Put your hands for impeding and obstructing for the traffic. >> We're our supervisor. >> When the police say there is no choice, you have only one path left. Comply or face the consequences. >> Sir, is your last warning to open the vehicle and exit before we're going to break the window. >> What you mean? I was putting my hands behind my back. I was going to walk The seemingly simple traffic stop order suddenly turned into a nightmare just because of two words. No cooperation. The law requires obeying police orders. But what happens when the driver asks back, "What did I do wrong?" >> Open the door and exit. You are under arrest for resisting. What is your reason? >> Marijuana in the right pocket. >> Just seconds after asking to see a superior, the door slammed shut and the situation took a dangerous turn. >> Yes, sir. >> Is there a reason why you're popping the door open like that? >> I don't have a window that works. I read that reason why I'm pulling you over. For one thing, inclement inclement weather, you don't have your lights on. Two things, you're not wearing your seat belt. It's not weather. It's not raining. This is an increment. It's not raining. >> Okay. I'm not arguing with you. I'm telling you why I'm pulling you over. Give me your driver's license, registration, proof of insurance. >> How did you pull me over? >> Step out of the vehicle. >> Step out of the vehicle. >> 25 for 94. Driver just slam the door and locked it. >> Yep. >> 25. >> 25. Anybody responding coming in from Commonwealth? Block the vehicle, please. >> I'm coming west on Commonwealth. I'll be there in >> Keep your hands where I can see them, sir. Your body came on, too. >> Right now, you're under arrest for resisting. >> You understand? >> You're under arrest for resisting. The longer you take the take us on, the worse it's going to be. Keep your hands where I can see them, sir. Okay. When the final warning sounded, the man still did not get out of the car and the first shot was prepared. >> Sir is the last warning to open the vehicle and exit before we're going to break the window. Open the door and exit or we are going to break the window. Open the door and exit or we are going to break the window. No, he's under arrest. Open the door and exit. You are under arrest for resisting. Under arrest. >> Open the door and exit. You are under arrest for resisting. Open the door and exit. You are under arrest for resisting. >> Open the door and exit. You are under arrest for resisting. >> Vehicle's locked in. He's locked up. He's putting the window down. I try to talk to you. You still have to go. >> Hey, I'm about to break a window. >> Huh? >> I'm about to break a window. >> All right, go for it. [Applause] >> Exit the vehicle now. Exit the vehicle. >> Show me your hands. >> Clear. 33 21 hours. >> Dragged out amid the shouting, he still managed to shout, "I am not resisting." But it was too late. >> What is your reason? >> Put your hands behind your back. >> Resisting hands behind your back. >> What's wrong with you? >> What you mean? I was putting my hands behind my back. I was doing wrong. >> Ain't no talking now, man. No talking [ __ ] bro. How you doing, bro? >> You're under arrest. >> You going to throw the phone like that, bro? >> Yeah. I'm going to take it off now, man. >> And I'm just trying to have a conversation. So, your partner didn't even ask >> marijuana in the right pocket. >> He talking about arresting me and stuff, bro. I didn't do nothing. >> I was going resusing, idiot. I didn't do nothing wrong. >> I know. >> Can you back up rescue 67y old Mike last? >> I know. I know. >> No. No. >> Oh, yeah. >> You good? >> Is that you or him? >> Okay. >> What was the reason for the stop? The seemingly simple answer raises a host of questions about the legality of the entire arrest. >> Can you unlock the door and step out? >> Can you talk to me though? >> I will. Can you step out? >> Cuz you don't you don't even know the whole situation. >> If there's a traffic stop being conducted, you're required to comply. not required to actually >> correct. >> Huh? >> Why he pulled me over? >> Okay. So, what did he ask for when he when he I guess talked to you? >> When he pulled me over. >> Oh, yeah. >> And then he I said I said, "So, what I did wrong?" >> Yeah. >> He said, "Well, for one, uh, your headlights are off under this weather." I'm like, >> "Okay, >> there's multiple people." >> Okay, that's still a legitimate reason to pull somebody over. There's no right. >> It doesn't matter. >> You're still required to have headlights on. Yeah. When you step out of the car, I will. >> Citizens can be charged with resisting an officer in the performance of official duties and possession of a controlled substance. However, escalating police actions, using force too early and without a clear explanation can open the door to counter suits, especially if the footage shows violations of arrest procedures or civil rights. Next, a young officer who thinks he's the law is about to be trained in the field. Who really holds the power? >> I'm telling you right now, we're conducting a traffic stop for officer safety. You guys uh for impeding and obstructing for the traffic stop officer, >> I tell you what to do. >> Police ordered people to move out for safety. But is there something hidden behind the order? >> We're standing out of the way. We're 20 ft away. >> Okay. I'm telling you right now, we're conducting a traffic stop for officer safety. You guys cannot be here. Okay? So, you guys got to go. Okay. >> You don't care. This is a traffic stop. >> You don't care. We have rights. This is America. >> I get you. Okay. But right now, it's a traffic stop, you guys. >> Okay. Well, do your traffic stop. We're We're not going to bother you. >> Okay. >> We're just going to stand back and watch. >> You'll stand by that tree and you guys can film over there. >> We can't hear nothing from there. >> Okay. But you're in We're in the middle. >> That's ridiculous. >> Okay. You guys got to go over there. Sir, >> if you're going to be recording, you got to go all the way either by that post or go all the way by that creek. How many times does he say I'm not going to tell you again? >> I need identification from the both of you. >> For what? >> Because uh for impeding and obstructing for the traffic. >> We're not impeding or obstructing. >> I told you where to stand. >> Can you You got paint cuz I didn't see you draw anything. >> Okay. I said go stand by that tree. So go stand by that tree. >> Dude, we're not obstructing from this far away. Get your supervisor. >> Why are you so scared? I'm trying to stop. >> He's scared, but he his wife. >> Hey, where's Michael Huff? >> Sergeant Huff who his wife Sergeant Huff his wife, right? >> This cop gets out, starts agitating us. >> Tell me what to do. >> Residents suddenly recall the name that once shocked the whole area. An officer, a murder, and a dark past. >> I said, I don't think I don't think we've recorded these guys yet. Sergeant Michael Huff his wife and then he killed last year, didn't he? Glendale Heights. Sergeant Michael Huff wife had a suit last year, right? Was like October of 24. Sergeant Michael Huff. >> Did you guys know Michael Huff? You guys are being really quiet now, huh? Michael Huff, right? He himself and he his wife, right? Michael H. Michael Hub, right? And he killed wife, right? >> H back up. >> Be quiet now, dude. >> So, how long you think they'll drag this out waiting on a K-9 and the rest of the entire department to show up? >> They look they can talk, but they're really popped that into you. >> The first cop was just like, "Don't even listen to him. Don't even talk to him." >> We got backup. More backup. >> What's up? >> How you doing? >> H not too bad. Look like we got two of them in this car. [Applause] They stalled. They called in reinforcements, but what they were really waiting for wasn't proof. >> Over here, media lands. No strikes. Oh, you got the blue line. What is that blue line? Look at those tags. This is the face of tyranny right here. This is America. >> So 9 minutes in, what they're doing is just dragging this out, waiting for a K-9 to show up. Dragging it out. >> They could have wrote a ticket, been over with by now. But no, let's drag this out and wait for a K9 to show up. >> This is the officer. This is where the officer He was his wife and just like, "Take out the garbage." And he's like, "You don't tell me what to do. I'm a Glendale police officer. I tell you what to do." >> It's like true Drew Peterson in Bowling Brook, right? Drew Peterson in Bowling Brook Salvio. All you sergeants like >> Signal's dropping a little bit. Something Yeah, that's better. >> Finally, the people showed their IDs and the police's reaction made the whole audience burst out laughing. So I would call it >> fist bumping. What the hell? >> Hey, you still want my ID? >> I'm okay. Thank you. >> Here it's right here. Obstruction and interference is a physical act. You can't do it from 10 feet away. >> Hey, nice try though, man. Nice try. >> You make yourself look. >> Citizens may sue public officials for violating their constitutional rights pursuant to 42 US Code SS1983. Individuals/organizations are required to pay damages to the injured party. Violating police officers may be disciplined, have their licenses suspended, fired, or expelled depending on the policy of the agency/ police chief. When finally asked, "Do you still want my ID?" The officer replied, "No, suggesting that the original request was unwarranted and threatening, the citizen claimed that obstruction was a physical act, not something that could have been done from a distance while filming, highlighting the absurdity of the charge. >> I am not. >> Put it apart. Get out of the car. Turn around. Put your hands behind your back. You want to off my truck. My truck. You truck in the park. Yes, I am. >> Children and our his service dog. >> Okay. >> My husband has a traumatic >> Nolan was pulled over for driving slowly, even though he had his hazard lights on and a valid safety concern with the trailer. Before he could present his documents, the officer escalated to force, turning a simple stop into an unnecessary confrontation. Try to get inside the hand and see where it come. Hello. Hi, I'm Deputy Lane with the sheriff's office. How can I help you? >> Uh, so we got called to Sunshine Key about you and then on the way up there I saw you going 15 miles an hour and a >> hazard off, right? >> Okay. That's not legal. You can't do that. >> Can't do what? >> You can't drive that slow under the speed limit. >> It's a safety hazard. >> It's a safety hazard for you to be on the road driving that slow under the speed limit. Correct. Do you have your driver's license on >> department, sir? I need to get to this landing. Can we get it off this? I work here. >> Okay, fantastic. Good for you. I need your driver's license. >> For what? >> Okay, >> get out of the car. Get out of the car. >> Unlock the car and get out now. >> The situation escalated quickly. Nolan was pulled from his vehicle and despite not attacking was accused of resisting and threatened with a taser. >> You want to You want to try and grab me? >> Get him out. >> Oh [ __ ] My truck. My truck. You the truck into park. >> Put it into park now. Put it into park now. >> Put it into park now. >> In park 41 resistant. >> I am not. >> Put it into park. Get out of the car. Put your hands behind your back now. Put your hands behind your Put your hands. Stop pulling away from me. Stop pulling away from me. You're going to get tased. You're going to get tased. >> Stop. >> Stop. >> Stop pulling away from me. You're going to get tased. It's in your back right now. >> Okay. Stay right there. >> This is a >> Okay. Well, he needs to listen to what I tell him to do. >> Listen. Did you see me? The glove box has been open. I was getting you and I was asking you. It says to stop and shoulder. >> Okay. Can you adjust? >> Yep. >> Left 23 code 51 to 10. >> Other one, please adjust the other way. nervous not spinning in it. >> Do you have anything on you that's going to stick me, poke me, hurt me? >> Uh, pocket knife. >> Your pocket knife. >> Uh, I'm good for now, >> man. >> If you if you can talk to her inside of the car. >> Why is she being rude? >> I'm not sure. >> Why is she being rude, too? because I'm a law enforcement officer and so is she. I'm handcuffed right now. >> Okay, but no need to be rude, is there? >> Even though it was merely a reflex in a moment of panic, Nolan was still treated as if he had assaulted an officer. The rigid interpretation of the law by police reveals a clear sign of abuse of power. >> Grabbed my hand and pushed me away. That's bad law enforcement. That's >> not exactly what I was doing. >> You grabbed my hand. That's felony. >> Oh my god. I was trying to put >> Hello. Is there anyone else inside the car or shoot? >> My children and our his service dog. >> Okay. >> My husband has a traumatic brain injury, so his ability to process information and respond effectively is impaired. I was going to try to see I think his wallet is here in the boat. I was going to grab it. He has a brain injury card. I am his legal caregiver in addition to being his spouse. We were volunteering here at the park and it just became stressful because it was Katie Bates. >> So the problem though is that when I tell someone to give me their ID and they say no, that's refusal to identify. >> Did he say no? >> He said no. >> No, he was not. And then when I tell him to open the door and he says no, that's again refusing an order from Hold on, I'm talking. That's refusal to ident to identify himself and refuse to the vehicle, which is an order from law enforcement officer. Furthermore, when I reach inside the car to unlock the door and he grabs my hand, that's felony battery on law enforcement. Fourth, when I do finally get the car door open and he pushes me away, that's battery on law enforcement. He cannot touch me. I don't The brain injury that sucks. I'm very sorry for you and your family. He cannot touch me. He cannot refuse orders that I give to him. This is a a legal, lawful traffic stop. He's impeding the flow of traffic going 10 mph on US1. You cannot do that. He is correct. It is a safety hazard to do that. That's why I pulled him over. He can't do that. Okay. >> I apologize. Like I said, his response to his ability to know what to say is impaired because of the brain injury. He literally has missing pieces of his brain. And so when orders or whatever, his responses are often off. Like even when I'm asking him to do something or reminding him to brush his teeth even or things like that. >> Despite apologizing and cooperating, Nolan was still arrested solely for a reflexive reaction in panic. The police remained rigid, ignoring the context and valid justification. >> Last year, look, I am very I was not trying to be combative. I have a slow thinking. >> She explain she explained that to me. Okay. >> All of a sudden I realized I'm not an art and I'm like >> I understand why you got back in the truck. That was probably for the best since you have kids in the car. >> Thanks. >> I'm very sorry. I know I I've worked in the fire my whole life and I know exactly what y'all go through at that moment. I know exactly. >> Okay. >> I want to thank you the highest for not pulling that trigger when I jumped back in. I know when the adrenaline starts pumping. Oh my gosh. Yes, >> my adrenaline was pumping. >> So, so the main problem that I have though is you grab my hand and you push my arms away. You cannot do that. >> I didn't mean to push you away. I was trying to to assure you that here you have my hand, but let me reach with the other hand and but I I can't think of how to say it. My adrenaline was pumping and I'm just like, "Here's one." But let me I swear to you on God's hand. I put God all over my life. Ever since my accident, I swear to you, I was not trying to be I put my life in God's hand on that swear. >> I assure you if there's any way I could prove that to you, I guarantee you I will. >> Okay. All right. No, I'm going to close the door real quick. Give me just one second. Okay. I could look past the initial refusal to give me his ID at first and I didn't I didn't give him 20 chances to do it, but if I tell someone to give me their ID and they say no, to me that's that's a no. That's I'm not giving it to you. Okay. The the the problem though is that when I try to get him out of the car, he grabbed my hand. He pushed my hands away from him and then I'm trying to put him in handcuffs and he's pulling and turning away from. Because of that, I have to take him to jail. >> Is there any way we can >> I have to take him to jail. Is there anyone who could have the mercy in you to view it like someone with autism? >> That he doesn't know not to put his hands on a police officer. He should not have a driver's license. Okay. So, either he is more mentally incapacitated than the state of whatever state his driver's license is out of knows or he's more intelligent than you're leading me to believe. Because either way, he's driving a car. So, he's got to have at least like an 80 IQ to be able to drive a car. So, if he's got that, >> I'm not sure what >> he should probably know not to not to grab a police officer. >> I'm not sure what the testing was that they did. They they went through a a neuroscychologist, neuros psychiatrist, full um driving tests, like more than just the driving test that a teenager goes through to get their permit. And he was approved through that. But of course, in a class like that, it's not going to be a situation where an officer is trying to grab him out of the car. So, it's a a different thing to be in the moment. And like I said, the you know, view it like a person with autism, like their initial response is to be like, "Someone's grabbing me. Oh my god, let go." So, is there any chance you could please have >> I just talked. >> Despite the clear circumstances, no one was taken to jail, leaving his family in turmoil. The case was later sealed, raising further questions about the transparency of how the incident was handled. a jail with a mental disability. But at the same time, if he's driving a car and I pull him over for a traffic violation, going 10 miles an hour in a 55 mph zone is a traffic violation. He can't do that. That that's why that's why I pulled him over. When I tell the driver of a vehicle on a traffic stop to give me his driver's license, he has to give it to me. If I tell him to step out of the >> If I tell someone to step out of the vehicle under Pennsylvania versus NIMS, they have to step out of the vehicle. If they refuse, that is obstruction. >> I understand. I understand. From your perspective, you have to protect yourself to get home to your own family and all of that. Trust me, >> I'm not putting you in jail. You're still here. You can take the car and the boat, go back to your campsite. You can get him out tomorrow. We'll have first you you can look there. There's ways in the court if he's actually got a brain injury. You could ask >> Catherine, are you able to >> Are you able to drive this back to your campsite? >> Probably not. >> Okay. Cuz the other thing we'd have to do is call tow truck. Um, I can probably get someone here in the park. One of our friends here. >> Yeah, this guy right here, I don't know if you know him, but >> why why was he going so slow? >> Because we drove from here, we were headed to Marathon to get gas and as we were driving down the road, he realized that the trailer was like bouncing too much and he didn't feel safe driving it. So, he pulled over at that gas station. Go >> ahead. That's his items I was given to you. The officer's actions reflect an abuse of power and rigid enforcement, treating a disabled citizen like a criminal instead of responding with humane and reasonable judgment.
