What are you filming? Anything I can see from public. Right. You won't see your ID if you want to be that way. Do what? >> You have to show me your ID. Just because of a camera, the police demanded identification, but shockingly, no crime was ever stated. What would you like my details for? Because obviously in the interests of public safety and everything like that, when somebody is out filming and having a look around public building. Let's get a supervisor out here. You need reasonable articulable suspicion of a crime. You need reasonable articulable suspicion of a crime. When police cross the line, that moment can turn into a million-dollar lawsuit. A citizen stands in a public area outside a police station and government buildings, but what seemed like a lawful act quickly spirals out of control. Civic enforcement for those who don't know. Um Traffic wardens, dog warden. Basically, any anyone employed by a council. And this would be where they're based, let's see. Social services in. This is the drug alcohol action team. Oh, and the police station here. And there's one of the wardens there. So, wide variety of services. >> Says Also that's yeah, that's the police station entrance. Drug and alcohol action team is offending. Civic communities. Hi yeah. What are you doing? I'm just filming. Oh, what for? I'm just filming. Any anything I can see. All right. Okay. Okay then. All right. Do you work for the Is it Civic Enforcement? Is that like traffic wardens and dog wardens? It's We're not wardens. >> Right. Same job role. Well, no. We do a multitude of things. We do fly tips, environmental crimes, abandoned vehicles. >> All right. Parking yes is one of them. Right. Okay. Excellent. Thank you. Everything started off normal, but within minutes the atmosphere changed. Simple questions turned into suspicion. And then an unexpected demand was made pushing the situation into a tense confrontation like never before. Which was central I believe. Which was quite good of them. Are you going to be okay? No, not at all. Thanks. I'm just wondering what you're doing. >> I'm I've just explained to one of these Civic Enforcement Officers I'm filming. What are you filming? Any anything I can see from public. Right. And is there a reason behind that? >> Um it's for a story. Right. Okay. Can I take your details please? >> Um what what would you like my details for? Because obviously in the interests of public safety and everything like that when somebody is out filming and having a look around public buildings we have to a duty of care Right. >> you out. What a duty of care to whom? To the general public. >> I'm part of the general public. >> Yes. I don't have to give you my details, then. Right, I can just get other people Well, other people still I'm still not obliged to give you my details. I'm asking because I at the moment I don't know whether you are committing any criminal offenses in this area. >> I'm certainly not. This gentleman is out filming and is pointing up looking at all the cameras and obviously in light >> the cameras up there? In in light of I'm not filming that. I'm filming up there. I was filming up there when this lady approached. What's what's the issue? >> I'm There isn't an issue. I'm just wondering why he's filming public buildings. Yeah, why are you filming up there? >> I'm perfectly entitled to to to film anything I can any Wait, hang on. Wait a minute. I'm perfectly entitled to film anything I can see from a public place, including council buildings that are owned by the public. Okay, we have concerns about public safety. >> concerns are? We don't know who you are and what it looks >> It is. >> It isn't. And this in the day and age that we are in >> I Are you Are you accusing me of being a terrorist? I'm not accusing anybody of anything, but >> have reasonable suspicion to believe that I'm up to anything other than I don't know what you are up to. Go on Google. Google filming in public. It'll tell and even legislation. >> what I need to do. >> Right, well well well, don't tell me that I need to give my details when I know that I don't. As the demands became more confusing and increasingly pressuring, the man held his ground. But it was clear the situation was heating up by the second. Then, everything suddenly escalated. New justifications were introduced, but were they truly lawful or just a pretext for a controversial action? I replace it wise. You need a section 60. You need a sec to to to remove somebody from an area without probable cause you need a section 60. Well, I'm concerned for public safety and what you are doing in this area. >> told you what I'm doing in this area. Well, you need to move away from here now. >> Right, well I'll move to the other side of the road, if that's all right. You've obviously got nothing else better to do with your time, have you? Well, well, that's not your concern. What what I do with my time is nobody's concern but mine. Fair enough. Okay? Can I ask you to identify yourself? You haven't got any uh numbers on your epaulets. 1,000. 1,000. And name? Sarah Bainbridge. >> And yours? 2629. You're also on body cam. Yeah, that that was fine. Um and you're based here? Yes. Yeah, excellent. Well, I'm based out of Darlington. Right, okay, excellent. Hello there. Hi yeah, you all right? >> Hello. This gentleman is filming. He's now refusing to give any details and I >> I refuse to. >> Uh I can't understand why he's out filming um buildings, council buildings, refusing to give any details in light of the incidents that we're having around the area at the And and those in- incidents, whatever they may be, no concern of mine, nothing to do with me. >> who you are and I can't check you out. >> Well, you don't need to. Yes, I do because I have a duty of care to the >> you what it is, right? It's anti-terrorism. Uh there's no terrorist there's no terrorist threat at the moment. >> I don't know who you are. >> do you mean there's no terrorist threat? At the moment, we're still on high. There's no terrorist threat at the moment and nor has there been over the past 5 years towards any public buildings any public buildings >> lie cuz there was one yesterday, actually. What's that? Well, I wasn't aware of that. Where was that? So, we don't know. So, here? Yes, it was, actually. It was one of the council offices, as well. Right. In Darlington? By an unknown male. Right. It was a bomb hoax yesterday. >> Was it? At 11:00 yesterday uh so, yesterday morning. Right. An unknown male at one of the council offices for us that could possibly be you. Right. Well, that's not that's nothing to do with me, no concern of mine. >> How do we know Right. Well, were they were they were they still outside with a mobile phone? Look, I'm not we're not getting into this. I am now asking you to leave the area because I feel that you >> On on what grounds? Because you are alarming the public. >> W- Which section of the law? You give me the section of law, I'll quite happily move. You just need Uh uh beg your pardon? I'm just a I never said one word. Tensions had now reached a boiling point with neither side finding common ground. Arguments were made, but no one was willing to back down. Yet the most shocking part was still to come as this confrontation entered a new phase where boundaries began to be tested more clearly than ever. tells and I quote My right so >> happy that there is no My details My details won't give you any other information. I would like to check you out so that I am happy that I can leave you unattended on site on site. >> You've got no You've got no You've got no actual reason other than curiosity as to why I'm filming to be to be stood here asking. >> who you are to make sure I don't have to identify myself and you you're well aware of that. I know the law just as much as you. >> shortly I will for to prevent a breach of the peace. You can't prevent prevent a breach of the peace if none was going to take place. I'm not breaching anybody's peace. I have colleagues and members of the council staff who are very concerned about why you are out here filming in light of the incident I'm filming a story. I'm not filming in light of those incidents. Those incidents weren't even known to me until you made them aware. or negate either way all I want is your details to make sure that no members of the public are of threat to you. My details wouldn't give you any more information about that. People tell me every day how good they are. I'm I'm I'm not saying I'm I'm not saying Hang on. I'm not saying I'm good. What I'm saying I'm not denying either way. Everybody says every time all the time with interactions with the police it wasn't me. That's because That's because your interaction instead of instead of accepting what I'm doing is perfectly legal is to state laws that don't exist. Say that I You cited a law that doesn't You You told me that you were going to move me. You can't move me without that section without the powers under a section. I have reasonable grounds to believe you If you're asking me to move Yes. Right and you can state me a section of the law, I'll move quite happily. Quite that's perfectly reasonable request. >> It's fine cuz we've got supervision coming in. Right. If there has been If there has been a threat a threat yesterday of some sort, then yes, I can understand. But but I wasn't aware of that until you told. The argument was no longer just a back and forth. It had turned into a tense confrontation over rights and legal boundaries. Then an unexpected development emerged making everything even more unpredictable. Was this a turning point? Or just the beginning of a much bigger issue? Based on the current threat levels and the incident that happened yesterday could have ended up getting seized, okay, under the terrorism laws, okay? >> Your body cameras will also be made public knowledge to me and I'll use that. >> That's fine. I just I want to know >> I just can't see why you're being so obstructive with your phone. >> at all. And what applies? Uh no, there's there's no obstruction because I'm not obliged by law to give you unless you reason Unless you reasonably assume I don't need to because it wouldn't go to court. You would you'd be looking at a lawsuit. >> You're being obstructive. I don't care. I'm not being obstructive at all. Refusing to give my details when being asked is not an obstruction. You've asked for our details, okay? Because I'm as as a member of the public and and you've been civil you're you are legally obliged to give me those details upon request. >> You've obviously got no no no spell better to do. >> Well, but that's that's my concern, not yours. Yeah, with you and Google, do you know what I mean? And getting yourself up to up to see the local current laws and stuff. Yeah, that's fine. Right? But you're going to be the one that's going to end up in this situation. Intimidation and threats from local police. Until I feel that you do not pose a risk to the general public The situation ended without any clear answers, but everything that unfolded during this confrontation left serious questions about the line between authority and citizen's rights. Up next, two cameramen stood on a public sidewalk outside of Sonic filming the exterior. What seemed like nothing more than a few curious glances quickly shifted as questions began to arise and the atmosphere slowly started to change. She's recording back the lady drive-thru. Why are y'all recording this? Huh? Why are y'all recording this? We're doing facial recognition There you go. There go the spear. Yeah. >> to smile. I'll be right back. Yeah. She's really cute. It says Sonic on her hoodie. I think she said she'll be right back. I heard that. [clears throat] I was like, "What she mean?" The questions were no longer just out of curiosity. They started to carry suspicion. The tension grew as every word made the situation more sensitive. Then suddenly, everything escalated. A decision was made that pushed the situation far beyond what anyone had initially expected. Now, he's approaching us. Can you guys tell me a little bit more about what you're doing? You say who did what? >> Can you tell us Tell me Tell me about a little bit more about what you're doing. We just We just doing We just trying out the new AI facial recognition and we're just gathering some license plates. We're not speaking to anyone. They're speaking to us. >> Yeah, because they're wanting to know why you're taking their pictures. Like we're we're a business. >> Yeah, facial recognition and license plates. >> Hey, did somebody send you here? Yes. Okay, who who sent you? We can't really get to that. >> I'm going to ask you to leave my property. We have no intentions on going like >> Okay, you So, here here's my deal. If you cannot tell me who sent you and you're taking pictures of my my customers, then I'm going to ask you to leave my property. Uh are there How many workers are inside of there? I'm not going to answer you. We we wasn't even going to be here long, just like a couple hours. I'm going to go ahead and call the police. >> ain't got to do that. Hold on. Hold on. Hold on. Real quick, come back. Come back. No, don't do that. Hey, come over I have warned you. No. Come here, please. Let me Look at that walk, man. On a mission. I'll get you too. She was cool at first. I mean, I let her know what we were doing >> the same lady that was okay with it, gave us the okay, and rolled off. She smiled at us and said she'll be back. She got to change her baby's diaper, so They did say they was calling law enforcement, so I'm just going to stick around 5, 10 possibly 15 minutes just to see how this going to take place, y'all. Stay with it. The tension had now become undeniable as the demands grew more forceful. It was no longer a conversation, but a confrontation quietly escalating. And then the inevitable happened. The arrival of the police, which was expected to resolve the situation, instead opened the door to an even more controversial turn. I'm going to walk her over here so you can get in the sun. Come on. So you can I'm sorry. I can't hear you with the cars. I'm sorry. What are you doing? You said who did what? What she saying? I'm trying I couldn't hear you. I'm sorry. What are you doing? Yes. So we're just standing out here documenting, recording. Documenting what? >> What are you documenting? Oh, anything we can see. A lot of a lot of different businesses and >> Well, I will tell you I drove past here about 15 minutes ago and you guys were standing right here Right. Yeah. facing them. Still recording. Why would you keep recording them if you're doing everybody? You should be recording at us. We're getting some b-roll. But can can we ask you a serious question? First What is your name and your badge? I can't I can't see. >> 2092. >> So Officer Swix, with all due respect, if if you can please de-escalate, what rights do we have right now on this sidewalk that you are here to defend? What rights What rights do we have Are you here to defend though? I'm just documenting. I'm recording. We told you. So Who? You did. I have a what? Why you screaming damn I have a boy please don't call the cops. Yeah, you don't call the cops. I have I have like 50,000 You don't know who's watching, you know? But I understand what you're saying about privacy and I understand what everybody how everybody feels. They they didn't they weren't doing So I just wanted to say that. I don't know exactly what they're You were just a little escalated though. You was, KJ. What rights though do we have? First of all, I raised my voice because you said multiple times cuz you can't hear me because of the cars. We can hear you. We're right here. We we are right We don't need you. Goodbye. Goodbye. We we don't want to talk to you anymore. Goodbye. And you're a corporal. You're about to be a sergeant, you know? So No, she's not. She got at least one stripe. They they gave it to her. >> Okay. Let me go ahead and see your ID if you want to be that way. Do what? >> You have to show me your ID. Let's get a supervisor out here. You need reasonable articulable suspicion of a crime. You need reasonable articulable suspicion of a crime. Articulate the crime. I just told you. Yes. She's going to really make her department look bad. >> Articulate the crime. Don't violate our constitutional civil right. You're out here documenting on a public sidewalk. The exchange was no longer simple as rapid-fire questions and rising tension pushed the situation closer to a dangerous line. Every word seemed to escalate it further. But unexpectedly, instead of spiraling out of control, things began to shift in a different direction. And that moment would determine how the story ends. Bro, we're getting people coming and going. How do you know where we were before this? How do you know how long we were standing here? >> You are a law enforcer, not a feelings enforcer. They have a right to be there. [ __ ] how they feel. They have a right to be there. That's all should have been said. All this was just extra, Miss K. Jane. I'm not here to make you look bad. We want you to do good. We would love to capture you on camera educating them. We are aware that they don't know, but you're supposed to know. And when you pull up, you're supposed to go educate them. Speak to them first. You came straight at us. You should just go educate them that hey, look, it It looks like they're just exercising their rights on public. Two of the ladies are already aware of that. And I'm glad this Frost is here. He's a supervisor. He He should be knowledgeable. That's Frost. Uh I'm so I I can't see If you came up closer, I would have asked you for your name and badge, you know? And I'm a horrible reader, so and I apologize. Hey Hey, sir. Your voice was escalated from the ghetto. Disrespectful, and they think it's funny to do What happened? >> Before you get out of here, uh sergeant, can I get your CFS, please? Say again? Can I get your business card and the CFS number, please? Officer House, badge number 2146. We have a sergeant arriving right now. Can I get a CFS, please, or the CAD? I don't know what that is. Your call for service number, CAD number for this. The report number that was generated for this call. I didn't know how to tell you what. But you knew what we was talking about. Hey, Jane. I want you to know when you record this. Just leave. Just leave. Just leave. Yeah, just leave. You suck. 10-8. You suck. Thank you, sir. Both of you. I think this is the supervisor right here or another officer. I don't think he was the supervisor. He just said officer. Okay. There's the Oh, they called him off. I think they called him Oh, now he's coming. After all the tension, everything gradually settled in a way few expected. The heated arguments and confrontation faded, leaving behind questions that [music] make viewers reflect. Citizens can file a lawsuit under Section 1983 if their rights are violated. Officers who overstep [music] may face financial liability, disciplinary action, or even termination. When law enforcement fails to stay within proper limits, they can end up harming the very people they are meant to protect. Hey, everyone. What do you think about this situation?
