I understand that my partner's going to get your coat. >> Okay. >> I don't want no issues. I I I don't want issues, but we got issues tonight. Okay, that's what we have. >> Please not me. >> I understand that, but we're going to have issues tonight. Okay, clearly we're going to have issues. >> Please not me. >> I'm not trying I'm trying to figure out what happened, but you're not talking to me. He's talking. >> I'm I'm confused. My head hurt. >> I understand that. I have an ambulance coming for you. Was he in the car with you? >> No, he he it was having here. >> Okay, so you pulled it. Where are you from? >> Everywhere. >> Okay. I don't know what that means. Literally everywhere I'm from. Initially from Georgia. >> Where do you live right now? >> In a hotel. >> In a hotel. Okay. So, you pulled up in this car and went inside to get a drink or something. Correct. >> Yeah. I went in to get a pulled out. >> Okay. You come out. What happens? >> He's there. >> He's there. What happens when you see him? >> Escalade. >> Escalade. What's escalate? You walk up, punch him. He walks up, punches you. >> We We start fighting. >> You started fighting. Verbally fighting. >> Okay. >> We're both. >> Okay. So you and then after you guys are verbally fighting, who hits who? >> I know I swung first and I shouldn't have. >> You hit him first. >> I I kind of pushed him back. >> You pushed him. Okay. >> You pushed him and then what? He swung on you. Okay. Okay. So now we're getting somewhere. I'm trying to figure out what happened. Okay. >> Gave him discombobulated. >> I understand that you got you got a good bump on your head. Okay. And you're bleeding pretty good. All right. >> It looks like it stopped bleeding cuz I don't see it anymore. >> I'm okay. I just I want to go home. Please. >> Okay, you're not going >> right now. Okay, you're not going. I'm going to go straight to jail. You're not going to jail. I didn't say you're going to jail. Okay, relax. >> I need you to come over here. I need you to have a seat. Okay, >> I'm going to get you out of >> You want If you want to sit outside, >> okay, then don't go in the car, but sit on this curb. Okay. And just don't move. >> Yeah, please get off here. >> No. >> No, I'm not. >> Absolutely not. >> They started arguing driving down state. >> Okay. He said, "I'm done with this." got out of the car. >> Okay. >> Stopped at the bus stop. She drove down a little bit, flipped around, came back for him. That's when he got back in the car. They came here. He went out to the Dollar General. >> I saw him sitting here a little while ago. >> Um went to the Dollar General. She got out the car, left the kid, started chasing him. He ran back over here. >> There's a shooting star. I mean, who's that? um chased him back over here, started grabbing him by the jacket like this and uh they started grabbing him. He said, "Get away from me." He said like shoved her but she tripped on her own feet. It wasn't a hard chug. I was like, "What the?" And she came back at him, started undoing his pants, trying to She said he she tried getting a handful of balls. And so he was on the phone with dispatch at that point. And naturally she grabbed his boys. He hit her with the phone and she got off of him. And she they said that's right when we threw up. >> She states she was in in here. >> Yeah. Came out. He was here. Immediately started arguing. She says she pushed him and then she won't elaborate what happened after that. >> So cuz she's worried. She doesn't warrant and she's afraid to go to jail. Well, she should be more worried about driving with her child under the influence. >> Yeah. >> I'm sorry. Nobody tell me what I should be doing right now. I just >> She's going to the hospital. >> I have no idea. [laughter] >> I'm sorry. This has been a real >> It sounds like I saw you sitting here earlier just just chilling. >> I was I was going >> Yeah. I was like, "No, at some at some point somebody's going to see her out here acting like this." At that point, I had to like >> I didn't see her at all. Where was she? I mean, cuz I saw I I thought it was odd that the car was so far from the gas pump, but I was like, maybe they're just chilling. I don't know. I never saw her. >> Yeah. Yeah. No, I was that was when I was I was laying down on the ground and at this point she already tried to rip my balls off, so I accidentally attacked her with the phone and it was in I just flailed. >> No, I I get you. I get you, buddy. >> So, damn. So, now she's leaking and she wants to take the phone and hang up. So, all I could do was hold the phone and she's trying to rip out my hand. So, she just bled all over my [ __ ] hands, all over. >> Yeah. She's everywhere. And she's like, "Well, I hung up. We can just go. We can just go." I was like, "Okay, well, you're so drunk and you're bleeding. You need to get medical attention cuz you know, I'm sure this came on set. Okay. And if I made you bleed like that and you're drunk and something happened to you, Kayla, I didn't call to get you help cuz I may as well just say I did it on purpose in that, >> right? Yeah. Um, are you okay, though? Do you need a squad for anything? Are you feeling okay?" >> Okay. >> Um, >> you want to get my baby home soon? >> Me, too. Yeah. Unfortunately, none of you guys can drive a car, which you guys all know that. Um, >> so I would work on it doesn't I mean to be honest man I'm trying to figure out all the details. I have four witnesses to the whole thing. Okay. >> Okay. I know. >> So they're going to work I have an officer talking to them now. We're going to go off what they got to say and if that's the case if everything is kind of how you played out which not going to lie she's not very being very cooperative. >> She's probably going to be arrested and you're going to get out of here. Okay. But I can't say for sure. >> I see her face. She is that from her? >> Yeah. >> And what's the blood in your mouth? >> Oh, yeah. >> What's that from? >> Um, she's so comfortable with hitting me at this point where she felt like she could dodge out the side of my cheek and I wouldn't bite her. >> Yeah. With her fingers. >> Yeah. And I didn't bite her because I knew that first when when I inflict purpose injury to you. That's that's going to make it a different conversation. >> Is that all blood and [ __ ] on your coat? On your >> Yeah, cuz as I'm as I'm holding the phone trying to talk to the dispatcher, she's trying to hang up on the lady. She's like, "Oh, well, we can just go. We can just go." And I'm like, "No, Kelly, you're bleeding. You're bleeding all over my hands. all over the phone. You need medical attention. >> I'm not just going to just hang up the phone and we're just going to go home and bleed all over the car. Like, no, you need help. Bad. She needs psychological help. And I don't know how bad that bleeding is, but she should probably get that looked at, too. >> Um, should you start a pack with him? >> No, not yet. >> Start a pack with him. >> Um, throw away pen. >> Yeah. >> All right, buddy. So, all right. >> Here, take >> this is >> Yeah, I'll we'll toss it here in a second. Um, how much has she been drinking a night? All night. >> I don't I don't know. We were We were with I was with um her friend's boyfriend. Her friend's boyfriend's friend and all the kids. Her and her friends went out. >> Oh, okay. Okay. >> You know what I'm saying? All the girls went out. She came back. She was upset because she thought I should try to stick up for her friend to go get her beat by her man because Kayla could $20. I'm like, Kayla, what I look like? I think I want to get hit in my mother. >> I'm for me get hit in my face any damn. He said all they saw was they heard the arguing, turned around and saw him throw her to the ground and start punching her in the face repeatedly. >> Then we tried to check the right. It was closed. >> Me and my friend each other. We saw a woman screaming. She she started she got like up and to the ground. He started hitting her >> just hitting her >> violently and then she started screaming asking for help and then he started holding her head dragging her and then that's right when he started running back. >> Did at any point in time did you see her push him or hit him? >> Uh no. No, just screaming. Just Okay. When you turned and looked at him, did you see the whole thing of him grabbing her and then hitting? Yeah. Okay. >> No, no, no. We saw like we just saw cuz the car was covering him. Okay. >> We just saw him hitting. >> So, did you ever see a scuffle before that? >> Yeah, but we saw >> you saw a scuffle. >> Like pushing back and forth. >> Only him. >> Only him. >> Yeah. >> Okay. So when you guys looked at him, were they had like distance or was he already had a hold of her? He already had a hold of her. Okay. >> I saw for a split second her trying to grab at him. Like he said she had something in his hand. She looked like she was trying to grab at him. So that seemed it made sense. I remember when I was looking at her, it only looked like she got hit once in the side of the you see his phone. It's pretty. It looks like it could have been broken beforehand, but um >> that's what I'm So >> this one looks like it's my opinion. I [clears throat] think she is a primary aggressor. I think she started it cuz I remember I knew know she said she came out, she pushed him cuz so far her story is against what everyone else is saying. She pushed him and then she said something about hitting him but like mumbled it and then when I asked her you did what she didn't answer again. All right. So the kids, three of the four said that she has a charge against she has an arrest and tells us on the team he's the victim. >> Oh yeah. I I I 100% believe she is the primary. So I just want to cover make sure like we're doing >> 100%. Yeah. This will show >> this will show that if we get video >> I just don't know if that camera here I think would show. >> Oh that yeah >> because obviously we're up and down and stuff. >> Oh there's blood over here. Yeah. There's literally blood right behind you. >> So um go to the hospital take photos. Ask um you obviously look at her face. See, we see things even ask medical doctor. Hey, this is domestic. There's a claim. She was hit multiple times in the face. Is it anything that you're seeing consistent medically that she was hit several times in the face? >> Um, you know, so do that. >> Do you want me to go with you? Cuz it looks like we're probably going to make an arrest on her. And if she starts to get a little fishy, >> she was begging me not to go to jail. So, she's not going to be happy when she finds out. >> Cover those bases. Ask Ask them like, "Hey, when when is she going to be released?" Um, I would imagine she's probably going to kill. You go up there as soon as you can before we release her. She probably doesn't have a ride though. >> Um and then uh grab your photos, do all that interview with her, do the packet. >> Yeah. >> Um and let me know what you get. Okay. >> And if it's pretty much going to be an arrest. Did you guys get interview? >> I won't lie to you. Yeah. You're going to jail. You're going to jail tonight. >> I appreciate that. >> I'm going to be sh Yeah. You're for domestic violence. >> Okay. Yeah. Do you see me? >> I see you. But according to everything that's making sense, you started it. >> Sorry. Let me know if I'm >> No, you're not in my dress. >> The way it sounds like, it sounds like you were trying to get the phone cuz you guys were obviously going through something. You didn't want him talking to the police. My phone. >> Okay. You didn't want to talk to the police? >> Because it sounds like you were the primary aggressor in the situation. >> I'm not. >> Okay. No, I was staying in the hospital while I was filming myself and cuz that wasn't your case. And if I'm going to like do this again, >> okay, how many times you going to do it? Like years. >> Okay, but like you just going to keep running? >> Is that the goal? >> Running. This is >> Yeah, it is. You just said I'm going to stay in the hospital. >> You have two warrants. >> That's a general. >> Yeah. >> 5 years ago, I got choked. 3 seconds of living. >> Okay. I I wasn't there for that. I don't know what happened. abrasion. >> I don't know what happened there. What happened in that situation? >> To be honest, after I got here, I >> No, I'm not playing. I don't want to be alive. I do not want to be alive. >> All right, we'll handle >> I have not wanted to be alive since I've been born. >> Okay, Kayla, we'll handle that. Just relax. I just got to read you stuff, >> dude. >> Kayla, you're not going to jail then. If you just want to chill, just relax. I just got to read you the stuff. Okay. >> You don't get it. You don't get it. I'm trying. >> No, it sounded like tonight went really bad. It sounded like really bad and I'm trying >> and I get that but it sounds like you had a bit to drink things. >> I'm trying >> and I get that. OKAY. >> AND I'M TIRED. >> ALL RIGHT. All right. We're going to read you the same thing we read him. Okay. So, I read it the same thing to him. Okay. This is just if you're if you're alleging domestic violence against that he domestic violence you then you can look to file charges against him. But like I said, he's not filing charges against you. We the city of Chicago in >> a day that if I like I'm dying. Okay. This happens I'm dying cuz y'all ignored it. >> Okay. >> Multiple times. >> You have a jacket. Did you have shoes on? >> No, I have nothing. >> Supposed to know that. Kayla, >> how would y'all care? >> Kayla, stop yelling at everybody. >> How would y'all care? I mean, for real. >> What are you talking about? >> For real. >> I don't know. >> I have been awarded y'all sick. >> Okay. I don't I don't know. Caleb, this is the situation that's happening tonight. I know it sucks, but but this is what it's going to be tonight. I'm not trying to sugar coat it. It's going to suck. >> Always hurt me. >> I you know, we haven't even touched. >> So now I will myself where I never have to deal with >> Well, we have a facility for that. >> Well, >> all right. Please don't just please don't please don't do that. Please don't do all that though. Okay. I won't force anything. >> Switch your wrist this way. So it's put in the front. >> I do hear that like what? just mean type deal. Not help you out really. >> They don't put you in a cold shower and then make you sit in a cold for hours. >> They put you in a cold shower >> and then make you sit in the cold for hours with no socks, no shoes, no nothing. >> Nothing. >> And I'm afraid because I'm anemic. Like it's kind of Wait, it's >> Where do you guys live in? >> A hotel. >> Hotel? >> Because it's me and one of the room AMHA. Like I I've been through some >> Oh, were you in AMHA? >> I'm not going to run. No, we until we get downstairs in the hurry. >> Hey everyone, it's Trent, prior deputy sheriff, patrol sergeant, and canine handler. When it comes to these domestic violence investigations, a primary investigative goal of law enforcement is determining who the primary aggressor is. Who started it or instigated it, who continued it, who was acting in self-defense and who wasn't. And things like injury or severity of injury or who called 911 first, or in certain circumstances, what one independent witness has to say, those things as a standalone do not always automatically determine who the primary aggressor is going to be. And that's why it's important for law enforcement to look at the totality of the circumstances and complete a thorough comprehensive investigation by reviewing surveillance footage, speaking with medical staff and doctors, and determining, which is a very common thing to do, if this woman's injuries are consistent with what is being alleged about the situation and incident that transpired. Also, criminal history can be a relevant factor as well. This woman is a prior suspect in a domestic violence case against her significant other. She has two warrants for her arrest. These officers notated in the report, they spoke to four different independent witnesses. One of the witnesses we hear said that he punched her multiple times and her across the ground. And that's why you're going to be relying on that medical staff as well as surveillance footage and other independent witnesses. Not all witnesses see the entire thing. They don't see what happened before. Everything that happened during and even after. It depends on if their view was obstructed, how far away they were, how long they were at the location, etc. But according to these officers report, after compiling all of that investigative information, they were able to determine that the female suspect here was the primary aggressor. She was charged with simple assault under the Domestic Violence Act, but remains innocent until proven guilty in a court of law.
