He doesn't give you any permission from his office. >> I don't need his permission, miss. >> You do. You're >> I don't want this thing to escalate. >> He's not going to escalate. Yeah. >> Yeah. >> Let me educate you. Let me educate you. >> You just need to mate. >> Okay. >> Can you uncuff me? Can you take your hand off me? Can you take your hands off me, please? Listen, you are now technically you [music] are assaulting me. >> A YouTuber just wanted to film a documentary, but within minutes he [music] was surrounded, interrogated, and threatened with arrest right in the middle of the airport. when I feel that you're infringing on my rights. Well, >> that's what I feel, you know. >> Claimed he was filming a legitimate documentary. The argument broke out and it quickly spiraled beyond the bounds of reason. >> I don't believe I've committed any criminal offense for me to >> private property. >> That doesn't mean I have to give you my name. We'll show you by law cuz it is a bylaw. It seemed like a normal [music] encounter at Heathrow airport suddenly turned into a tense standoff when the YouTuber was accused of being a spy >> to where I believe is public area. >> You believe it or and and I will tell you where >> but I'm not going to believe a police officer. I'm sorry. >> When he refused to provide his name and address, the female officer began to lose her patience, citing laws that even she didn't seem to fully understand. Yeah. >> So, >> boot. Okay. Yeah. Yeah. >> Yeah. So, but it does extend. Yeah. I see. >> So, normally I use this one for um protests really. So, when I'm at the So, I can obviously go like high above the crowds. Yeah. >> But, um sometimes there's >> some places that's just a button to turn it on and off. Yeah. >> So, I've just actually switched it on. I wasn't actually recording. That's fine. So, that's why obviously it looks a bit like our um >> batters. Batterns. What's what's your name? >> I'm not going to give you my name, buddy. Yeah. I don't believe I've committed any criminal offense for me to >> have to offense. You're on private property. >> That doesn't mean I have to give you my name. >> Your name is We'll show you by law cuz it is a bylaw. I've been working here for >> 15 years now. >> Silver car. >> So, uh, sorry, what was your name, miss? Constable gardener. >> Yeah. >> Yeah. And your number? >> 3244. >> Yeah. And yourself, buddy? PC peek 340. Are >> you based in that little corner place? The little >> cargo unit. >> Yeah. Cargo unit. Yeah. >> Yeah. So that's all that is. Yeah. >> But you are because you're on private property and you're not allowed to film. >> Miss, what you what you've just you just read out the things. Yeah. What it says >> causing a disturbance? >> I'm not causing a disturbance. >> They are because Seg have asked you to leave and you're not doing so. >> They haven't asked me to leave. Well, I'm asking you to leave. >> You can't. You haven't got the power. You have You got the power to ask me to leave. Yeah, I could ask you to leave. >> Also, you know the law about trespassing. So, come down here cuz they do. They come down. >> Yeah. Okay. >> And they'll say, "Right, sir. You got no law no reason for being here. >> Yes, you believe you've got a reason, but they're going to say you haven't got a reason their eyes. >> Please, can you leave?" And they will ask you to leave. >> Tension kept rising. Police threatened to throw him into the van for filming in a so-called restricted area. But did they really have the right to do that? >> What we're telling you? >> No. Well, not that I'm not believing what I'm what I'm what you're telling me. I'm not disputing. You know what all I'm saying is I've got a legal reason to be here. >> You haven't got legal reason. >> I have. I'm making a documentary. >> You You haven't got their permission. >> I don't need their permission. >> Receptionist. >> I don't need their permission. >> But you're on private land. Uh >> mate, I'm on So you say I'm on private land. Yeah. >> Tell me anywhere where one it says no unauthorized access. We show you on the sign is I've looked at the sign you I'm not going to be going. Yeah. >> Um I will go when I want to go. Yeah. I'm not saying I'm going to be sleeping here and things like that. Yeah. And I don't really want to go round and round and >> I don't want to go around circles and I don't want this thing to escalate. >> It's not going to escalate. Yeah. >> Um all I'm saying is >> but we're not going to be directed by yourself. If we know we're right, I'm not going to listen to you telling me you're not going. >> Yeah. But I'm not going to be directed by you when I don't think Yeah. When that's going to be a problem, isn't it? when I feel that you're infringing on my rights. >> Well, that's >> that's what I feel. You know, >> you're here to you're you're here to make a documentary, right? >> Yeah. Only about the men's issue. >> You're coming across >> very obstructive. You're not giving us your name and address. I'm telling you by law. There is. We proved it to you. >> Right. First of all, >> he's going to get management teams to come out because he doesn't he doesn't give you any permission from his office. >> I don't need his permission, miss. >> You do. You're high. He's just said himself there should be filming out here anyway. >> I don't need his permission. >> Yeah. to film this building. I'm sorry, but I don't. >> So, if that's the case, then why did you go into the reception? >> Just to tell them. Just to let them know. Yeah. Just so you guys don't get called. >> Yeah. But I'm aware of what I'm I'm not stupid. >> Shocking moment. The female officer snapped. You're making me very angry. A line that marked the thin boundary between authority and abuse of power. >> You're telling us you're making what you're trying to do permission to film. >> So, what you're I never said I never said I had permission. You said you've gone and spoke to reception. >> You didn't say I had permission. >> Okay. >> You said you went in. >> I went in. I told them what I was doing. Mom, I'm not stupid. It's not even blue anyway. It's white. >> Yeah. It's cloudy. Yeah. >> Okay. >> Right. Are you going to leave the area? >> What area? >> This this cargo restricted area that you're in now. >> What? So this place here? >> Yes. >> You want me to leave this place? >> I want you to leave out of here. Out of shore and road east. Turn left and go onto the southern perimeter road. No, I'm not going to go that far. I'll go to the publicly accessible areas. Yeah. Where I'm legally allowed to go to, >> which is something. >> Okay. So, let's come to Follow me, M. >> So, as soon as you come in on the Sterling Road and it's got the great come with me, let's stop with my colleagues. >> Oh, don't worry. Yeah, I'm not, you know, I'm not >> It's not They're not public access. It says, it's a great big sign above the It says restricted area. >> Yes. >> Yeah. restricted area. >> So that means restricted regulated area by the CIA which don't give you permission to film. And as you can see, everybody that's walking up and down here has got high vid jackets on. >> No problem. >> Because that >> not a problem. So I will go back Yeah. to where I believe is public area. >> You believe it or and and I will tell you where. >> Yeah. But I'm not going to believe a police officer. I'm sorry. Yeah. But I'm not going to believe what a police officer. Just because a police officer tells me something doesn't mean it's true. >> Okay. >> You know, you you've quoted stuff from me from your telephone. >> He wrote bylaws I got off Google. >> Yeah. So Yes. So you've quoting stuff from Google. >> The man stayed calm, citing every law and every line on the signs. The police, however, began to lose control. And in the end, one wrong move might just land them in court. >> Oh, here we go. Come on. >> What? Let's go. just go to there. I'm going to check my uh I'm going to check my documentation. >> If I believe I'm right, I'm coming back to here and I'm going to carry on with my filming. >> That's fine. Go to my road. >> No, I'm going here to check. No, >> you're not. >> I am. >> You're running. Okay. I'm going to go and tell the family. You're going to come to the jet. All right. >> You won't. You are. >> I'm telling you. Yeah. If you do, you're going to get in trouble, geese. >> So, I'm putting in a simple plate. >> I'm not scared. You're threatening me. I'm not threatening you. I've been doing this job a lot longer. >> Yeah. I'm not threatening you. Don't think I'm threatening you in any way. Yeah. >> That seemed like a threat to me, eh? >> All I'm going to do Yeah. is check my own Yeah. What I want to check. Yeah. >> And if you are right, I will apologize. I will apologize. If you are right, I will apologize. >> Yeah. And make my way. >> Which bit do you not believe us? >> The bit where for one, you say that you're going to put me in the van and take me off. >> Yeah. 24-hour role rejectment. Yeah. Whatever. Yeah. So, look, it's not doing nothing. Yeah. Um I know you got bylaws here. >> We can quickly check it and then we can with our day, can't we? Because >> I don't want you to be, you know, you don't need to be harassing me. You know, >> you're harassing me. Then I've got to walk back. In the United Kingdom, police officers who abuse their power can be prosecuted for misconduct in public office, facing up to 7 years in prison, permanent dismissal, and a lifetime ban from service while citizens have the right to file civil claims for compensation. The citizen firmly insisted on reviewing the legal documents and continued [music] filming, declaring he would upload the incident to YouTube to expose the officer's actions. Up next, police rushed in after reports of a man with a knife. But within minutes, everything took an unexpected turn. >> You haven't heard any threats, have you? You've been with me at all times. Yeah. >> All right. >> You've been with me at all times, and you haven't heard any threats. >> Just unzip, mate. The top jacket. >> You've been with me at all times. Yeah. >> Okay. But you've been with me. Yeah. >> I'm just going to unzip the jacket. Okay. >> He's saying he's not being with you all the time. That's what he's telling me. >> So, when did I threaten somebody with a knife then? >> I never threatened anybody with a knife. Yeah. >> No. No. Oh, yes. They do. >> Why? >> Oh, yes they do. Yeah. >> Cuz this is illegal. Yeah. >> This is an illegal search. Yeah. >> And you know it is as well, bro. Yeah. >> Yeah. >> So in a momentality >> once I'm under >> because this is private property. >> Yeah. This is private property. Yeah. >> My pictures everyone in his personality. >> Yeah. Yeah. Yeah. And as you do not know this is the camera is still running. >> Yeah. Yeah. Camera is still running. Yeah. The camera will will run at all times. >> And just so you know, I also have a hidden camera. >> Yeah. That records at all times as well. Yes. >> Is the pocket within the pocket? >> 105. >> Um, can I get the instant number for this call, please? >> Can I get it now, please? >> Not right now. >> Okay. The man was handcuffed and searched in broad daylight. He calmly protested. This is an unlawful search >> and every moment was caught on camera. >> You going to take the handcuffs off now? Bring your backpack. >> Okay, no problem. Take the handcuffs off now, please. Officer, can you take the handcuffs off now, please? Officer. >> Officer, I've requested three times you to take the handcuffs off. One second, mate. >> This woman is grabbing me by the arm. Okay. Is the stop search finished? >> Has the stop search finished? >> Has the stop search finished? >> Can you uncuff me? Can you take your hand off me? >> Can you take your hands off me, please? Listen, you are now technically you are assaulting me. >> You are assaulting me. You are assaulting me. And I'll explain why. >> I don't need to listen to you. No, you need to listen to me. You need to listen to me. >> You are in big trouble. >> You are in Now take now. Take your hands off me now. Please take your hands off of me. >> And the cuff is off. >> Excuse me. >> Excuse me. Excuse me, officer. Hello, officer. >> Handcuff is off, mate. Hang on. >> Take your hands off of me. >> There you go. Handcuffs are off. >> Thank you. >> Yeah. >> Just stay here for me. >> No, I'm not detained. >> Details. >> No, you don't. Yeah, we need to do the stop search, mate. No, you don't. No, no, no, no, no, you don't at all. Just give me the reference number. Yeah, >> no. We need your details. We need to submit a form. >> So, you search you search my bag. Yeah. >> Let me educate you. Let me educate you. >> We just need to submit a form, mate. We've stopped you. That's >> okay. Let me educate you on Pace. Let me listen. Let me educate you on Pace. This is Pace here. Yeah. >> Would you like a receipt for the stop search? >> No. Just give me the reference number. I will go to the local police station. No, you don't. You give me the reference number. Put the reference number. I'll show you in face. Yes. >> No. No. >> So, here we go, guys. >> There's there's a form that we need. >> Do you do you think I do you think I'd just go out on the daytime and just for fun and do this? >> When no weapon was found, the officers changed their tone and demanded his identity. But he didn't back down, citing the law clause by clause, leaving them visibly unsettled. Details. >> Then you're going to arrest me? >> Yes. >> That you you said that on camera? Yes. >> Okay. Come over. I'll give you my details. >> Not a problem. You do realize Yeah. that what you're doing is illegal. Yeah. >> It's not. It's been al there's been an allegation offense. You've heard it there, mate. If we can't heard you is this. Yeah. You have come here under under they've said that I've got a knife and I've threatened people. Yeah. This is not true. >> But why are you here? >> I have not threatened anybody. >> But why are you here? >> Hold on. Let me I'll answer that in a second. Yeah. I've not threatened anybody with a knife. That's a false allegation. >> Yeah. Now, right when we're around the back here, Yeah. they illegally detained me. They citizens arrested me. What I'm doing at this precise moment is called trespassing. Yeah. Which is a civil matter. Yeah. There's they can these people are not allowed to stop and detain people. Yeah. They can't do that. Yeah. Now, I went to this door to try to get in. He grabbed me and pulled me. Yeah. >> He grabbed me and pulled [music] and pulled me >> whilst you're trying to enter the premises. While I was trying to enter the premises trespassing, >> right? Hold on. Yeah. Is >> that correct? While trespassing, you tried to enter the premises? >> I tried to enter >> by forcefully pulling the door. >> No, no, no. I can't forcefully pull the door. Hold on. I This is not a police match. On the website, >> from what we've heard, mate, you've been threatening to stab people. >> No, I haven't. And you tried to enter the premises. You searched me, which would then mean you're using violence to secure entry premise. >> No, I never use violence. This is what sound like, isn't it? >> No, but you have searched me. Yeah. Weapons. Let me I want to give them to you. Yeah, but I just want to get this all on camera. Yeah. Just so when I commit to my solicitor, >> yeah, that it's everything counter allegation. >> That is all that is. I'm not making counter allegations. >> They've said that you pushed that you've pushed them and now you're saying that they pushed you. So that's technically a counter. >> No, I have not said that they pushed me. You said that? >> No, I didn't say that. I said they pulled me. >> Yeah. I never said that they pushed me. I said that they pulled me. Yeah. No, it's not. >> Well, it's an assault either way. >> It's not. Yeah. It's Listen, I'm not making no allegations. All I'm saying is this. You've come here. Yeah. because they turned around and said to you that I've got a knife. Yeah. And I threatened to stab people. This is not true. >> Accused of pushing a security guard, he activated a second camera and called his lawyer on the spot. [music] What happened next forced the police to lower their tone? >> Well, you do you pay for the civil claims that you put in? >> Do I pay for it? >> Yeah. >> Well, technically, yeah, >> technically taxpayer, isn't it? Yeah. So, >> well, I pay tax as well, so technically we all pay for that. >> Yeah. Exactly. Yeah. But I think with civil claims, I feel that if you uh if the police infringed your rights, >> Yeah. then I feel that that the police officer should pay. >> Okay. >> Yeah. That's what I feel. You know, I don't think it should be fair that taxpayers should be uh should be doing that. Do you know what I mean? >> How long have you been doing this sort of thing for? >> Quite a long time. >> You know, I need to stand up for my rights. Yeah. And uh I also know Yeah. [music] that what's happened here today, I've shown the guy. I run past him. That's not classed as no assaults. >> Yeah. You know that as well as I do. >> I know. But running past somebody is not classed as an assault. >> No, but we don't know whether that's the time he's meaning, do we? >> But you've seen all the you've seen the free incidents now. >> Yeah. He has the whole thing though. >> No, but he's seen the free bits when I tried to go in. Yeah. When the GoPro footage revealed the truth, every accusation collapsed. But the real question remained, were the police hiding a far greater mistake? Their actions showed clear signs of violating PACE 1984, Police Reform Act 2002, Section 50 and the Human Rights Act 1998. Next, right on the city sidewalk, a group of people holding banners are suddenly approached by the police. But what makes them threatened with arrest in just the first few minutes? >> This is the uh the code enforcement >> city sidewalk. >> Could you show it to us? >> No, >> you can look it up because you should have got a permit before >> we don't need a permit. The Constitution is our permit out. >> You need a permit out here. >> So what do you what do you what is your demand? >> Disperse. >> Do you realize that that puts you in league with only a handful of >> No warrant, no law, just a cold command. Disperse or you will all be handcuffed. Was this law enforcement or arrogance of power? >> Gentlemen, you can remove the signs or you can come with me. Up to you. >> Uh, officer, we are the bloodstain men. We believe we have a constitutional right to uh hold signs in public. >> Well, it's vulgar >> and it affects other people. You got >> the ACLU has the ACLU has defended our right to protest >> for skin and penis on your signs. Officer public view. >> Officer, I suggest you call the city attorney before you push your your uh your viewpoint off further than this. >> I'm telling you to pack it up and move. If you refuse to disperse, you'll be arrested for disorderly conduct. >> Who will you arrest? Me or all of us? >> All of you. >> And you and how many officers you going to bring us? >> Don't worry, there's more coming. >> So, you are saying we don't have a right to protest in this town? >> Not here on a city sidewalk. >> Could you show us this the uh the code enforcement? >> City sidewalk. You can look it up because you should have got a permit before. >> We don't need a permit. The Constitution is our permit out. >> We don't need a permit out here. >> So, what do you what do you what is your demand? Do you realize that that puts you in league with only a handful of cities? We've been over 500 cities across the United States. >> Time to go. I'm telling you to go or we can do it my way. Up to you. >> Why do you say it's your way? Who Who ordered you to do it? So, you're doing it on your own? >> We got because of this. >> The protesters did not give up. They demanded what few people dared. Specific law quotes right on the spot. And the police's response will shock you. >> You have blood on your crotches. >> Laws, officer, we are not breaking any laws. We have a constitutional right to protest. We have a constitutional right to protest in the United States. Were you Were you raised in the same country I was raised in? We have a constitutional right. >> So, you're refusing to disperse? >> I didn't say that. We're talking. >> No, no, no. >> I want to see I want to see the legal citations. Now, what do you mean by disperse? >> Go back to your vehicles. Pack it up. >> Can we Is there a Who is your duty officer? Who's your duty lieutenant? >> Our duty lieutenant. >> Who is in charge? >> Probably a B ship lieutenant. >> We would like to talk to someone higher than you, officer. >> We feel that you're making up. >> Well, you can put the signs in your vehicle till the duty lieutenant shows up. >> We're not blocking the sidewalk. >> You're on the sidewalk. >> We We do not block We do not block anything. What I'm saying is, all right, Mike, move over a little bit so that they can't claim that we're blocking the sidewalk. >> If you're not on the sidewalk, then you're going to be on so property. >> We are not going on private property. Officer, can you please bring on Can you please bring your uh >> They're already on their way. >> Whoever's in charge on their way >> cuz I'm willing to talk to you, but we we are firmly convinced that we have a constitutional right to do this. >> Okay. Cuz >> the ACLU the ACLU will back us up on that. We're on two weeks tour. >> Really? >> We have This is day four. We were at uh Orchard Park earlier today. >> Yeah. How'd that go? >> Then came the surprising accusation. Someone reported you guys were exposed. Was this the truth or a ploy to silence the protests? >> Fine. The police didn't involve dead. We were in Mont what what other cities >> we were in Orchard Park this morning. We were in uh yeah auditors. We were in Onian yesterday. >> It was reported that you guys were exposing yourselves. Was anybody exposing themselves? >> Absolutely false. >> Okay. Absolutely false. The officer said that someone called it and said that we were exposing. That is absolutely false. Officer absolutely false. >> We've been doing this for 11 years. Several years ago, someone >> I was telling you what it was reported about. >> I understand that and I and I believe you because it happened before >> and when but we're not insane. >> No. Are you you're with them too all together, but no one was exposed. >> Absolutely not. Absolutely not. That that that would we are not lunatics officer. >> No, I No, I understand you got that report. >> Guess the only issue would be obviously if there was any >> exposing exposing themselves. >> Officer, we we've been doing this for 11 years. >> We've been doing this for 11 years. Officer, we >> we pride ourselves on getting along with the cops. We are confident. >> In the end, no arrests were made. But what was left on camera? A stain on power or evidence for an upcoming sensational lawsuit? >> Oh, sure. Hello. Um, people with horse. Uh, yes. And bloody crotches. They're on the sidewalk. They do not have their pants down on their head. >> No, just uh just the words, the verbiage. Okay. All right. Thank you. Good God. Where is he? Penny 37. Oh my god. Citizens may sue public officials for violating their constitutional rights. Pursuant to 42 US code SS1983, the individual/organization [music] may be required to pay restitution to the injured party. In severe or intentional cases, punitive damages may be ordered. Next, in the middle of Edison Street, a man holding only a camera but unexpectedly immediately caused the entire bank to call the police. >> Hear me now >> a little bit. >> All right. They're asking for you to leave from in front of this problem. Sir, why may I ask why you reporting in front of this bank? Is it something that I >> tense [music] moment? Police show up, demand identification, and order people to leave. But do they really have the right >> you could park? >> How you doing, sir? >> That's the best way you could park? >> Yes, it is. How you doing today? >> That's crazy. Where does somebody need to get you now? >> A little bit. >> All right. They're asking for you to leave from in front of this property. >> Can I get your name and badge number? >> 488. Officer Owens. >> Officer Owens. 488. Did you hear what I asked you? >> No. >> They're asking for you to be removed from in front of this property. >> Okay. >> Okay. >> Okay. >> So, you can record, but you can go down to that corner to the light, but not right here in front of me. You're still recording it, >> huh? >> You're still standing here recording? >> Yeah. Yeah. >> And I asked you to not record right here in front of >> So, you asking me? >> I asked going on >> what's going on. >> Let me see your ID. >> ID for what? >> Can I have your ID? No. >> Just so I can see who you are. >> No, you can't have my ID. >> Okay. >> You all over there. The camera ID in your face. is in my fitness. It's pointed directly at you and I'm asking you not to. >> You're asking again. >> You have your ID on you? >> No, I left I left my my wallet. Where you from? >> Do you live in Edison? >> Where you from? >> Do you live in Edison? >> I don't ask him questions like that. >> A heated dialogue erupted. The citizen fired back with an answer that left the officer speechless on the spot. >> It's not people just going to have to stay here, >> okay? >> Cuz they're asking you to not record in front of their property. >> Okay. >> May I ask you why you're recording? I want to take pictures. >> But this is not a picture. It's like this like pictures. >> That's not a picture in a video. >> It's like multiple pictures all in one. >> May I ask why you're doing that? >> Yeah. >> Sir, why may I ask why you're recording in front of this bank? Is it something that I can >> I like the building? >> They don't want you to record. >> I might want to buy this building one day. >> It's not for sale. >> It might be one day. Everything for sale. Everything got a price on it. It does not. Well, you don't have to build that. >> That's a backup. >> You know everything else. You tell me. >> You guys can 108. >> 10. Tell them to 108. Who? >> 547. >> 547. Hughes. Thank you, sir. >> Asking to leave >> again. You asking me. >> Well, now I'm telling you. >> What are you going to do? You going to arrest me from standing here? Why? When [music] police escalated, threatening trespass, man launched a legal argument that turned things around. >> Excuse me. >> Why? I can't stand here. >> What you're doing? >> What I'm doing? >> You tell me. >> I'm recording. >> And they don't want you. They're worried that you're going to be sending their customer. >> But isn't this a constitutionally protected activity that you are you a customer complaining about you? >> About what? >> Now you're bringing a problem. >> What are they complaining about though? making them uncomfortable recording them. They don't know >> now in public. They don't be watching me either. They got cameras looking at me. >> But you're here and they want I got the right to be here, right? >> Okay. You can stand here all day, but they don't want the camera here. >> Okay. Well, you know, a lot of people want a lot of things, man. The building. I want to record the building. That is that a problem, though? >> But people are coming in here to spend their money with this bank and they have a right to say so. >> I don't know. Then they out in public. When you out in public, when you out in public, there's no expectations of privacy. >> You have a debit card, right? And when you go to the bank, >> when I go to the bank, >> at the ATM machine, >> of course, every time >> when you go to the ATM, they don't record you every time. >> That's how they put in. >> Well, it ain't it ain't what you do when you It ain't what you look at when you recording. It's what you do with the information. >> There's no crime. >> That That's So you just That's what you What are you saying? >> There's no crime. It is a problem. >> So now I got to have a reason to record. >> I mean >> to take pictures. >> You people just normally just stand and record a bank. >> Yeah. >> You taking pictures, man. Recording. >> Taking pictures of a bank Saturday. >> Yeah. What are you guys doing on a Saturday? You here watching me take pictures? I was You guys ain't got nothing to do. >> And then the shock. Without ever entering private property, he was warned of arrest. Was this evidence of blatant [music] abuse of power? And when you got called here, you see me taking pictures. You see, I ain't doing nothing wrong. So you guys can leave. >> Nobody really just records a bank. >> You know, it's weird, but it ain't illegal. You know, some things is weird. Violating police officers may be disciplined, have their licenses suspended, fired, or expelled depending on the policy of the agency/ police chief. There was no formal arrest, [music] but Edison police showed signs of corrupt authority by asking to leave and threatening to trespass without grounds. If an arrest were made, the incident could violate the first amendment press and the fourth amendment preventing arbitrary searches. The contrast citizens can request body cam records, file internal complaints, and even file lawsuits. Global suspicion. Could it be that those enforcing the law don't even understand it? >> What's your business? >> Just relax, man. It's not a big It's not that It's not that big of a deal. >> No, it is a big deal because you're not allowed to be in this area. >> There is no uh there's no signs saying authorized personnel [music] only. So, >> no. Well, I'm telling you that. So, you can go into the parking lot. >> You can't just This is This is a This is a public guy. Is that how I say that? This is This is a public parking lot. Yeah. Because it's funded by taxpayer. >> It's not. >> You're wrong. >> It's not. You're wrong. You're wrong. >> You're wrong. You can take a walk over there if you'd like. There is no signs deeming this [music] a restricted area. >> I'm telling you. >> Yeah. You can't do that. >> I'm telling you. So, then maybe you're having a hard time listening. Okay, that's what the issue could be here. I'm just trying to tell you, bro. Go take a walk over here. That's it. You're not allowed to be over here. [music] >> It has to be restricted already. This is not a restricted area here. >> No, you're you're sadly mistaken, pal. >> Okay. >> You're sadly mistaken. Uh why don't we walk over here where you're allowed to be or we can have an issue. >> Oh, what's the issue? Is that a threat? >> No, that I'm telling you right now, you're not allowed to be in this area, bro. You're not understand. >> I'm asking for a supervisor. You're not understand. >> Does your policy not stay having a hard time? Does your policy state >> you have you have like you have you have issues or something like >> I think you have some issues in this area dude >> this guy came over here >> come over here and walk over here >> there's there's a complete difference this is the contrast in America and then you got cops like you sir >> cops who want to escalate and cops who want to deescalate because people like you when they go in all gungho >> let me finish what I'm saying I will just finish what I'm saying >> can I have your ID please so we know who we're talking to >> unless I committed a crime >> trespassing just like you guys said. So you see this this area why do you think the public's not here? Why do you think the way walk is not? >> This is not a restrict. This is not a It's authorized. Authorized. I I read it already. Authorized [music] vehicles only. No, no, no, no. Authorized vehicles. >> Detaining [music] a citizen without stating a specific charge? Are they enforcing the law or overstepping their authority? >> Because you have locks on certain doors. >> Why? But is there any sign saying you can't? But there's an expectation. Okay, that's what I'm getting. There's an expectation. You're telling me you can't freely walk through that building, right? Because it's a police station, right? >> No, because because you set up you set up barriers. >> Excuse me. Because there's an expectation that that's not normal, right? You see anybody else just walking through here cuz it seems normal to walk through here. >> But what's normal to you? You know, it's this is we have this is this is the United States of America. We could have disciplines of opinion. >> Ask you this. So most journalists, right, they want to come and they want to do stories. They want to hear information. Guess what you could do? You could walk around here and say, "Hey, officer, >> but why would I do that? Why would I do that when I can do it anyway? I mean, you could do this all you'd like. Am I Am I detained? >> Huh? Right now, yes. Until we figure out for sure what you're doing. >> So, you're telling me that I'm detained? This is an unlawful detainment, just so you know. >> Okay. Until I can figure out what your true intentions are. You're telling me a journalist. >> Can you Can you Can you tell me what crime? Can you articulate a crime that I've committed? >> You're This is suspicious right now. This is suspicious. >> Suspicious. Is suspicious a misdemeanor or a felony? >> Huh? Suspicious activity right now? Well, it all depends on how you want to speak. All depends on what you're doing, doesn't it? >> It's It's neither. >> I don't know. I don't know what you're It's neither. I don't know. It's neither. I'm here. I'm here conducting my own business. I'm being detained against my will unlawfully for no crime I've committed. And since I'm being detained and since I'm being since I'm being detained since I'm being detained, I'm going to >> Absolutely. Well, guys, come talk to you. You could have just told us what you >> You guys You guys are going above and above and beyond your authority. You have no authority to detain me. None. Zero. >> When I have a strange walk around where I work, normal activity, >> you you enforce you enforce the law. You can get yourself hurt. >> And then someone appeared with just a few [music] words turning the entire situation around who had the power to end this tense standoff. >> My officers are doing the right thing. You're in our parking lot taking photographs and everything. Not illegal, okay? But certainly something for us to be concerned about. Okay. >> There's a lot of stuff going on. I'm not everybody's >> part with your phone. This is Okay. >> Well, unless it's unless it's unless it's restricted. This is our private block, right? There are signs mostly for vehicular traffic, but it does say unauthorized people. I said that it's mostly for vehicles. Okay. [music] But again, this is why you were stopped. >> Yeah. >> Is because it's >> not necessarily illegal what you're doing. Granted, that's private property. A little bit different, >> but or say you're parked in in Walmart, right? And someone you come outside, someone's taking pictures of your car, looking inside of your car, >> right? >> Yeah. And and like and like I told your officers, I have no problem with them coming up and making contact with me. Voluntary contact. You're holding up my freedom of movement. >> We're we're we're investigating what was going on. Okay. >> Yeah. But as a sergeant, you should know that you know your your officer here didn't know what reasonable articulable suspicion was. >> What I said was I never heard the way you described the first order. >> Reasonable articulable suspicion. You said you didn't know what that was. >> No. No. As far as how we conduct business, we don't conduct business. >> That's not That's not speaking the way I do. >> Like you just said, everybody's different, right? So, how when you detain somebody, what's your what's your burden of proof? What do you have? What do you just go to random people and say you're detained? >> Enough. We don't need to sit here and argue. Okay, you guys are all set. >> All right, you guys can go. >> The most intense moment had passed, leaving behind raw images [music] of how the situation was resolved. The journalist continued filming after being released with no arrests made. >> I try and say, "Hey, listen. I [music] know you you I know you're worried that I'm filming the cars. I'm a journalist. I'm g gathering content for a story. I'm just filming the police station around the police station, the different cars. I've never been here before. >> Uh what? >> I'm independent. I'm independent. I'm independent. Yeah. >> You have like a blog or whatever. >> Well, to be honest with you, the story it's it's on the police department, right? But you know, >> our specific police department >> about your specific police department today. Yeah. I do this to a bunch of different police departments. And he didn't and he didn't know what you know what reasonable articulable suspicion is. Correct. >> Yes. There's two there's two ways to to for these situations to be handled. Look, I I've watched a lot of these videos. I get I get all that. Exactly. Okay. But >> but the point but what I want to make very clear to you, Sarge, is that you know, obviously you guys doing stuff that you're not supposed to is going to get views. But what I what I try and [music] do is I'm trying to say, "Hey, listen. I'm going to be reasonable. I'm not going to curse at you. I'm not going to do anything that's going to try I'm not going to try and a aggravate you." And then whatever your officers or whatever police department I'm filming at that particular day decides to do it's on [music] them. You know people there are people who do what I do and they you know like to agitate a little bit. Exactly. And my profession what I'm doing is like I said if they want to go crazy yes that is good views >> at your point. >> I I prefer to have a good conversation like I'm having with you right now Sergeant. Like I prefer to listen I I can understand that >> maybe if you do this again I'm sure you're going to be doing it again. Maybe stop in >> Yeah. and be like, "Hey, you know, this is what I'm this is what I'm going to be doing." >> When civil liberties are disregarded, when the ignorance of the law by those in power can turn an ordinary situation into a potential disaster. New [music] style of police teaching the law during the day, breaking the law at night. >> Stop resisting. >> Stop resisting. >> I'm about to tase you. Okay. >> No, don't three. Taser. Taser. Taser. >> Get it again. Put your hands behind your back. Do it now. What seemed like a normal traffic stop suddenly turned into a tense drama as the arrested [music] person repeatedly resisted arrest and the police suddenly resorted to extreme measures. What happened behind the scenes? >> So, you got uh some funky stuff going on with your IDs and you got some warrants through Jonesboro. Put your step back here. Step back here for me, man. I'll get everything out of your pockets. >> I ain't got nothing in my pockets. >> All right, I'll turn around for you. >> What's going on? I want to put you in a handcuff. Stop resisting. >> Resisting, man. >> Stop resisting. >> I'm not resisting. >> You are resisting arrest right now. >> Listen, I'm about to tase you. Okay. >> No, don't tas. Three. Taser. Taser. Taser. Get it again. Put your hands behind your back. Do it now. >> Don't know what your malfunction is, man. You want it again? >> You better cooperate. >> It's not that. >> All right, let's get out from under the car now. Okay, >> come on. You can move now. >> Hey, come on. Let's slide out from under this car. >> You got any gloves? >> Go ahead. >> I'm an idiot. >> I took that ride with me. These are not the connected ones. >> Trust me. >> I told you to get back. >> I know. >> I said I'm an idiot. >> All right. I'm going to pull these probes out for you. All right. All tangled up this handcuffs and stuff. Look out. When the police checked the documents, an unexpected mystery was revealed. [music] The identification documents were not only incorrect, but also showed signs of forgery, raising big questions about this person's true identity. >> 5315 making drugs is what they said. >> They hire from me. >> What' you say? Did they confirm? So, did they confirm? >> Does it matter at this point? >> No. >> I don't know why he's doing that. >> Otherwise, it's a misdemeanor [music] warrant. >> Can you turn around to Jennifer Auto auction? J for auto auction. Give me a reference for stolen property. >> Oh, that's weird. His Arkansas driver's license was behind the stereo. >> Yeah, it was behind the stereo. >> Well, he's got a Texas ID that returns to a female. >> It's his picture on it, though. >> Yeah, it's just I pulled the stereo out and this popped out with it. Was he trying to hide it? >> Maybe Arkansas cuz he knows it's suspended. 191 Pierce. Johnson pierce. I have 189. He needs another unit. >> Said I pulled you over. >> You got these lights flashing underneath your car. You almost ran into me at the stop sign back there. [music] He's What's wrong with them lights? They're illegal. You won't believe what happened when Brandon Gibson resisted arrest, forcing police to use their electric batons multiple times. Was it a necessary action or a blatant abuse of power? It says it. Look at it. It says he's a female. For one thing, when you run it, it comes back to a female, but it don't have a picture. It has his picture on it. >> I say it's fake. >> But it looks real. >> Yeah. And my dumb ass catches him when he falls and gets shot. >> That hurt. I told you what the [ __ ] you doing. >> I told you it was my fault. I'm an idiot. >> You ain't got to be nice and catch them. >> I know. Stronger than otherwise. >> I know. Oh, guy couldn't budge his arm. >> Let me What is What's the good ID? >> I think the Arkansas one's the good one. I'll just take a picture of it and send it to you in just a second. >> Whatever. I got warrants. Huh? You [ __ ] >> I'll go by >> misdemeanor warrants. That's it. Huh? >> Yep. >> That's what you dumb ass >> and driving on suspended. I think that Yeah, I think that ID is fake, but I don't know. It's po is it possible that Texas put him as a female instead of a male? I don't know. >> Hey girl. >> In what seems like a simple arrest, a series of unexpected incidents occur one after another. From conflicts over documents to controversial electric shocks. Every moment [music] is captivating. >> The arm still feels funny. >> It shouldn't have done anything. You see those pictures yet? >> No, not yet. I haven't. I'm I'm doing the stuff right now. You can take them with you as long as you bring them back so I can log them into evidence. Let me >> take a picture. We think the Arkansas one's a good one. It's actually who he is. >> I'm not sure. I mean, both of them is actually who he is. One of them they couldn't get a return on it. Said it's a female. You look on there. >> I don't know. >> I'm going to take it. >> What's y'all's address? Go. >> What's y'all's address? >> Our address is uh give me one second. >> Repeated use of a taser may be considered excessive, potentially an abuse of power, and raises questions about the legality and ethics of the restraint. Questions about the authenticity of identification and the ability to conceal identity add legal complications. There are signs that the police have not handled the case properly, which could raise questions about the method of arrest. [music] the rights of the arrested person and the protection of human rights. And then an unexpected threat echoed across the empty courtyard [music] as if power itself was being challenged right before our eyes. >> Run away. >> Yeah, run away. That's what I said. >> Step back away from my door. >> You stepped to me. >> Okay. You're calling me out here. >> I didn't call you. >> Can I help you with something? >> I called this guy. What's your policy on taking pictures of people? Take [laughter] pictures of whatever you want. You can step back out of my face. You stand in my face. You came to my face. I got it. >> You were in my doorway. >> You got it. I got it on camera. You came into my face. You got out of the door. You >> my doorway and you're calling me out here. I'm here to speak to you. What would you like? >> I don't need nothing from you. I would like you to take your ass back to work and out of my face. How about that? >> You think you're in charge here? >> I am in charge. >> Really? >> Yeah. >> Not going to happen, dude. >> Not going to happen either. You ain't in charge of me. >> We have left you alone. done nothing to you and you want to come to my office and start crap. >> You've done nothing to me. >> I don't even know who you are. >> Why is this guy out here recording me? Are you on duty? You on duty? What's the policy on recording people? It's nothing to me. I don't give a [ __ ] When you come out and step to me and get super close with your little attitude to my door with your little attitude and your ego saying go run away, run away like you're tough. You >> stay out of my face. >> I need you to be quiet. >> Or you will be removed from my personal space. >> Oh, I'm going to be removed when I'm feet away from you. You were very comfortable when you walked up to me, right? A seemingly routine call for a complaint form suddenly revealed a shocking truth about the conduct of those entrusted with upholding the law. >> Let's go ahead and call dispatch and uh get me a uh complaint form that I can file against these dudes who are not good officers at all. Yeah, I'm outside of the sheriff's office out here and I need to get a uh complaint form if possible. I just had an officer threaten to use physical violence against me for no reason. Yep. It was here at the office. Um, no, I'm not going to give my number, but there has to be a complaint form, right? I mean, it's actually a penal code here in California. Yeah. I mean, if if there's officers in there, I'm sure one can bring a complaint form out. Shouldn't be take more than like 10 seconds, right? They're just there. I mean, and I know they're here cuz you guys have to have them cuz it's a penal code, you know? It's an actual law. Like we have to be able to file a complaint against the peace officer, right? So did you want me to wait for somebody to run one out or so online or come back? But there's officers in there. Why can't one run one run out to me? Okay. Well, when they get off, I see one pulling up right now. We can uh have him run one out to me, huh? There's one pulling up right in the thing. And I don't do online and I would like a hard copy of the form. But and I still don't do online and I still have a right to have a hard copy. So I don't understand why this is so hard. I just need a complaint form. Okay, I need a complaint form. Is somebody going to bring one out or not? Letting them know is not telling me whether Oh, you hung up on me. >> What a dirt bag. >> But this is not all. A seemingly minor detail lay bare the chilling gap between justice and reality. do something of that nature. >> Go ahead. >> Oh, go ahead, bro. >> No, I don't like people following me. Go ahead. Please. >> Please do. >> No, I'll chill right here. >> I'll stand here. I don't care. >> Okay, cool. Me neither. >> I don't like people walking behind me. >> Uh, me neither. I share the same >> thing. Just go across the street and then we won't have to walk behind each other. >> No, no, I'm walking here. You can go across the street. >> Okay. Just don't follow me, please. Okay. Oh, >> I'm going to I'm going to roll with you. I'll be with you guys for a minute. You got a name? >> Nope. >> You don't have a name? >> Deputy. >> What's your name, bud? >> What is it? >> What is it? >> Turner. >> And you got a number? >> 31. Or my badge number you're asking for? >> Yep. There you go. Badge employee. >> 41. >> 41. And what about you? Nobody. One. And what about you? Nobody >> blocking it. >> Yeah. >> Why? >> I don't want you to know my name. You have to give me your name. It's in your policy. >> Okay. >> So, what's your name? >> What's your name? >> What's your name? >> How'd you get them chevrons if you can't even tell somebody your name? Huh? Wow, bro. Make your make your department look good, huh? Trash, man. Give you one more chance. What's your name? It's in your policy. You contacted me. All right. >> Security of my building. Yeah, but you contacted me. I need your name. Hey, I warned you. That's all I'll say. I warned you. Thanks for identifying yourself, Turner. Appreciate it. >> And just when everything seemed to be over, one final statement left the entire public agency on edge. >> Those don't look too bad. >> ID. >> Oh, that's not ID. That's a police ID. I was talking about you got a ID. >> This is my ID. >> Oh, no. That's different. There's one. The one with your address and stuff. The one that you give when you're for driving, like driver's license. >> Oh, yeah. See, I don't have to share that with you. >> Oh, okay. I was just I didn't never said you did. I just asked him. >> Oh, well, that's what I said. So, I'm giving you my my law enforcement ID. >> Oh, yeah. It is different. That's something else. >> Obviously, you're not respecting the badge or the name or the uniform. >> How is that? >> What? >> How's that? >> Well, cuz I asked to see your ID. >> Well, do I have to give it to you? >> Well, you just want to make sure that you're not up to anything nefarious. >> So, how pretty it's pretty suspicious filming a police department. You know, there's >> I don't see how there's all kind of stuff to take pictures of. Oh, but not when you walk up to the gate. >> What do you mean? There's all kind of stuff to take pictures of. >> It's obviously we're closed to the public and it says restricted area. >> Hey, y'all got police cars back there, >> huh? >> Y'all got police cars back there? >> Yeah. >> Yeah, that's that's what we want to take pictures of. That's the issue. >> Oh, well, make sure you only take pictures of the police cars then. Okay. >> Well, I can take pictures of anything, but that you know, if I want to take pictures of police car, it ain't no big deal. >> Okay. >> So, yeah. I mean, it ain't I don't understand. You didn't never asked my question. Do I have to show ID? So, >> um, but you say I'm not respecting the badge or the or the ID. What is >> I'm just being respectful. >> What is it? Showing you my ID is being respectful. >> Well, I asked for your name >> and that's being that's respectful. >> I ask >> I'm just trying to figure out the philosophy. That's why I'm just That's why I'm asking. >> Well, I see where we stand. So, I just asking for your name and want to make sure that we know who we're talking with. >> Okay. So, it's not every day somebody's around videotaping and taking pictures and >> Oh, you should feel flattered. >> Citizens may sue public officials for violating their constitutional rights pursuant to 42 US Code SS1983. He cannot touch me. >> The brain injury, that sucks. I'm very sorry for you and your family. He cannot touch me. He cannot refuse orders that I give to him. This a legal, lawful traffic stop. The police remained rigid, ignoring the context and valid justification. >> Actually, look, I am very I was not trying to be combative. I have a slow thinking. >> She explain she explained that to me. Okay. >> All of a sudden, I realized I'm not an arc and I'm I wasn't trying to resist you. No, I'm going to close the door real quick. Give me just one sec. Okay. I could look past the initial refusal to give me his ID at first. And I didn't I didn't give him 20 chances to do it, but if I tell someone to give me their ID and they say no [music] or what for. I understand what you're saying. He was reaching for the glove box. I wish he didn't have those moments where he doesn't. >> I'm very sorry that your family has to deal with that. Catherine, please. Cuz this is something that's like you're basically putting me in jail. >> I'm not putting you in jail. You're still here. You can take the car and the boat, go back to your campsite. You can get him out tomorrow. We'll have first [music] you you can look there. There's ways in the court if he's actually got a brain injury, you could ask. >> Catherine, are you able to >> Are you able to drive this back to your campsite? >> Probably not. >> Okay. Cuz the other thing we'd have to do is call tow truck. >> Um I can probably get someone here in the park, one of our friends here. >> Yeah. This guy right here, I don't know if you know him, but why why was he going so slow? >> Because we drove from here. We were headed to Marathon to get gas and as we were driving down the road, he realized that the trailer was like bouncing too much and he didn't feel safe driving it. So, he pulled over at that gas station. Go ahead. >> There's That's his items I was given to you. >> The officer's actions reflect an abuse of power and rigid enforcement, treating a disabled citizen like a criminal instead of responding with humane and reasonable judgment.
