You mind taking your hand out of your pocket for me? No, you're good. You're good, bro. No, no, no. You're good. I just Yeah. No, you're good. Anything on you? >> No, no, no. No, you're good. You're good. I >> I just have I just have keys in my pocket. That's it. >> Okay. So, what? No, you're all right. So, guys, what? Let's get out of the road. Let's get out of the road. >> Here, follow him and I'll close the door. >> What is going on? Um, so, uh, I'm supposed to start school tomorrow. I had her I I have plans for her to come out and hang out with me before I start school. >> Okay. >> Have dinner and whatnot. And >> clearly, you can smell. >> Yeah. >> Um, and where >> smell you? >> Where where she resides >> where she resides is in Berlin. >> Okay. And there's no way in hell I'm gonna let a friend >> no >> drive. >> Absolutely not. >> So, we're just trying to figure >> Let's walk over to the driveway. Let's get out of the road. >> We're just trying to figure out the best option because she can't stay here. >> Okay. >> Her mom is on the way. Wake her up. >> No, no, no. I'm sorry. >> Um Okay. So, who has keys right now? Who has the keys? You have the keys. Okay. All right. Um Okay. Um, if you don't mind, you could just I know the keys aren't in there. You don't have any spare keys, right? >> No. >> No. Okay. If you want to just go sit in >> My mom has them and she doesn't. >> Okay. But if you don't mind, if you you can just uh sit in the vehicle just for now and I'm going to talk to them real quick. Okay. And then I'll come talk to you in a second. All right. I just want to have you guys separate. >> Present. >> Well, I just want to separate the parties. That way I can get the story on both sides. >> So, yeah. Got it. >> So, Yes, sir. Okay. So, I could tell you're clearly upset, right? So, yeah. So, what what happened? >> So, my son is living with us. >> Mhm. >> He has his own problems. >> Okay. >> But his kindness is, you know, he wants to shred off this girl. >> Okay. So I said, "Okay, she can come over. We're going to have chicken Alfredo and everything else. >> Watch the games." >> Yeah. And watch. >> And uh but he told her, "My mom is not going to allow in the house. >> She's not going to allow you in my house in her house if you've been drinking." >> Mhm. >> And she drove here drunk. >> Okay. Now, I know you can't do anything about it >> because you didn't pull her off. I understand that. >> Yeah. >> And it's been a long time. So, in in theory, she could just say, "Yeah." So, >> and so I told him, I said, "Call her mom. She's not staying here." So, cuz she was going to spend the night. >> Okay. How what time did she arrive here? >> Probably about an hour. >> Yeah. Roughly 5. It's 5 now. So, roughly about 4:00. >> 4:30. >> Yeah. Okay. >> Yeah. >> Okay. because uh she's like, "Hey, come out and meet me." I'm like, "Okay." And I saw her on the road. I went up to the road and I was like, "This is weird." Okay. Why would you just pull up here? Okay. >> She was in front of >> And immediately I walked up and I just saw the glossiness and I saw a man run to someone. I'm like, "Bro, real >> I I was like, >> "No, I got you. I got you. >> Come on, man." Like, I mean, >> I got you. >> Yeah. So, I just want to I just want to make sure though uh at any point did it turn into a verbal altercation? Did it turn into a physical altercation? >> No. No. No. No. No. No. No. >> Okay. So, no no crimes, just more preventing one from happening, keeping her safe, but then saying, "Hey, we don't want >> Trying to get her dose of a dose of reality." No, absolutely. >> Like, I mean, I don't want to I don't want her to go to jail. >> No, >> it sucks there. Um [laughter] >> No, >> I've been there. I got you. Um, and I've been trying to talk about rehab or whatever with her family and stuff, but it's just trying to figure out the best possible way to kind of get something to >> Yeah. >> click a little bit without the worst possible thing ever. >> Yeah. >> I'm 10 time. Thank you. Uh, and then question. Um, >> your guys' relationship, is it strictly strictly friendship? >> Yeah. Yeah. I mean, we're not seeing each other. Like, we've hung out and all that stuff, but we're not together. >> Like a romantic relation. >> Gotcha. Okay. I just wanted to have >> Yeah. For from my side of everything. >> Um, >> it's like I just >> No, I got you. >> I mean, >> I got you. No, you guys are doing the right thing. >> I messed up in April, you know. I I've never hit anything. I got my first deal on April. And >> did you? I and I went through with the veteran and all that. So I'm on probation. So like you know my time ran up and it's just she's a young kid. Like as a vet going in >> you're still going to treat me a certain way but you might be a little bit more lenient. >> Yeah. >> But with the civilian >> Yeah. No, I got you. >> You know what I mean? >> Then remind me her name real quick. >> Uh Cheyenne >> Cheyenne Karai. >> Yeah, I'll talk to her. So Cheyenne, um, your mom's already on her way, right? >> Is that correct? >> I don't want her to be. >> I know. But so >> my mom is not a safe person for me. >> Okay. >> I don't want her to be here. >> Well, so here's >> that will cause me more stress. >> Okay. Well, so here's the problem. What then? Who else can come pick you up? >> Charlie. >> Who's that? >> Uh, the one that lives on the property with me. >> Okay. So it's a friend. >> Yeah. >> Yeah. Okay. Do you have her phone number? >> Uh, I have his phone number. >> Oh, it's a it's a him. >> Yeah, it's a him. It's a Charlie. >> Okay. >> Um, he is a child. >> Okay. >> So, what? >> Yeah, he's he's a he's a registered sex offender. >> Um, >> threw that out there out of nowhere. Cheyenne, that caught me off guard right there. Um, >> I'm sorry. >> No, no, no. So, here's the problem though. Obviously, you can't No, I got you. Obviously, you can't drive away, right? They don't want you here in the condition you're in, right? So, that's the issue that we're running into. Okay? So, >> we got to get someone to come out here and pick you up. Okay? That's that's that's what we got to do. So, I don't know if that's Charlie, if that's your mom. Someone's got to come pick you up, right? >> A few moments later. >> Hello. >> Hello. Are you Cheyenne's mom? >> Yes, I am. >> Yeah. Okay. Um, so yeah, they know you called in, right? >> Yes. >> Uh, so they didn't give her the keys because she's very clearly intoxicated, >> right? >> And they didn't feel safe with her driving home. >> So they wanted to keep the keys from her to prevent her from being able to drive home. Um, you did the right thing calling us. Um, right. Especially you weren't here. You're not sure of the situation. You just have your daughter calling saying, "Hey, they're not letting me leave." >> Actually, she didn't call me. >> Oh, really? Oh, okay. Gotcha. Gotcha. Okay. All right. I've been in contact with her. >> Perfect. Okay. So, we're kind of all on the same page here. >> I'm just trying to help her out. >> No, I got you. So, um, his mom said they have no issues with her parking the car in the driveway for right now. Um, you hopefully are willing to give her a ride home. I'm assuming so since you drove all the way out here. >> Um, >> I can. >> Yeah. >> Um, we've been battling this for a long time. Um, her alcoholism is not my responsibility. It's not David's responsibility. It's not his parents responsibility. It's my daughter's responsibility. Do I want to take responsibility for her right now? No, I really don't. >> I got you. >> Um I don't know what her options are. I don't know what your options are. >> So my options um we did look into it a little bit and there is actually um we would be protected under case law um to kind of pursue a DWI investigation. Um but um given the time delay and everything that's happened again on the law enforcement side, we would still be covered under case law to pursue it. Um but I you know with you driving all the way out here if you're willing to take her. I'm just saying I don't know if that's the route that's most beneficial tonight. I can talk to my sergeant and see if that's the route that we want to pursue. Um, but I >> Well, let me tell you something. On Christmas Eve, >> Mhm. >> she was driving into Berlin and somebody had called in her license plate number. >> Mhm. >> She had had a few to drink. A state police officer caught up with her. She was at the ATM, so she wasn't driving. >> He talked to her, took her keys from her, drove her back out to the property where she was living, gave her friend a ride back to get her vehicle. Mhm. >> My dad was a New Mexico State Police officer. >> He retired from the department. My uncle was a New Mexico State Police officer. He retired from the department. >> Yeah. >> I worked for the state police for eight and a half years. >> Mhm. >> I told Cheyenne, I said, "You know what? This was your grandpa looking out for you." >> But I will tell you exactly what your grandpa would tell you. >> This one's on him. Next one's on you. >> I said, "You do not drink and dry." >> Yeah. >> Yeah. No, I completely understand that. Um, >> and I'm sorry I had to call you and have you drive all the way up here, but I'm just >> David. You're good. >> Well, a long time no see. >> I know. >> So, I don't know. I just got more information. Apparently, this is something she's been doing. It's been a constant issue. >> Want to like take her because of how frustrated she is about the situation. >> I'm going to go talk to her. >> No, absolutely. >> What do you want to argue that you had? >> Yeah, I didn't know she >> as well. He didn't admit >> she did not >> but we have >> that's what I was getting. That's what they were saying she drove you. >> Like I said if she initi within it's within the time period but I don't want you >> happy. >> Oh you just don't care for my advice. So, let's call him on. The reason they didn't give her her keys cuz she's very intoxicated. Um, so they had said she drove here like this, but it was by the time I got here, it was 45 minutes after. Um, and then I had her saying like, "Oh, I know I can't drive. Like, I know I know I'm not okay to drive." Um, and then but I have them saying she drove here. Mom just pulled up. Mom told me this is so I wasn't going to pursue a DWF. Um, mom pulled up. She told me this has been an ongoing thing. Um, she's been stopped. Um, she was stopped by state police, but she was out of the vehicle at the time. And so, state police did her a favor and gave her a ride home um, instead of charging her. Um, Koger is telling me that we are covered um, fully to pursue D-Dub if she admits she drove here, even with the condway. If she admits she drove here and drank before driving, she's very clearly intoxicated. I smelled it. I mean, before I was even talking to her, I was a few feet away from her and I could smell it. Um, but mom's already out here. So, um, I just and and mom was saying like I kind of she was like, I don't even know if I fully want to take responsibility for her right now because her drinking was out of control and she's not fixing it. And then she told me she's been driving like this like while drunk. Um, she's like, "I don't know what you guys are able to do, but I don't even know if I want to take responsibility for how she's acting." Okay. All right. I'm gonna go talk to her then. >> All right. Byebye. >> Can I speak to you for a second? [snorts] >> Um, so I spoke with my sergeant. Um, I want to speak with Cheyenne. Um, but yeah, it sounds like we are going to go like talk to her and see if >> um because it it depends a lot on what she's willing to tell me. Um, if we're able to go >> and I don't know if she might have enough container. >> I got you. Yeah. So, I'm going to at least talk to her, but it sounds like that might be the direction we're heading tonight. Okay. >> Which you sound fully understanding of. So, >> I appreciate it. >> Sorry, I'm smoking. >> You can have them. Give me a [snorts] minute. >> All right. Cheyenne, I'm going to ask you a couple questions. Okay. >> Yes, sir. Um, so when did you drive here? >> Uh, it was not too long ago. Uh, like an hour. >> Like an hour ago. So >> hour or so? 2 hours. >> It's uh >> 5:50 right now. >> Light out when I came. >> So light out. Okay. Um, they they had said around 4:30. Does that sound about right >> in that time frame? >> Later. Uh, I can show you my phone. >> No, you're okay. >> So I David, apologies. No, you're okay. >> No worries. >> Um, so [snorts] >> yeah. So, I went that distance and obviously the house is right here. I had that in my location. >> Okay. >> This is where I was going. >> Okay. No, I got you. But do you remember around what time that was? Just roughly. You said about an hour ago. It feels like it's been like 2 hours. >> 2 hoursish. Okay. Yeah. >> Um. >> All right. Cheyenne, when was the last time you had anything to drink? >> Um, before I left. >> Before you left. What did you have to drink? >> Vodka. >> Vodka. How much vodka did you have? >> Not a lot. Just one shot. >> One shot of vodka. That's all you had? >> Mhm. >> I don't know. You said >> But I drank before that. >> You were drink So you've been kind of drinking all day. >> Yeah. >> Yeah. How much would you say you've had to drink today? M maybe five >> five shots or like five mixed drinks? >> Five shots. Mixed drinks. >> You just just straight vodka shots. What What type of vodka? >> Um >> like what are you drinking? >> At the moment I'm drinking uh importers. >> Importers. Okay. Um so but you're telling me >> I preferka butka. Okay. >> Um I got you. But um so I just want to make sure I have this right. If you can confirm it with me, your last drink was around what time would you say that was? >> Cuz if you said about 2 hours ago is when you think you drove over here, that puts you about 3:50, 4:00. >> Yeah. >> So, when was the last time you probably had to drink? >> Done. >> Just like right before you left pretty much. >> Yeah. >> Yeah. Okay. Then you were When would you say >> I I decided to drink and drive? >> Okay. What What What time would you say you started drinking today? When I woke up >> around What time was that? >> Noon. >> Noon, you said. Okay. >> All right. Sean. Um, so I'm going to if you're okay to step out of the car. >> Um, >> yes, sir. >> All right. Are you going to arrest me? >> Well, I'm going just going to finish talking to you outside of the car. >> No worries. >> Yeah. And you can leave your phone on the seat. >> Okay. >> Yeah. >> All right. So, I'm going to ask you a couple questions. Okay. Um, >> I still smoke. Is that cool? Uh, you can have one more one more puff of it. Okay. Um, so with the information I have, okay. Um, I want to run you through what we call a standardized field sobriety test. Okay. It's completely voluntary. It's up to you if that's something you're willing to participate in, but I'm asking you if you're willing to participate in some standardized field sobriety tests. Yeah. >> You're okay with that? All right. We're going to walk around to uh the front of your car over here. >> Yeah, absolutely. >> Go ahead and stand right here for me. >> All right. >> Okay. Um before we get started, uh Cheyenne, do you have any uh traumatic brain injuries or head injuries? Recent head injuries that I need to know about? >> Not recent, but I have hypotic and sephilopathy. >> What is that? >> Uh so I hit the back of my head. >> Okay. >> A couple times. >> Okay. How long ago was that? A long time ago. like two or three times ago. >> Okay. >> And I take uh Cheyfaxin for that. >> Okay. Uh how often do you take that? >> Uh twice a day. >> Okay. Uh what are your kind of your like your your conditions? What is >> So I will hallucinate. >> You'll hallucinate. Okay. Is that like the main thing that it >> that you got from that? >> Yeah. >> Okay. Um >> and then No, no, you're fine. Um >> I'm trying to keep my hands warm. I don't have anything in my pocket. No, once I finish once I finish questions, I'm going to have you keep them down to your side, but I know it's a little cold right now, so while I'm asking you questions, you're fine to put them in your pocket. Um Okay. Uh do you wear contacts or glasses? >> Contacts. >> Do you have them in right now? Yes. >> Are they hard or soft? >> Uh hard. >> Hard, I think. All right. Um I know. I >> I wear them while I'm sleeping. I don't I don't know. I spend like $500. I'm legally blind. >> Jeez. Oh, are you really? Yeah. Jeez. Okay. Um Okay. Uh, do you have any physical limitations that are going to prevent you or hinder you from walking, balancing, turning, walking a short distance? >> Um, my conditions like you could look it up. >> I'm sure. >> No, I got you. >> Yeah, I've got like 13 conditions. >> Okay. >> That I've got to deal with. So, >> and does that does that kind of hinder your like walking and balancing? >> A little bit. Okay. >> A little bit. >> What do you do for work, Cheyenne? I I'm currently not working, but I am working out on the property and I'm getting, you know, stuff done. >> You're working on the property? What are you What are you doing on the property? >> Carpentry. [snorts] >> Dang. Are you really? >> So, how many hours a day would you say you're doing that? >> M I'd say like six a day. >> Six hours a day doing that. Okay. In about five five days a week >> or >> uh always? >> Oh, just every day. >> All week. Yeah. >> Dang. Okay. All right. Um >> I'm a carpenter. I actually graduated from CNN. Carpenter. I'm a certified carpenter. >> All right. Okay. Um, so for this first one, what I want you to do, heel to heel, toe to toe, just like that. And then you're going to have your hands out of your pocket down at your side. All right. So, for this first one, what you're going to do, go ahead and look up at me. What I want you to do is follow the tip of my finger. Are you able to see the tip of my finger? >> Okay. What you're going to do, using your eyes and your eyes only, do not use your head. Do you mind just kind of like parting your hair for me a little bit? >> Sorry. I meant to like >> cut my bangs today. >> No, you're all right. Can you just get that last little bit out of there? Yep. There we go. Perfect. All right. Back on the tip of my finger. Uh, you're able to see the tip of my finger. No problem. >> Okay. Uh, using your eyes and your eyes only. Follow the tip of my finger. Okay. Do not use your head. Any questions? >> Mm-m. >> No. All right. >> Okay. Yeah. >> All right. We'll restart. Okay. Focus on the tip of my finger. Cheyenne, [snorts] you keep looking away. Focus on the connection. >> I'm sorry. I'm ADHD. >> No, you're all right. You're all right. >> Okay, let's start over. >> Yep. Keep your hands down at your side for me. All right. Use your eyes and your eyes only. >> Yeah. >> All right. Okay. Focus. >> Okay. Can I lean? >> What do you mean? >> Is that cool? I've got like uh I've been hit by a car and so like standing straight is a little bit hard. >> Okay. So, you need a second. >> I got Yeah. No, I got hit by a car um whenever I was like >> 21. >> Okay. And uh I was on my bike. >> Okay. Um >> so yeah, I caused some traumatic brain injury. >> Okay. >> CVI. >> I got you. So um >> and I'm 28 now. >> No, I got you. >> But it's still >> So with all of your uh health conditions and everything, right? Do you feel that you're able to to do the physical sides of these tests? Cuz I there's also alternatives I can run you through. >> I'm just cold. >> Okay. But do you feel that >> I'm hypoglycemic as well? So like I tend to run cold. >> I got you. Um so uh again we can if the the tests all in itself is completely voluntary. If you feel that you cannot physically perform the tests, you you don't have to do them. You can stop them at any time. Okay. With all the [music] conditions you're telling me, um I'm I'm asking if you're still willing to do the physical ones or if you just want to do the alternatives because the alternatives does not it's not anything. It's not walking. It's not balancing. It's not turning. It's nothing like that. Yeah. >> You want to do the alternatives? >> I'll do my best. Yeah. >> Okay. All right. Okay. Um, just because of the road conditions, we're actually going to do alternatives. Okay. What's your highest level of education? >> Uh, I graduated high school. >> Graduated high school. Okay. >> Yeah. And I went to college and I have an associates in carpentry. >> Okay. So, um, it's going to sound like a silly question, but you know your ABC's. >> Yeah. Don't worry, it's not going to be backwards. Okay. Yeah. So, you know your ABCs and you know how to count one. No, it's not. I [laughter] couldn't even do that. >> Um, and you know, you know your numbers 1 through 100. You know how to count 1 through 100. Okay. Um, all right. So, for this first one, all right, you're [clears throat] going to start at the letter I. Do not start at A. You're going to start at the letter I, and you're going to go to the letter Q. Okay? So, starting at the letter I, do not start at A, and do not sing it. Start at the letter I to the letter Q. Do you understand? >> Do you have any questions? >> Go ahead. I J K L M N O P Q R S T V. Uh, stop at Q, right? T U V L. No. >> Okay. Yeah. Start at what? >> Starting at the letter I. >> I >> go to Q. I whenever you feel you're done. >> L M O L O L O L O L O L O L O L O L O L O L P Q R S T U V W S O Y N V. >> Okay. Um All right. So, like you said, you know how to count one through 100 and everything. Okay. So, this one is going to be backwards. Okay. But it's not anything present. Starting starting at the number 57, count down to the number 42. Starting at 57, count down to 42 and just let me know when you're done. Do you understand that? Do you have any questions? >> Yeah. 57 to 42. >> 57 to 42. That's correct. >> Any questions? >> So, no, not at all. Uh 57, 56, 55, 54, 53, 52, 51, 50, uh 49, 48, 47, 46, 45, 44, 40, 43, and 42. too. >> All done with that one? >> Yeah. >> Okay. Um, this last one. Okay. It's going to be It's finger dexterity. Are you able to with your thumbs and everything? You >> Oh, well, they're cold right now. >> No, I got you. >> Yeah. >> Are are you able to touch the tip of each finger with your thumb or No. >> Yeah. Okay. And it's only going to be with one hand. Okay. So, whichever one you're comfortable with. Okay. >> I'm right-handed. >> All right. Perfect. So, I'm going to demonstrate it for you. Okay. And then and then you're going to do it and I'll explain it. Okay. So, what I want you to do, okay, you're going to start at your pinky. You're gonna go and then just just uh let me demonstrate and then you can do it. Okay? So, it's going to look like this. One 2 3 4 4 3 2 1. That's going to be one pass. Okay? You're going to do three passes. So, I'm going to show you one more pass. Okay? 1 2 3 4 4 3 2 1. Do you understand that fully? Do you have any questions at all about >> three passes? >> Three passes. Yes. And going both ways and back. Yeah. >> Exactly. >> Okay. Got it. >> Whenever you're ready. >> All right. So, 1 2 3 4 3 2 1 1 2 3 4 3 2 1 1 2 3 4 4 3 2 1 >> All done. >> That was three, right? >> No. Yeah, I was just kind of making sure. Okay. >> All right, Cheyenne. Um, >> go ahead and turn around for me. Okay. Uh, you're going to be under arrest for DWI. Okay. >> I appreciate you being pretty cool about it, not giving us a hard time. >> K, can you keep her sleeve up for me, please? >> I've never had this. >> Mom, I'm going to jail. >> Hold on. Hold on, man. Just a second. I'm going to be roasted. >> You want to let her talk to the window? >> Yeah. >> Okay. Those aren't too tight, are they, Cheyenne? >> I'm not going anywhere. >> Those aren't too tight. >> Here's the issue. I want to be honest. Like, I >> We'll let you talk, ma'am. We'll let you talk to her. >> Anywhere. >> We'll let you talk to her at the window. >> Can I have it? >> Okay. We're going to back walk back to my ID. Okay. >> Why am I under arrest? I'm parked and I'm not going anywhere. 140 p.m. I'm going to have Cheyenne 1547. >> No, tell me. >> Tell me. >> Let's just We're going to go >> Tell me why. Why? >> You're going to walk out to this unit. >> No, no, no, no. >> Cheyenne, you've been super cooperative. You've been super cooperative. Let's not change that. Okay, we're going to walk out. >> I'm not trying to, but I need you to speak to me and tell me the truth. Why am I going if I am not on the road? >> So, you admitted that you drank before driving here. You've been drinking all day. You admitted to me that you had at least five shots. You had one shot directly like immediately before driving. You drove all the way here from Berlin. We have them >> confirming that you did drive here. >> But I am literally parked. >> I know. But you drove here [snorts] >> right now. But you weren't when you drove here. >> Okay. >> Okay. We're going to walk back to that car. Okay. >> Let's keep in touch with her. >> Um [snorts] does she have her phone? Yeah, we'll get everything medication on a lot of the >> Can I get it? No. Not right now. >> Yeah, we got to watch the car. >> Do you have your list in the car >> of your medications? >> No, it's proper. >> Here, I'll I'll talk to you about it after we get >> No, this is not okay. Are you kidding me, dude? Like I like you don't understand how many [ __ ] suspensions I've got and I'm going to die in your care because you don't understand what I have to go through. >> All right. >> Try having syphilopies. >> Go ahead and sit down. >> Gave it a hug. >> No. Go ahead and sit down. >> No. >> Cheyenne, go ahead and sit down. >> Can I give my mom a hug? >> You already gave her a hug. Cheyenne, sit inside the vehicle. Cheyenne, get inside the vehicle. >> Yes, sir. >> Just swing your feet in. >> Yeah. >> This officer is going to come around the other side. >> Oh, yeah. I will. Yeah. >> You understand that you don't have to handcuff me? >> I have to. It's policy. >> I know. It's It's policy. >> I'm about to. >> Okay. Okay. Did officer Alan >> ask why I'm actually being arrested? >> So, give me a second. So, >> because I am I'm not going anywhere. >> No, I got you. Um, but >> I'm not driving. I'm not doing anything wrong. I had some to drink, but I'm not going anywhere. Why am I arrested? >> So, you're arrested for driving here while drunk. I understand that you were not going to drive here when I was drunk. >> You already admitted you did. >> No. Yes, you did. >> Well, I did. I did. I wasn't drunk. I had a drink. >> Yes. So, I put myself under arrest. >> So, >> so I admitted to my wrongdoing, but I am in a safe place. >> So, why am I in the back of a cop car? >> Because you being arrested. >> You drove here drunk. >> Yeah.
