, put that backside. Go get it. >> It's not assigned to the car. I'm not having my registration in my >> You're getting a ticket today for speeding. We can go in front of the judge and we can explain how you were speeding today. >> There's a fine that you can pay or call the number to traffic. >> I'm not putting license plate back. You're free to go. I have my registration in here. >> Arguing is obviously not helping. Just move on. Go get another license plate. >> But first of all, she thinks she knows more than the police officer, who is a motor, by the way, and they're usually experts in traffic law. Number two, she's in the wrong. Her attitude sucks. Um, yeah. I'm curious to see where this goes because we got a lot of video left to go. So, I'm guessing that she's not going to drive off. >> Go, >> which you never asked for. >> I don't need it. You're free to go. >> Yes, you do. It's a temporary license plate. You're not supposed to go. >> I need my license, sir. >> You are free. >> I need my license plate. How am I going to drive without a license plate? Make it make sense. >> Just drive. >> I need a license plate. How am I going to go drive without a license plate? >> I'm not talking to anymore. You're free to go. >> You know, Frank always says, "Don't hold court on the side of the road." And I agree with that. You know, don't hold court on the side of the road. There is sufficient for a traffic violation here. He gave her her citation. She should just move on. She can fight it in court. >> Get back in your license plate. You're not supposed to do that. YOU'RE NOT SUPPOSED to do that. I NEED MY LICENSE BACK ON MY CAR. I HAVE SIX DAYS. >> She doesn't have six days. >> You're not supposed to do that. You racist ass. >> If you don't get back in your car. >> Oh, now it's racism. >> If you're going to get back in your car, [ __ ] >> get back in your car. I shoot your ass. >> Get back in the car. >> Oh, now she made a threat. >> She made a threat. >> GET THE OUT MY FACE. I SLAP YOUR ASS. GET THE OUT MY FACE. DON'T TOUCH ME. FREEDOM OF SPEECH, [ __ ] GET OUT MY FACE. >> Smash her up. >> Get your ASS OUT MY FACE. DON'T TOUCH ME. IF I DON'T TOUCH YOU, >> OKAY, freedom of speech is you don't get arrested for what you say. Um, but there are consequences to it. But in this case, she said she would shoot him. That is a threat. So no longer your freedom of speech doesn't cover because that is actual violation of the law. >> Touch me simply 53. You need to take out my face. >> 54. Just have somebody tell me. >> Get your ass out of my face. >> To be arrested. Get out of the car. >> For what? Get out of the car. >> What are you arresting me for? >> Get out OF THE CAR. >> WHAT ARE YOU ARRESTING me for? >> Get out OF THE CAR. >> WHAT ARE YOU ARRESTING me for? >> Get out of the car. >> What are you arresting me for? I NEED TO KNOW. WHAT ARE YOU ARRESTING ME FOR? >> Get back in THE CAR. >> WHY ARE YOU ARREST OKAY. SO WHAT? I CAN STAND OUT IN THE STREET IF I WANT TO. >> Tell me. >> I can stand at the street. I CAN STAND IN THE STREET. DO I HAVE A GUN? >> NO, I DON'T. SO, YOU CAN'T ARREST ME. Let me go. Let me go. Let me go. Get out of the car. >> I'm not getting out of the car. >> Get out of the car. >> Let me go cuz you're ARRESTED ME FOR NO REASON. LET ME GO NOW. >> YOU'RE GOING TO GET OUT OF THE CAR. >> OKAY. We've done a get out of the car video before and I love that they they did the get out of the car counter down here. I like it. Get out of the car 11 times. Let's watch that. >> Charge for resisting. >> Let me go. I'm not resisting. You arrest me for no reason. Let me stop. >> Stop. >> Don't call me. Do not call me. I'm going to call my people. >> Okay. >> Let me go. >> You can sit here until my my backup gets here. >> Oh, don't let her use the phone. >> You stupid? >> Yeah. Don't let her So, you're going to call more people. >> HEY, COME GET MY KIDS. >> OKAY. SO, she's basically under arrest already. So, her ability to use the phone that becomes an officer safety issue. I know you folks may or may not like this while you're watching it, but she's basically under arrest right now. And now the officer has concerns for his safety and hers. Um, I wouldn't let her use the phone either. >> Are you stupid? >> YEAH, >> SON. GO GET MY KIDS. ARE YOU STUPID? I HAVE TWO kids in here. >> Stop. Stop. >> Don't touch me, sir. Back up. Don't touch me. I'M TELLING YOU, DON'T TOUCH ME. >> You're making this worse. >> YOU'RE MAKING IT WORSE CUZ I DIDN'T TOUCH YOU. SO, DON'T TOUCH ME. >> YOU'RE MAKING THIS worse than me. >> Don't touch me. I'm calling my family. SAY, "COME GET MY KIDS. IS YOU STUPID?" >> Get out of the car. >> Don't touch me. >> Get out of the car. >> Don't touch me. >> Get out of the car. >> Don't touch me. >> Get out of the car. >> Don't touch Get out of the car. >> Don't touch me. DON'T TOUCH ME. STOP TRYING TO TOUCH MY PHONE. >> REALLY MAKING THIS WORSE. >> Don't touch my phone. I have the right to USE MY PHONE. THIS IS MY PHONE. >> You are under arrest. I'm telling you right now, you're underrest for anything. You are resisting. I'm not under arrest for anything. >> You are under arrest. >> Back up. Let me go, sir. >> Oh my god. You're going to get tased. Let me go. >> You're going to get tased. You want to get in front of your child? >> I got suits. I can sue you. >> Cuz you ain't suing nobody. >> For no reason. You're arresting me for no reason. You're arresting me for no reason. I'm getting two. We see 14 nearby. We're getting >> check. >> Okay. >> Motor 26 video. I'm trying to go 10:15. She's resisting. Get somebody here. >> Somebody to come get my kids. I have two kids in here. >> Let go. >> Right now. You grab her other hand. Grab that hand. Yank her out. That's the opportunity right now. [laughter] >> HE KEEP TOUCHING ME. I HAVE TWO KIDS. >> You didn't have to grab the phone. You could have grabbed the phone. >> I need somebody to come GET MY PHONE. YOU'RE SCARING MY KID. >> YOU'RE SCARING YOUR KID. I NEED SOMEBODY TO COME GET MY KID. NO, I'M NOT GETTING OUT OF MY CAR. I'm not getting out of my car. >> This is incredible. >> I didn't touch you, so don't touch me. >> Get out of the car. >> I didn't touch you, so don't touch me. >> There you go. Grab that. >> I didn't touch you, so don't touch me. You arrest me for nothing cuz I said I'm going to shoot you. That's not okay. So what? It's a freedom of speech, sir. It's a freedom of speech, sir. I can W MY MOUTH. >> NO, you can't. >> It's a freedom of speech. You're mad >> to a certain point. >> Racist. You're mad cuz you're racist. Yeah, you're >> okay. Here's the racist. That's you're racist. Um, if she thinks she knows the law, I'm all about freedom of speech. All about it. Unfortunately, you can't threaten people. That's a law. That's against the law in most states. Probably all states. >> Don't touch me. Don't touch me. Like I said, don't touch me. >> Don't for >> Don't touch me. Don't touch me. WAIT TILL YOUR other officers get here. Don't touch me. I'll let them arrest me. You don't touch me. They're [ __ ] >> You don't touch me. You don't touch me. >> Stop touching me. >> Stop touching me. Stop touching me. Stop touching me. >> Is just north of Jersey. >> Stop touching me. I don't want you touching me. >> There's 51. >> Don't touch me. >> I'm over here by Ros Street >> by my house. He's arrested me cuz I told him I'mma shoot him and I DON'T CARE CUZ YOU'RE RACIST, SIR. You're racist and I got my license. >> She just acknowledged that she had made that threat. >> Since I don't care. I got to rest your license. >> You cannot. >> I got to rest your license. Don't touch me. Don't touch me. >> He keep touching me and I told him not to touch me. >> You got a citizen now jumping in. >> I'm not I got my kids. >> Don't behave like this in front of your kids. Yeah, he's right here. >> Here we go. 247. >> I don't want you touch me. I don't want you touching me. I'll let somebody car up against the car. >> Can you please come get my please? >> It's okay, baby. It's okay. I'm okay. >> You know, we just pulled up the help. It's okay. Later on, she'll blame the cops as if the cops were terrible for arresting her. But the reality is this was her behavior. The cop was gone, gave her a ticket, moved on, and now she'll blame the cops later on, the police. And they'll she'll go around tell everybody how she hates the police cuz they arrested her in front of her kids when it was solely her behavior that took got her to this point. >> Love you. I'm sorry. I'm sorry. Don't cry. I love you. >> I love you. I'm sorry. >> You wouldn't act like this in front of your kids if you were sorry. >> He took my license plate on my car for no reason. I have six days to get a license plate. It just expired TODAY. WHY DID HE TAKE MY LICENSE PLATE? >> I have a temporary plate. >> He's not supposed to take my license plate. How am I going to drive without my license plate? >> I'm right here. >> You're not understanding WHAT HE DID. HE TOOK my license plate off my car. STATE OF FLORIDA. YOU HAVE 6 DAYS TO GET A NEW LICENSE PLATE. MA'AM, >> IT JUST EXPIRED TODAY. >> MA'AM, >> it's not EVEN EXPIRED YET CUZ TODAY SHUT YOUR PIE hole for a second. I can't get a word. All you want to do is yell at me and I'm trying to help you. I'm talking to you. >> I'm walking back to my car. She got out of her car, started walking towards me. >> So hard to walk. >> Started calling me all kinds of racist things cuz I took her expired temporary license plate. I tried to 105 her. She got back in the car. She was calling people out. Nice job. My license plate expired today. It's not even today yet. >> You just need to calm down and put in the car. >> You took my license plate for no reason. >> She's got kids in the car, too. >> For no reason. My license plate expires today. This is me. I'm suing you. I am suing. You cannot take my license plate if it's not even passed today. If it was >> She ain't suing nobody. This lawsuit, she has zero grounds for the lawsuit. Um, yeah, that she can just put that away. Put her back in her pocket cuz it ain't going to work. >> The 27th. I wanted to stand for 26. You cannot do that. So, you're going to jail. I'm telling you, I'm suing y'all. >> I am Billsboro, Tampa area. >> I am suing you. And you touched my phone. You hung up my phone. Yeah, I'm suing you, sir. >> You did that already? >> No, I didn't. >> I am suing you. >> Gloves were just the bodies. So, I think that it's Take a step back. >> I don't think she has any pockets. Well, I'm not sprayed my legs, so I never been arrested before. So, >> well, I'm I'm helping you AT LEAST. >> I'M SPREADING HOW FAR YOU WANT ME TO GO. >> NO, step back. >> A peach >> partner did illegal [ __ ] >> He did [ __ ] >> I highly doubt it, but we're going to figure it out. >> Sir, he took my license plate for no reason. Today is the 26th. Why did he take my license plate today? >> I haven't been here today. >> Okay. I have >> It's not a fire. Is it? I'm confused. Is that a spire? >> Well, give me a minute. >> I'm trying to bend my legs. I CAN'T STAND UP LIKE THAT. >> What's your name? >> Jamo. >> Okay, pay attention to me. Okay, so >> just went a body. So, she should be good. >> I'll help you out. I'll figure it out. I I'll be able to explain it to you. Okay, I'll be able to explain it to you. >> Do that. >> I will be able to explain it to you once I know what the hell's going on. >> Okay, I understand. >> I want to ask you a question. If my license plate is expired today, I have up until tomorrow. Gosh, >> get off it, lady. >> Okay, get in the car. >> Just relax. Okay, >> she got out of the car as I was walking back to the car and said that she was going to shoot me. She needed her temp tag back and all kinds of stuff. >> Why can't you get out of the car? You're under arrest. And she went out of the car. I just held on to her the whole time cuz I wasn't going to tase her with her kids in the car. >> Okay. >> I just got here. Somebody's calling. >> So, I've been call the deputy. These are deputies. So, I'm sorry deputies cuz I couldn't see initially until I saw the Hillsboro County. So, the deputy was very kind. He didn't use a ton of force. he could have. Um I thought he was very good about how he did this and kept control of her so it wasn't a danger but waited till he had somebody else so they could get her out without hurting her and like you said don't want to tase her in front of the kids. That's this is already traumatic enough as it is for the kids. >> Hey. All right. So like where's your mom's phone? >> Should be on the roof of the car. >> It was right here. >> It's out here on the roof. Somebody's been calling. I don't know who it is. They said it was grandma, but >> but yeah, if you want to take it back to us. >> Yeah, cuz I don't It's locked. >> Yeah, I saw that. >> All right. We're going to get somebody here for you. Okay. >> So, well, he told me you you told me you were stopped for he said for speeding. All right. So, I he was probably giving you a warning for that or what have you. He said the tag uh expired today, right? However, it's not. However, hold on, hold on. Let me finish. However, he said it'd been replaced. >> I didn't know that. They didn't tell me that it's a temporary tag. But what happens is when it gets replaced, that temporary tag becomes no good at that point because now it belong now the car belongs to the new tag. Whatever it is, a new temp tag, a new hard tag, whatever. >> You guys have any water or anything? >> No. But like I said, I've only talked to him for a little bit. But now the problem is where you are now is because of the screaming and yelling and whatever transpired prior to me getting here >> for me screaming yelling. >> Well, apparently you threatened him and multiple things. >> I did threaten him. That's not illegal. >> When you threaten to shoot somebody, that tends to >> Okay. an intentional unlawful threat by word or act to do violence to the person of another coupled with an apparent ability to do so and doing some act which creates a wellfounded fear in such other person that such violence is imminent. So the deputy can articulate that she makes this threat then turns around and goes back towards her vehicle. It is common for people to have guns in the vehicle. I carry a gun in the vehicle. So the the officer could in could articulate that he was then going she went back towards the vehicle. He has no idea whether she has a gun in there. And she did quickly reach in for something. Um so this meets the standard of the of the uh code here. >> No, it's not. If I don't actually do it, it's not illegal. I can say what I want in my life. >> So you only think if you shoot somebody, it's illegal. >> If it's if you shoot someone, it's illegal. But saying it doesn't put action into it. actually doing it does. Okay. >> But I did not actually shoot him. So that's not an actual arrest. >> I got you. >> Surprise, surprise. This one's illegal. You can't say it. You threatened him. It's assault. And some say it's would be like threatening and intimidating. This one it looks like it's assault. Um but yeah, >> I got you. >> So I'm trying to understand what I'm going to jail for. >> Once we get all that sorted out, I've been back here with you almost the whole time. >> You could watch his camera. I didn't touch him. >> Same with him. He got here way after me. >> All right, hang out right here for me for a second. Okay. >> How long is my mom going to be in jail? >> I don't know, sweetheart. I don't even know what's going on yet. Okay. >> He said, "Well, I'm taking I said, "You can't do that." I said, "When did it expire?" >> How sad that the boy has to ask how long his mom's going to be in jail. The kids, while they were upset for a period, I don't know how upset. It feels almost like this is kind of normal behavior that they've been used to, which is really sad. Um, yeah, because then it, you know, the kids grow up disliking the police as well. >> It expired. He said today, I said, "Today is not over. I can see if it was the 27th, that's different, but today hasn't ended." And it's a temporary license plate. It's not like it's a hard plate. It's a temporary license plate. And he said, "No, I'm not getting I said, "Sir, you need to get my license plate back." And that's when I got out of the vehicle. Said, "Can you get my license plate back?" He said, "No." I said, "You racist, I will shoot you." And then he came and grabbed me. I said, "What are you grabbing me for?" He said, "Because I told you to get in the car." I said, "Okay, I can stand in the road if I want to. It's not illegal to stand in the road." He said, "Well, I'm going to arrest you." I said, "For what?" He said, "Get out of the car." I said, "I'm not leaving my kids in this car." So, I'm trying to understand where and when did that become an arrest? I got to tell you, that's a pretty I mean, she's she's lacking tone, you know, she she left out the tone part of what she was saying, but she recounted it pretty well. And so, I've counted at least three times where she's acknowledged the fact that she's threatening him. She did it to the officer, the uh deputy. Then she admitted to to this deputy that she had made the threat, and then now she admitted it again. So, multiple admissions. >> We'll get all that. All right. Don't worry. You know what? All this will be on body camera. So, it won't even have to be your word against his. All right. I'm gonna close this door. I'm gonna give the deputy your phone for right now. Okay. >> Feel bad. I was saying officer cuz it was deputy the whole time. >> I don't know. >> But she needed it on for the location. >> So, she was charged with resisting without violence and assault on law enforcement officer. >> End of my investigation. >> All right. There you have it. Let me know what you think. Should she have been charged? Was the Was the deputy right by taking her license plate? I want to know what you think. I think he was absolutely right. Um, that's the way the law reads. It wasn't the end of the world. She could have driven off and gone and got a new temporary tag or a new plate. The plates's probably at her house. Um, yeah, that could have been an easy just drive away mad. You know, you can mother f them all you want in the car. But don't don't make the situation worse worse, which she clearly did. And then let me know if you thought that her freedom of speech over crossed a line. I think it did. Clearly, it it was a violation of Florida's criminal code for assault and assault on a law enforcement officer because she made a threat and had the ability to act on the threat or at least the officer, the deputy believed that he had the ability or she had the ability. So, I'd love to know what you think.
