Yeah, I got a camera. >> State property camera. >> Public property. Don't touch my camera. You cannot do car. >> You cannot touch my camera. I >> I can I'm not detained. I can walk up anywhere. I'm not doing nothing. You guys say, >> but I mean I'm not going to act based off of this just with an old signature. >> So, it was a signed order before >> copy of that. >> But it wasn't because you >> just one camera and an ordinary citizen and the entire system of power reacted fiercely. These this is the one that slammed me and choked me right here. >> Yes, you slammed me and choked. >> Watch how a man was stripped of his most fundamental rights just for daring to raise his camera. >> I'm not trying to fight putting your hands on. Where's my glasses? >> A man holding just a small camera. But what happened next would send shivers through the entire community. >> And they went and snatched my phone. Wouldn't give me my phone back at all. From an action that seemed harmless, a powerful hand suddenly tightened and the words, "Stop choking me," echoed in desperation. >> All right, we got contact. >> What? >> Camera? >> Yeah, I got a camera. >> State property camera. >> Public property. Don't touch my camera. >> You cannot do car. >> You cannot touch my camera. This is public property, sir. You're a parole agent. You can't grab me. >> You can't grab me. Ow. >> Go like, >> you can't do that. >> A personal vehicle. >> You're choking me. >> Stop choking me. >> Stop choking me. >> All right. >> Stop choking me. You're a parole agent. You can't grab me like that. Get off me. >> What's wrong with you? You can't grab me like that. Grab me to the ground. Put my glasses back. >> Back up. >> I'm trying to grab my glasses. >> Pop the wall off. I'm grabbing my glasses. >> You'll get it there. Do you understand me? >> Grabbing my glasses. >> You understand me? You'll get it there. >> I'm not trying to fight you. >> But you don't come. >> I'm not trying to fight you. Stop putting your hands on me. Where's my glasses? >> Back here. >> I'm not hiding you. >> I'm not trying to fight you. Stop fighting me. Call the Get my glasses. My phone. >> You can't just take my stuff. You're a parole agent. You ain't even a cop. Come back here again. >> Quit touching me. >> My house. Okay. Get out my glasses. >> Get on the ground. Get out of here now. >> You understand? Hold on. >> Okay. No. No. I need her name. I need her name. This [ __ ] tackled me. When the police arrived, would justice be served or would the cold silence reveal an unbelievable truth? >> Name? Name? >> Okay. What's your name? >> Name. Okay. These the one that slammed me and choked me right here. >> Yes. You slammed me and choked me. I >> I I can I'm not detained. I can walk up anywhere. I'm not doing nothing. You guys say >> shut the door. >> Oh, no. No. I can go in. This is open to the public. Slam me and choke me. >> You can't. >> This is not >> This is open to the public. There's public information right here. You see the police aren't doing nothing. You idiot. Dude, you can't slam me and choke. They walk right up to No, no, no. What we're doing is >> he needs to be in handcuffs. I have the film. I'll show it to you. He walked right up to me, slam me and choking me. That's it. >> I'm going to talk to you outside. >> That's it. No, no. I'm going to I'm going to film. >> Then we're Then we're going to get up on out of here. Okay. >> Okay. There's nothing more for us to do here. >> I'll file the paperwork. You're saying there's nothing more for you to do? What' they tell you? What' they tell you? >> They didn't tell you. Well, then go do your job and then talk to me. >> Well, you came in here and then he went back there. >> They don't. They've been holding me and my phone for an hour. They ripped my glasses off my face. They're probably all scratched up. They slammed me to the ground. [ __ ] choked me. Didn't even say a word. Walked right up. Slam me. Choked me. That's it. They said, "What are you doing?" I said, "Hey, I could do this." I was on the ground. That's it. started pulling out pepper spray, threatening to beat me up. Yeah, it's and it's all on camera back there. So, let's get him right. You slammed me and choked me. Is that correct? Come on. Let's get his side. >> Yep. You see how I can do this now? >> You see how I can do this? You see how I could do this? Do you see how I could do this now? >> Sir, are you on parole? >> This dude needs to be gone. California state parole. This guy needs to be gone. This is Robinson. He needs to be gone. This guy had just assaulted the [ __ ] out of me. Beat me up in the back, stole my phone. >> It ain't I didn't want a response. I just gave I just gave Martinez a shout out today in Martinez PD. I'd rather highlight police officers and peace officers. You walk up and slam somebody when for no reason and then detain them when you're a peace off. You don't even have authority to detain. While the victim cried out, "I'm reporting a crime," someone turned their back and walked away. The question remains, is this protecting citizens or a staged cover up of power? >> No, no, no. >> Talk to him. >> You're not going to tell me how to investigate. >> Talk to him. >> Talk to him about what happened. You need to get a statement. >> I I can be in there. >> Okay. >> Yeah, you can. >> This is public. >> Yeah, exactly. >> Okay. I need you to investigate to him. Investigate pictures of the cars. Whatever you want to do with public property, >> investigate. I'm telling you right now, there's you have to take a police report. There is a crime that happened. I was assaulted and battered by that pole officer. Investigate on camera and on their camera. So, I want you to go get a copy of their cameras for your police report. It was there's two cameras in the back and it happened right on those cameras. >> Okay? >> So, go investigate. >> My partner was saying, um, head on down to the Conquer Police. So now instead of the the police doing it while they're here and everything's here, they're just refusing unless I go down to the police station. >> This is a This is sort of hostile right now. I don't >> I'm asking you to investigate. There's nothing hostile. Go investigate. >> Do that right now. >> But you didn't. >> But here's the thing. >> Well, the first thing you should have done, Luciano, listen. The first thing you should have done is get me my phone so I could record and then it would have been uh uh I would have been quiet. See? Okay. I'm telling you, I'm reporting a crime. Are you walking away from me reporting a crime? Yep. Because these are this is state parole. They are walking away from me reporting a crime right now. This is conquered PD. >> After it all, there are the sweat, the wounds, and the troubling questions about freedom and justice. Could this be a wake-up call for the entire system? >> Dude, these are the most foul parole officers I have ever seen in my life. And they went and snatched my phone. wouldn't give me my phone back at all. And then the cops refused to investigate because they said, "Oh, that's what he wants. We're out of here. He was too loud. He's talking too much." So they refused to investigate me being beat up. Dude, I mean, he slammed me, choked me, detained me for an hour, told me I had to sit down, tried to make me sit down, said they were going to pepper spray me. It was to the point where I finally told him no. He tried to handcuff me, too. But I told him, "You can't handcuff me. I ain't going in cuffs." And I pulled away from the cuffs all for recording. And his reasoning was I don't know who you are. I don't know who you are. That's his reasoning. Arms man. >> The only documentation I have. >> What do you mean documentation? I need a title 15. Okay. I need a copy of your cameras. I need a copy of your Then I need a a Freedom of Information Act. so I can get a copy of your cameras. Hey, then you better figure it out. All right, I'm staying here. I I I can't even walk now anyway, so I'm staying. This is all they'll give me right here. So, she's trying to take pictures of me. Make sure that's on your uh parole phone so I can get a copy of all your records, please. Now, she's taking pictures off of her phone. They said he wanted a citizen complaint form. >> Yep. >> Citizens may sue public officials for violating their constitutional rights pursuant to 42 US Code SS1983. Individuals/organizations are required to pay damages to the injured party. Violating police officers may be disciplined, have their licenses suspended, fired, or expelled depending on the policy of the agency/ police chief. BAT was injured and had to be taken to the emergency room right after the incident. This calls for reforms in the recruitment and training processes of public officials. Up next, right in the heart of Kansas's justice center, just a small camera was enough to shake the entire system of power. >> Is grabbing the head off. Okay. Yeah. Waiting. Yeah. >> Yeah. I kind of saw you were waiting, so I figured I'd just fill you in so you know a little bit more about >> Okay. So, they're printing out the the judge's order. >> Yep. And I'll bring it up here so you can see. >> All right. Thank you. I appreciate that. Mhm. >> This is the correct order. It's just the old judge. So, I would not going to act on an order with an old judge's signature. So, >> you said that's the that's the order. Well, this is an old order, but I mean, I'm not going to act based off of this just with an old signature. >> Oh, yeah. For a judge that's not even here anymore. >> Yeah. >> Yeah, for sure. >> For sure. That's probably the smartest move you ever made. Yeah. No, I'm just kidding. But definitely. I appreciate that. I, you know, if a current judge signed it, then we could have a discussion and then, you know, whatever happens. >> Pretty much, you know, so I I get what you're doing. You know, you're out doing what you need to be doing. So, >> yeah. just out, you know, exercising my constitutional rights, sir. That's all I'm doing. >> Yep. >> The same ones. And it's always so funny to me because it's the same or ironic, I should say, because it's the same ones that each and every one of you that are looking for this judge's orders took an oath to uphold, right? So, I can't wait to see the judge's order cuz normally it's usually inside the courtroom. But even if it is inside the hallways or something, that would be unconstitutional. But we would, you know, I want to see the order first. I don't even know if it exists. So, I'm not gonna I'm not going to debate an order that I don't even know if it exists, you know. >> Well, and I'm not one of those guys who's gonna chase you around the building and try to grab your phone. >> Yeah. Yeah. Yeah. And I Yeah, we could deescalate. Exactly. There's There's no need for it to get out of control. You know, I'm not obviously a threat to you or anyone here. You know that. >> You know. >> Okay. >> So, thanks for your patience, Sean. >> Sure. >> Obviously, I understand you were standing up here for a while. >> Yeah. Um, so we have a signature from Judge Kelly Cornney, division 2. That courtroom right there, signed today. Courtroom local rule one, that's the one that's posted on the doors that says recording inside the judicial center is prohibited without prior permission of the court. This includes audio and video by any means. According to this, this does refer to the whole building, including the hallways. Just moments ago, a paper was hastily signed. But does it have the power to stop a citizen's constitutional rights? >> Side of the spectrum is we do have a signed judge's order saying that we're courting, which is why you're asking me. >> So what you're basically saying is that a signed judge's order is more important to you than United States Constitution. That's what you're saying, Deputy Coleman. That's exactly what you're saying right now. >> You're putting words into my mouth. I'm saying that in this building, the judge signed an order. The judge has perview of the area of the courts and they're saying no recording. That's all I'm saying. I'm not talking about your your first memorized. I understand you want to start those and I think that's great. I mean, I really do. Not even speaking from the uniform, just from me. I think that's great. But right now, the judges say no recording in this hallway. >> Yeah. >> Now, that doesn't mean you can't go up to the second floor of the sheriff's office portion of it >> or talk to the AA and, you know, let get get an okay for recording. But, >> I don't see why I would need an okay to exercise my rights. I I don't I don't I wouldn't need one. Why do I need someone to tell me, "Okay, you're okay to exercise your rights now. You're cool. You're good to go. Exercise your rights peacefully when I've been doing it for the last 30 minutes while I'm waiting for you guys to have this order signed." And there's been no interruption in court business. No problems. I don't understand. That's why I'm saying that I'm peacefully exercising my rights peacefully. Key word is peacefully. And now, because you have an order that you just got signed right about 5 minutes ago, you had it signed. Now, it's you're going to be held in contempt of court if you don't stop recording. So, it was a signed order before a >> copy of that, >> but it wasn't because you it was just signed the >> Okay. Just cuz we didn't have a signed copy to give you at the moment doesn't mean it was not a signed order by the court. All the local courtrooms are available online. I mean, that's >> Yeah, but I mean there was no signed courtroom court order until you went and go got it signed from this judge over here. I literally watched her bring the paper over there and have him sign it. >> In the courthouse hallway, two choices were given. leave in silence or face the risk of being handcuffed on the spot. >> How are you? >> Good. >> Were you asking for a supervisor? >> Are you supervisor, sir? >> Yeah. >> Okay. >> Yeah. So, I was just threatened to be arrested for just I'm not causing a disruption. I have the the memo here. It says interfering with the um an officer. That's what he said he would arrest me for. The deputy downstairs. I'm not causing any disruptions. I'm doing anything. Simply recording peacefully my first amendment right, freedom of press. That's it. So, I don't understand why I had to be removed. >> What do you got here? Can I see it? >> Yeah, sure. It's an internal memo that they gave me and they had a judge sign it. >> Oh, >> that's not a court order. It's just a judge signing an internal memo. Apparently, a Dale, a sergeant, said that he dealing with First Amendment auditors. >> Okay. I wasn't aware of any of this. >> You're going to be held accountable for your actions. I promise you that. That's so sad. You had an internal memo signed by a judge. >> The judge is asking that >> for what? >> In the court section. >> But for what? For what? >> Am I disrupting anybody? Am I disrupting anyone? >> Sheriff side of the building, but >> I'm not inside the courtroom. >> Yeah, but I'm not in the courtroom. And I didn't want to go. No, but I'm not I'm not disrupting any business. I gave it I gave him my copy already. I'm not disrupting any business. I'm not interfering with your carrying out your duties. I'm not doing anything anything illegal. Anyway, I'm I'm documenting for the public consumption as a journalist. When the commanding officers arrived, tensions reached their peak, but the final decision will surprise you. He gave me an internal affairs packet to fill out. I'm also going to be getting the body camera footage. If you don't see it on this video, it's because I didn't get it yet, and I'll upload a different video once I get it. We'll get the body camera footage. And I can't believe they gave me this internal memo. This isn't a judge's order. This is a memo from a tyrant officer, Sergeant Dale. The auditors in this video are out of control with their contempt and disruption of the court proceedings. It would take me 30 seconds to tell this person that they are in contempt. And if they don't stop the behavior and apologize, they will do a 24-hour sanction at the county jail. If they don't comply, I would direct their arrest. This is not even a close call in my mind. So, instead of having a positive internal memo about First Amendment auditors and how to deescalate, you know what's funny? I have not seen not one mention of deescalation. I'll put the memo up on my community feed so you guys can see it if I haven't already put it up already. We're going to be getting out of here. Have a good day, Deputy. Take care. >> I'm on my way out. >> I hope that you learn some deescalation techniques. Truly, I do. Not just for your safety, but the safety of the public. That you identify yourself properly. >> Sure, >> as is required under your policy. Deescalation works wonders. This didn't have to come this far. >> And when it was all over, the biggest question still echoed. Freedom or power? which will prevail. Shawn left the courthouse without being arrested, but the incident exposed a lack of transparency in issuing orders that restrict citizens rights. Kill me. Show my son. The man screamed in despair as he was forced to the ground. But who was really losing control here? >> Hley, get off the steps. >> Look, man. >> Would you get down the steps and calm down? You going to pull that be? Why don't you come down here and tell us what the problem is? You're not going to listen to what I'm saying to you. And you going to listen to that radio, then be honest. Be honest with yourself before you tell Hio. Before you talk to him, see how I listen to him. He's not being honest with himself. I'm not dropping. >> Get out here. If you going to kill me, kill me. >> Somebody want to kill you. Get down here. >> Tell the truth. >> Get down here. If you want to shoot me then kill me then cuz he's being disrespectful. I'm talking to you sir. You came up honest. He's being disrespectful sir. I'm trying to be honest. I'm not a 13 sir. I'm not a 13 sir. I'm not a 13. >> I'm not. Listen. Listen to me. You're touching me. If you touch me I'm calling police. No touch. Don't touch me. Kill me. Relax. >> Kill me then. Tell my sons you going to kill me. Show my son you won't kill me. Show my sons you won't kill me. Show my son you kill me. Tell my Tell my bro. Tell my sergeant. Tell my bro. Tell my set of cups on them already. I never Okay. >> Amid the repeated apologies was a groan. I can't breathe. Was this a belated apology or evidence of a serious police error? >> Yes, sir. >> I can't breathe. Yes, sir. >> Yes, sir. >> Yes, sir. >> I can't breathe, sir. Yes, sir. I I apologize, sir. I really can't breathe. >> I really can't breathe. >> It's over. >> I apologize. >> Now listen. Relax. I need you to listen. >> I need you to listen. >> I really can't breathe. >> It's over. I won't I won't send your knees up your chest. Yes, sir. >> Yes, sir. >> Conduct. >> It's okay. Hey. Hey, Sergeant. >> Hey, just stay back. Just stay back. Tell the truth. Tell them the truth, Sergeant. I apologize, sir. You was right. I want no problems. See how my sergeant is. I'm in the military, sir. I'm not trying to cause no problems. I don't want no problems. Sir, my pocket is not having nothing on me, sir. >> All right. No, sir. I couldn't breathe. I'm not injuring you. >> Yes, sir. >> Yes, sir. Got it. Yep. >> Okay. Can I get my phone? >> I'm not saying he's a bad guy. >> I don't have on me. >> Nobody said you did. >> What the I'm not a bad guy. We all in the army here. >> I don't care. >> I don't have I've been in the army. I'm about to hit my 13th beer in the next month. >> Why are you over here? >> Because I got his three kids in my car. >> Okay, we're doing something. >> That car right there. >> I'm going to playing, man. >> I'm not playing. I got his three kids in my >> right now. >> I had three kids in the car. Another soldier stepped forward trying to calm the situation, but instead of listening, the police officer became angry. Why was a person who helped treated like a troublemaker? >> Listen, why does this have to be a power struggle? Listen, I got his three kids sitting right there in my car. >> All I'm trying to do is talk to y'all. >> Listen, stop. I got it. >> It disheartens me. >> It's going to be my 13th year next month. Listen to me. >> 13 years. Air Force. >> It disheartens me to know that a service member doesn't understand when the police just got done fighting with a guy in the front yard. I didn't at all. So, we get done fighting with somebody in the front yard. We're trying to get them out to a cruiser and and put away. When we come up, he's completely will not listen to us, will not comply with any orders, will not talk to us, >> and just keep yelling. Okay, so that's the situation we're at and he's under arrest. So, we go grab his arms, he tenses up and says, "I'm a demon. I'm a demon." >> And we were talking in the kitchen and the whole time we were talking, I said, "Hey, man. So, you met him tonight? >> Yeah. >> And you wanted to vouch to the police that he's a good guy when you don't know him. >> So, we going like we going to play this good guy, bad guy. >> No, I'm just saying you know he's a good guy that you don't even know. >> Fair enough. You know how hard it was for me to get into the Air Force and I did my first five minutes. >> It took us for 5 minutes for me to explain to you what I went through. >> So, why are you going to waste it not listening to the cops? >> It's not a waste. >> It is. Because every >> dude, all you could have done is >> it was only when I put on my military license plate that they stopped stopping me without cause. Confessions of a soldier treated like a criminal. But is the title of veteran still valuable in the face of prejudice? >> I'm not a racist man. I'm not I just I had no chance to experience like >> Okay. So, how does that affect what happened tonight? >> Because you look at me as being an aggressor and I'm not. >> Oh, I just look at the >> Hey, listen. Hold up. I'm close. This is a reasonable conversation. >> Oh, you want you want I can take you out of cops. >> Step up. >> I don't care who came walking up yelling and I've got about 20 officers around here that have worked with me for years that will tell you the exact same thing. I don't care what color your skin is. I'm not going to deal with it. You saying that just you're profiling me cuz I'm a police officer. Cuz I'm a police officer. I I have to be racist, right? Is that what you're saying? Cuz I judged you as the aggressor cuz you came walking up and you're black, which has got nothing to do with it. >> I never even went that far with it. >> Hey, explain to me what you meant then since we're talking and we're going to hash this out. Explain to me what you meant. >> 13 years of being in the military. Let me search the car because let me see if there's some drugs in the car. >> Okay, let's be fair. >> You just asked me to explain people thought I and I went to school to be a pilot at Kent State. >> Have I ever given you a ticket? >> I don't know. I've been pulled over by so many police officers. >> I haven't. Let me make that clear. I have never pulled you. >> The coercion, trampling on the right to breathe, and failure to render first aid when the detainee said he could not breathe likely violated the fourth and 14th amendments of the US Constitution. The veteran later filed a lawsuit against the police force for excessive force, seeking damages and seeking liability. When power is granted without oversight, abuse of authority can creep into every courthouse hallway, every seemingly small decision. Hey everyone, what do you think about this situation?
