I got out of my wrist. I DIDN'T OPEN THE DOOR. >> [screaming] >> WHEN POLICE SHOW UP TO A WELFARE CHECK, THE ONLY concern that they have is just to make sure you're safe, not to arrest you. But today's video is just completely wild. We're watching a mental health call go so wrong that this woman begged the cops to take her to jail instead of the hospital. And then does something crazy to force them to arrest her. >> Sheriff's office. Autumn. Hey, Autumn, come here. Autumn, come here. Autumn. What happened? >> [laughter] >> I'm not asking you that. I'm not asking you those questions. How much have you had to drink today? >> No, sir. >> [laughter] >> Not one thing? >> I have like a shot. That's it. But I've just been up all night cuz I've been alone all day and I was supposed to have sleep. I just I didn't put any hands on him. Nothing, [laughter] sir. >> Okay. >> Nothing. >> So why why did we get called back out here? You don't know? I think you're going kind of crazy, huh? >> Oh, [ __ ] [ __ ] the castle. Please, because she has a 102 fever. I was just upset and someone else was supposed to come over one time and I said, "Oh, never mind." And like By the time I'm over it and they still didn't come over. I was like, "Okay, I got to run. I got upset. I called you." I was like And then I'm emotional up, trying to calm back down, and I just And then my voice went up, and I kept getting angrier, but it's because he kept saying things that I don't want to hear. >> I think you should stop drinking tonight. Okay? Did you have water today? >> Do you want to pour out the rest of what I've had? >> You want to pour it out now? >> Do you want to pour it out? >> No, I don't need to do that. I'm just I'm >> Do you want to? I would I would appreciate it if you did. >> Okay, that He can do that. That's his property to do what he wants, right? >> paid for it. >> How'd you pay for it? Okay. >> That's my money, and he took it, paid for it. So, if you would have dumped out some, please. [laughter] >> You You can dump it out. You can dump it out right there. >> I don't want to be issues That wasn't to leave me alone. He has a room and a bed This won't house like he can do >> This is his house, right? >> This is my house, not his. >> You own this house? >> My momma does, and she rents it out to me. And he can go back there. He says he doesn't have a bed there, but he does. So, he can go there tonight. And leave me alone. >> Okay. >> Which I'm not saying he has to go there, but if he wants to, he can. Just spend a separate night to >> [laughter] >> us, and not I can sleep in this room. He can sleep in the other side of the house. And not I'll sleep on the other side of the house, which is this corner in that side. >> No, I believe you. I thought >> It's this corner right here. >> Yeah. Yeah. >> And that is the master bedroom house, and not just being coordinated to him. It's just that he will probably come towards me. >> Nothing physical happened? >> No, sir. >> And for confirmation, >> I've been upset. >> I'm going to do that as well. >> I've been [laughter] upset, and I haven't been But like exactly. But he got here, started I started shaking. I told him he was wrong, but I didn't put my hands on him or anything. I was just trying to explain what happened while you were here. I was like, "Just so you know, the cops were here just to calm me down, because you couldn't over [laughter] the phone." That's all I was trying to say. And he took it too seriously, and that's where I was like, "I'm sorry." And I tried to step away and yes I was in the room but I tried to step away and that's where he was like I don't need to go here and that's where I came out. >> I got you. Can you please hang out tight out here? Can you hang tight out here? >> But he asked me if I could pour it out for him and I was just trying to find the pour it out but I guess that was just an emotional It was just emotional. I was sorry. >> Why are you why were you being >> I wanted to grab my alcohol. I wanted to pour it out for you, sir. I wanted him to follow me so I could try to find it. >> No, I'm talking about like 15 minutes ago. You were being >> Cuz I do that when I'm upset. I don't mean it as any psychological torture or anything. >> Okay, I wasn't going there. >> I just do it and I am in therapy and in stuff for it. >> All right, listen in the video there's a video of you doing this, right? So that's >> I'm not going to do it again. I'm in therapy for it. I wanted to pour my I was trying to find my alcohol. I thought that the boss I wanted to pour it >> All right, let me talk. Let me talk, okay? Let me talk. All right. >> I wanted to pour out my alcohol and he can leave for the night and I don't want to. >> Yeah, I know. I know. I think I think it's >> Sir, I basically do not want to I'm in therapy. He can tell you I'm in therapy. >> We're we're not wor- we're not worried about what he has to say anything, okay? >> Last Thursday. >> Okay. >> And next Friday I have another appointment cuz I had a reschedule it shirt. I can't Can you come inside with me? You have full permission to. >> I am. It feels nice outside. I want to stay outside. >> Okay, let's stop right here. Did you notice how she was practically begging them to come inside the house [clears throat] and the officer just called me said like no, not now. Like not yet. It's nice out here. He's not talking about the weather. He's using a high-level tactical protocol to avoid what police call the fatal funnel. In tactical training in narrow hallways are known as the fatal funnel because they're very restrictive places with practically zero cover. If an officer walks into a stranger's house, they have no idea who's inside, where the weapons are, or just what the layout is. It is the easiest place to get ambushed. [music] By keeping her on the front porch in the open air, deputies are able to maintain the visibility that they need and total control of the scene. >> Are you listening? >> Yeah, I got you. >> If you are listening, please look at me. We went to Walmart, >> Mhm. >> to go get some things for his grandma's garden. Nothing happened. She was over not even 5 minutes ago telling him that I was upset that no one went to help with me, and that's all I was trying to transfer to him. I didn't do anything and I didn't put hands on him, nothing. >> Yeah, but in the video it shows you trying, but it it looks >> I didn't lay a hand on him or anything. I don't want to hurt him, nothing. I can go somewhere else tonight if you want me to. >> Looks It looks like you're just like swinging or >> No, sir, I'm not. Like yes, that's how it seems in the video, but I didn't do anything. >> All right, just just listen >> Can I show you my therapy? I can show you that I'm in therapy, sir. >> I already believe you, okay? >> No, you don't. >> If you did, then you would understand. Let me show you my proof. >> I'm not here for your therapy. >> I'm not No, I don't want to be on alcohol or nothing. I'm in therapy for that. I can empty it out, please. I can go somewhere else tonight if you want me to. That's for a little BIT OVER MY GRANDPARENTS, PLEASE. >> WHAT? >> PLEASE, PLEASE. I WANT TO LIVE WITH THEM. >> AUTUMN, AUTUMN, calm down, okay? Take a breath. >> I was just thinking I don't want to be baker acted, sir. I'm a stupid >> Well, you can speak to Autumn. >> Sir, I don't want to. >> [laughter] >> I really don't want to. I really don't want to. I really don't, please. >> So, like you got you got to see it from our point of view, okay, Autumn? >> I see it from every point of view, but I don't want >> Well, I don't I don't think I don't feel like you do. >> you said you would literally if I grab my Can you please come with me so I can pour my alcohol? I won't Sir, I I will pour my alcohol. I don't want nothing to do with myself. You can take everything out the house. YOU CAN TAKE KNIVES and everything. Please. >> Calm down. Can me and uh Deputy Drew come with you to go grab a shirt really quick? >> Sir, I shouldn't even be getting arrested but I'm on my property. There's no options. >> go grab a shirt? >> Sir, please. >> Okay, at this point the officers have a bigger problem. She keeps offering to leave and the deputies are now realizing that they might have to legally take her freedom away. In Florida, this is called the Baker Act and it has a fascinating history behind it. Back in the 1960s, Florida's mental health laws were just a nightmare. Police could basically lock someone away in a psychiatric ward for months just cuz the family members said that they were acting crazy. A state representative named Maxine Baker was so disgusted by this that she wrote a massive reform bill in 1971. And now the modern Baker Act prevents officers [music] from locking people away just for acting weird. The Baker Act, officially known as the Florida Mental Health Act of 1971, is a law in the US state of Florida that allows mental health practitioners, [music] judges, and law enforcement officers to detain, involuntarily commit, individuals to a mental health facility for [music] 72 hours. Today, an officer can only invoke the Baker Act if there's evidence of violence or suicidal behavior associated with the severe mental health condition or if the individual is at significant risk of harm due to an inability to take care [music] of themselves. The Baker Act aims to provide a period to assess the individual's mental health and address any immediate crisis. During this time, an evaluation will determine if this person has a mental health condition and whether they pose a threat to themselves or others. And if they're deemed to be no longer a risk, they're typically released after 72 hours. [music] And now at this point the deputies are trying to decide if Autumn meets that extreme legal threshold. [music] Let's see what happens next. >> So I'm going to get therapy and everything. >> to you're going to get your alcohol. >> here, okay? Who said that? Okay? I mean, whether it's going to happen or not, you're jumping to your own conclusions. Hey, wait. You're you're freaking messing everything up, Ethan. >> Thank you. You're messing everything up, like you said. Sorry, what is happening, please? >> Listen. As I'm speaking to you, I understand you're in therapy. I understand you're getting help, okay? I'm here to help you now, though, okay? Not every therapist, okay? So So So, I know you are. I know you are, okay? I've been I've been with people before. Listen. Yeah, I know, but you're not going to hang out with them [clears throat] tonight, okay? I know. The keys are on. Autumn, can you throw this on, please? Autumn, throw it on, yeah. Autumn, throw it on. Autumn, can you please throw that shirt on for me, please? >> dumbasses >> Well, how were we supposed to know you were going to take your top off? dumbass Okay. Autumn, throw your 2 tops on, please. All right. So, here's what's going to happen, okay? You got to put the vape down. Put the vape down. Okay. Yeah, yeah. Yeah, absolutely. We've been trying to be calm with you this whole time. Just take a breath. Don't worry about Hey, hey. Autumn, stop. Autumn, stop. It's fine. >> hold something to his head or >> [laughter] >> just to calm down. >> Okay. All right. All right. All right. So, here's what's going to happen, okay? >> I'm going to jail now. >> No. No one said jail, all right? Listen, you're going to come with me to my car. >> Please explain it. >> It's going to be a Baker Act, okay? You're going to be placed under Baker Act. >> Come to me real quick so I can tell them I'm going to get a Baker Act. >> He already knows. He already knows. Now the neighbors know. >> I'm going into a Baker Act. Can I go to Daytona or Orlando? >> Yeah, I don't know who would take you to Orlando. >> Not Orlando. Baker Baker Act. What was the last I can't go there, please. >> I know we're [laughter] going to We're going to We're going to Daytona. Come on. Come on. What do you think, sir? Put the vag on, okay? What are you What are you doing? >> Doing it with one hand. Man, handcuffs. >> All right. We'll do that over by the car, okay? Just so you don't need to walk across the street in handcuffs. >> I'm scared. They showed me >> But Autumn, we're going to make it as appropriate as possible, all right? All right. I think you got enough of it. >> It's 4:20, Ryan. >> I'm going to see if uh What would you do, CTU? >> I'm not going to be in a normal Baker Act. Thank you. [ __ ] you. Yes, it is. You called the cops. >> You're not being arrested. >> Baker Act. I got to fight Baker Act. Fight. >> We're going to have a seat. Come on. All right. Yeah, we're not going to sit on the side. I don't feel safe. I'm going to put the seatbelt on you, okay? Excuse me. >> I got a handcuff out of my wrist. I got a handcuff out of my wrist, [ __ ] I don't care. >> You have a handcuff out of your wrist? >> There you go, [ __ ] I don't care. Take me for a felony. I rather have a felony [crying] than a psych evaluation for 3 days. >> Autumn, 10-4, 10-6. >> Didn't you say you were out of them? >> Yeah, and I can put myself back in. No, I rather have a felony than a psych evaluation. I don't care. >> I DON'T WANT THAT. >> NO, I RATHER HAVE IT. I DON'T CARE. >> STOP. STOP. STOP. STOP. >> I RATHER HAVE IT. I DON'T >> STOP. STOP. STOP. >> AUTUMN, 10-4. >> I RATHER have a felony. >> Stop. >> Autumn, 10-4. >> I don't want to be psych evaluated. >> [laughter] >> I WANT TO BE LET GO. I DIDN'T SIR, PLEASE UNDERSTAND THAT I DIDN'T WANT TO PLEASE. >> STOP. STOP. STOP. >> I didn't want to go. Please. >> Autumn, STOP. >> SIR, I DIDN'T DO IT. >> LET ME TAKE THE HANDCUFF OFF. OKAY. OKAY, let me take the handcuff off, all right? >> Please, sir. I DIDN'T WANT TO PLEASE. >> OKAY, LET >> IT. >> [screaming] >> PLEASE. IT DOESN'T EVEN MATTER TO YOU. I CAN STILL GET the off. >> How? >> CUZ I CAN, YOU DUMB ASS. >> I don't believe you, Autumn. >> Cool. Cool. >> Stop. Stop. Autumn, stop. >> I rather have a felony. I don't want to be psych evaluated. >> It doesn't really have a choice, Autumn. >> I rather be A FELONY. I DON'T WANT TO BE PSYCH EVALUATED. LET GO SO I CAN SIT BACK AND EAT LUNCH. >> SIT IN THE CHAIR. >> I AM, YOU [ __ ] [ __ ] off. >> Okay. Have a nice day. >> I'LL GET YOU CAUGHT. >> OKAY, LET'S PAUSE RIGHT HERE because the psychology of what Autumn is doing is absolutely just fascinating. [music] Autumn does not want to go to a psychiatric ward for 72 hours. So, she does something wild which psychologists call maladaptive counter control is a response where an individual resists, escapes, [music] or tries to fight back against a form of control or authority in a way that is harmful and ultimately worsens the situation. For example, let's imagine John is pulled over and arrested for driving under the influence. The police officer cuffs John and tells him that he needs to [music] sit in the back of a police patrol car. Then John feels powerless, controlled, and angered. Josh wants to regain control, so he starts screaming insults at the officer, refuses to move his feet, [music] and kicks inside of the police car door. And Josh thinks he's standing up for himself. However, his actions do absolutely nothing to stop the arrest. Instead, he just added a new [music] charge of resisting arrest and destruction of police property to his file. And in this case, Autumn decides [music] that she prefers being in jail, somewhere where she understands the rules, rather than in a psych [music] ward where she has no control. So, she intentionally slips out of her handcuffs and aggressively writes to the officer that she can just do it again. It is a calculated escalation. She knows that escaping restraints and fighting the cops [music] will force them to hit her with a felony charge and take her to jail. She's literally trading a medical hold for a felony record just to feel like she's the one that can make decisions and like she's in control. Let's watch this desperate psychological game unfold. Oh, yeah. I'm not going to do that. Please, there's a time limit. Autumn, you can relax. >> NO, I'M NOT GIVING YOU MY LIFE. I'M FINE. >> NO, you're not. You keep kicking. >> I'M NOT KICKING. I STOOD UP FOR YOU TO DO THAT. I'm not kicking you. YOU DIDN'T HIT ME. NO, THAT'S GOING TO TRIGGER ME. I'M FINE. JUST LET GO. DO IT AGAIN. YOU'RE JUST GIVING ME THIS. NO! >> [screaming] >> STOP. >> YOU'RE TRIGGERING ME. NO, YOU'RE TRIGGERING ME. YOU [ __ ] you're triggering me. Please, don't. >> You are triggering ME. NO, THAT TRIGGERS ME. I WAS ON A PLEASE DON'T. PLEASE. NO. PLEASE DON'T. PLEASE. PLEASE. DON'T PUT ALL THIS NO, you can KISS MY ASS. NO. PLEASE STOP. I WILL BE FINE. JUST I'M LOSING THIS ENTIRE THING. >> NO, WE CAN'T. NO, WE CAN'T BECAUSE YOU ESCAPED last time. >> No, I didn't. I didn't open the door. Nothing. >> Yeah, because you can't. >> I stood outside for you to tell me everything. I'LL BE FINE. I'LL BE FINE. I DIDN'T OPEN THE DOOR. >> [screaming] >> THANK YOU. I'M FINE SITTING RIGHT HERE. DO NOT PUT >> I'M GOING TO >> SORRY, IT'S ALL IN YOUR HAIR, BRO. >> I knew it is. >> DO NOT PUT [ __ ] ON MY HAIR. OH, YEAH. >> CHARLIE 212 JUST GOT SPIT ON. >> [clears throat] [clears throat] >> I was just supposed to know because no one would hang out with me. And I called him. >> [laughter] >> The people at the house didn't want to hang out with you? >> No, just no one in particular was hanging out with me. I was just supposed to know and I didn't try to do anything. And he said I did and I wasn't trying to. I was just trying to express my feelings and apparently I did something wrong. So, now they want to put me in jail [laughter] and they want to put me in Baker Act just so You have dealt with me before. Trust me, you've seen me at my worst. I don't want to Please, >> Listen. >> YOU KNOW WHAT I DO AND THEN YOU KNOW WHAT I do. Please. >> I know, but listen. >> They said there was a video apparently, but I don't know there was a video, okay? >> You just said there's a video. >> I don't know if there WAS OR NOT. I was just saying there is or not. >> They they they wouldn't Baker Act you. They didn't have enough to Baker Act you. So, obviously they had something that they can Baker Act material. >> I can stay somewhere else. I can't Like no one can say that I can just go somewhere else. Can you listen? The other issue is the other thing is you spit on the deputy. He's not even TALKING TO YOU. IS THERE a reason you spit on him? Because unfortunately because of that, it's either you're getting baker acted or you're going to jail. I am happy you're still here. I'm happy you're doing better. No. Because right now it's not that's not happening. Okay, just give me one second. All right. We're going to go right over your head, all right? You breathe? This is spit mask applied. Well, because you were spitting earlier. You spit you spit on the officer. >> [screaming] >> LISTEN. AND EVERYTHING. >> NO, YOU BUCKLED ME AND DON'T DON'T LET HIM KNOW ANYTHING IF BUCKLED ME. >> LISTEN. LISTEN. LISTEN. He's going to take you to jail. Okay? You said you prefer jail over the hospital, correct? >> Can you take them off? >> Only Only if you start listening to me and say okay when I speak, okay? Are you okay with going to jail with this deputy? You prefer jail over the hospital, correct? >> How long will I be there? >> You have to go there, get booked in. They will let you know when you get there. The jail deputies will. Okay? Three days. In the back of this car, can you stay calm? >> Do not put that [ __ ] on the ankles. I have those plates. I will, but do not put that [ __ ] on the ankles. You saw what they did to me. >> but do not put that [ __ ] on my ankles. You saw what they did to me. Something happened. >> understand. If you If you do If you stay calm, it does not go on your ankles. If you become unruly again, he's going to stop on the side of the road and I can put them on your ankles. >> Please, sir. Please, I'm going to jail. >> Yes, I will tell him. >> He has his number, please. >> All right, I will. Take his spit mask off. >> I'm not spitting. I only was going to take it off for a second. >> Don't be escaping your cuffs. >> SIR. SIR. >> TRY >> WHAT IS ANSWER. >> I'M NOT. >> MY DAD'S HERE. ARE YOU DAD, HELLO. HELLO. YES. YES, WE GOT [ __ ] CAUGHT. >> STOP SPITTING. STOP. >> Tell me. >> No. Where Stop. I already told you stop. Bottom. Can you not spit on me, please? >> spitting on you. I trust you. I'm not. >> All right, can you not spit on him either, please? >> I'm not going to, but I don't want him near me. I just want you near me. >> Unfortunately, we both need to be here right now. >> I understand that, but I prefer you to handle me, not him. >> Okay, we're going to figure that out. >> Okay, can you answer one thing? >> What's your question? >> Why can I not communicate with my boyfriend over the phone? >> While you're in our custody in handcuffs, you cannot. >> right there? >> Correct. >> You want me to shut up? >> Can you not spit on him? >> I'm not. >> I do have to do this. >> Especially if you do >> to hold >> He did it first. >> And there it is. You hear the radio call Charlie 212 just got spit on. >> Charlie 212 just got spit on. >> This is the exact moment this stopped being a medical call. Under Florida Statute 784.07, spitting on a law enforcement officer is classified as battery on a Leo, which is a third-degree felony. She literally begged the officers to take her to jail instead of the mental hospital and by spitting on them, she forced them to do exactly that. Ultimately, Autumn was medically cleared at the hospital and then immediately booked into the county jail for felony [music] battery. She later pled no contest as her case was resolved through a pre-trial intervention program. So, if she completes 12 months of supervision, a mental health evaluation, and 50 hours of community service, the felony charge will be completely dismissed. >> It's just crazy how understanding the history [music] behind the Baker Act and police tactics like the fatal funnel just completely changes how you view these videos. You start to realize they're not just reacting, they're following a very strict legal [music] and tactical playbook.
