that could request for the 911 audio of an incident um that I was involved in at the post office here in Bair and he made contact with with the people who called the police. >> We just didn't have it on >> wondering um >> we don't do freedom of information press here. You'd have to do a pilot. Anything to do with 911 is protected by the arts. >> 911 calls. 911. An ordinary citizen challenges the entire system of power right in front of the camera. >> What's your name? >> You don't want to identify yourself? >> You don't know how to read. What's your name? >> You don't know how to read. >> Do you know how to read? >> You need better training. This is a first amendment protected activity. >> Just one simple question made the police reveal the truth about power and law. >> Is this private property there? >> I don't know. You want to arrest me for it? Is this what you get paid for? Harass a citizen that you're supposed to protect the rights on? From the very first moment, a seemingly simple request sparked a tense confrontation. >> I was just wondering, um, >> we don't do Freedom Information Press here. We're actually not subject to Freedom Information or the the RSA. >> What's your name and badge on it? Cuz you're telling me not to keep moving. >> With just a seemingly harmless request, but the cold answer opened up a wave of debate about civil rights and limitations that few expected. >> Do you work here? >> Yeah. >> Oh, you do? Okay. Are they uh are they taking any service calls? Like no. I uh I'd like to do a public records request. [Music] >> Hi Joanna. Um how do I go about doing a public records request? I'd like to do that with this office, please. >> How do you go about I'm sorry. Could you repeat that, please? >> I'd like to do a public records request with this department. >> A public records. Let me check with the supervisor. Hold on one moment, please. Is this a publicly accessible lobby? >> Uh, let me check with the supervisor. One moment, please. >> Okay. >> How you doing? >> Beach. >> How you doing? >> Good. I just talked to Joan. Um, >> we don't do freedom of information requests here. You'd have to do it. File it. >> No, I have to do it at this department. I'm not going to >> This is New Hampshire 911. We're actually not subject to Freedom Information or the the RSA. It is >> because our records are closed. >> Yeah. You don't even know. >> Yeah. But you don't know what I'm requesting. >> Anything to do with 911 is protected by the No, no. You can look that up. That's what I like to But I'm going to have uh I'm going to give you my director's information and you can contact him. >> Do you have a card? >> So that's director Mark Doyle. >> He's the guy that's our director. >> Um reach out to him. >> Yeah. Yeah. No, I will. Um I I typically do my record. Okay. Well, what do you mean? I'm curious. >> I've seen your videos. >> Have you really? >> Yeah. Yeah. >> Are you a dispatcher? >> Uh no. >> You're not? >> N you like I see what you >> Thank you. Take care, bud. >> Okay. All right. >> Well, I'm glad you know about me. The whistle had not yet blown, but the blue jerseys had already appeared. A seemingly simple question, "Am I being detained?" fell into an incomprehensible silence. >> Am I detained? >> Am I detained? >> Am I detained? Yes or no? No, I'm not going to listen to you. Am I detained or not? >> You can't go up to the property over there and put your phone against the window. >> Of course I can. Call a supervisor right now. Unless you have a problem with it. Don't blow smoke up my dude. Further. >> What's your name and badge on it? Because you're telling me not to keep moving. That's why. >> Ask you to come talk to us. >> I don't want to talk to you. Am I detained? >> You're not a very friendly person. >> Am I detained? Answer my question. What's your name? >> You don't know how to read. >> What's your name? >> You don't know how to read. >> Do you know how to read? >> Yeah, I can do the same. >> Is it right here? >> Say the same thing right back to what's your name? >> Officer Petra face. >> Thank you, officer. Yeah. Pizza >> professional. Shut up. realing professional. You >> No, you weren't. Just say your name and badge's number, dude. Don't be a >> Yeah, you should though. >> Okay. Can you just step back up from the car a little bit? >> Make me. Unless you're getting in it. >> I am going to be >> You getting in it? Good. Get the out of here then. Is this private property? Is this private property there? >> I don't know. You want to arrest me for it? Something I'm legally able to do. Do you understand me? I'm going back up there and I'm going to exactly do what you told me not to do. I can and there's nothing you can do about it. Do you understand that? >> Yeah. There you go. >> Demanding transparency, demanding fairness, but a delayed decision has raised suspicions. Who is hiding what? >> Ah, unreal. [Music] Don't look through my windows. Hello. >> You need better training. This is a First Amendment protected activity. >> Yeah. First amendment. I can look through your windows all day long. Get it right. >> What are you doing? What are you doing? >> What are you doing? It's going to sit here all day. You are. Call a supervisor. Call a supervisor. I'm requesting a supervisor. No, you can't. It's your policy. I'm requesting a supervisor. Do it. I'll get the out of here. I'm not leaving here till you do. You know that, right? I don't care. Is this what you get paid for? Harass a citizen that you're supposed to protect the rights on. Is that really? Call a supervisor and get out of here. That's the deal. And when you leave, I'll leave. My job is done here. Once you leave, my job is done. It's as easy as that. You want to talk, let's talk. But now you don't want to say a word, right? Why? Cuz I'm right. And you couldn't what? Tell me where to go and what to do. I'm not your averageing Joe, dude. You have no authority over me. You understand that? I'm not breaking the law, dude. Once you leave, I will leave. I promise. Oh, shake your hand on it. >> In the end, the police left quietly without making any arrests or providing any legal grounds. The incident highlights the gaps in police training regarding constitutional rights, especially the First Amendment. >> That's a slow drive of shame. Come on. Put on your direction to the right. All right, everybody. So, that's going to be it over here today at the Division of Communication Services in Laconia, New Hampshire for our first amendment audit. Uh, they did great at first. I talked to George and uh they uh yeah, he told me that he watches my videos. Maybe they did some training or something, but uh unfortunately uh they failed on this one. Uh 20 minutes after uh I ended up leaving actually and all of a sudden I hear a call on the radio about a suspicious male uh looking through windows and so forth and so on. So, I ended up rushing back here just in time for the PD. And uh obviously uh you know there's always one tyrant man. There's always one tyrant officer. Couldn't identify himself verbally. Couldn't be professional telling me to come here. And then the other officer identified himself. Name and badge number. Laconia PD so forth. >> Citizens may sue public officials for violating their constitutional rights. Pursuant to 42 US Code SS1983, individuals/organizations are required to pay damages to the injured party, violating police officers may be disciplined, have their licenses suspended, fired, or expelled depending on the policy of the agency/ police chief. The incident reflects the risk of abuse of power when police are not transparent and do not follow procedures. Up next, a camera, a public building. Just a few minutes later, the atmosphere in the post office lobby heated up by the second >> that there's no photography allowed in the post office. I was told that uh got sent a letter by the records clerk and uh she told me that there was only a 911 audio and there was no body camera footage. >> A camera, a public building. Just a few minutes later, the atmosphere in the post office lobby heated up by the second. >> Um, who are you? >> I'm the postmaster here. You're the postmaster here. >> Okay. Um, no. Just the clerks were saying that there's no photography allowed in the post office. >> What are you recording for? Are you a news agency? >> Why Why would there be no photography allowed in a public building, sir? >> This is not a public building. This is federal building. This is federal property. >> Federal public. It's It's all the same thing. You're mistaken. And now I can see why your clerks are mistaken. Can I get your name, sir? >> My name is Rob. >> Rob. And you're the postmaster here? >> Yep. There's 100% recording inside of lobbies, foyers, and >> Is there a reason you're recording? >> Oh, yeah. No, there's a reason. I'm an independent journalist. I'm just gathering content for a story that I'm working on. >> Okay. What story are you working on? >> On the post office here in Bair. Oh, I don't want to divulge the specifics until the story is actually published. But no, I'm working on a story on this on this post office here in Belair, Maryland. >> Like what? Not specifics, but what's your story about >> the post office in general? In general, >> about what? operations or what? >> Yeah, everything operations. >> And if you're a journalist, something along those lines, yes, then that is something that could be done. >> Yeah. >> But the reason that there's no filming inside of this lobby right now, there's no customers in here. Well, that's why it's not >> I mean, I can technically see their credit card information. What would be the difference? >> Well, you're not supposed to see it either. That's why there's no reporting in the post office. >> Yeah. No, that's not true. And I think I think the problem that we're having here is that you know you don't even have the rules and regulations posted as is required by the United States Postal Service. Are you familiar with poster 7? The rules and regulations governing conduct >> should be on that wall right there or right outside? >> No, it you don't have it posted. Are you familiar with the rules and regulations governing conduct on postal property? >> Sure am. >> Also known as poster 7. >> An emergency call is made. The police are on their way. Who will be in trouble when the truth comes to light? >> No. You can leave the lobby or I can call the postal police and have them come out and explain it to you as well. >> I would I would invite you to call the postal police, the postal inspectors, because I think they'll explain to you business here. I just told you I'm an independent journalist, sir. >> Are you buying postage? Are you doing any of that? >> That's irrelevant. The the the point is is that I'm an independent journalist gathering content and exact and I am telling you that >> post office and I'm asking >> but you're not running it effectively, sir. >> I'm asking you to I would invite you to call the postal inspectors. No, it's not. No, it's not. I would invite you to call them so they can educate you. >> What's going on? >> I have a customer in my lobby that's recording uh videotaping. Please >> I can barely hear you, sir. >> Can you hear me now? >> Am I on speaker phone? >> No, I'm just in a bad spot. >> Okay. >> I have a uh I have a customer in my lobby that's recording video recording. >> Okay. That's not against the law. >> Well, in the federal building, it's not permissible. Okay. And why is he videotaping? >> Video and a story on the postal service. >> Okay. Rob, what's your last name? >> Robinson. >> Your call back number? >> 443. >> 845. 8229. >> 8229. What's he >> asked him to leave? Um, is he wearing all black? >> He's all wearing all black. >> And he's still in the lobby? >> Yes, he's still out there. He's He's He asked me to call the police. Oh, he asked me to call the police so so I could be learned >> what my what the rules are. >> Okay. All right. I got all my guys on a disturbance and I'll get somebody over there after that. >> Thank you. >> Thanks. Bye. >> Nice. Bye. >> The police showed up, but they quietly went straight inside. Not a single camera was turned on. What was hidden behind that door? >> Hi. Yeah. Who are you, sir? >> I'm the chief. >> Oh, the chief. >> Yeah. >> Yeah. So, I was told that there was no Can I get your name? Sorry. >> Charles Moore. >> Charles Moore, the chief. >> And what's your name? >> My name is Sean. Okay. >> I was told that um when I did a records request for the 911 audio of an incident um that I was involved in at the post office here in Bair, >> I was told that uh got sent a letter by the records clerk and uh she told me that >> mean sir like >> it means it for us he was following our policy and the policy says there really wasn't an interaction that required turning it on >> and that's in line with your policy here or just turn it on whenever you want because I would think that the public would say if you have body cameras and you're using taxpayer money to fund body cameras, you should have them on it. >> So, if you want to see our policy, it's online. >> Yeah. There was a 911 call though, sir. >> And and police responded to a 911 call incident. >> And I'm telling you, Mr. Reyes, >> well, I I just think that the public should want >> the police officers here to keep their body cameras on. >> He didn't even come in. Did he come in contact with you? >> He didn't come in contact with me. No, he did not. But he came in contact to what happened. He came. It's not like he didn't come at all. I on the camera you can see his you can see the officer pull into the parking lot and go and speak with the people. So it's like it's kind of with with the postmaster. So why wouldn't you turn on your body camera? Is there something that your police department is hiding or >> Absolutely not. >> Okay. I mean just doesn't make any sense to me. Chief, >> I'm sorry Mr. No, it says that you turn it on when there's an interaction that looks like it rises to the level of needing a body camera. I'd have to look double check it, but I invite you to go check the uh policy out online. >> Okay. I would I would suggest that you know any any interactions with the public because then what's the point of having body cameras? You had an interaction with the postmaster. >> Yeah. But it didn't rise to that level. And also and I know it really didn't we're not looking at the really the post office's rules about videoing and photographing in there, but he might have been looking at that, too. >> Yeah. >> A small sign appeared, but it carried a big message about civil rights and the responsibility of law enforcement officers. Poster 7 was officially hung. The postmaster admitted his mistake and had a peaceful dialogue with the people, pledging to understand the law better in the future. >> Maybe you can get one out there, too. >> Yeah. >> Just just so that way everybody could see it. Did you speak to the inspectors? >> Yeah. >> Everything's okay. Right. >> Well, they said just, you know, if you're not bothering anybody, not impeding anything, >> right? Yeah. Well, so they what they said was as long as you're not up here in this area, if you're taking pictures of like that wall out there, that >> their concern is is the is the credit card transactions, but you know what I just noticed? >> You guys, your credit card transactions aren't even working right now. >> Right. You're right. >> I'm going to have credit card transactions. >> So, in all honesty, >> yeah, >> I see this stuff on TikTok, right? I see it on YouTube. You need to leave and then it turns into this big >> Yeah. >> Is that what you're doing? >> But do you but do you see the difference between me and some of the other people? is that I I'm trying to be more, you know, educational type of deal. More respectful. I'm just It's more for educational on our rights and, you know, the rules and everything else. That's all. >> I guess my question is next time you want to do that. >> Yeah. >> Why don't we go all in and just call me? >> Well, she Well, they called you right away and we had but we had that disagreement in the beginning because >> about the about the rules >> about this rule right here. >> About this rule right there. Exactly. >> Did you Did you zoom in on that rule? >> No, but again, photographs for news other photographs. That's why it says other photographs. And that's why I' I've spoken to many postal inspectors and I wouldn't do that. You know what I mean? And when I first walked in, you didn't see me. I'm taking pictures of, you know, all around here, the cards and everything like that. So, you know, I'm I'm not here to, hey, listen. No, it's not because >> not only for what I do, but like let's say I've heard people people have uh reached out to me via email and say, "Hey, you know, I'm taking a picture of my package and they say you can't take photos in here." So, >> you know, I just try and educate so that way look now if as somebody comes like this, it comes here and films, you know, it's going to be a different story, right? >> So, what is the rule or your take on the rule of videoing people that don't agree to be videoed? >> Well, if you don't agree to be videoed, you shouldn't be in public. >> Any abuse of power, no matter how small, can erode social trust. Hey everyone, what do you think about this situation? If you enjoyed the video, don't forget to like, subscribe, and support us with a donation. Thank you so much. >> Help me. Help me, please. [Music] >> You feel them. >> The controversial arrest was captured in full on a police sergeant's own body cam. >> Give me an arm now. >> Wait, here go other. >> I'm helping. I'm helping, bro. I have no idea why I'm in handcuffs. >> I don't know why you're in handcuffs either. >> Amidst screams for help and cold handcuffs, the man repeatedly begged, "Don't let me die." Well, why was he arrested in his own yard? >> Do you feel better? >> Do you feel better, bro? >> This [ __ ] hurt like a mother, bro. >> This [ __ ] hurt like a mother [ __ ] bro. Cuz I've done nothing. That's not >> Do you see now? Just because of a broken car and some sidewalk stories, it led to six police cars and a series of street fights. What did they really do wrong? >> What? >> Help me. Help me, please. >> Give me your arm now. Wait, here go other. >> I'm helping. I'm helping, bro. >> There you go. Yeah. Yeah. Yep. You want to search my booty hole, too? >> There you go. You want that too? That's what you want? That make you feel better? B. Ain't nobody did [ __ ] to you. Nothing. You feel big. You you feel big. >> Hey, this will go better for you. >> No. Hell no, man. You weren't even here. This [ __ ] ain't do [ __ ] >> Apparently. Hey, you know being black in America is the worst thing you can do, right? >> That's it. >> That's it. Being black in America, baby. >> You know who I am, [ __ ] >> Let's go, baby. >> Out of here, man. >> I love you. That was smart. >> Hey. Hey. Being black in America is the worst thing you can do these days. >> Being black in America is the worst thing you can do. A shrill protest amid handcuffs. But who really crossed the line? >> This [ __ ] hurt like a [ __ ] >> Put on your ass, bro. >> This [ __ ] hurt like a mother. >> Hey, he locking us up because nothing. Literally because of nothing. I feel >> literally a big ass mustache. That [ __ ] need to say, >> "Hey, can I get name and badge numbers >> for everybody?" Can we get a naming badge for every man? You know what? I like you, man. Cool. >> Huh? >> What's your name and badge number? >> I'm the supervisor. >> That didn't answer my question. >> What's your deal? >> I have no idea why I'm in handcuffs. >> I don't know why you're in handcuffs either. >> All right, we in the same boat. What's your name and badge number? >> Thorne. What's your badge, surgeon? What's going on? >> I don't know. I came up. They were at my door. They put me a handcuff. >> Okay. >> What are we fighting over today? >> I have no idea. What? I have no idea. >> Like [ __ ] Like, see that truck over there? >> Okay. >> See how it's on the mother thing? >> There's one that's smoking. >> No, no, no. That That's I had just put in I just replaced the wheel bearings for a test drive. >> Didn't work out. >> Okay. >> So, my old truck came off and stuff, right? We got some pigs we got to pick up. Like nothing. So I have zero idea why these guys are here. >> So someone called 911, said that there was a fight here or an argument. >> It was not me, her, or him. >> So who was it? >> Not me, her, or him. >> I know. I I I don't know. I I don't know why I'm in cuffs. Like Like I came around the back, right? Because my daughter came and she was like, "Hey." >> This man claims I did everything they asked me to do. So why is he the one lying on the sidewalk injured and being charged? >> You being less than cooperative. >> I haven't I've literally done nothing but what they've asked me to do. They got cameras. They So you we'll see it. So >> yeah, I'll I'll look at the cameras. All right. Give him your information so we can get all this sorted out. >> Giving [ __ ] bro, cuz I've done nothing. >> All right. >> Do you see? Now we see. >> All right. >> Now we see what >> I'll talk to you in a minute. >> Oh, you s >> Yeah. >> Oh my god. I come up cuz the truck up. So we were trying to get our car to work. We were switching out [ __ ] [ __ ] in the car. G nothing happened. I said, "What do you mean exactly?" So I came outside. So I come outside and I'm like, "Hey, what's going on?" That one cop is around and fighting with Terry and [ __ ] They rolling around steady push me and [ __ ] You know, it don't even mean look, >> okay? >> It don't even matter to tell y'all cuz you It's not like you're going to, you know, I mean, it's a mix. Y'all wear that badge. So, I mean, all this is recorded, right? Because we all got body cameras. I got a body cameras. He has a body camera. >> And when And when your man's got here, I told him, "Bro, ain't no fighting, ain't no argument, ain't no none of that, bro." >> He say, "All right." He said, "Can you get him off like Can you get off his back and shit?" You know what I mean? >> He got mad at me for saying >> again, say this to y'all because you're not going to believe me, brother. >> You know what I mean? And that's part y'all here to serve and protect, but anything I tell you is going to be understated. Y'all not going to listen to me. You see what I'm saying? >> You're not. You're not. You're not. >> When the officer confesses, "I knew who he was the moment I saw him," the truth about the warrant is revealed. But is it reasonable to arrest someone first and then verify their identity? >> I think you know who lives here. >> I recognize him as soon as I saw him, but he's still continuing to refuse to identify himself. >> We got called for a domestic disturbance. Knock on the door. Terry Rucker comes around the back, says, "I don't answer any questions. Get the [ __ ] off my property. Runs back inside the house. She comes out of the house and talk to us. >> Yeah, I think this should be good. Be okay with her. Thank you. >> She comes outside, starts talking to us. >> Terry comes back out and starts pushing her back inside the house. Franchie pushes him back and then he starts using two things and he won't tell us his name and he's got a warrant. >> So, he's going for refusing to identify. >> I know who this is >> and I found out his ID. Oh, >> and he's got a warrant. Good work. >> So, he's going for resistant. He's going for resisting his warrant. >> Cool. >> What's his name? >> His name. >> We're good, Barge. Appreciate it. >> Hey, what's what's old boy's name over here? >> Should be William. William Degraph. That name sounds familiar. It's got a warrant, too. Valentine. >> I need some leg room cuz I'm so tall. >> Can we get in a truck? Cuz I need some leg room cuz I'm so tall. I need some leg room cuz I'm so tall. >> If it is proven that the police made an improper arrest, assaulted someone without cause, and violated civil rights, it could be grounds for a lawsuit or internal investigation. Sergeant Thorne's body cam video could very well be used as evidence against the police in court. [Music]
