many police officers misuse their authority to harass innocent civilians but do they always get away with it what happens when these same officers are quickly humbled and reminded of how to perform police officer from fuqu aren whose body cam footage captured the illegal arrest of a 14-year-old boy named Malcolm Ziggler it wasn't until another officer arrived on the scene fact checked the reason for the Minor's detainment and ordered the first officer to release Ziggler that he was humbled here's how the interaction unfolded D you're in possession of a stolen motor vehicle what what DS you in the back seat of the patrol car another officer arrived and quickly realized the arrest was completely unlawful ordering that Ziggler should not be in handcuffs here's how the interaction played out so you just go put your legs in for me for a second all right you got it almost there power see you we like a for yeah all right this ain t for man all right hey is he detained or he he's detained right now because he is he did's 14 he's 14 yes okay so I already explained to him he's detained right now I told him that so why is he detained because that's a stolen M vehicle okay so I mean digs verified the VIN number right did you is that before all that that you verified before you I detained him and then that's asked if he was 1095 or detained he's detained okay so obviously he's a juvenile right yeah you're not charging them with lony of a nope okay cuz say that didn't happen so worst you have is what possession of MOT vehicle which is you going to think you get secure custody and all that probably not or a petition all right the 14 me personally he ain't going nowhere you here with what Dad mhm ain't no sense having sit in the car t with handcuffs on where you ain't if he was 18 and you might be taking a jail for possession stolen property different but we you ain't going to take him joil right it's going to be a petition mhm I'll go ahead and take him out um question for you um so supposedly I know they're working on getting the bill cell right now M I haven't ask him plent questions that he's been running his mouth he said that he got it from some guy off in this is a case of mistaken identity involving Suisun police officers including officer maror who had an encounter with army Sergeant CRA in his own apartment on a Saturday night despite the situation CRA didn't hesitate to put them in their place the officers including former patrolman maror were responding to a call from a hospital to conduct a welfare check on a three-year-old child who had swallowed nail polish remover however they arrived at the wrong address and acted completely unprofessionally infringing upon the Sergeant's Fourth Amendment rights here's how the interaction transpired why because we received a call from North Bay for the incident that occurred earlier look look right there supp me investigator if you're investigating something 9 years US Army now what's the problem what's person I don't have to identify myself to you do I am I under investigation you want to tell me what's going on don't knock on my window can you come out here no she can't come out reaction was to order him out of the car at gunpoint and detain him after questioning the officer read Tran his Miranda rights and went on to violate his fourth amendment rights by unlawfully use her position to avoid charges she quickly introduced herself to the officer who initiated the traffic stop despite being caught speeding she repeatedly insisted that she wasn't here's how the have any weapons on you I live right there okay I would normally but do you have your some kind of ID or anything on you my ID is not here but I'm a penel kind W okay do you have some kind of idea on you no I was just driving that way I dropped my friend off and then I went this way because my I live right there I get that but I pulled you over cuz you were flying past everybody and you were cut no I was just driving okay when I was pulling at this point you were going like 56 and a 40 you were flying no I was not flying I was just do you have your registration with your name on it or anything well this car is not mine so okay do you have anything that you name on is that your driver's license right there it's my driver's license and my um can I see your driver's license sure do okay how would you describe your overall health good fair or poor I think it's okay at this time want to give you the opportunity to participate in Tom more field sobriety tests is that something you be willing to do you think that I'm impaired right now after eyes so in in the eyes you're showing signs of impairment I want to give you every opportunity to show me that you're okay yeah okay so again there's two additional tests the walkin turn and the one leg stand is that I'll do all of the tests okay perfect um hang out with him I'll be right back with you the officers initiating the traffic stop however did not treat her any differently than any other civilian caught breaking the law and driving Under the Influence finally Deputy Shelby performed the field sobriety test and here's how she did put your left foot in the line other left and then you can put your right foot front like this standing Heel To Toe arms down at your thids yep just stay in that position don't move till I tell you to begin now when I tell you'd begin you're going to take nine heel the toe steps down the line okay it's going to look like this one 2 3 and so forth end of the ninth step you're going to keep your front foot planted you're going to step off of your back foot you're going to turn around by make them here is a small step and we'll put this then you're going to take nine Heel To Toe steps back down the line one 2 3 and so forth several things I want you to keep in mind during this test when you look down at your feet keep your arms down at your sides count your steps out loud once you started this test I don't want you to stop until you finished do you have any questions so you want me to do nine heel toe steps down the line Y and then on the ninth you know we need to do small steps con count out and then 90s yeah turn around as I demonstrated keep your front foot planted you're going to step off of your back foot you're just going to turn around like this you don't need to count your steps when you're turning around you count your steps down your nine steps down and your nine steps back okay [Music] me no okay you may begin one 2 3 4 5 6 7 8 9 and then I'm going small Heel To Toe steps m one two three 10 four 5 6 7 8 9 all right so for this next test you can just reg the line we're not going to use it so what I'm going to have you do is you're going to stand with your feet together arms down your sides stay in that position don't move till I tell you to be in now when I tell you to be in you're going to raise one foot whichever foot you want approximately 6 in off the ground keeping your legs straight you're going to count Out Loud by a thousands it's going to look like this 1,1 1,2,3 and so forth until they tell you to stop sever things I when you keep in mind during this test keep your arms down your sides look down at your feet count out loud don't hop or sway for balance got now if you put your foot down which I don't want you to do but if you do I want you to pick that same foot up and continue counting where you left off so if you're at 1 1003 and you put your foot down you pick it back up 1,4 1,5 and so forth got it do you have any questions you just want me to pick my foot up count out loud look down at your feet then when you stop and I'll tell you when to stop M okay you understand the instructions I understand all right I'll let you know when you which leg do you want me to pick whichever foot you want whichever one you're more comfort you to pick up huh right left whichever one you want I'll pick up forever okay that's fine I'll let you know when you can okay okay whenever you want all right a soda can right yep you may begin 1001 1002 look down to your feet 13 1004 1005 1006 1007 1008 1009 100,0 1008 1009 10010 101 112 manys 10000 huh keep down your hands next to you oh um now I forgot and now you may stop oh I'll conclude our field the r test sorry I miscounted when um what time is it right now without looking if you had to guess uh 12:00 um how much you have to drink while you were down there I didn't have anything to drink okay here's the thing we both know you've been drinking okay by telling us complete lies like I know that you're not being honest okay so I know you had something do you remember where you had drinks how much did you have okay so why do you smell like alcohol I do not smell like alcohol I smell like pigment that's not pigment that's very strong alcohol Deputy Shelby was detained after failing field sobriety tests humbled by her attempt to use her position to evade the
