I call for a tow truck and a cop car pulls up I've got two squads behind my car and a tow truck in front of my car [Music] on February 5th 2022 officers received a call from a towing company stating that there were two people who got stuck in a snow bank and needed to tow their vehicle in Eau Claire Wisconsin the tow company believed they should be checked on as they sounded intoxicated over the phone the couple was identified as Courtney Moulton and Michael Moulton when the officer arrived on the scene he knocked on the passenger side window and made contact with the passenger who was Michael the officer could immediately smell the odor of intoxicants as he spoke with Michael and the driver Courtney Michael advised that Courtney drove because she only had a couple of drinks and they ended up sliding into the curb and becoming stuck slide here earlier a little slip and slide how long you guys been out here but uh my 20 30 minutes we're waiting on a tow truck you pull us out okay did you guys called so yeah we did you guys did who'd you call it was uh do you guys have ideas on you of course snaggles how'd you end up here try to take a left I'm trying to take a right turn going this way towards Altoona to the right there's life while speaking with Michael the officer noticed his jogging pants were about mid thigh and his ankles were exposed Michael advised that he was handicapped and needed to urinate so he had pulled his pants down and had trouble getting them up hey ma'am Courtney Courtney have you been drinking tonight we just got back we just got back from Cancun yes we had a couple drinks tonight okay oh okay all right a long night okay do you have an ID on you I do okay um children Waters I'm gonna pop my doctor [Applause] she thought you know she only had a couple and that's kind of how we were at tonight so okay and we took we to the right turn real too quick and uh we you guys do live like in one of these apartment complexes we actually live we actually live on the south side and so we were actually getting turned because one of our friends like lives down the streets felt like we took and turned away too fast and they're no longer awake and no longer answer their phones because now we're gonna and this is where we're at okay all right well you can just stay warm for a little bit William 149 headquarters I'll take a second [Applause] what's up buddy he's handicapped I don't think okay so what that's going to present a problem okay saying that they were coming to visit a friend from time he was saying that he's really intoxicated and she is admitted to have any questions Hey sir how's it going all right oh there you are I'm 40's Dad I just need to know what I what what do you want me to do to stay out of your way for now probably just hang in your car for now yeah just give me one give me one sec I just got to talk to Courtney and Michael and what's your first name Sir Arthur Arthur Arthur if you just wait in your car for five minutes I'll come and talk to you okay okay I'm gonna go back behind the tow truck perfect okay sounds good sir all right I'll let them know what I'm doing yep thank you [Applause] his pants are like down to here so he said he had to like pee and he had to get out because I was like what's going on here so he said and I have okay and I've seen him like get real he's in a wheelchair so I can confirm also that he's beautiful that's I'm happy that the officer then proceeded to ask her to step out of the car and transport her to the police department to conduct field testing all right Courtney oh if you just come over here I just I wasn't sure what you wanted me to do yeah so um based off of the driving and you admitting to drinking I want to run Yuka I want to run you through some field testing to make sure that you're okay to drive are you okay with doing that for me okay so because it's really cold out here and I can't properly test you in the cold um I want to take you to the police department garage it's a it's about I don't know 6 55 60 degrees in there instead of negative 10 out here okay Courtney um would you be willing to do that with me okay um if you if I don't have a sense that you are over the legal limit or that you have that you're not too intoxicated to drive a vehicle I'll drop you off wherever you need to be dropped off okay um if if you are if my tests deem that you are over the legal or are intoxicated and impairment is what may be the cause for this crash um or maybe one of the causes if not the cause um then also fighting when this happens so what we're also fighting when this happened okay that's that could be another reason that that it caused this um okay so do you need anything else from the vehicle right now so I have my ID I have your ID oh you do I do nope yeah you have my ID no okay uh do you have anything else do you have anything on your person like any weapons or anything just because I'm gonna have you no just some battery pack just a battery pack you got like a cell phone wallet nothing else oh I have a cell phone right here okay my vape cool can I just pat you down quick just to make sure because you're gonna be driving back and I can see these are pretty loose okay I'm just gonna have you sit in the back of the squawker and then this is your fa your father's here did he just show up yeah okay I called him I called him so for him to take me out because we were fighting okay so I called him so I could stay in his house gotcha okay so I'm because your dad just want kind of wanted to know what was going on so I'm gonna go over there and kind once I I'm just gonna have you get in the back of my squad car where it is a lot warmer and then I'm what's your dad's first name Arthur Arthur I'm just gonna go have a small conversation with Arthur and just kind of let him know basically what I know at this point okay are you okay with that yeah okay Courtney why don't we just make your way back to my squad car it's just this first one and then I'll also tell Michael kind of what's going on [Applause] it's like a weird Contraption but now I can just seat belt you okay okay perfect well I just see Bill Newton because that's the law so give me a minute while Courtney awaited transport the other officers questioned Michael about what had happened why the [ __ ] did you have to fight with me yeah if it's this way all right hey man do you know Arthur her dad at all of course yeah okay I don't know if you have a father-in-law yes oh gotcha okay that's my wife all right because so here's the deal she's oh I didn't know you guys were married sorry yeah oh I just I'm the one who came second so I don't got all the information so um my partner is gonna be taking her down to the police department do some field testing sobriety and stuff um just to make sure that she wasn't too intoxicated to be driving yeah around that whole limit thing it's like I knew I had too much drink because I had to work tonight like I said I said to your partner we like we got back from Mexico uh literally like tonight so a lot of people wanted to welcome us back yeah I'm like I know I can't drive and then we got then like you know so we have some friends down here like down this block and we took the [ __ ] turn a little bit too fast and here we are and now we're entering their phones because I'm sure they passed out yeah honestly so anyway so um yeah so here we are so yeah that's what that's what my partner that's why we're robbing the whole concern she wanted to be over the legal limited totally fine guys yeah I understand it's like like I'm like do you know where you're in and she started yelling at me and we yelled yelled at each other yep I'm like it's called to a truck can you back out this is this and yeah so okay so you think you can ride home with Arthur then I if if not if we can drive I mean like I haven't I have my Walker in the back so I handicapped so like if I ever walked in the back either way I have no idea so it's like if you can drive this car if you can pull it out I don't know I mean all it needs is just to tell all of it but like he wants to drive this car back home because I don't have a way to get into the house without this pretty much this car because I have no garage door opener well you can take the garage door opener with you like you just told me no the garage door openers program oh gotcha so nobody has keys to get into the house I think she does but I don't think she has them on her well you can drive tonight I definitely can't because I'm like you just told me I am here so like yeah so I don't know so here's that's that's the problem so if he can drive if you can drive this car and take it back home to him I'm gonna let him decide that if if you yeah if you're not gonna do that because he wants to drive his own car then that's just the way it's going to be I get that yeah it's totally fine like I mean if you can drive this car and just take it back to his house tonight that's fine park it in the parking lot something because he's only one man too so get two vehicles home good point two point yeah so if you want some park on the other side on the outside tonight that's my that's why it just want to be getting towed out and being parked here because I don't know if it's gonna be able to get home I'm not gonna well it'll get home by itself I know that I mean it's just we're just up on the Snowman we just no no I mean I don't know if there's anyone who's gonna be able to drive it tonight because again he has to drive his vehicle home Crush yeah and you can't drive as long as you can park I mean I'm sure you can park down the block or something like that you know whatever but we'll see how it works yep we'll make it my squad car right now she's gonna be headed down to the police department I want to be running Runner through some field sobriety testing okay um because she's admitted to driving she's admitted to they're coming from um Galloway Street Bar District they wrote drinking um he said that he's too intoxicated drive so she drove um sounds like they were trying to negotiate this curve they come to a friend's house someplace on this in this area and that's when and she also said that they were arguing um and so a combination of both I I don't know but whatever happened she slid they slid off into the roadway and the vehicle got disabled so then they had to call a talk um she's been honest she's been nice to me I'm just going to take her down to the field take her down to the PD garage because it's way too cold to be doing field testing out here right now I can't keep my finger from moving and that's one of the tests so um we're gonna bring her I'm gonna bring her to the PD run her through the test and um I was do you have any questions for me in regards to any of that um is Michael free to go Michael is free to go yep okay how about if I take him home that would be awesome and much appreciated because the tow truck driver was gotta I can give you my phone number you can call me and tell me what's going on with Courtney yep thank you thank you where did you live I live on Walnut which hopefully I can yeah and and again you live on Walnut so so basically every before covet it was a thing anyone who was found that we determined um where we believed was guilty of an OWI when we arrested for an Oliveira had probable cause of arrest they went to jail and they had to wait till they got sober before somebody had to come pick him up in jail nowadays ever since kovid they made a couple things nicer this is one of them we have this we have this piece of paperwork I basically have to sign a Rover to somebody who's over the age of 18 and sober which you seem like you're both right yeah yeah and I'm not I'm not calling you old but you are you seem like you're over here and uh and you you seem sober just from talking with you so um if that's the case Okay I I have to read her this lengthy form she's got to basically say again this is all if she ends up getting arrested for another bike I'm just trying to explain to you the process it'll be about an hour an hour to an hour and a half before you before you get a call from me and I say hey can you come get her for mail or hey I'm going to be dropping her off on Walnut okay hopefully I can come get her and you can tell me where to go to together yep also uh they've just they just got back today from Mexico not Mexican yup that's what they told me yeah they told me they went to Mexico they were at they went but first they said they said their comeback from Cancun and that's and then they were today they were drinking in my off cycle okay so you guys were driving from Cancun like like the restaurant so and then they're like no no no we had a wedding that he was that Michael was DJing at yep and then they were like no and then we went back to my office tonight and we had some drinks there and and I have seen him DJ down there so I I that's my knowledge um and then yeah I talked with the tow truck driver because there was a concern as to how we were going to get him where he needed to go because he he cannot walk okay gotcha all right well I'm gonna tell the tow truck driver that you're gonna grab Michael and help him get home and then can you just ask Michael where are you Michael or your daughter where they want the vehicle code or if they just want it because I don't know the damage to the vehicle at all do you think this vehicle is just going to be like a hot shower type of thing yeah okay I'm hoping to get back to this car he's easy to ride home told them to describe so I asked him to ask Micah what he wanted with the vehicle so that he can relay I need anything else okay perfect thank you very much have a good night hopefully go pick her up they want to know where you guys want the car taken um so that's just because they don't know what the damage is so I'm taking you home if you want them to bring it to your house and then just add it to the case yep okay just yeah I know he lives in a walnut so if I do end up faster I can drop him for office sounds good yep foreign we just went up on the curb and we just we just got stuck between the all-wheel drive and stuff that's pretty much all it was awesome okay so we're gonna drop it over in the lot here yep that's fine with me of a cop car right now 10-4 and Crema is still in my car my dad was talking to him right now and then the cop is gonna end up talking to him but I'm pretty sure I wanted to jail for the rest of the on yeah no that's where I am already can hear me yeah I can hear you okay we're gonna be headed to the PD garage now okay I felt like I was going there what was it I felt like I was gonna go there as soon as you guys showed up it's fine well it's just it's just the garage you just I just want want to see you you know as long as my car gets out of this snow bank yup so so I'll kind I'll explain to you kind of what I've been doing the last 10 minutes or so um so I talked with the I talked with your dad Arthur and he's good he's gonna help Michael out and get Michael where he needs to go tonight and then um it's I don't know if your vehicle's like I don't know if there's something that's damaged with your vehicle no nothing's damaged with it okay so and again just the way that it's caught up in the snow bank when they go to pull it out if something does get ripped out or damaged I do not know like so at this point I talked to the tow truck driver he said that uh it sounds like he's just gonna be able it's called a winch out where he just pulls it out of the snow bank and then leaves it like parked on the side of the road yep okay so your vehicle either be there and I took it again I told this all to you to Arthur too so the vehicle is going to be there or hold on or it is going to be um code to wherever your dad or Michael asked for the vehicle okay okay and then um I told your then your dad's going to give Michael a ride back and then we had a salsa and walnuts um this goes past the test that I that I got from you um if not then we'll just we'll discuss that when it comes thank you foreign just come over here all right here all right so we're just I'm just gonna run you through three tests okay um just because you admitted to driving admitted to drinking I could smell I could smell alcohol um uh once he's out of the way the three tests basically I'm gonna test your eyes I'm gonna test uh you want a walking turn test and I'm going to test you on a one-legged stand do you have any like ankle or knee injuries that prevent you from walking or so when we do the probably when we do the one-legged test again you can pick whatever leg you want and then the other test is just I'm gonna have you follow my finger um with that do you have any history is it like head injuries like um any tbis traumatic brain injuries okay uh what about you wear glasses contacts you do you have contacts in I have contacts in right now okay and you can you can see my finger perfectly fine Perfect all right I'm gonna have you just step to the front of my squad car and for this first test I'm gonna test your eyes okay so what I want you to do is stand just like me heels and Toes together arms down at your side don't put your hands in your pockets or flail around okay just stay like this and I'm just going to ask that you keep your head perfectly still just like it is right now and you just move your eyes and you follow my finger you understand all that okay perfect all right I'm not going to touch you I'm just going to stay about this far away from you just want you to follow my finger ready okay [Music] I'm sure you're keeping that head still [Music] [Music] yeah going to do is you're going to put light put your left foot on that line just like I am right now just put your left foot out there okay you just want to take a couple steps away from my spot car for me there we go and then put your so put your left foot out there just like I am nope just like this just just like this Courtney just look at my feet Courtney look at my feet just put your left foot out there just like that just like I'm doing yep just stick it out there and now put your right foot just like that and keep your hands down by your side and stay just like that okay stay just like abbreviation because if I do all the way nine I'm gonna hit the squad card so no nine this way nine back so nine Heel To Toe steps down do the turn how I instructed you and showed you and then nine Heel To Toe steps back while you're doing the test make sure you keep your hands at your side um you watch your feet you count out loud and once you start this test don't stop okay do you have any you're ready you may begin okay alrighty Courtney I got one I got I got one more test for you okay all right so this this one is that uh stand on one light but again you can do whatever you want okay Courtney all right so for this test uh I'm gonna stay I'm gonna pick my right what I'm gonna ask you do just like for the first test heels and Toes together hands on at your side what you're going to do when I when I instruct you to do so not while I'm doing it is I'm going to ask you pick up either leg pick a leg of your choice you're going to raise it about six inches off the ground you're gonna point right it's weird it's just basically pretending pretending there's a pop can under you okay so when I instruct you to do so about six inches make sure you keep your keep your legs straight and I want you to point your toe at me watch your toe and I want you to count like like I count one thousand one one thousand two one thousand three one thousand four until I tell you to stop the test is going to go about 30 seconds but that doesn't mean once you get to 30 it's done because you might count quick or come slow okay so just whenever I tell you to stop stop but know that it's about 30 seconds okay so again when I tell you to start you pick up either leg that you want what I want you to do is I want you to count out loud I want you to watch your toe I want you to make sure you're keeping your hands down and if you happen to get to like one thousand three one thousand four and your foot if you stop because your foot hit the ground just pick your foot back up and start counting hopefully less than that I feel like I might be a little bit older okay and but we're also fighting and that's why my car went into work do you feel um did you feel safe to drive tonight based off of how much you had to drink you didn't feel safe to drive so you'd be you'd do this you drive like you drive like this often no but tonight you did feel safe when you were driving okay um so knowing that that legal limits point away I want to give you it's called a PBT it's basically basically breathalyzer would you be willing to take that for me okay all this is going to tell me it's going to gauge uh where you're at for me okay um it's all zeros when it's done it calculates for about five to ten seconds when it's all done if there's no alcohol in it it'll turn bright red you see how it lit up a little bit okay so all I'm gonna ask you do you ever taken one of these before nope my brother's house Brothers have okay so all you do is take a deep breath as deep as you can and then act like you're blowing up the world's biggest balloon I'll tell you when to stop okay just blow as hard as you can until I tell you this out deep breath in perfect you can stop okay I'm just going to throw away the tube all righty and then you guys were on your way back from just my office where you're visit your husband or your boyfriend your husband how long you guys been married a year and a half year and a half after conducting the field sobriety test the officer determined that Courtney was unfit to drive and the PBT determined that her blood alcohol level was 0.140 which was two times over the legal limit oh it's still going not gonna sugarcoat in her life do or anything I'll show you what it's at um and I did I determined what I was going to do before this and you I'm you shaking your head and saying you already know what's going to happen so you kind of so you're you stopped at a you stopped at a point one four okay so that's almost two times illegal isn't it um uh so tonight you are going to be arrested for an OWI all right do you have any questions for me right now okay I'm gonna put if you're gonna get you've been Cooperative with me I assume you're going to continue to be cooperative with me I'm going to put you in handcuffs but they're going to be on the front Okay so normally we're paying a couple people in the back if they're being uncooperative or just that's how normally we do it I'm gonna handcuff you on the front do you have any objections today it's a lot more comfortable so I'm gonna do that um and then I have a some paperwork I have to go through with you and then we'll go from there okay have you ever had an OWI before no okay all right just give you you do have to pee okay we let's actually take care of that then first um I'm gonna bring you either been arrested for an offense that involves driving or operating a motor vehicle while under the influence of alcohol or drugs or both or you're the operator of a vehicle that was involved in an accident that caused the death of grape bodily harm to or substantial bodily harm to a person or you are suspected of driving or being on duty time with respect to a commercial motor vehicle after consuming an intoxicating beverage this law enforcement agency now wants to test one or more samples of your breath blood or urine to determine the concentration of alcohol or drugs in your system if any Test shows more alcohol in your system then the law permits while driving your operating privilege will be suspended if you refuse to take any test that this agency requests your operating privilege will be revoked and you will be subject to other penalties the test results or the fact that you refuse testing can be used against you in court okay if you take all the requested tests you may choose to take further tests you may take the alternative test at this law enforcement agency provides free of charge you also may have a test conducted by a qualified person of your choice at your expense you however will have to make your own arrangements for that test if you have a commercial driver's driver license or we're operating a commercial motor vehicle other consequences may result from positive test results or from refusing testing such as being placed out of service or disqualified in addition your operating privileges will also be suspended if a detectable amount of a restricted controlled substance is in your blood Courtney will you I'll repeat that Courtney will you submit to an evidentiary chemical test of your blood yes or no so I hate needles um so now I can kind of tell you how the rest of the process is going to go because that's kind of what it what it hinged on um so what's going to happen here is you are going to be I'm gonna we're going to be going to Mayo hospital okay and the phlebotomist there is just gonna they're gonna draw your blood um I'll take you out of here out of the handcuffs they'll draw the blood I have to fill out some paperwork there that takes about 10 minutes once we get in there and they get you set get you set down um and then I will will come back out to the squad car I have to complete some paperwork and add and read your rights and then I'll ask you some questions you can again you can answer whatever you want or not answer anything doesn't matter um and then at the end um it sounds like I talked I talked with your dad already just in case I did arrest you for an OWI tonight it sounds like he's fine either picking you up or me dropping you off I feel I can save him some time give him a call and I can just drop him off drop you off at his house and I have to get him to sign a form basically saying that he's responsible for you until you get sober or until you sober up from like tonight okay okay yeah all right so that's kind of the process again we should I'm hoping to have you I'm a daddy's girl so he'll probably come get me honestly okay I'm hoping to have you out of my squad car at five so that take responsibility of her um you base it that this is basically just because we don't want to just drop her off at somebody's house and say hey she says to them hey I'm taking me back to my car I'm driving again because we don't want that so that's basically all this is saying okay so this is your copy and then I would just ask that you sign here print your name here and then date it underneath the bottom uh the other two are citations because it's OWI first offense it's it's not a criminal offense it's just a it's just a citation okay in the state of Wisconsin Most states your first offense is a misdemeanor which is Criminal Wisconsin is not that way okay so basically at the end of the day it's a really big fine and your insurance goes up okay that's really all it is you didn't hurt anyone you didn't get hurt at the end of the day that's all it is okay Courtney and again I we had this conversation in the car I appreciate you tonight okay you've been super decent with me super cooperative we're honest um so the two two citations tonight one is for operating Under the Influence okay and the second is for failure to keep your vehicle under control because that vehicle ended up sliding off the roadway and went into an area where you needed to get towed self-explanatory do you have any questions about the citations okay so up at the top is your court dates March 29th at 1 30 PM that is a mandatory court date right up here I wrote you have to come two hours early that's in basically because you're not going to jail tonight um you just have to show up two hours early for photographs and fingerprints okay um so if you you got to go to your court date if you don't go to your court date there's going to be a warrant that's put out for your arrest okay um so your two citations and your informing the accused paperwork I'll give that to one of you perfect all right Arthur Courtney do you guys either one of you have any questions from you you know what happened with with that and and they 100 will that's that's why it says estimated point value because it's not a guarantee one way or the other just like the final mode on there's not a guarantee they can work with
