Look, there's the tire marks there. There's the truck. >> Not in my face. I'm not There's only one thing we ask of you. Under your roof. >> What's that? >> That's all we want. >> If you're carrying a firearm in those areas, >> you will be detained and cited. I don't think the state statute actually says this particular percentage. But >> what seemed like a simple video instantly turned into a battle between civil rights and authority. >> Which box are we talking? >> The black one's right there. I honestly >> You're fine. Right there. >> The time is a misdemeanor. still. >> So, it was kind of like a discretionary. >> One step into the Department of Labor and it instantly turned into a heated confrontation. Tension erupted the moment we walked in. All because of a camera. Staff questioned us non-stop [music] while security scrambled for instructions. >> So, we're talking about a foot. If you're trying to preserve evidence, you have to put up crime scene tape. But the big twist came when the cameraman stepped into the back elevator and it took him straight to the third and fourth floors. Hey sir, you're actually in the scene now. So back up. >> I'm on a scene. >> You're in the scene. >> I don't see any tape. >> I'm asking you to back up. You can film all you want, but you're in my scene. Okay. You can't be in my scene. >> I'm not in your scene. >> Yes, you are. >> I'm giving you Look, there's the tire mark there. There's the truck. >> Not in my face. >> I'm not getting in your face. I'm asking you to get the skid marks that you just walked over. >> So, where would you like me to stand? >> Stand right there on the sidewalk. >> On the other side of the skid marks. on the side. >> There's skid marks. See those skid marks? >> That's part of them. >> I don't see them. >> Why don't you guys just do your job and let me do >> We're doing our job. You're standing in the middle of a crime scene. >> Crime scene. >> There's a crime scene. >> Yes, there is. >> So, we need some yellow. >> I'm going to tell you one I'm going to tell you one more time. >> One more time just to move over to the other side of the sidewalk. You can film all you want. >> But if I refuse to move, then what happens? >> Then I'm going to arrest you for being in my crime scene and interference. >> Okay. Simple as that. >> Thank you. Thank you for saying that. >> Just stand on the other side of the marks and you'll be fine. >> Which marks are we talking? >> The black one's right there. >> I honestly You're fine. Right there, actually. Right there. So, you want me to back up 18 in? You're on the path. >> Just on the other side of those skid markers. >> No, now I'm standing where you wanted me to stand. So, why don't you go create some privacy for yourself and have your conversation? >> You maybe backed up a foot. Ego tricks, man. That's what >> The tension exploded when an employee rushed in, got in his face, even reaching toward the camera while Bat was simply standing in the hallway. That's why you guys get yourselves in trouble. People are watching, man. So, I was standing right here on this line and he wants me to stand right here behind this skid mark. So, we're talking about a foot. If you're trying to preserve evidence, you have to put up crime scene tape and create a scene. It's >> the way it goes. I'm standing on a public sidewalk. So, we have Iowa State Patrol vehicle 118. Then we have Davenport 001, 805, and 807. >> Okay. So, >> this is Officer Gillespie. >> What? Yeah. >> Okay. You want to start all over again? Just be cordial. I'd be happy to do that. >> Okay. So, here's the deal. >> Okay. So, what is this? >> Officer Gillespie. >> What? Yeah. >> Okay. You want to start all over again? Just be cordial. I'd be happy to do that. >> Okay. So, here's the deal. The crime scene starts actually in the street and then the the black marks up there are part of the crime scene. So, we're getting that taken care of. >> Okay. >> Um once she takes photographs, you guys go as close as you want for example on your >> Yeah. No, I just Yeah. I didn't know exactly where I mean how far out it started other than the black marks on the sidewalk. So, we're good. >> And I thought you were just giving me a hard time to get me. >> Police arrived and were instantly pulled into a legal showdown. One side cited the law, the other cited policy, and the entire building seemed to come to a halt as the debate erupted. >> She is done taking photos. Uh >> well, once you guys are done, we're out of here. >> Okay. Well, we're just waiting for Freds and her to take photos and then then you can film whatever you want. But how do you uh pronounce your last name? Just so I >> It's Gasp. >> Gasp. It's with an A. >> 709. >> 709. Yep. Thank you very much. See, I appreciate that. >> Yeah. >> And just there's only one thing we ask of you. Honor your oath. >> What's that? >> That's all we want you to do is honor your oath. Yeah, that's what I was doing. >> Defend the Constitution. No, I'm not saying this. >> Absolutely. >> Okay. >> Absolutely. >> That's all that's what we're out here for. That's what we're doing. >> I know. I know you didn't ask, >> but Well, you have a right to film me whoever you want, right? So, >> but you you have a right to ask. >> I knew what you were doing. You're filming. I just didn't want you in the crime scene. That's the only thing. >> Okay. So, your crime scene is still on the on the outside of those skid marks. >> On the outside, I don't see any skid marks. I'm concerned with where the skid marks started, where the truck jumped the curve. >> Step on the skid mark. >> Exactly. Until she's done, cuz I didn't know exactly what we had on this end of it. So until that until that time it's it's all a crime scene until we can shrink it. >> BAT was issued an indefinite trespass from a public building despite committing no crime. A highly controversial decision that could spark a lawsuit shaking the entire city of Boisey. >> Communication solves a lot of problems. >> I agree. >> And there's a huge divide between law enforcement and the citizenry these days. And what we're out here doing is trying to close that gap. >> We want to communicate with you guys. We want you guys to communicate with us. We want you to respect people's rights. We want to respect what you're doing. >> If everybody did that, it would be much. >> And here's the only thing I would ask that that when we when we ask, "Hey, can you step back just a little bit?" We'll explain it to you eventually. But if we've got a crime scene and we're trying to deal with a witness, we have a suspect that's over on this side dealing with other officers. Can we just say, "Hey, can you step back a little bit?" I don't care that you film. I really don't cuz we're filming, too. But the thing is is until I can figure enough information ascertain how far back the crime scene is, that's all we ask. Then we can come back at a later time and explain to you why we did what we did. Fair enough. Is that fair? Now, just so you know where I'm coming from, I have had we've been doing this for a very long time as my son, >> okay? >> And I have had numerous countless officers give me unlawful orders for no reason, just because we're on an ego trip and they want to tell me what to do. >> Okay? And you do what you need to do, okay? But just give us our space to investigate. >> I think you can understand why we don't always just give blind trust to law enforcement. >> Well, and I I think you can understand why we don't always just explain everything that's going on course at the same time. >> Oh, you didn't have to You're not obligated to explain anything to us. >> I'm not, but I'm taking the time right now to do that. And I appreciate that. Yeah. Yeah. So, I think I think we're both going to walk away a little better from this. >> Agreed. >> Maybe maybe we'll both think a little bit more next time. >> Definitely. >> All right. Definitely. >> Have a good day. >> All right. >> All right, guys. So, we said there's a suspect over here. I think we've gotten pretty much everything we need here. They're going to take some crime scene photos. Um, you know, had a little conversation, meeting of the minds. Maybe that uh maybe that'll inspire the officer to think, maybe not. Definitely. Uh I try to use everything that happens to my advantage. and uh you know of course going to rerun how I handle things and what I did and uh you know see how I can improve what I do for the next time. point of these audits is to for for the point of the way we do things is to open up dialogue, communicate, and have that conversation we just had. Whether or not it goes anywhere, I don't know. But if I have to have >> citizens may sue public officials for violating their constitutional rights pursuant to 42 US code SS1983, individuals/organizations are required to pay damages to the injured party. Violating police officers may be disciplined, have their licenses suspended, fired, or expelled depending on the policy of the agency/ police chief. BAT stated he will file complaints against the officers and pursue a federal civil lawsuit. Up next, the moment we stepped up to the federal gate, a single camera was enough to trigger a security alert. >> City Police Department and this is vehicle T77. your information while you're out and about if you go to a city park. Okay. >> Say it again. >> This is from the mayor's office. So if you go to a city park, you might want to read that. >> If I go to a city park. >> Yeah. >> Okay. >> So just take it's just just paperwork for you. Nothing. >> So just give me like the the quick rundown. What's the >> city park, city property, which includes Civic Plaza. If you're carrying a firearm in those areas, you will be detained and cited. >> Okay. >> Okay. And then your firearms tag for evidence. >> That's standard. What what would make you tell me that? >> Because we've had because this is now being enforced basically during all the protest aspect. >> Oh, I got you. >> I didn't want you to go over there to the city plaza. Okay. >> And have an officer stop you and not know what's going on because this is recently being publicized by the mayor's office. >> And what is it prior to this? You were not enforcing it. >> Prior before that, the mayor's office wasn't having us enforce it. There is a state statute. It's 30- >> usually in most states. You can't go into parks with a >> you cannot most places, but it was being It was a the time was a misdemeanor. Still is. >> So, it's kind of like a discretionary thing, >> right? So, but now they're requiring to be enforced, especially in the business areas as well as the city areas. >> I got you. >> I just want you to get blindsided by an officer. >> No, I appreciate that. >> Not physically. >> The conversation shifted fast when federal police demanded ID and the reason for filming, but the citizens response is what suddenly flipped the entire situation. >> We're This is my son. >> Hi. >> Uh his name is Jason Ben. >> Hello. Um, and what has been happening here now? We're just traveling around the country. I mean, are you guys seeing an uptick in crime or things like basically businessual information officer? So, I can't give a a statement to the department. Um, if you'd like, you can reach out for our PIO. I just saw that you were carrying a firearms, which is legal, but I wanted to make sure you had a copy of that in case you were new to the neighborhood or wanted to go by a city area such as Sim Plaza. Okay. I didn't want you to get >> No, I appreciate that. I didn't Thank you for that. >> I can't really say much else. >> Okay. Now, let me ask you another question. I just cuz it's a little confusing uh as far as going into a restaurant. >> Okay. >> My understanding is is that there's a certain percentage of hard alcohol sales or something. >> The >> there's a line there. >> I don't think the state statute actually says this particular percentage, but a business has to have the primary income from food. I'm talking about it like going into a restaurant. Okay. >> The majority of their income has to be from food services. >> Even if they sell hard alcohol, >> right? Okay. So like you can't walk into a liquor store or a club, but theoretically you're allowed to go into Texas Roadhouse. >> So yeah, so if I'm in a restaurant and I'm sitting down a table eating, even if they serve hard alcohol and there is a bar, it doesn't matter, >> right? But again, also if you're open carry, it's subject to the establishment's rules and regulations. >> And I understand that is enforced here in New Mexico. >> It is. Okay. So >> tension spiked when the officer mentions scouting and security threats, but the citizens struck back with constitutional rights, stopping him in his tracks. >> Trespass. So we show up, you're asked to leave. If you refuse to leave, you're detained for criminal trespass. You're giving us >> Oh, I got you. So you guys, so if the restaurant asks me to leave or the business asked me to leave and I refuse, let's say, you guys would show up and then ask me again to leave. Yes. And then at that point, if I refuse your request, then I >> Gotcha. But is that an O light flashlight? >> Yes, sir. Awesome. But I'm actually a uh affiliate of theirs. >> So am I. >> Yeah. Are you? >> I'm a big fan. So >> No, no, but I actually Well, I work with them. >> Oh, I'm not I have I'm an affiliate like by code. So like I give it to my friends. >> You know what? I'm Oh, so you do have a discount code? >> I do have a discount code. >> Okay. I was going to say I give you mine cuz you were so nice to us. I was going to >> No, I I love it. I really want their new the It's like the Marauder X9. The the one that's like >> I I have the size of a Coke can. >> I have the X7, which they don't make anymore. I really want the X9, but I can't bring myself to spend 600 bucks yet. >> It's a lot of money. Yeah. You know what's great about the X7 I like over the X9 is there's no USB plug, >> so it's completely sealed. >> Yeah. You don't have to worry about any water, >> right? >> But I don't know. I I'd use it for a search light for work. So, >> yeah, of course. Yeah. >> You'll have to excuse me. I do have a rest. I have to finish paperwork, but I just wanted to give you that. >> I appreciate you. Let me know. Thank you very much. Have a good day. Stay safe. >> Take care. >> Suspicion quickly turned into a heated clash over press freedom. One side fearful, the other firmly defending their rights. The tension at that moment was at its peak. >> All right, guys. Well, that was Officer Faulner. And um you know, that's a that's an example of a uh good police officer from what I can see. Um, you know, I really don't know what his whole uh situation is beyond this little twominute conversation we had, but uh, you know, I'm carrying my personal protection device open. And, uh, he wanted to make sure that I knew, uh, what the rules were. So, I appreciate that. He actually gave me a copy of the rules, um, about public parks and that kind of thing. So, I'm going to read through this. I appreciate that. You know, we like to recognize the good guys. Uh we're not just out looking to give these guys a hard time. Uh we love giving them a hard time if they give us a hard time. And uh those of you who know my channel know that uh that's what we do. But uh good officer deserves to be recognized as a good officer. And in this case in these couple of minutes, I think we can say that about officer Faulner. So, you know, uh, if anybody wants to, uh, call the Albuquerque, uh, New Mexico Police Department, I'll put the number in the description and you can let them know what a good guy so far, Officer Faulner, uh, or how he came across today. Um, but anyway, that's going to wrap it up for this one. I just want to remind you that if you guys appreciate what we do and you like these videos, uh, please feel free to like, share, and subscribe. uh helps our channel out tremendously. Doesn't cost you a penny and uh gets our videos out to more people and uh we appreciate that. I'd also invite you to do the same for watching the Watchmen. Uh his channel's doing great. He's putting a lot of work into his videos. Uh there's a lot of information, angles, and commentary and things you won't see on my videos. So, check him out. I'll put a link in the description to his channel as well. Uh for those of you don't who don't know, he's my son. Um so, I'd love you to go check out his channel and support him, too. Um, but that's going to wrap it up for now. We're right across the street from the uh Fernal Leo. >> Just when the argument seemed ready to explode, it took a completely unexpected turn, leading to an unpredictable ending between the cameramen and the federal officers. Next, a police chief claims he only drank after the accident, but the strong smell of alcohol makes everyone question it. >> Last night or anything? Uh, last night I drank at the uh, cabinets. >> Where's the vodka bottle that you were drinking? Is it up there? >> Vodka? >> What started it? >> He admitted I knew I was done [music] for, even as witnesses contradicted his testimony. >> I don't know, dude. Like I got to do the investigation and cuz they are saying, dude, we got witnesses already saying that you were hitting the guard rails and stuff back there. >> [ __ ] >> We got all these witnesses. >> Anybody even behind me? >> Well, I don't know. Honestly, I'm going jail today right now. Probably, dude, to be honest. So, we got all these people. >> I drank alcohol after I crashed. >> I know, but we got witnesses saying otherwise. I mean, >> what witnesses? >> I don't see anybody. [music] We have enough witnesses to say otherwise. And I'm not trying to be a jerk. And maybe it would be different. >> Where would I been just rubbing the >> Are you on any medication or anything like that? >> Uh at night time I'm on. >> Were you drinking at the lake at all last night or anything? >> Uh last night I drank at the uh cabinets. We have six cameras, GPS, and dash cam. But instead of clarifying the truth, the police officer asked, "Do you want me to take you home?" >> Well, here's the thing. I drank [music] after I after I crashed. >> Okay. I still have to ask all the witnesses and everyone who came here. Where's the vodka bottle that you were drinking? Is it up there? >> Vodka? But you said you chug vodka after the crash. >> Yeah. I don't know, bro. >> I'm not trying to pick on you, man. I got >> Today's my Friday. I don't want to do this. >> No, you're not. >> Come on. My life >> is over. >> I wouldn't say that, dude. >> It is. >> Are you going to perform some tests for me or no? Tell me what to do. >> What? >> Tell me what to do. >> Dude, I'm I'm bound, man. Like, as >> I know you're bound as >> dude, it's like as far as like me, dude. We have like six cameras on video, GPS, two GPS. Yeah. I can't I mean, I'm All these guys are here. Like I I I'm >> I'll do the tiff. >> You will? Okay. I have to get on flat ground. I want to give you the best chance you can do, dude. I mean, I'll have to get on flat ground. >> Okay. Well, we'll I'm going to get on flat ground and then we'll get a we'll get a witness there and then we'll give you a fair shake and I'll get on as fat flat flat as possible. >> If you blow the [music] blood pressure below the threshold, I will just sign a light ticket and take you home. A suspicious deal right at the scene. >> Let me ace these tests, dude. Kill them. >> Henry, >> do good on them, dude. I mean, it's not like I want to make stuff up. I don't want to I don't want to dude. Today's my Friday. I don't want to do all this paperwork. >> Here's the moment. >> Do you want any of those people call her that actually know her or No, >> let's do the test. >> Okay, we can do the test first. I got to find Well, first we do this uphill is going to jack. We got to hit flat. We >> came back down. >> Yeah, >> they're all with her. I got these sandals on, but >> probably can still do what I need to do. >> I could do it on that dirt road that they're blocking off. That way we're not in the way. Let me get this. You're good. Oh, you're good. We're not getting out yet. Hey Cindy, will you move your truck so I can get on this dirt road? >> What's up with it? >> I'm not [ __ ] up. We We literally woke up and then we wanted to go get stuff to go back to the cab. >> Dude, I'm not arguing with I'm not saying >> I mean No, what I'm saying is like like we woke up and it's like so you get [ __ ] plowed before you can go get your gear. We We realized we were going to stay another day. Uhhuh. So it's like better just hang out together. Spend time with my daughter. It's all I got left. I lost detective sergeant. I lost $20,000 in pay [ __ ] Whole bunch of hits, man. >> I assure you I am no longer the chief of police, but no notice of dismissal was issued. Little under what? >> 1,400. What? >> Uh, well, I won't charge you a DUI if you a little under >> cuz I process your [ __ ] really fast, >> dude. I'll just I'll have to I'll sight you [music] for PI and then I'll just take you home. >> Lost my job, though, too. My whole life. Do you know what started all this? >> The divorce, probably. Maybe. I'm not sure. Dude, let me let me talk to Seven Star. >> I'm all ears, bro. I don't I'm not trying to be real. I promise I >> Sorry, dude. I didn't mean to be rude. >> This is not something I want to do. I really just wanted to have a quiet Sunday, man. >> And I'm disturbed that. >> It's all right, man. Just part of it. What started it is ranking up. >> Yeah, Mike's wife. She started to look jealous. Where are we supposed to be? Should be >> in the state of Oklahoma. Violating the rules of office is considered a misdemeanor. Penalties include fines ranging from $100 to [music] $1,000. Immediate dismissal upon conviction. >> Key to that cap, >> that the red tag one. >> Yeah. Well, I don't remember what code it was. Give that to Samantha. >> Uh-huh. >> And let him take everything out of there. >> Okay. I have to do that. Have your phone or anything in the car? >> No. Why? >> Okay. I'll just make sure. I don't want to get towed for your gun. >> I need the chief's phone handed off to Andy. >> Okay, I can do that. >> Cuz I guarantee I ain't chief after this. >> Oh, it ain't over. It ain't a thing. >> All right, brother. >> All right, just get that cheese foam and and let Lindy tell you everything that needs to come out of there shows up. Just let get everything out of it. >> I can do that. >> All right. Thank you. >> Yes, sir. >> The police did not apply strict procedures [music] to handle a law enforcement officer who broke the law. Morrison declared, "I am no longer the chief of police." But there was no formal notice of dismissal or [music] suspension. The gentle handling, negotiation, and sympathetic language from colleagues [music] raise suspicions of abuse of power and favoritism within the department. In a civilized society, citizens have [music] the right to hold public institutions accountable, and law enforcement must uphold and respect that right even more. Hey everyone, what do you think about [music] this situation? If you enjoyed the video, don't forget to like, subscribe, and support us with a donation. Thank you so much. [music]
