You're still detained for a certain look what you're doing cuz I don't know what you're going to get out the bag. >> I can't see your code. I can't see the code. >> I'll push the button and then I'll clear the code. Okay. Because I'm not going to look at it. I'm not going to look at it. >> Normally I wouldn't do this. Normally I just say the bag open. >> That's fine. That's fine. We've gone through it. >> You're going to get someone hurt. I'm telling you, you shouldn't be in this job if that's what you're doing. Shut your mouth and just keep it off it. All right. >> It's not nice. It's not nice. >> I don't give a You're not nice. Not nice. Pouring a teaser. >> When an ordinary citizen fights back with the law, the heated debate over trespass and public access makes the police back down. >> I'm walking about carrying out perfectly lawful activity. I've not got anything illegal in my possession in a police car. >> I've got a perfectly looking. >> Right. Can you let me explain the point without you talking over >> because you're not want to listen to my point. Let me tell you why and then you can say your peace. Okay. Absolutely delusional. >> Right. You going to let me speak or not? >> I'm not going to talk to you anyway. >> I've not made any threats. I've told you >> you threaten me. >> That's an offense that you're committing. >> Am I? Yeah. >> I'm not. So arrest me for it then. >> Uh I'm not going to at the minute. Find out the outcome of it. >> [ __ ] nonsense. You don't know what you're talking about. >> These are absolutely delusional. You know what I mean? He's absolutely off your nut from my point of view. Again, you're still failing to to appreciate this. I'm walking about carrying out perfectly lawful activity. I've got nothing illegal in my possession and I get a [ __ ] pointed at me. >> We've explained lightly. >> It is a legal. >> However, I would recommend >> Put it back in the bag. Shut your mouth. >> No, I'm going to give it back to you, but I'm going to give you some advice. >> Shut up. >> That if he was found on the street with that, it might be a different Don't walk in front of bus. >> Yeah. If he's happy to go off site, then um he can go off site and he'll be on his way. >> Am I arrested now? >> No, you're not. You were never arrested. >> Okay. Like I said, if you want to collect a copy, you can go to the inquiry. >> No, I want a paper copy now. >> Three months. Okay. >> I'm requesting my paper copy now. >> I don't have my laptop with me right now. >> The bag. Take out the bag. >> Took it then. >> I'll take it out of the bag. Give me as you took it. >> What about the bag? >> You can see my hands up here. >> All right. Take out the bag. I'm not touching any of that stuff. All right. Where's my stop? He's refusing to go and get me that. >> He hasn't done it yet. He's refusing. >> He needs to do the softening. >> I said Listen. Are you refusing to be here? >> No, I can't just magic out of thin air. >> I'll wait here for it. >> You're not We don't wait on the side. >> Private premises. >> Come on. >> Okay. >> Exactly. That's why. >> Just don't make it awkward. We're asking a minute. >> I'm definitely asking you nicely. I'm asking you nicely. >> I don't care. >> The court dismissed all charges. The police failed completely. But that was not the end of the story. As the victim declared, "I will sue to get it all back. >> I've been handcuffed. I've had all my stuff ripped out out my pockets, out my bag, and all that sort of stuff. You are absolutely off your head and delusional if you think that is happening now. >> Okay. >> Private car park or not, civil trespass isn't a police matter. Okay. >> Will you walk over to the employer office with us now to the stop? >> And if I refuse if I refuse I'm not leaving to you. >> We can't leave you in the car park. >> Why not? Private property. >> Okay. Public right of access. There's a public right of access. Well, there is. I just walk straight in. There's no gates or barriers that are breached. No one. >> No, it doesn't. >> But it doesn't say that. Can I show you? I got it on film. >> It definitely does. I can't. >> I guarantee it doesn't say police station, >> but it doesn't say the way I walked in. >> So, you either go over to the inquir and wait for it. >> So, what I'm going to say is, >> would you like it if you were in our roles and you someone like you was stood here and they were around everyone's personal vehicles where they on private property over a lot. No, you've not been that at all. >> You just delayed the process of doing your stop and search record. >> No, you can go and get it. I'm not stopping you from doing anything. >> You can't stay here. You know, let's just go over everything quite often. We'll get you stop. >> No, I'm waiting here. >> Okay. >> This is when I had a a loaded >> weapon here, but that's fine. We'll defend with our sergeant. >> I'm going to take this from you cuz you're now under arrest. All right. >> Video's being ended, but our body came. >> You have to say anything. Anything you do, maybe. Do you understand? >> Yeah. >> Who's the sergeant here? >> Is that the sergeant? Citizens may sue public officials for violating their constitutional rights pursuant to 42 US Code SS1983. Individuals/organizations are required to pay damages to the injured party. Violating police officers may be disciplined, have their licenses suspended, fired, or expelled depending on the policy of the agency/ police chief. The man was arrested and detained for 8 10 hours and all his equipment was confiscated. The police charged him with obstructing an officer in the execution of his duty and applied for an order to destroy his property. But the court did not accept any of the police's arguments and dismissed all charges. Next, in the middle of a peaceful morning, a man just stands still on the sidewalk. But just a few minutes later, a patrol car drives up and things start to spiral out of control. I I I'm here to investigate. Somebody's taking pictures of a building. >> Well, if he's out in the public, he's allowed to take pictures. >> I'm going to arrest you. A seemingly simple sentence, but it sparked a silent but dangerous confrontation between citizens and the police. >> Hello, sir. Hey, how's it going today? Can I help you? Um, can I ask what you're doing? >> I need to talk to you. Okay. Can I talk to you, sir? Sir, you are allowed to record out in the public, but I still need you to talk to you cuz obviously you're making people nervous you're taking pictures of a bank. Sir, I need you to talk to me. Okay. Sir, what's your name? Can you explain what you're doing? Hello? Are you just going to ignore me? Is there a reason why you're just taking pictures of vehicles, sir? Can I help you? Can I get your name? I need you to tell me what your name what you're doing here, and then you can be on your way. Okay. You're taking pictures of the sky. You have a driver's license on you, ID identification of some sort. Sir, I need you to talk to me. Okay, sir. I'm going to need you to talk to me. If you don't if you don't talk to me, I'm going to have to detain you until I figure out who you are and what you're doing. So, I need I need you to communicate with me, okay? I'm trying to just figure out what you're doing and then you can be on your way, but I need to determine what you're doing. This is a bank building. Obviously, they're a little concerned that you're taking video footage of a bank building. I mean, as long as you're not doing anything illegal, you're perfectly fine. But I need you to talk to me, sir. Are you not going to talk to me? If if you do not touch me, I have to determine who you are. >> From harsh to soft, the policeman began to wonder, was this just a YouTube show? But the answer was absolute silence. >> You're allowed to be on the sidewalk, but you can't be blocking their driveway. Are you aware of that? Is this like a bit you're doing? Is this like a YouTube thing? You're You're just not gonna talk to me at all? No. What's that? >> I can identify yourself at all. Police Department, sir. You're welcome to record the vehicle all you want because this is not an issue today. >> You want to record the bank? You're allowed to do that. Can you at least tell me your name is all? No. Are you staying on the sidewalk? >> Well, if he's out in the public, he's allowed to take pictures. >> No. >> You're out in the public way, you can take pictures. I'm just trying to identify who you are. As long as you stay on the sidewalk and you don't interfere with anybody. You understand that? No illegal acts were committed. No words were spoken. But this freedom check caused the police to quietly retreat without daring to take action. Come on, guys. Come on, man. This dude was getting all up in my way and saying I couldn't stand where I was standing at. And that right there is uh how you uh not talk or not respond to the police whatsoever. He knew that I was out here exercising my rights, but uh still tried to get my identification. Was telling me that I can't stand here uh blocking the driveway. Obviously, I'm not blocking anybody from uh driving in or out. But uh the best uh response to the police is no response whatsoever. And that's what we did here today. So hopefully he goes in there, educates them. Yeah, guys, that'll that'll be a wrap if he just gets back in his truck truck and leaves uh without coming back over here uh trying to talk to me again. So, we'll see about that. Y'all stay tuned. Come on, guy. Just leave. Just leave. Please don't come over here. Yes. Unless he's uh looking for me. Maybe he's looking for me. One person standing still, one camera, one right, protected by the Constitution. And this is a wordless lesson for those who want to control citizens through fear. There you go. That a boy. He put his seatelt on. That's good. Always like to see uh when police officers also wear their seat belts because they are out here enforcing uh traffic laws, they have to abide by that as well. So yeah, we're just going to uh stand here and uh watch him drive away. And then we're going to keep on pushing, guys. Wondering uh what we're doing. So, yeah, guys, subscribe. Subscribe. Looks like he's driving away. All right, we're going to stay in here for a little bit longer cuz this officer is leaving. So, uh yeah, guys. I did pretty good out here today. Leave a comment down in the comment section if you guys like these uh audits where I don't say anything. Uh put a one down in the comment section or uh just let me know how you feel about these. All right, y'all. That's pretty much going to wrap it here. >> After several minutes of failing to get the cameraman to talk or identify himself, the officer gave up, got into his car, and left the scene without making any arrests or detentions. The cameraman concluded that silence was the most effective form of resistance to an unfounded police request, especially when there was no evidence of a crime. Next, when a group of peaceful citizens stood in a public park, they did not expect it to lead to a tense confrontation with the very people tasked with upholding the law. >> This is not a private event. This is a public event. >> A festival that claims to be welcoming to all. A group of people showing up with a message of love. And then something happens that makes freedom of speech a topic of threat in broad daylight. you guys. You want to get on the outside of the of the actual festival. >> So, where have they rented? Where is >> So, they have from the pavilion all the way down all the way down to where crews run on the other side. >> Is that like a permit or something? You have a copy of it? >> I do not have a copy of it, but >> can you easily obtain one? >> Correct. >> Can you So, can you obtain one and show us what they've actually rented in the car? Also, >> why you wait? What's your name, officer? >> I'm just ask you very nicely if you guys step on the outside road and you can do what you want. >> Sergeant, what's your name? >> Lee. What's your badge number? >> 304. >> Okay. I'm Mike. Hey, uh we're going to respectfully decline your request and we're going to stay here for now. Okay. This is a public park. We're on the public access of the park. We understand they've rented some pavilions and things like that. We're not going to occupy their rented pavilions and things like that. And they have signs that says everyone is welcome. And this is a public event, by the way. It's not a private event. I already talked to the parks and wreck people. >> This is not a private event. This is a public event. >> What would happen if we don't leave? What will you do, Sergeant? >> Oh, actually, I should just move on the outside. >> I understand you're asking. I'm just respectfully declining. >> All right. >> Okay, >> cool. We're all good then. >> Yeah, I suppose so. >> All right. >> But if I get if I get no words, I'm >> What are you going to do if we don't? >> Remove you from the park. >> How so? How are you going to remove me from the park? By force. >> I'll get you I'll get you a copy of >> you. How are you going to sergeant? How >> man? >> Yeah. Thank you. My name is Merrick. >> Lord bless you. >> How are you? >> Hi. >> A vague contract, a refusal to show documents, and an implied threat to leave. Is something crossing the legal line? >> Yeah, I know. >> So, I got I got the paperwork here. >> Uh-huh. >> You look You guys are more than welcome to be out here, but that's entrance. You guys stand on the outside the entrance, but >> they have signs. Everyone's welcome. >> Okay. Listen. Listen to what I'm saying. >> They don't want they don't want the protesters in here. So, >> we're not protesting, sir. thing is this is an event that they want you gone and you guys have >> I was told it was a public event and that they rented the pavilions and things but this is still accessible to the public this whole park right >> no it's not >> the public's walking through here freely all they want >> right but they're not in here protesting >> we're not protesting this doesn't want you guys in there what am I protesting >> whatever this is you got going on right now >> this is what God's word says about pride this is a pride event right >> you guys are welcome to go up to the entrance and do what you do but they don't want you inside. >> What does the paperwork say? It's right here. >> Right here. >> But what does it say? >> Does it specify the location that they have rented? >> Yes, they have this printed right here. >> Where does it specify? >> Can Can I see that? >> What are you going to do? >> I mean, you showed me the document for like 3 seconds. If I want to be informed so that I can make a a wise decision, let me see where is specified that they've rented. Like, are you saying I I can't stand right over there? >> No. I I told you guys born in prison. You can go stand right over there. >> So they haven't rent rented there. >> You guys go right over there to that car path and do whatever you guys want to do. They don't want to get inside. >> Can you show me where all the way over there by the cars, >> right? Or you can Okay. Well, the entrance is right there. That's what they >> I'm happy right here where I'm at. >> I'm perfectly within my rights to stand here. This is a public space. >> Right there. See? See right there? That's where it all started. >> You got You got Black Lives Matter. You got all sorts of messages floating around this place. That man, that young man's not contracted to be inside of here with Black Lives Matter right here behind you. >> Yes, they are. >> No, he's not. >> It does. There's all sorts of messages. Everyone's welcome. It says right there, >> what's going to happen if we don't leave? >> I'm not sure. This is a start arrest. We don't trespass. >> We're not trespassing. This is a public park and it's a public event. This is a public event on a public park and we're not interrupting the event. We're not disrupting the flow of traffic. We're in a public park. >> We want confirmation that they've actually rented the entire park because we were already told you that we were told where it says >> like where did you get that information right now? >> Does it say it's a private or public event? They have to specify that contractual agreement with the parks department. >> This is a public event. A cry rang out from the crowd. But when people stood still, what made the police see this action as a threat? >> Taking their invitation. They asked everybody to be here. It's a public event. >> Public event. He just said so. >> Yeah. Yeah. That's all. >> We've had many non. >> No. No. >> Makes sense. >> Hey, thanks, man. No, we're we're not domestic terrorist. >> Christian Taliban >> one in the pink that >> I mean really. She's walking up and down intimidating us. >> She's been following us for >> I appreciate you. >> Yeah. No, I I I totally understand their side. So, I just want to let you know we we have no intentions to block a vendor booth. >> I'm only here to make sure there's not a rug and everybody's safe. That's it. >> And we don't take up arms. >> Yeah. Once they figure out what they're going to do, Yeah, we affirm and actually I don't know but if you know but in the Bible it says that >> so I heard I heard him say it's a public event. >> So it's open to the public very high. >> No they they can control who's in their pavilions, who's in their vendor booths, all that stuff. They can't control who's in this part of the park. >> No they can't. The public can walk through here all day long. If they wanted to control who's in this part of the park, they would gate it off and they would they would in let people in and out. Have some sort of security. They wouldn't be using the state. They wouldn't be using Southbend. They wouldn't be using the university police to enforce their will. >> So they can tell you >> No. No. They don't control who's in here and who's not. You're wrong. It's a public event. They invited the public. It's a public event. It's not a private event. >> When the law is broken in the middle of the park. Who is the real troublemaker? The people holding the banners or those who claim to maintain order? >> Charging admission. It's open to the public. Traditional public forum applies. Okay. Now, we're not allowed to do anything criminal within their event, and we're also not allowed to disrupt their permanent event, which we're not doing. We're just standing here with a message on signs. That's it. You guys get one of these. >> Love hasn't won yet. Talked about like class oppression and who in our society is most oppressed. >> Am I with the abortion people? Like the Planned Parenthood people? >> No, like the anti-abortion people. >> Oh, like the Christians? >> Yeah. >> Yeah, I'm a Christian. Yeah. You get one of these? Y'all get one of these? >> I'm an atheist. Oh, that's fine. Christ came into the world to save all kinds of people. >> I was once an atheist, too. >> This is number 30. >> Oh, hi. Hi there. Who am I speaking with? >> Mike. >> Mike. >> I'm Merrick. >> Merrick. Yes. >> Um, so the main issue is obviously this is an open air vet. >> Yep. >> I understand that. >> Um, but if you're going to be stationary problem, >> what problem? because they rented out all these spaces to the vendor. >> We they we said they could set some up here if they want to. We're not blocking anything. >> What I'm saying is you're stationary vendor that situation. >> I'm not bending anything, sir. >> You're handing out. >> I'm not bending anything. I'm not I'm not soliciting anything. I'm not selling anything. Freedom of speech. >> There's no exchange of money. I >> I understand. Yeah. that you're coming at me with a little bit of venom there. >> Oh, I just want to make sure I establish our right to hand out literature if we want to. >> And it's not a crime to be stationary in a public park, but it's a public venue and a public event. >> Right. I understand that. But the people that are here that are stationary areas >> have rented out you being station. >> How often do I have to move fabulous? >> My suggestion is you continue to walk like >> do I have what if I stop moving for five minutes? If you stop moving in five minutes, are you going to be talking with the vendor? >> What about 10 minutes? >> No, just talk to whoever I want to. >> You're trying to get a number. >> We're we're trying to understand why talking with a vendor is a criteria. >> Well, you don't have to. >> But you you brought that up. You mentioned the kinds of things I was doing. Like how is that a valid criteria in any legal discussion of where we can be? Like if you want to have a personal discussion about that, >> we understand. >> What's the legal ultimatum? >> What you're here for. >> Perfect. Okay, I understand what they're here for. >> Yeah. >> Okay. And it's different ideologies the way things are. >> Citizens may sue public officials for violating their constitutional rights pursuant to 42 US Code SS1983. The individual/organization may be required to pay restitution to the injured party. In severe or intentional cases, punitive damages may be ordered. Additionally, the court may order the losing party to pay the plaintiff's attorney fees and litigation costs. The police ultimately did not make an arrest, but repeatedly pressured and threatened to remove the group from the public space. If the group wanted to, they could have filed a civil or federal complaint for abuse of power and interference with constitutional liberties. It turns out that silence is what makes the whole system most confused. Hey guys, what do you think about this situation?
