Do you understand that? >> I love question. You can ask me as many questions as you like. I Yeah. Do you understand what I just read right here? >> Fully understood. >> Fantastic. What happened today? >> I walked in at 10 minutes to whatever they're opening. >> Walked into where? >> The Wendy's. It was I was there early. I said, she goes, "We are not open yet." >> Uhhuh. >> And I said, "What time is it?" She said, "10 10 to 8 or something." She goes, "Have a seat. You're welcome to have a seat." So I sat there like a gentleman. >> Uhhuh. >> She said, "Sir, come up. ready to order. I got up and I presented my debit card and I said, "I'm not sure it's working. Can we try it first?" >> She said, "I don't know how to do that." I said, "Ma'am, use your head. For God's sake, is she's the easy as hell." I mean, it's not hard to test your debit card, but she's there for a reason. I don't I said I mean blacks have to be told their color for God's sake. I mean she got heated really heated and started calling me an [ __ ] >> Mhm. >> So I ran made a run for it. She chased me out the door and threw a sign at me and that was the end of the incident. She was he she was I was a gentleman. She said you can have a seat. I said thank you ma'am. And I waited patiently and I presented my debit card without any I didn't throw it at her or push it at her or poke it at her and I said I'm not sure it's good. I you know I have money in the bank but it's acting funny. So and she didn't know I don't know how to deal with this and the managers to her right. I mean she didn't even bother to look around or ask or she looked at me and said I don't know how to do this. So I said, "You're, you know, you got to call blacks and when you're out in the field, you just take and that's their color." >> All right. And she's she's new or something. And I That's about it. I'm going home. You want to take I my I I met my first friend in jail. I like jail. >> Okay. >> It's I make my friends in jail. Okay. I want to go. >> What'd you go to jail for? >> That's beside the point. >> Okay. >> So you went to the Wendy's a little early. Right. >> Okay. Guy, I mean, it's not worth repeating yet. >> I want to make sure I understand. >> Just let's get going. I mean, >> you know, like how I just made sure you understood what I read to you. I'm trying to make sure I understand what you're telling me. >> It's understood. Everything's understood. >> So, you went to Wendy's a little bit early. They said, "Can't order yet." So, you took a seat. >> I said, "Ma'am, thank you." I said, "Thank you kindly." I mean, >> then she said, "Ready to order. Called to the counter." I said my I I wanted to get cash at the presto at Publix. That's how I know and it wouldn't work. That's why I said I told her I didn't tell her my the Presto to give me cash. I knew it already. >> So that's why I said let's test let's give this a test. >> And she goes, "Yeah, I I don't." She had like a really heated look, mean look on her face looking at me and I was like, "For God's sake, just I mean she's fairly bright, you know. She's got a job at Wendy's, of course. I mean, she's got to must have a high IQ. She's got to handle cash and way to communicate with customers and relate to people. And she didn't do any of that with me. And I'm an older man, too. I'm 61 years old. Okay. So, I'm I mean, Wendy's is my favorite restaurant uh fast food, you know. I like going there. I wanted to get some milk and something at Publix, but I decided on Wendy's. I wanted to give my business to Wendy's. >> Okay. So once she said she couldn't figure out your debit card, you got a little upset. I'm guessing that she couldn't figure it out. >> I told her to use her head. >> Okay. And then did you like >> I called her? >> Okay. Did you like throw anything? Did you hit her? >> No, I grabbed my debit card and started headed to the to the door. >> Okay. Grabbed your debit card off the counter from her finger in her fingers. >> Okay. Um you didn't grab her like at all. Just just the car. Okay. >> Didn't touch her. I wouldn't I never would have never hurt a woman. I don't. >> All right. Well, give us a few minutes. We'll figure this out. All right. >> There's a guy. There's Just let me go. I mean, it's all the incident's in the past. It's over with. She's still got her job. I'm sure she's going to be a great cashier at Wendy's. >> If what you're telling me is all good and true, then I'm sure we will let you go. But for right now, we have some other We have conflicting stories. So, >> see, she's not telling the truth. >> Let us figure it out. I'm sure they have cameras. >> Come on. I'm an older man. I'm 61 years old and I'm a white, too. >> Okay. >> Hello. Who's her? >> Who is her? >> Yeah. >> She's in the office back here. >> Okay. >> Hi. >> Hi. >> Excuse me. >> Oh my god, they hurt so bad. >> Hello. >> Hi. >> What happened? Um, >> secure. [clears throat] >> We wasn't open yet, but whoever the manager was, I guess, never locked the doors, so he came in >> and I was very nice to him. I told him, I said, "We're not open yet, but you're more than welcome to sit down in the lobby and once we get ready, I'll go ahead and help you." >> Okay. Uh, the ambulance should be coming in if you don't mind grabbing them really quick. >> So, um, when we got started up and stuff, I called them up to the front and, um, I was like, "Um, what would you like to order?" So when he came up, he seemed nice normal. So I was like, um, what would you like to order? He was like, um, I want to try my card first because I don't know if my card is going to work. So I was like, well sir, you got to in order to for me to run your card, you got to either order something and that's the only way I can check your card. So he was like, "Um, you need to tell me you you can't just run. You can't just check my card." And I was like, "Hold on now." And it kind of spurred from there. We just we kind of started arguing. >> Talked to me about when he touched you. >> He like um he he didn't really touch me. He just like threw something at me. I don't know what it was. And I like went the charge at him like just went the he when he threw it he took off running out the door. >> So when he threw it, did he actually hit you? >> It like hit my shoulder. >> Okay. So he did strike you. >> Yeah, it like hit my shoulder and then I um I grabbed the tray and I started running at him with the tray and when I um when I hit the corner right there, that's when I kind of fell on my shoulder and I dislocated my shoulder. >> Okay. >> Morning. >> Good morning. Oh, >> I can't move it. Okay. >> Do you guys have video cameras? >> Do you guys have video cameras that might have captured this? >> It is anyone else able to access that while he's taking a look at you? >> Okay. Um, my my GM is on his way. >> Okay. >> If you if you support that just like it is, you walk with me. >> Yeah. >> Okay. I'll tell you what. Oh my god. Oh my god. Oh my god. Wait. >> It [clears throat] is definitely dislocated. We'll just what we here. We'll wheel you out. Take I'll tell you what. Take one of your clipboards. Put it up underneath there. Okay. >> We got the uh >> We got a triangle manager here. >> Yeah. Throw it on. Do you have your ID or person here anywhere? >> Do you have your driver's license anywhere in here? In >> my car. >> Okay. Okay. >> Can you have one of your employees grab it? Oh, >> yeah. >> Did either of you two witness this? Did either of you two saw what happened? >> I >> Okay. So, what happened? >> Um, when I was coming out >> and are you able to grab the her ID, >> her driver's? Yeah, it's from her car. >> Oh, okay. I got >> you know where her car keys are. >> It's um on top of my dashboard the driver. >> Okay. >> All right. So, what happened? >> Okay. As I was coming from the back, I heard him call her. >> Okay. >> And stuff. And um >> then she told him to get out. >> Okay. >> Then come around and he hit her. He hit her on the shoulder and she picked up the trays and was >> So he hit her first. >> Yes. >> What did he hit her with? >> His hand. >> Okay. So she's saying that he threw something. >> He probably did because when I was coming up, they was already arguing. >> Okay. >> And I seen her. I seen him. He hit her. I was trying to go get the other. >> How did he hit her? >> Um on the shoulder. >> How? Look, >> it happened so fast. probably with I don't know probably with the trace he just >> Okay. >> Yeah. >> Like did he punch open hand? Did he have something in his hand that he hit her with? >> It seemed like he had something in his hand. >> Okay. >> Cuz he kept going up underneath his shirt. I thought maybe he had a gun or something. >> Okay. All right. Yeah. If you can grab his ID. >> Thank you. Do you mind grabbing yours as well, ma'am? >> Yes. >> Do you know if there's any access to video that we can watch it happen? Um, you found it. >> Yeah, I got it. >> You want to watch the video? >> He got to wait to come. But sometimes sometimes >> I don't know. Me too. >> Okay, I'll tell you. >> So, he made the first move to hit you. What did he hit you with? >> I don't know what it was. >> I don't know what it was. I just when we were arguing back and forth, he kept calling me. I called him. >> Did you scoot back and sit back? I don't know what he hit me with, to be honest. >> Okay. But that's the only time that you and him made contact. >> Yeah. And then when I ran out to him, when I ran out, I grabbed those trays right there. >> Mhm. >> I grabbed like two trays cuz I was going to bump him in the face with him. I'm being ran and I like slipped right there on that on that rug. And when I slipped on the rug, give me my phone. It's in the office. When I slipped on the rug, that's when I fell and hit my shoulder on the wall. >> Okay. >> Yeah. So, he didn't dislocate my shoulder. >> How bad did he hurt you when he threw something at you? >> It didn't really hurt me. I was just mad. >> Okay. >> Yeah. >> Yeah. But the trays was outside. So, he put the trays outside. >> Okay. >> Oh, you took the trays. >> They was on the um outside on the ground. She picked them up. >> Oh, yeah. Cuz I tried to hit them with the trays. You that ID still >> uh my partner has it. He's just running the name down real quick. >> Okay. >> You grabbing your ID, too, ma'am. >> Her story and a witness. It's still a little vague. The GM's coming so I can get video of it. He wanted her to test. >> Don't leave with her ID, please. I'll be right out. >> We'll be here. >> Thank you. He came in, didn't know if his credit card was going to work. wanted her to test something before he ordered. She said, "She can't do that. I need an item." And then he started calling her the n-word. Both of them started fighting verbally, just verbal fighting. Apparently, he picked up something, doesn't know what, threw it at her, hit her right shoulder. That's when uh the other witness came in and saw the guy hit her with something. Neither of them know what he hit her with, but she felt the pain in her shoulder. She started grabbing Trey, screaming at him to get out, ran after him, and then slipped and dislocated her shoulder. That is what I got so far. >> She admitted to hit him with trace. I mean, she's claiming some type of battery. And he's not even saying he [music] got hit with tra. >> No, he's never got physical. >> The only physical contact was him hitting her with something first. He made the first move according to those two. Hit her with something. She was attempting to hit him and like chasing him out because he wouldn't leave. >> No, he didn't cause a dislocation, but he did throw something or hit him in the right shoulder. The GM's coming, so I want to see like exactly what happened cuz >> there's no proof of anything that happened before the dislocation. >> Nobody knows what he >> No, it all happened so fast. >> Did you throw something at her? >> No. a uh I said before I was I had grabbed a debit card. She had my debit card in her fingers. I said use your head. >> Okay. >> Grab a D. She >> Mr. Obviously they have cameras in here, right? So like I'm going to go look at them. That's why I'm just asking you before I go look at them. She throws something at her. >> Absolutely not. >> Well, like what? There's no objects in a Wendy's. Like a rock a rock in Wendy's or something. I don't know. Anything. [snorts] >> Well, what would I throw at her? I mean, >> I don't know. It could be a a cup, a tray. Uh, >> well, a cup's not going to hurt her. I break her shoulder. >> Okay. Anything. >> No, I stood it up to the counter ready to order. I wanted something checked the debit card. We're face to face, body to body, nothing between us. And she she said Check the cameras. I'm good. These handcuffs handcuffs are kind of hurting me a little bit. All right. >> I mean, I'm a 6'3 guy. I cramped in your car here. How about it? I'm not Well, I'm not going to run off. I mean, you want me to come into the Wendy's and watch the camera with you? I'll watch a camera with you if you want. >> I don't need to do that. >> Okay, that's fine. >> Zelda hands her phone to a deputy so he can call her manager. And while he's holding it, a text message notification pops up on the screen that changes everything. >> Wow. I was using her phone that hopped up. That text is from her. >> Yep. I'm going to ask her about it, but that's kind of She can see you from better. She says she want to give you a phone number or something like that. >> You want to explain this to me? Wait, give me my phone. Wait. What that says? >> Oh, about the >> I'm I'm going to give you one warning, right? You know, filing false police reports of crime. >> I'm not f I didn't even want wanted to call y'all. I wanted to just go to the the hospital. >> Okay. Did he hit you? >> He didn't physically hit me. No, he didn't. >> Okay, then why are you trying to get us to arrest this guy? >> I didn't want y'all to arrest him. >> I never wanted y'all to arrest him. >> That's not what that says. But I never wanted y'all to arrest him. I just told Oh, I got him on these drugs. >> You're on drugs? >> We just Okay, >> but I don't even I didn't >> Okay. So, he didn't hit you at all. >> He threw something at me. He never hit me. I never said he hit me. >> So, then why did you not want us to look at the cameras? Because I did run at him with the trays. That's how I failed. Oh god. >> Okay. >> I ran at him with the trades. >> Okay, that's fine. >> You can look at it. Don't matter to me. But um Oh god. Jesus Christ. >> Okay. So, your boss is I'm guessing on the way. He didn't answer, I don't think. Yeah, his phone only my problem. >> You feel me? I feel I ran red with the train. I tried to get him to get him out the store. >> I understand that. But so the crime of battery is if he hit you at all. So I got >> I told your officer you didn't touch me. He threw something at me and that's why we're at my shoulder. On my shoulder. >> I don't want the man to go to jail or anything. He don't have to go to jail. You can trespass him and wait for him. >> Okay. Are you able to call the boss? We were having a problem getting a hold of him. >> I don't have his number cuz I just started. >> Oh, okay. >> Get him number. >> The boss. >> No, >> YOU DON'T KNOW HIS NUMBER. >> NO. YEAH, >> I Yeah, I have to see the camera footage. >> He want to see the camera footage. >> If not, we're going to close the Wendy's and write a warrant for the cameras. >> Oh, okay. He said he's on his way. >> Okay. Good morning. >> Good morning. >> Why was Why was she telling you not to let us look at the cameras? I don't even know. I was home. I was asleep. She just told me something happened and she text me. So I run to herself cuz they can't leave nobody if I don't store. >> Mhm. Yeah. She slipped on her own at the door. It's not even the right shoulder. It's the wrong shoulder. She fell on her left shoulder. She's all wrapped up on her right shoulder. Yeah. Okay. Um, I'm going to need copy of this. >> Yeah, dude. Everything he said was true. >> So, we're releasing you from custody. However, you are going to be trespassed. Okay. So, I'm going to need you to sign this. That basically says that you understand the above trespass warning. You acknowledge that you can never return to this property. You understand your >> I won't be back. >> Okay. I'm going to finish reading. Just be respectful. You understand that your failure to comply with this warning will result in your arrest. This trespass is permanent and applies to this Wendy. Okay. >> Got it. >> All right. You can exit out. >> Kill me. Did you >> Okay. Yeah. Please. >> Let's get out of the vehicle and I'll take them off. >> All right. All right. >> So, I appreciate you. Okay. Um, here's the deal. Went back and look at the video footage. Like I said, I was going to Everything she was telling us is basically a lie, right? So, she's going to be going to jail. Okay. That's why I I understand this isn't the best thing, but we we got to let us work through this. I'm going to leave you. I'm going to take your bus. Let's get >> Because Brelda was receiving medical treatment, she wasn't arrested on the scene. Instead, deputies filed a warrant. 9 days later, Corporal Rolando spots her vehicle and initiates a traffic stop for an illegal window tint. >> Hello. Hey, Sheriff's Office stops being audio and video recorded. Raise our for your window tint. The windshield and your side windows. I just got a um I just went to court for it. >> Okay. How are you? >> Everybody in a rage, I guess. >> I got everything under control. >> Who's in a rage? I said didn't say everybody cuz it's like talking about who's in the rage. Um why did you have pulled over? >> Why? >> Yeah. >> Her window. >> Oh, okay. You're right. >> I don't know cuz I got th on m but it ain't that dark. >> Yeah, her windshield and all her windows. [screaming] >> Are you able to? >> I don't know. I'm her mom. That's why. >> Are you staying here? >> Yeah, I live out here. >> Okay. >> Mhm. >> Okay. Was that your only question? >> Yeah. >> Okay.
