channel is about the constitution. I'm not going to I'm not going to do a video showing thousands of people of me waving my rights. Do you have Do you have your information? Your driver's license? What's that? Do you have your driver's license or name and badge? When refusal to provide ID and everything spirals out of control, what happened next is sparking intense controversy. Cuz you're refusing to give your information, you'll be going to jail for failure to identify as you're a witness to a crime. They want They want my ID. Right. Right. Right. And you have an issue with showing your ID? What happened and what was captured on camera this time could make a badge disappear forever. Just for standing on the street and filming, this man was suddenly ordered by police to provide identification. But what made things truly tense was the reason they gave. So, sergeant said he's going to be over here talking to you in just a little bit, okay? What's that? Our Our sergeant He's He's going to be over here talking to you in just a little bit. He's here. He's actually All right. You got a business card or anything? A business card? >> Yeah. Not on me. I can get you one out of my car in a little bit. >> All right. Cool. Uh do you need my name, badge number? What do you need? >> Yeah, that's what I was getting. That was That's what I was going to need, but I can't hear over the highway noise. Okay. So, you need all of our badge numbers or >> Just yours and I guess if the supervisor needs to speak with me, I'll talk to him. Uh he doesn't need to speak to you. I thought you wanted to speak to him. Yeah. Yeah. I'll talk to him. I mean, if you don't want If you don't need to speak to him, then I'll tell him not to waste his time. No. No. He's already here, so I'm not going to waste his time. He already told me he's here, so I'll talk to him briefly. Okay. Okay. And like I said, he'll be more than happy to give you anybody's name or badge number that's Um and then if you need business cards or anything like that, you give us a little bit, we'll be able to get some business cards to you if you'd like. No, just yours. That's it. Okay. I can I can get you one. Okay. All right. Thanks. Have a good one. Do you have Do you have your information? Your driver's license? What's that? Do you have your driver's license or name and badge? For what? Well, cuz now you're a witness to this crime that we're doing. What crime is that? The crime that we got these people in the back of these cars for. I don't know what crime they committed. You don't have to know. Well, well, okay, well, how do I know what they did? I don't know what they did. >> Okay, they broke the law. They're in possession of narcotics. That's why they're in the back of our cars. Okay, now you're telling me that, okay. Yeah. So, do you have your name and date of birth? No. Or driver's license? No. So, you're going to refuse to be listed as a witness since you're you sat here and videotaped the entire scene? >> If you need a copy of the video, I can give you a copy of the video. Well, yeah, but we're also going to need to identify you in our report that you were here videoing, so when we come to get a copy of that video, we can get that. All right, let me talk to your supervisor. He said that he won't want to give us her name his name and date of birth until he talks to our supervisor, so. And you're probably ain't going to end up going to jail cuz right now you're witnessing a crime. >> Well, I asked to talk to your supervisor. He's here, so why can't I speak with him? Cuz you're refusing to give your information. You'll be going to jail for failure to identify as you're a witness to a crime. So, I need to give you my So, I need to give you my ID to speak to your supervisor, is that what you're telling me? No. Okay, I need to speak to your supervisor. >> Why do you need to speak to the supervisor? Because I requested to speak to >> point then? Because I requested to speak to him and he's here. >> Okay. What's your point? He's here. I need to speak with him. He's got You've got no part of the scene, right? But you want to speak to our supervisor. >> here. You can you can speak to him. Okay. Yeah, but you'll be in handcuffs and you'll be at the jail. The officers quickly demanded that he provide identification, claiming he was a witness to the incident. But the cameraman firmly refused, insisting he was simply exercising his right to film in public. Just seconds later, everything escalated when police claimed he was standing on private property and ordered him to leave. Speak to your supervisor. Is that what you wanted to speak to? >> to speak to your supervisor. Why don't you understand it? You put yourself in this situation right here. You see that? You're on private property >> Private >> right now. Or public? You're on private property right now. Okay, what does that What does that have to do with anything? Do you have permission to be here? Did the owner trespass me? Well, he actually this guy >> want you here. >> This guy actually did want to tell us he wanted you to leave. That guy right there? So, What's his name? So, what's your point? What's his What's the guy's name that don't want me here? So, do you want to identify yourself so we can list you as a witness to this crime or >> I'm I'm just asking him a question. The guy that you just talked to, he doesn't want me here. >> Yes. So, is he trespassing? >> ask him to go ask him to tell you to leave himself? Don't you Do you already have that notice? Yes, he told us when he came over here and gave me his business >> do you have to go ask him then? If you would like for him to tell you himself. He can tell me whatever he needs to do. If he needs to tell me to leave, I'll leave. Simple as that. He needs to give me a He needs to give me a warning before I before he can trespass me. And now you identify yourself, now you're forced to not leave. All right. I need to speak to your supervisor. Okay. What's your name and badge number? Don't worry about it. You'll get it in a minute. What's up, bud? You guys got the same name plates? Yeah, Deputy Chilly, 315. You like that? You got the same You got the same name plates? >> Yeah. Same person or Yeah, we're the same person. We're all one. He's He's the same person as me. There's obviously two of us standing here, but we're the same people. All right. Must be twins or something. Yep. That we are. So, why'd you come over here? I don't answer questions. You don't answer questions? >> So, you just like coming in getting in the middle of crime scenes and filming them? I think it probably would have been a good idea to keep walking today. The man refused to leave and repeatedly demanded lawful confirmation from the property owner. This only made the confrontation more intense as both sides stood their ground. Moments later, the arrival of another person at the scene shifted the situation in a completely different direction. Are you here to do business? What's up? Are you here to do business? I could. On the property? I could. Okay. You want to come in and look at something then? Yeah, sure. As soon as I'm done here, I can go in and get some information. Okay. What are you looking for? What's that? What are you looking for? Prices and everything like that. Okay. >> What up, man? What's going on? Can I talk you a second? Yeah, that's fine. Uh do you mind if I go on your property and talk to him or All right, he's going to be in the property. He can hang Oh, no, no, I was asking He can hang out. He can hang out. No, no, I was asking if we can go over there cuz of the road noise. I can't I'm not able to hear you. Uh well, we're leaving here in a minute anyway. Okay. So, what's up? All right, so before I leave here, I just need to get his badge number and his uh or his business card or whatever the case may be. It's Deputy Camacelli. 315 is my badge number. Okay. All right. So, my only problem is I was just Here. Y'all Y'all can step over here. I don't want y'all to get hit. So, I can get your business card um but this is what I do. I film what public officials are doing on public property. I'm a journalist. I gather content for stories. That's cool. Uh but this officer here was telling me that I had to move back over there and stand over there. And I was asking him why. He told me that I I wasn't allowed to film inside the vehicle here. I mean, that's that's how That's their privacy, too. We got to get their consent to go in, so what makes it any different for you? Well, that's to go in. But I'm not going in. I'm just I'm just observing. That's kind of like equivalent to This is his property, but I can't film it cuz it's on his property. You know what I'm saying? It doesn't make sense and it's not against the law. Okay. So, he needs to get educated on that cuz that's clearly not the case, okay? Now, am I currently being detained here or am I free to go? You're free to go, man. I I I came all the way from Canisteo to talk to you. >> information. You need to identify me? Yes, sir, I do. >> For? Because you're witness to a crime and you said here and recorded the whole crime. I don't know what crime was committed. I told you. You Yeah, you told me, but I didn't know. I didn't know beforehand. >> ditch is under arrest for possession of narcotics. I didn't see y'all pulling the narcotics >> you still wouldn't identify yourself until you spoke to our sergeant. Now, you spoke to the sergeant, so I need to get your name and date of birth so I can I can give you a copy of the vehicle. I'll give you a copy of the video. >> a copy of the video. I need your identifying information so I can list you in the report as a witness. Yeah. I'm a witness. So, right now you're failing to ID as a witness to a crime. What crime? Hey, hey, hey, what's what's your first name, man? I'm I know what I'm What's your first name, sir? I'll give you my first name, it's Phillip. Philip? Yes. Just as the confrontation seemed to be calming down, a new exchange at the scene made the situation even more complicated. But only minutes later, the demand for identification was raised once again. And this time, the argument reached its most heated stage. That's what we're trying to explain to you. So, I didn't even ask for a witness. You're part of a You're part of It's You're part of any type of information that anybody that comes in We're going to have to ID him because he's in our cameras now. Yes. Yeah, everybody. That's how it works nowadays. See, I already got his business card. He already identified himself. Exactly. He gave his name and date of birth and all that stuff? I've got it all right here. I said I can go get a business card, too. I I said that. Well, that's fine, but here's the thing. You can't leave until we identify you. He walked up and had it ready. So, you can give us your name and date of birth and then you can you can walk off all you want, but the thing is is we got to identify everybody now that's a witness to this. He came up, he's in the video video of our cameras, so now he's identified as a witness. So, is he going to be subpoenaed? Is he going to be sent to court? >> be, yeah. He He can be. Just like you can be. So, it's up to the attorneys if they want to subpoena anybody. But you got to understand that all these cars have cameras on them and they see you standing here and they're going to be like, "Well, who's this guy? Did he have anything to do with the scene? Well, why didn't y'all identify him?" So, that's what I'm trying to get at. Where Where'd you come from? That's not relevant. It's not relevant? >> not. So, you just How do we know you didn't get out of this vehicle? You walked behind it. You're with them and you walked over. Did you Did you just really ask me that? Did I seriously just ask you that? >> Is that a serious question? Yeah, it actually is a serious question. Why would you randomly walk up to this and then fail to identify yourself? I already told you my supervisor what I do. I'm a journalist. I really don't care what you do. It doesn't matter. Any questions? Uh no, I just I'm just waiting on his business card and I'm out of here. That's it. I gave you I gave you my name and badge number. I asked for a business card. You said Well, I told you I don't have any. You don't have any. We don't We all don't have any, man. Okay, what's your name and badge number? My name is Cameron Shelley and my badge number is 315. >> Okay, thank you. For right now. Like I said, I already told you I'm a journalist. I gather content for stories. That's Yeah, we have no problem with that, man. We just don't like space. Everybody I mean CNN could come down here properly we wouldn't tell them to leave. I mean there's no difference just because you have a smaller camera. I don't care. Just don't get Just be careful where you go. Okay? That's what I was That's what I'm trying to get at. That's That's fine. I have no problem with you video taping. There's no issue. We don't do anything wrong. That's what I told you earlier. I didn't have a problem with you video taping. No. Sorry. Am I free to go or am I being detained? You're being detained. Tensions escalated as police continued demanding identification while the cameraman firmly refused. Both sides argued intensely over rights and responsibilities at the scene. But then a conversation with a supervisor began to shift the situation in an unpredictable direction. Yeah, we don't know what you're doing with and then we [clears throat] we there's no reason we should we should be looking behind us to see who's who's up to what. We don't know. Yeah, I told you that. That's why I sat there and I told him when he came over I said I'm not going to move from here and that's it. I mean you guys got like it was like five sheriff's officers up here so I wasn't talking to anybody. I wasn't yelling at anyone. Sat there silently filming and did nothing. But I mean I already got his information. I told you that I would get your business card. Um Yeah, we >> My car's back that way so I just need to go down there to get my go back to my car and get your business card and I'm out of there. And if you need the video I might have a business card. I might have to dig one out. >> Okay. I don't think I need your video, man. I'll be honest with you. I got plenty of video rolling. But I'm just telling you worst case scenario if something were to major Yeah, we would need as much as we could. Okay. >> so just just be careful with what when you get into whatever you're doing. I know this isn't the first time it's going to be the last time. I know. I I deal with this type of interaction all the time. I I should This is not the type of interaction I I would like to get myself involved >> You're You're The only reason these guys I know that they want to get my information but I'm telling you I didn't see anything. And I'm not going to lie and say I saw something that I didn't see. That's just point blank and period. I told you what I saw. I saw them put a case in a brown bag and some clothes in a brown bag. That's it. I don't I didn't see any narcotics. So you said Sir, Phillip? First name is Phillip. Man, it's been one of those days, man. So yeah, what's a good contact info for you? I I got a business card in the car and I can give you that. Is that your uh Is that your car up there with the I'm in the way back. Where you at? You see that car down there on the side of the road? That's where I'm at. Yeah, man, this this is what I do, man. This is what I do. All right. Uh I'll get your business card over there. Right there in the front seat. >> wait a few minutes. Just make sure you don't get run over or anything, man, and uh I'll stop by. Okay. And you And you just walk across when I pull up this side of the road. Okay. All right. All right. Thank you. >> All right, man. Be careful. The confrontation ended with a handshake, but what was captured in this video could spark a wave of legal controversy afterward. Up next, a group of activists walked into Houston City Hall to exercise their civic rights. But just minutes later, they realized entering a public building wasn't as simple as they thought. It's okay. You're not going to get your picture. Who? Are you a cop? Sorry. Are you a cop? You're a police officer. Why is he denying entrance? Why is he denying entrance? He's not denying you entrance. In order to come in, you have to sign all of these sign-in sheets. All right. To come into To come into the public to the to the public building? Yes, sir. Why is that? You have to also understand that's what they want in a public building. It's a government building and that's what makes the United States of America I know, but what about what about our fourth amendment right? This is a public building. We have the right to conduct business here without anonymously as well. And then they want to make you go through the rapey scan. Do you know your rights? Rapey scan, Jesus. Can I have your name and badge number, please? Yes, I'm Officer Green. My badge is 6587. I appreciate you, man. The moment they stepped into Houston City Hall, they were immediately asked to show identification. The cameraman refused and began questioning citizen's rights when entering a public building. But when he explained his real reason for being there, the argument quickly became more tense. Hi, how are you, sir? Good? >> How you doing? >> Good to meet you, Enrique. I'm Armstrong. Nice to meet you, sir. Um, I'm I'm a photographer. I go around the entire country doing videos in publicly accessible areas. I've been probably hundreds of city halls. I I understand this is Houston, it's a different place, but um, I'm concerned about them not letting me conduct business here and anonymously. They want they They my ID. Right, right, right. And you have an issue with showing your ID? Well, I have I have an ID. I don't have a problem with with with showing it. And but I'm working on a video about constitutional rights. >> That's fine, but we still need to know who you are. I mean, right? Can we ID you find out who you are? Well, you can if I give you my ID. But the thing is, sir, um I'm the type of person that I I I love and I respect the Constitution. And you as a police officer, you took an oath to to to to to my fourth amendment. >> Yes, sir. So, I mean, I'm not committing a crime. I'm not suspected of I'm not, you know, of any crimes. So, if I would like to conduct business here anonymously, uh you guys can't deny that. >> Okay, so that's the rules for here. Then, you got to follow the rules, right? Since you believe Well, you're you're a a law enforcer, not a rule enforcer, sir, with all due respect. Um you can't just get me to waive my rights if I want to. So, what exactly do you You want to come to this building anonymously? I want to No, I want to No, sir. Okay. I want I would like to conduct business anony- >> What kind of business? I want to do public records request uh from this uh building. I have the right to do that without giving out my name. Uh I don't know. Yes, sir. Yes, I Trust me, I'm the expert at this, not you, sir. Uh-uh, I'm here. [laughter] I'm here. So, do you have an issue with showing us your ID? If it's not an issue If it's not an issue, can >> It's not an issue. I'm not wanted. I mean, I'm just by a lot of women. >> [laughter] >> But sir, uh it's just The cameraman tried to explain his purpose for coming to City Hall, but police insisted he follow security rules before receiving assistance. Moments later, the next exchange pushed the situation into even greater tension. Could you at least help me with the form? Okay, I I I just give me the just give me the form. And that's fine. I'm here to pay for it, but there's we want to tell that we have thousands of We have thousands of viewers and we want to let them know that you know we're welcome at the city hall. You know we Once you get here that you're you don't have your first amendment he said I can't take pictures. Then you don't have your fourth amendment. Second amendment definitely out the door. So what's up with you guys swearing to protect and honor a constitution that you're not you're not really protecting. You're getting everybody to wave it at the city hall. This is not like the White House. You know what I'm saying? This is city hall. This guy gets voted in here by the people and then Correct, but it's So I talked to the lady that's in charge of the pretty much of how to rule the the rules for the building, the law and you know what the rules is pretty much that you you have to be coming have an appointment. You or anybody here particularly you want to see? That's fine. I'll make an appointment, but I'm just not showing my ID, you know I Yeah, you know I I I I I understand, but you the law is the law sir. You can put whatever in a in a paper, you know, you guys you guys didn't take an oath to to to the rules of the city hall. Well, all I'm trying to get is a form. Could you at least give me the form so I No, it's freedom of the press. It's free. In a private >> The debate continued as the cameraman questioned his right to film and access public services without providing identification. But just seconds later the exchange began to wind down as police made a final decision on how to handle the situation. This is public access. That's why I'm That's why I'm, you know, arguing this. No, and I know that I can get that I know I can get them I know I can get that through email. >> [laughter] >> I understand that, but I'm I'm Look, sir, I'm not trying to give you a hard time here at all. No, I'm at No, sir, I have I'm working just like you, sir. So, I'm working on a video. My channel is about the Constitution. I'm not going to I'm not going to do a video showing thousands of people of me waving my rights when I'm telling them they have rights, and you guys swore to protect that. So, So, so this whole building right here, sir, with all due respect, people should be welcome here to pick up whatever you you guys have everything everything has been provided to you guys. You can't just get me the form? Armstrong. Enjoy that walk of shame, Armstrong. This is not what you signed up to do. Have a good day.
