instructions for this test release when i tell you to i want you to take nine heel to toe steps down that imaginary line you keep your hands up to your side look down at your feet and count out loud together place your right foot in front of your left foot touching heel to toe maintain that position release don't move until i tell you to do so when i tell you two i want you to take nine heel to take nine do you understand yes hey on your ninth step keep that front full planted using your rear foot turn yourself around last time i took this type of test i said it was gonna pass yeah it's not a pass or fail so there's no pass or fail so once you get to your ninth step use your rear foot to turn yourself around taking a small series of steps all right well i guess i'm ready do you understand the turning post that's elias uh you need to say sometimes yep you turn around like i showed you that thing your left foot is gonna be the one that you turn around yep and then you're gonna take nine more steps towards the front of my vehicle once again hands at your side look down at your feet and cannot allow for each heel to toe step i'm gonna give you a demonstration one two three your blood pressure so basically you have a right to refuse consensus you have a right to refuse to consent to my request if you refuse to consent you cannot face criminal penalties for your refusal do you understand of this that counts basically if your food's like i can't charge you anymore or do anything more okay however refusing consent has other consequences in accordance with new mexico implied consent act and state law those consequences may include driver's license and or non-resident operating privilege for one year additionally the fact that you refuse consent nations evidence additionally if you consider to have your blood flowing the right to choose an additional independent test if you choose this additional independent test you have the right to your reasonable opportunity to rent for a physician a licensed nurse a laboratory technician or technologist who is employed by a hospital or physician of your own choice to perform an additional chemical test the cost of this additional test will be paid for by the law enforcement agency so knowing your right to refuse consent the possible consequences and your right to an independent test do you get consent
