y'all have three cop courts because I'm feeding cats you all are unbelievable this is what you're wasting City gas on hey it's gonna get ugly if you don't stop it is July 2022 and kind-hearted cat loving 61 year old Mary Alston is feeding trapping neutering and homing cats in Wetumpka Alabama she is doing this out of the goodness of her heart but three police cars have just pulled up beside the patch of public ground where she was placing her traps and they were piling out of their cars to investigate the incident the police officer is greeting Miss Alston asking her what she's doing and telling her that the police have just received a call informing them that she is feeding cats the officer then asks her for her license she is surprised that three patrol cars have turned up to stop her feeding the cats surely one police officer should suffice in this investigation she doesn't have to give the police her license because the Fourth Amendment of the U.S Constitution has been designed to protect people from unreasonable searches and seizures by the government the police have not provided reasonable cause to demand her license but she is collaborating with them in any case how are you I'm good how are you doing all right what question what are you doing trying to trap some cats okay all right we got a call that somebody was out here feeding the cats and stuff like that so I'm trying to track them okay you have your driver's license with you man what are you taking once you travel okay wait a minute I got three y'all have three cop course because I'm feeding cats no we always we always do this it's unbelievable all right thank you ma'am all right give me just a second myself if you come back and we catch you out here you go to jail for Criminal Trespass third this is public property City properties which makes it public yeah and the city does not want anybody feeding the animals around here because they're becoming a nuisance I'm trying to help that nuisance by catching them I mean you should they should be thanking me I've got a trap set right there trying to help catch them and get them out of here control off to a certified I know that and Terence noticed that I try to help him catch them okay we're done you know okay the trespass stands just don't be around here traveling anymore okay the First Amendment of the U.S Constitution guarantees her right to freedom of expression from government interference including her freedom to feed cats the police do not have the right to stop her feeding the cats instead they are threatening to send her to prison for Criminal Trespass if she comes back to the same place in the U.S the police have the right to order her to leave public land and to charge her with trespass if she doesn't comply nor do they need to supply a valid reason why she should leave she is telling the police officer that she is trapping the cats so she can re-home them but the police officer tells her this is the job of animal control sadly Animal Control has the right to impound and euthanize kill colonies of cats nearly 1.4 million cats are euthanized every year in the United States Animal Control is the number one cause of death of cats the police officer then orders her to leave immediately or go to jail for trespass us well man we we told you to leave this area [Music] well for trespassing we told you to leave and you haven't left I could take you to jail now I'm not trying to do that ma'am do you have your driver's license with me uh yeah I mean we're trying to do it thank you ma'am the one-year-old Mary Alston is reluctant to leave the police officers are threatening to send her to jail if she doesn't leave immediately you want to handle her and she's still not leaving if you want to take her to jail too go for it all right Mr Roberts okay apparently they've had an issue with you out here before with the cats not here feeding the cats out here right well I feed them we've been trying to trap them and we get them neutered and then get them homes okay so we're trying to do the city a favor okay well the city has asked you multiple times the city yes ma'am not to do this okay and they have trespassed you okay and now you're trespassing I'm sitting in my car I'm not well you're on the your name you're on the property you've got cat food okay it's pretty I mean all in the back seat it's pretty it's pretty clear what your intent is okay all right so because you've been trespassed and you have returned yet again we're going to take you to jail okay Jesus Christ no no no no the police have to attention to 85 year old Beverly Roberts she is telling them that she is feeding trapping and re-homing the cats the two police officers are insisting that she is trespassing although she is sitting in the car and reminding her that the city has warned her multiple times the police are arguing that the presence of cat food in the car suggests Criminal Intent feeding the cats is not a crime but trespassing is they have already warned her so they are taking her to jail you can go too I'm just no so I'm not allowed at home no that doesn't involve you the police are threatening both 61 year old Mary Alston and 85 year old Beverly Roberts with trespass and jail Mary Alston is demanding her right to freedom of expression under the First Amendment but she is refused Beverly Roberts is insisting on her right to consult a lawyer but she is also turned down she is told that she can see a lawyer once she gets to the jail the police are planning to arrest and in prison an 85 year old woman because she's trying to protect cats go ahead and get in your car go ahead and get in your car damn go go to your car before you get away I guess you wanted to no I just wanted to say okay get in your car go ahead get in your car get in your car all right Miss World we're gonna have to get your step out okay I'd be trespassing if I did well maybe you're already trespassing you all right unbelievable this is what you're wasting City gas on okay step up here okay I'm not gonna listen to him listen hold on where are you going Phil I'm gonna give her my car keys so she can get my car to my house give to that officer right there it's going to get ugly if you don't stop the U.S Supreme Court has ruled that officers may only use force that is objectively reasonable to effectively gain control of an incident while protecting the safety of the officer and others there is no evidence that strong physical force is necessary in this case the U.S department of justice has also stated that officers will be trained in de-escalation tactics and techniques designed to gain voluntary compliance from a subject before using Force the Alabama police would rather use brute for course okay now you just got another job congratulations yeah you know I'm tired can I get my car off no ma'am you just threw those keys at an officer you're not getting anything come on now you're 84 year old you were way too old to be acting like this come on now acting like a child listen I want my purse I want I want my purse my identification you can't take me without my purse go ahead come on close my heart don't worry we're gonna get all your stuff just step in for me well I can't without you know I'm almost 85 years old I had every intention of putting those handcuffs in the front for you until you started acting like that thank you a lower course you can get better the police are handcuffing her hands behind her back and Hauling her to the police car the Alabama police are clearly violating the ruling of the U.S Supreme Court these officers are not using reasonable Force to detain her nor are they protecting their own safety they are brutalizing an 84 year old woman that is desperately trying to save the local cats from being terrorized and euthanized they don't even permit her to collect and Safeguard her purse and her ID the Wetumpka municipal judge Jeff Courtney sentenced 61-year-old Mary Alston an 85 year old Beverly Roberts to two years unsupervised probation and 50 fines plus court costs for each charge he also added a suspended sentence of 10 days in jail for both women Roberts got charged with disorderly conduct resisting arrest from police officers that handcuffed her hands behind her back and Alston with interfering with government operations protecting cats from euthanasia Jerry Willis mayor of watumka admitted that he is the one that spotted the parked car and called the assistant chief of police who sent three three Patrol Vehicles mayor Willis acknowledged that Roberts had challenged him in the past about the actions of animal control but insisted that he did not order the police to arrest the two women Richard Beyer chief operations officer insisted that cats and buzzards caused thousands of dollars in damage to Vehicles the attorneys that represented the two women disputed the claim that cats and buzzards damaged vehicles and argued that Alston and Roberts were trapping and re-homing cats and reducing the damage to private property buyer on the other hand insisted that the cat food brought more cats and birds into the neighborhood Stephen tears director of Montgomery Humane Society argued the Trap neuter return programs have proved successful all around the United States Alice Burton director of alicat allies agreed compassion is not a crime These Are Good Samaritans that should be applauded and not handcuffed the defense attorneys claimed that the trespass charge infringed the First Amendment right to freedom of expression that included the freedom to feed and protect the cats the prosecutor and the judge on the other hand prioritized the damage the destruction and most important of all the monetary loss that feral cats have caused in the neighborhood so this case is all about money money has caused the destruction of millions of innocent cats every year all around the United States money has caused the arrest and Punishment of these compassionate women one local reporter has blamed small town politics it's so utterly absurd and to be quite honest it reeks of small town politics it smells suspiciously like some thin-skinned City official got peeved because some ladies had the gall to question him and he decided to flex a little muscle show those little gals where the power lies
