No. >> But you see, you don't know the whole situation. That's the thing. >> Yeah, you know, but it's like But you know the situation, do you feel differently now? I get that. I get that. So, when I went to go grab her and talk to her, she started running, leaving, pulling away from me, trying to fight me. >> Well, that's the thing. I didn't see her running, you know. >> before you go to a snap judgment, you got to get all the facts. >> But right here, she wasn't running. A passerby dared to stop and question, but the police's answer will shock you. Yeah, let me see your feet. All right. There you I'm going to stand up. Take your feet up. Okay, let's uh Let's get her out of here on the ground. We can hobble her. And then we'll get her in the car. On the ground. On the ground. On the ground. We'll figure that out. This lady is crazy. I'm going home. Stop doing that. I'm going home. All right. Relax. All right. You want to try to get her in the car again? Or we got more people. A concerned citizen. Yeah, we're good. So. Help get her in the car. One, two, three. Come on. Stand. Yep. All right, sit down. Hop, hop. Let's put her Okay, all right. Got him. I know this. Hey, we're going to sit in the car, okay? We'll get it. I got to get in the car. At the police station, instead of providing medical assistance, they had an unbelievable celebration in front of the pain of the arrested person. Come on, ma'am. I'm going to run. You're going to run? Oh, good thing we got the hobble. You guys grab her arms. Yep. We got her. I owe you money. That's okay. We got you. We got you. Ms. Garner was taken to the police station, handcuffed, and left to sit for hours without medical attention. The result, a broken and dislocated shoulder, nosebleeds, facial abrasions, bruised knees, and PTSD. Hopp's report was false, only minor scratches, and was approved by superiors. The city of Loveland hired an independent unit to investigate and prosecute Hopp and Jalali. On September 9, 2021, the city paid $3 million, $0 in compensation to Garner. The incident is considered a classic example of abuse of power and internal cover-up. Next. A normal neighbor greeting ends in blood and screams [music] right outside the door. Get out here. Are you done? Get on the ground. No. Oh, [ __ ] A 75-year-old man had just stepped out [music] when he was met with a series of shouts of put it down and an electric shock that knocked him out on the spot. Wait, wait. Sir, swing your legs up. The victim wiped the blood from his face and vowed if they met again, he would solve things himself. [music] And just when the story seemed clear, suspicions of police abuse began to emerge. Beat his [ __ ] ass. The fact that I got knocked out my [ __ ] face. All right, so what's going on with you? Over next door? She got punched in the face. [music] Cuz I'll take this into my own goddamn hands. [music] Well, that wouldn't be a good idea, either. No, absolutely not. You have one on the front, that's where the registration When the Constitution [music] is quoted in the middle of the desert, the police officer doesn't even bat an eye, and the reaction afterwards will leave you in disbelief. But when you put somebody in handcuffs, that's a disable event. It's not going to come off that way. I just got to It's not going to come off that way. That's a six. I think that's a 16. Well, when there's two or three of you, you keep trying to go back to your car, people aren't identifying themselves, I'm absolutely going to put people in handcuffs. No. All right, are you going to provide me with your identification? I just I have to identify myself, and I did. Now that I'm detained >> name and date of birth? My name is Mike Hera, H I E R A. I don't put hands on people unless they want hands back. That's how I was raised. Okay. Well, I got to do my job. Yeah, but you don't have to do it with tyranny or else because I don't When people are sitting here not doing nothing Finally, a surprising decision is made. >> [music] >> Two people are arrested, and the reason makes viewers wonder whether this is law enforcement or abuse of power. Well, you're both under arrest for interfering or interfering with ICE agents. And I have a minute girl liar. You're straight up >> Um, he's going to stay here. Well, he's not coming with us anyways. You're straight up liar. I'm not letting you into the camper to get to get stuff for anything. So, are you good with that? Does that satisfy? Yeah, that's fine. Okay. Can I tell him call my mom and tell her I was arrested? Where are we going? Oh, they're taking me, too. You're We're going to Henderson. Yep. It's a federally approved holding facility. Oh, it's federal or what? Is it federal or what? Is it federal or Is this because I said federal it's going to be escalated to federal or going this far? No, it's cuz you wouldn't get in handcuffs and you're out here illegally camping. Tell them what you need and everything, and then we can we can discuss that after, okay? Hey, call my mom, tell her I was arrested and taken to Henderson, Colorado. No. Or Henderson, Nevada. So, I'm going too, then, right? Yeah. Oh, tell Ryan what he was doing. And what are you arresting me for? Same thing. Huh? What is it? Illegal camping. >> I'm not camping. And >> It's daytime. And I asked you if I was here for longer than 24 hours. Yeah. And Resisting, interfering. I'm not resisting. I didn't resist. >> Absolutely. Okay. No, I didn't. It's no slower though. Cuz I'm on disability. Is that I didn't know anything you wanted out of the car? Don't even go in At the end of the video, both Michael and Theodore are announced as under arrest for illegal camping and resisting [music] police, despite the absence of serious resistance. Police refusal [music] to release handcuffs despite cooperation, detention without a warrant, and use [music] of unnecessary force can be subject to a lawsuit under 42 [music] USC SS 1983 for violating constitutional rights. Just minutes after [music] entering the public building, a journalist was suddenly surrounded by a mass of police and staff. They really think they're intimidating somebody when they're really not. Why are you confronting me? You don't want to be polite and give me your name. This is a public building. I'm not doing anything illegal. Seven officers standing in a circle [music] demanding to see ID while refusing to identify themselves. Is press freedom being stifled in government buildings? Very rude. Wait right there, call the deputies. They really think they're intimidating somebody when they're really not. Wait right there. I'm calling the deputies. >> [laughter] >> Like, there's no need for any of that whatsoever. You work for the public. You confronted me. I would just like to know your name. Why are you confronting me? You don't want to be polite and give me your name. Excuse me, get to where you need to go. Sir, I don't even You've been very, you know, rude and unprofessional, so at this point, yeah. >> worth of probation department, so I just don't want you What does that mean to me? Yeah, but, you know, you weren't You were very un rude. >> business here probation. I don't know what he wants. He's recording us and Hey, how are How are you guys doing? Can I get your name, please? I know you can't. Okay. Can I get your names, please? Why are you here, sir? Can I get your names and badge numbers, please? We have county business. Can I get your names and badge numbers, please? Can I get your names and badge numbers, please? You got to go. I have business to conduct here. What is it? I'm an independent journalist, I'm gathering content for a story, and I'm exercising a freedom of press right. So, no. No identification, no identification, no identification. You're not. I don't I need your name and badge number. Okay. Well, this is the probation department. >> business. This is a publicly accessible area. I have freedom of press. So, I do have business here. I'm working on a story on the probation department as well as the county building. >> Minutes of escalating tension, threats of arrest, forced eviction from the building. Was this a blatant abuse of power in front of the camera? And I need to know who you are. It's not that big of a deal. Can I speak to a supervisor? I am, I'm the supervisor. You're the I'm not on probation, so that way, you know, somebody with who has a jurisdiction here. I'm sure you can understand that it's just we have clients coming in and out of here, and we just want to make sure we You refer to them as clients? They're clients? Clientele, yeah, sure. Okay. People on probation This is a public building. I'm not doing anything illegal, I'm not No, no, I just want to make sure I I would have answered all your questions. I would answer all your questions. I would answer all your questions, but but you're not You've been very rude and condescending, and you haven't identified yourself properly. Can I get Can I get your name? Sir, can I get your name? You guys are setting a real good example for the sheriff's department here by not identifying yourselves. It's really unprofessional. It's ridiculous. We just want to make sure everyone's safe. So, you want to You want to circle around me and not identify yourselves? >> to make sure you're safe, too. That's all. Why would I not be safe? >> Well, sir, you wouldn't identify yourself, you know. I don't want people standing behind me. Okay. Um, yeah, you don't want to identify You don't want to You need to leave. It's constitutionally protected business, sir. You don't control the public public hallway. I'm not in a restricted area. You don't control the public hallway. This is a publicly funded building. There's no need for any of this. I'm not I'm not being disorderly. I'm not You don't have a right to know who I am. First of all, you're just a probation officer. Okay. Okay. So, you 100% does don't have the right to know who I am. Just you have a right to know who I am unless they have reasonable articulable suspicion I've committed a crime. Sheriff appears, a spectacular turnaround, opening up an unexpected turning point, but can he save the collapsing image of the force under his command? Tony Sheriff 820. Okay. Hi. Um, are you supervisor? >> [music] >> I'm the sheriff. You're the sheriff? Nice to meet you. I just All I'm doing is exercising a constitutionally protected right, taking some pictures and video. And the Yeah, but I'm surrounded by 1 2 3 4 5 6 law enforcement officers, seven including yourself, sheriff. And then when I asked for their names and badge numbers so I know who I'm dealing with, how you were so professional, sheriff, and you provided that to me, they would not. They would not provide any ID any type of um identifying information as their badge number or their name. They just >> a right to video. No, is it your policy to identify yourself to the to to people to the people you come in contact with? >> I just did, right? I'm talking about your your deputies. So, but your deputies are here, correct? Some of my deputies are here. And none of them identified themselves to me multiple times, sir. And they just stood there looking at me. I gave you my credentials. So, now I can ask you, do you have a legitimate purpose in the building other than just walking around videoing? Yeah, like I explained to all your other deputies, I'm an independent journalist. I'm just in the publicly accessible areas of the building. You want to do an interview sometime? You just came here. You got to go. You got to leave right now, trying to kick me out, violate my constitutional rights. And then when I try and hold them accountable by finding out their name and badge number, they don't want to give it to me. They just stand there, and they're like, I'm not giving it to you. No, I'm not giving it to you. Okay. Yeah, I gave you mine. After all the truth is revealed, but the consequences for the offending officers and the message for society from this incident will make you think. We're going to be getting out of here now. All right, guys, so we're just getting out of the Herkimer County office building here in New York. Definitely a crazy experience inside this building, surrounded by seven law enforcement officers, all for a camera. It really doesn't make any sense. Very unprofessional. You know, it's just professionalism that when you have the honor of working for the public that when a member of the public who pays taxes to pay your salary asks you for your name and badge number, you politely give it to them. It took the actual sheriff of Herkimer County to come down here for them to properly identify themselves and for him to de-escalate the situation. Cuz you saw at first, they were ready to remove me from the building with force, and I stood strong knowing that I was in the right that I was simply engaging in a constitutionally protected activity, nothing more, wasn't breaking any laws. The two deputies in the front still didn't want to identify themselves to me. What's the big secret? It's all public information. I don't understand. Why do they treat people this way? And if the deputies treat me that way while I have a camera remember if they're acting that way on camera imagine how they act when they're not on camera. I'm going to reach out to the sheriff here see if he will do that, sit down with me. I sincerely doubt it, but hopefully he wants to better and bridge the gap between the public and law enforcement, and we can try and hash out what happened here, and we can see how we're going to move forward to do better. Citizens may sue public officials for violating their constitutional rights pursuant to 42 US Code SS 1983. Individuals/organizations are required to pay damages to the injured party. Violating police officers may be disciplined, have their licenses suspended, fired, or expelled, depending on the policy of the agency/police chief. The video ends with no arrests, but the actions of the officers involved have eroded public confidence in law enforcement. Up next, just because of a camera, a citizen was surrounded, asked for ID, and had the answer whether or not he was detained [music] avoided. That would be a violation of state preemption. You know only the legislature can make firearms. No, you kind of came up cocky. And ma'am, if I ask you if I'm detained, please let me know in the future. And Lawful activity. You know who knows this is lawful activity? Your Sergeant Davis. >> The officers and an unclear verbal order. Violation of park rules, violation of election. But is it the truth or just an excuse to detain [music] people? Were you over there in Vince Foster Park earlier today? I was down on the sidewalk. Why? Okay. What did he ask? Well, why? Because you're you're carrying a sidearm and that's a violation of the park rules. And second off, if it was a violation of park rules of rules, it's preempted by the state of Pennsylvania. As a law enforcement officer, you should be aware of that. So, don't go and give me grief. That would be a violation of state preemption. You know only the legislature can make firearms. I'm sorry? You're not being stopped. >> Well, that's funny. I asked her like I mean, I know I don't feel like I'm detained. I know it. inside of a polling place or >> inside a polling place or I didn't say you did. Okay, well then what do you mean by that? >> from the government building stating there was a subject >> Congratulations. Acting I'm telling you what the caller reported to the police. >> That's fine. Okay, but you came up cocky. Yeah, you did. I said 90. Dude, I'm [music] respectful to you. No, you kind of came up cocky. And ma'am, if I ask you if I'm detained, please let me know in the future. Please, I'm not trying to be a Okay? But you guys got a freaking, you know, be reasonable. I didn't call you guys. I know you didn't. Okay, I was on my way out. >> a citizen called us from the government building. What about the citizen up here that threatened to beat my ass? I had to pull out my mace. Do you have a No, no, actually I don't. But he said he was going to call the police, so I figured maybe he did. But yeah, he was off his rocker, man. But like I said, um lawful activity, man. You know this is lawful activity? Your Sergeant Davis. So, and he knows. He knows who I am. So, you can talk to him, okay? But dude, I I know you didn't. But you can't roll up on me three deep for a lawful activity. That's unheard of. That's ridiculous. In Florida, shocking statement, everyone must carry ID by law. But when the actual law is cited, the situation completely changes. [music] So, Barbara, Quincy? I thought I called county. They called both of us. I'm just out here taking photos out in public. That's all. Uh the prison? Yes, sir. It's right there. I saw him washing his vehicle. Why are you taking pictures of the I'm a journalist gathering stories. It's investigative journalism. >> a ID on you? Uh I'm standing on a public sidewalk taking photos out in public. That's all. Well, that's fine. I actually told you to leave. I understand, but if I'm not being detained, I'm not going to produce any identification. Well, sir, you need to move along, then. What would happen if I don't move along? You'll go to jail. For what? For what? >> Yes. Because I've asked you to move along and you're taking pictures of the facility there. Is that illegal? You're breaking a law. I told you I'm a journalist gathering And then at this point, it is loitering because I asked you to find and you came and said Not really. I have no I know I'm trying to prove to you who I am. I'm Am I allowed to If I'm not being detained, I'm I'm saying You have a nice day, too. You're free to go. 13 and 109, if you could be in route. So, you Are you trying to trespass me from a public sidewalk? No, I'm asking you to walk along. Keep moving. Uh I'm not going to keep moving. I got a job to do, so that's I'm out here to do my job. I would appreciate it if you didn't I appreciate it if you didn't interfere and obstruct my with my rights. This this is constitutionally protected activity safeguarded by the First Amendment. I have every right to do this. Well, if you're from Florida, you said Florida also requires everybody to have identification. Which is true. So, you have to have identification on you? Mhm. At all times? Mhm. A chilling line rings out, the badge allows me to do [music] it. When power is used to silence citizens, what really happens behind this line? Yeah, he's he's recording right now. Am I free to go? No, you're not No, you're not free to go. So, I'm being detained. You're not free to go. I'm not free to go. >> Okay, this is not a public building. That's not a public building. It's It's a state correctional institution, man. You're in a public place. >> county sheriff's office phone number 627-933-233. And if you need anything further, I can give it to you. This is a security issue because >> This is a First Amendment issue. This is a constitutionally protected right safeguarded by the First Amendment. >> Once you come off the sidewalk, >> care about. You witness me on their property. I will request it. >> sergeant or lieutenant and let's just You did video tape? I have my chief of security right Okay, because if you step off the sidewalk, we have a we have a big issue. You're not free to go. So, I'm being detained. Temporarily. For what reason? What's What's your reason of articulable suspicion? >> an investigation. Based on what? What am I doing that's illegal? >> an investigation and you will and you will be quiet. >> your reason of articulable suspicion? >> an investigation based on a potential security issue. >> Potential security issue. >> Potential potential security issue. That's right. I've explained to you I have right to see the tapes. And after I see the tapes, So, you got to detain me till you see the tapes? >> Can you shut up long enough for me to finish talking? >> very nice. >> Until I see the video tapes, I am officially conducting an investigation. Once I view them and I see that you never step foot on this property, you are free to go. >> What's your reason of articulable suspicion that I've committed a crime? Did you take an oath to uphold the Constitution of the United States, man? Are you aware that this is a First Amendment right? Are you remaining silent? I am pleading the fifth. How about that? A sergeant ordered them to leave the public parking lot calling it private property without any signs or legal grounds. And then his own teammate [music] said something that stunned everyone. Isn't this not the public parking? Well, how so? It has no signs saying no There's no no trespassing sign, ma'am. No, I understand, but there's there needs to be no trespassing signs. Is that a lawful order? I'm telling you right now you can video tape. I'm just asking. Here, I'll turn my flashlight at you. But is is that a lawful I mean, I'm telling you this is private property. But there's no sign The office is now closed. I understand, but there's no signs saying no trespassing and no trespassing. Okay, I'm asking you to You can video tape from the sidewalk. I But is that a lawful order? I'm telling you please stand on the sidewalk. Well, I have a right to video tape the cars if they're in public. If I can see them, I can video tape them. Don't stand Don't stand on the sign. I did not stand on the sign, ma'am. I never stood on the sign. I never touched it. May I ask May I ask what his name and badge number is? Okay, so you're a sergeant and you're acting like that? That's disgusting. That's disgusting, sir. What's your badge number, sergeant? Excuse me, ma'am. So, we got Sergeant Nunez. He came and made this And he's a sergeant, guys. This is where your tax money goes to. I'm harassing you? I was asking the nice I'm done talking to you. You're irrational. I'll I'll wait to talk to you when you're ready. All right. Justice exists only when power is held accountable and every citizen has the right to demand transparency from those [music] who act in the name of the law. Hey everyone, what do you think about this situation? If you enjoyed the video, don't forget to like, subscribe, and support us with a donation. Thank you so much. Next, a citizen came to film a 100-year-old building. But just a few minutes later, the entire government office was in chaos because of a camera? Are you going to violate my rights? Come right in here. Which Uh who are you and what's your name? My name is Ann Reed and I'm the administrative [music] assistant in this office. Hi. All right, let me go see what else I can find in town. I appreciate you guys being professional. What seemed like a polite conversation suddenly turned into a fierce battle of words. Are the people encroaching or is it the government that is overstepping its bounds? I want to check out all the publicly accessible areas of this building. Just cuz it's the old building 1888. I saw it was built. Um The judge's office is at the end of the down in the hall. Okay. >> [clears throat] >> Looked like it ended right there, so I wasn't sure. >> a couple of offices down there. Okay. Okay, cool. All right, thank you. Hello, how are you? I'm just fine. Uh I don't need any help. I appreciate it, though. And actually, is there anything that you recommend I look at? Yeah, I'm just getting some video of the building. Uh so, it was built in 1888. Is that correct? Mhm. So, I'd like to check out historical uh public buildings. I don't know if we need to let you video inside. Oh, it's definitely a public This is a public building, right? So, this is a public building and anywhere that's publicly accessible, I have the right Yes, ma'am, and that's a First Amendment protected activity that the Supreme Court's already ruled on. So, I already asked where I couldn't go. I saw signs that said employees only upstairs. I'm not going up there. I just wanted to get some pictures and I'll be on my way. And that's That's how the law is. That's my rights. I'm not doing anything to anybody. No one expected that a few weeks later, the same deputy chief of police who had come out in support of the right to film would be arrested right on the street for blatant illegal behavior. I'm not going to get behind anyone's desk. What's the purpose of your video? Uh this is a historical building. This is a 150-year-old building. I usually put them on I I publish them in various places. I just >> You just said you would make demands of us. We can also leave. I'm not demanding anything. I'm just Is this the Is this your office or is this the public's office? I am in charge of it. You're in charge of it? Okay, and I'm not even asking to come in there, so I don't know where you why you butted yourself into this conversation. I'll continue talking to her. She was being polite. You You weren't. I'm not I'm not talking to her anymore. >> [music] >> We need to de-escalate. De-escalate. Are you going to violate my rights? Come right in here. >> Absolutely. I'd love to. Let's check this out. Who is this? Are you detaining me? I can leave right now if I wanted to. Would you please We've got stuff out on our desk. That's on you to to make private, ma'am. You just asked me to come in here. And I'm telling you to stand out in the hallway. >> You just asked me to come in here. >> Ricky to come over here? Yeah. Right now. I was being polite. I'm just getting videos of this historical building, and now you want to try to order me around. But, sir, you're telling I'm not going to say anything else in What was I telling you? I wasn't telling you anything. I was telling you that I was following the law. You can't make me do anything. You can't This isn't your office. This is the public's office that the taxpayers pay for. I wasn't even going to come in here but to say hi and leave, but you wanted to Uh who are you and what's your name? My name is Ann Reed, and I'm the administrative assistant in this office. Hi, Ann. I'm Justin. Justin. Justin. Okay. That's all. And why did she have to get up? >> works for the public, and I'm a private citizen. Uh you better leave. Why is that? >> Because you were told to leave. In front of the camera, he refused to take a breathalyzer test. Is there an exception to the law for people in uniform, or are all citizens equally responsible? And the only thing that they had was uh They were in a meeting with their insurance agent or whatever, and I said, "Well, I'll come back and get with the county judge." I don't know where Just want them Just want them to understand. All right, cool. Which uh Which way is the sheriff's? This way? Don't worry. We did not forget. Off camera, Sheriff Ricky Jones did give me that third lady's name. All right. Let me go see what else I can find in town. I appreciate you guys being professional. Yeah, the only other thing we really have in town uh Perryville City Hall. Well, thanks again, man. >> Yes, sir. It's good to meet you guys. Very good. Chief Deputy, Perry County. That's the sheriff. Okay. All right. All right. So, how much have you had to drink today? I've had about three, maybe four. We bought a We bought a bought a bucket. I got you. All right. Are you willing to do any tests for me? And if you're Chief Deputy, you know you're not supposed to be drinking and driving. I understand. I understand. You know, I can't I can't just not do my job because Right. Is it pretty warm? Right. Right. Again, I I still got a job that I got to do, okay? All right. And And you know that. Yeah. I understand. So, uh are Are you willing to do some tests? At this point with three, I don't know. And And I haven't written a DWI in 20 years. I got you. I got you. Uh but I'm not drunk. With Okay. I can't stand on my Are you willing to do a SFST? Yeah. Okay. All right. If you will, just remove your hat for me, okay? Place your feet together, arms directly to your side. When the sheriff publicly defends his subordinates despite clear evidence, the question arises, who will believe in justice if the law enforcers themselves break the law? Putting these hurting I I can't I can't do it. >> I got you. Would you be willing to blow in a PBT for me? I hate to argue with a police officer. No, I understand. >> You know. I understand. I can't argue with a police with a police officer. I had a beer right before we left. I drank about a half a beer and set it on the table. Bucket and a steak's what I've had. Okay. We had a bucket and a steak and listened to Jamie Campbell play or Jason Campbell play because he's from Perry County. I got you. All right. I don't know, man. We're just trying to gauge where you're at, man. You You know the rules of the game. That's my only problem. I know. But, like I said, I drank a half a beer before I walked in this That's what I told you. Which is I don't want to do that. I don't want to do a PBT. I don't And I I know it's not admissible in court. I just Okay. Well, here's the thing, okay? I do believe that there is enough to arrest you for DWI on the test, okay? Give me 1 second. Don't let me talk to my sergeant. It's not a pass or fail test. SFSTs, you look for clues. It's not a pass or fail test. >> clues did he fail on? You got it Yes, it's a pass or fail. >> It's not pass or fail. Comment. If you feel like I need to get a ride or whatever, that's fine with me. Somebody drive, whatever. That's I'm okay with that. I've had I We bought a steak each and a bucket of beer. Well, here So, Citizens may sue public officials for violating their constitutional rights pursuant to 42 US Code SS 1983. The individual/organization may be required to pay restitution to the injured party. In severe or intentional cases, punitive damages may be ordered. Additionally, the court may order the losing party to pay the plaintiff's attorney fees and litigation costs. I'm just Man, I I wouldn't have I wouldn't have gotten in my truck if I was if I was a drunk I promise you I can get you a ride. I promise you. I can't. Not with my bad ankle. I I promise you I wouldn't have crawled in the truck if I I'm not I'm not that guy. We got a steak and three beer each. And I I I say that we had a bucket of Did you just put a dip or a piece of gum or anything in your mouth? I've got Zyn. Zyn? Okay. I I will tell you again. The thing is is like I'm I'm trying to give you as much courtesy as I can. Right. Okay? We both know that. Mhm. Okay? Um I've called my assistant chief to see how to go about handling this, and it's pretty much one of them things DWIs are DWIs, >> Right. okay? So, >> there there is no professional courtesy. >> Okay. Uh But, it is what it is. So, man, right now I'm going to place you under arrest for DWI, okay? Let me get my wallet. You good? The actions of the sheriff and deputy were seen as typical of police abuse, law for the people and law for themselves. Deputy Chief Edwin Johnson resigned on Monday immediately after the incident. Sheriff Jones remained in office, but was heavily criticized and lost [music] credibility in the community. A camera in the library, and then five officers appear. >> [music] >> Are they there to protect the law or just enforce a shady policy? You could say there's no crime being committed here. You're free to film in our police [music] headquarters in the front lobby if you want. We're open 24 hours a day as well. So, that's a ridiculous statement because you could literally look up any book on your phone. Five officers and a piece of policy in hand. The question that shook the entire library, are they law enforcement officers or just [music] guardians of an anonymous piece of paper? The truth will surprise you. Do you mind if I speak to the director? She does not want to speak to you. She does not want to speak to me? What I don't what How do I Why can't I Why can't I speak to her? She's a public servant. I can't speak for But, you are though because you're you're you're bringing me a policy. Right. So, that means you're speaking on her behalf. Okay. That's what you're feeling right now. No, I don't want to dispute anything with you either, sir. [music] It just It doesn't seem You You enforce the law. You're a law enforcement officer, sergeant. Yes, sir. Right. So, this is not a law. I'm just happen to have a recording my [music] >> It's against their their policy. Right. But, their policy can't trump the United States Constitution and the First Amendment of freedom of press. I'm a journalist. I'm here conducting um an investigation for a story and using the library for its intended purpose. How can you That's like if they had a policy that [music] said, "Are you filming without the people's permission?" I The library didn't ask me for permission to film me, sir. Do you know why they don't have to ask me for permission to film me? And why [music] none of you who have body cameras on asked me for permission to film me today? So, no one needs [music] to ask for permission to film in public. Again, I'm not particularly wanting to film anybody. I'm filming books and Well, you're filming me, so I'm Right. Well, you're filming me, but again, no one has a reasonable expectation of privacy in public. >> [music] >> I've been through this with in federal courts before. Won some federal court cases in in New York City regarding [music] uh filming in public and filming law enforcement officers in the course of their duty [music] as well, which you are. To hand me a policy Cuz we got called over a suspicious suspicious person here. Filming people. Which is against their policy. >> What What about me is suspicious though? That was filming people. Walking around filming. That's what we got >> So, [music] by by that standard, you're suspicious. Because you're walking around filming people, sir. No, we only film when we get to a call. Right. >> for our policy. And suddenly, they drag children [music] and schools into the story. What is the real reason behind the obsession with a camera? Correct. That you would like us to get back to our duties. Right. Yes. I would love it. Right. So, how come I'm so sorry? Excuse me, ma'am. How could we do that? So, just let me go about my business and and look at my books. >> You stated that you were looking for the US Constitution. [music] Right. Do you know where that is? I do not. Not here, actually. Because you don't work here. I would direct you question for somebody that works here. Do you mind if I just get your badge number, sir? Yeah, you can throw my camera off. Oh, sure. I just walked in. Yeah, no problem, sir. I just like to get everybody's name. Sergeant Donald Wilson. Sergeant Donald, [music] thank you. 63. Thank you, sir. Appreciate it. Ma'am, how are you? Do you mind if Where would I find the United States a copy of the United States Constitution here? There's four of us here. Well, no. There was an another officer here. Right. Seems like overkill. [music] It must you know. The police headquarters is next to here. Oh, well. I didn't know that. You're free to film in our police headquarters in the front lobby if you want. We're open 24 hours a day as well. Oh. Right. It's public, right? Okay. Yeah, I'm just I'm just trying to use the library for its intended purposes here and and look at some books, read some books. That's all. Well, because I'm You always come reading books with a hand Oh, I record everywhere I go for transparency and accountability purposes, especially in government buildings, especially in a public building like this. When the library director refuses to confront, and the sergeant [music] begins to lose patience, is a force scenario about to happen right in the middle of the quietest place in town? Was I harassing anyone, sir? No, you were walking around filming. Okay. Was I looking at books? I don't know. Okay. Was I I wasn't harassing anybody. So, again, you're trying to make it seem that something that it's not. I'm not harassing anybody. I don't want to harass anybody. If you leave, that that Oh, what are you going to going to do? You're You're inferring that what I was inferring is wrong. I was asking you a question. I said, "Are you going [music] to harass him?" Listen, I'm not harassing anybody. >> listen cuz I have no choice but to listen to you. I'd love to be out doing other stuff. So, go do it. >> Okay. So, go do it. Respectfully, go do it, sir. I Yes, you can. You can say there's no crime being committed here and no one is being disorderly. [music] This man is politely filming. He's not raising his voice. >> to film children if they walk by? I'm filming what [music] I can see, which is the books right now and law enforcement right now. There's no children here, sir. Obviously. Right? It's a library. That's That's my primarily my primary point of concern >> [music] >> and that the staff right, they're here just to do their jobs. Right. >> Right, they're here to do their jobs. >> ask I asked this I asked this woman to >> is. You know, so why would anybody come to the library? Everybody >> knowing where the Constitution is in a library when you can pull it up on your phone? Sir, that's a ridiculous statement because you could literally look up any book on your phone. So, why would a library exist? If you could look up all the information you want on your phone, why would a library exist, sir? >> people that don't have it at home. Sorry. >> Ridiculous. It's ridiculous. It's ridiculous. It's It's ridiculous [music] that you would think I'm sure everybody in this library if you ask them right now they have internet access. There sure might be some. >> we said why does a library exist? But, the people that may come may not. Right? So, we're no point in talking in hypotheticals. Right, sir. Okay. I Listen, I just want It all ended in a way no one expected. A lesson in freedom, the power of the Constitution, and the price [music] to pay for attempting to abuse power. So, apparently that's the library director and they wanted me to have an officer follow me around the library. Ridiculous. They didn't want to take the Constitution [music] Explained book that I have here. Might have helped them out understand about freedom. All the law enforcement officers have left. So, we're going to be getting out of here. It's We're just getting out of the public library here in Franklin Lakes, [music] New Jersey. So, this audit started off pretty chill and he was here and his rights were violated. And that's what we did here today. It started off pretty chill. Nothing happened. No [music] public employee came up to us complaining or trying to exert authority over us. Obviously, they have nothing better to do here [music] at the Franklin Lakes Police Department. But, most of the officers were pretty chill. They didn't really escalate the situation. They don't know why so many law enforcement officers want to enforce policy. Sergeant Wilson, I will say, was very passive-aggressive [music] and very disingenuous in his arguments talking about minors. That's all it's good for. Freedom is scary. [music] He's a law enforcement officer. He knew that I had no intention of harming any minors or anything of that nature. If somebody wanted to do that, they could do that in secret and surreptitiously and there would be nothing he can do about it. It's an unfortunate, you know, scenario, but it does happen and they should be held accountable for that. You did not like the fact that I was there recording. Thankfully, your superiors thought better of it and did not remove me as you removed Toure under threat of arrest. It's about promoting education not only [music] to law enforcement, our government employees, but we the people as a whole. And I think we accomplished that here today. You know, our rights are like muscles. If you don't use them, you will lose them. You know, she was very nasty and very rude to Toure, I was told, and she did not like him filming, which had nothing to do with minors. The policy has to do with control, ladies and gentlemen. Has to do with you cannot [music] film unless you we give you our permission. That's why I wanted to read it for each and every one of you. But, Sergeant Wilson wanted to make it about something it wasn't. Citizens may sue public officials for violating their constitutional rights pursuant to >> [music] >> 42 US Code SS 1983. Individual/organizations are required to pay damages to the injured [music] party. Violating police officers may be disciplined, have their licenses suspended, fired, or expelled depending on the policy of the agency/police chief. The police eventually left. No arrests, no enforcement. Citizens continued filming fulfilling their purpose of using the library. Next, a camera silently records and then the sudden threat of arrest rings out setting off a tense confrontation. We're not searching you. We're patting you down for our safety, okay? >> Get off of that. Move. Identify yourself since you want to go hands-on. >> Sergeant Wild. What is your name? Am I being detained for a crime? We're investigating. We got called on you, okay? The siren had not yet sounded, but the atmosphere was heating up by the minute as overlapping orders were issued while the real reason remained hidden. Look, we got a complaint about you being up here. Talk to me. What's going on? They came ready to fight. Don't approach me. Don't approach me. Don't approach me. Put your PUT YOUR HANDS UP ON the car. I haven't broken a law. Exercising my rights IN PUBLIC. YOU HAVE NO RIGHT TO TOUCH ME. >> OKAY, LISTEN. I'm patting you down. You have the weapon. This officer is violating my rights. No, I'm not. >> Yes, he is. >> Okay, hang on. I don't consent to searches or seizures of my property. >> You're not searching you. We're patting you down for our safety, okay? >> Get off of that. Move. Move, man. Get off of me. Stop touching me. I already told you that. Sir, you have no right to touch me. >> calm down. >> Yes, I do. Calm down. >> touching me right here. What is your name? What's going on with you? >> What's your name and badge number, ma'am? Identify yourself since you want to go hands-on. >> Well, I'm Sergeant Wild. What is your name? What's your name and badge number, ma'am? Are you not going to identify yourself? >> I am. You need to identify >> E-hands. What's your badge number? E-hands. Okay, be respectful. What is your What is your name? You got an ID on you? Am I being detained for a crime? We're investigating. We got called on you, okay? How about you guys disperse and get up out of here? Okay. And why would we do that? Because you have no reason to be here. >> Yes, we do. Yes, we do. We got a call on you. The debate over the right to film in public places has erupted with words, threats, and defiant silence from men in uniform. I can stay here if I want. >> in the roadway, so >> Because you put me against the car. Uh no, we didn't. >> You Yes, you You stepped over here towards me. He did not move me. Okay, how about you get out of the roadway and get on the sidewalk? That's what we're trying to figure out. >> Not an issue there, but y'all pushed me against the car. I don't have to keep moving. I haven't broken a law. Do what? I haven't broken a law. Ma'am, do yourself a favor. You're not telling me what to do. I am. I am telling you what to do. Yeah, but they wouldn't listen to you, right? You're right. That's your fault. You chose to be here. No, we didn't. We got called on you. I thought it was very suspicious that you were hanging around the sheriff's office over here. Which is funded by our tax dollars, right? >> Oh, do you pay taxes? I'm sure. I pay a lot more taxes than you think. >> you do. E-hands, do yourself a favor. Go back in your car and and >> I can leave and when I can't. I don't have to listen to you. Well, I guess we're going to be here all day then, huh? I got nothing but I don't care either. Are you making false accusations? Are you making false allegations? >> Are you answering or not? Nothing wrong with exercising your First Amendment rights in public. What's the What's the First Amendment? Freedom of press. Okay, what are you Right now, I'm recording you guys. >> And the fourth That's good. We're recording you, too. Because you guys are funded by tax dollars. Can you guys disperse? >> we're trying to figure out because you won't >> I've already explained it to you. There's no You called on you. You don't need to explain nothing to us. Don't you want to ask for You stupid. Get out of my sight now. Well, I can't do nothing to you cuz I'll go to jail, so get out. >> Exactly. Yeah, cuz you got that badge. That's right. That's right. We got got called here and I'm doing my job. Well, now that there's no crime committed, how about I get going? I don't know if there's a crime committed cuz you will not identify yourself. >> Earlier, I asked you if you were intoxicated and you didn't give me an answer. I don't answer questions. How about that? >> Oh, okay. How about that? An ambiguous decision was made turning the area into a legal battlefield as both sides asserted that they were on the side of the law. Why does it say sheriff's department? >> public property. It's still funded by tax dollars. I could be at the prison and it wouldn't matter. It's funded by our tax dollars. So, am I being detained for a I said you were in prison. I said it's like being on a prison property. It's still funded by tax dollars. >> Yeah, that That doesn't mean you can't be on prison property, sir. I've exercised my rights on a prison property. >> Oh, I'm sure you have. Okay. So, I'm not detained, so you don't >> said you were detained. >> Okay, I just want I just want to get that clarified. If I'm not detained, then I'm free to stay. I just want to >> No, if we're We're waiting on an answer to see if they want you criminally trespass. Oh, I'm going to tell you something. I'm not detained, so you don't get my ID. The best thing you guys can do for yourself is to go back in your car and leave. I'm so glad I do these audits. Yeah, you're doing good. I'm very You're doing a very good job. And you're going to be the star of the show. >> Thank you. Yeah. I appreciate that. That's cool. I like being a star. Yeah, you got attitude problem, ma'am. That's why That's why there's a disconnect. >> Yeah, I agree. Yeah. That's what I'm here for, to test out to see if you guys respect my rights and you failed miserably. Thank you. You know, the other police >> on my email. The other The other police Or you can look up the complaint form and write a complaint, too. I I might do that. I got better things to do. >> Me, too. So, I mean, you can leave. I will whenever I get an answer. If If I'm not able to exercise my rights on a sheriff's department property, which is funded by our tax dollars, then that is going against the Constitution. Let me explain something to you, okay? This property is private property. If they want you removed from that >> Depending on the schools. No, it Public schools are private property, just like the sheriff's office. No, that's not true. Public property would be like the sidewalk right here. >> not on that. You were on it when I drove up. You didn't give us a chance, either. You took off running. Nah. We've gotten to that point now where we're talking to you about it. So, once we find out, then we'll go from there. All right. If you're criminally trespass, then we'll do that. It's on you guys, man. When everything seemed to be over, a sharp warning rang out leaving behind big questions about civil rights and limits of power. The video denounces the abuse of power warning of the risk of violating civil rights when the police arbitrarily issue orders without legal basis. Okay. Do you just want to go home now? I mean, do you want to go back on patrol? Clearly there's no crime happening. Clearly there's no crime happening. Right now. I'm sure there is elsewhere. Well, maybe you go >> that you have us tied up with. So, take you to jail. You going to violate my rights. That's how we going to do it. Okay. Okay. Well, you have a good day, okay? Bye. Bye-bye.
