bro let me go this your last chance to man get the [Music] out toss something but I L toss it out the window she could have out that window but who is is that heart no that's [Applause] uh oh my God oh my God often times Justice seems to be just Out Of Reach crimes can go unpunished Criminal roam the streets instead of sitting in a prison cell and even cops who were there to protect us often overstep their boundaries and violate people's rights without facing any consequences it happens all the time but today we turn things around bad things do happen but sometimes the good guys win today we examine some of the most gripping cases of officers who violated people's rights regardless of whether they were guilty or Innocent but these people fought back and they won let's do this stop I'm going home no you're not are you finished are you finished what you just saw was a police officer from Loveland Colorado manhandling a 73-year-old woman with dementia and sensory Aphasia sensory Aphasia is a condition that results from damage to the area of the brain that regulates language this means that the woman has problems understanding spoken written or tactile speech symbols basically she has issues with communicating and understanding what's being said officer Austin hop responded to a call about a woman accused of shoplifting in a local Walmart he tracked the suspect as she was returning home with his vehicle lights turned on he approached the elderly woman and the moment she failed to respond the way he wanted or expected her to do he violently slammed her to the ground all right let's stop ma'am I don't think you want to play it this way ma'am please stop you don't want to stop the lights on siren stop you just left Walmart do you need to be arrested right now no no no okay let's stop come on come on I'm going home no no no on the ground stay on the ground on the ground on the ground after officer hop slammed the elderly lady for the second time he put her in handcuffs and discorded her to the police vehicle the whole time she's being pushed around the woman is crying out that she's going home Loveland police has a policy that states police officers are quote not expected to act as mental health clinicians make diagnosis or provide medical or psychiatric advice but they should be aware of commonly encountered behaviors associated with mental disorders those include dementia being disoriented Andor regressed loss of memory and disordered thinking or speech we can all agree that the suspect's behavior clearly demonstrated signs of possible mental impairment Andor psychological issues but officer hop fails to notice or acknowledge any of them and it was about to get even worse we don't play this game you understand me if you try to kick me ho this is going to be bad I'm going home stop I'm going home I'm going home I'm going home are you finished I'm gone home when the female officer approaches she never questions the amount of force or if it's necessary both officers continue to manhandle the elderly woman and once again throw her to to the ground it's obvious that the woman resisted and tried to slip out of her cuffs but not once did any of the officers try to reason with her except by replying that she wasn't going home neither of them stopped for a second and tried to reassess the situation they just continued berading her and applying unnecessary Force once officer hop had the suspect in the squad vehicle a man approached and addressed the officers wa what you have to use that much agression what are you doing to get out of here here this is not your business what's that where is your sergeant huh who's my sergeant yeah okay well first I can tell you that Sergeant metler he's at the police department you can go talk to him if you have an issue yeah give me your car so I can put a report okay I see you say there how you throw that little kid little kid well I don't know not a little kid this he was just walking and I see you how you gra him officer hop then begins to explain that it's a woman and that she'd been stealing from Walmart in fact she failed but even so this situation clearly depicts the excessive amount of force used because the suspect didn't attack or threaten the officer in any way this concerned citizen was right to question the officer's methods according to the Colorado revised statutes peace officers in carrying out their duties shall apply nonviolent means when possible before resorting to the use of physical force a peace officer may use physical Force only when nonviolent means would be ineffective in affecting an arrest get your feet in the car all right here let me see your feet going all right here I'm going Pi your feet up pick your feet up okay let's uh give me my let's get her out over here on the ground we can hobble her and then we'll get her in the car on the ground the officers throw Miss Garner on the ground once again and strap her feet so she's immobilized even more at one point the female officer kneels on her back to restrain her Karen Garner was later diagnosed with a fractured and dislocated shoulder a bloody nose scrapes to her face contusions to her knees as well as symptoms of PTSD as a result of the event at the time the two officers were restraining Mrs Corner Sergeant Philip metler arrives at the scene and body cam footage clearly shows the three of them joking about the way the two officers handled the elderly suspect cool thanks you guys are okay yep we're good we're a little muddy dude I think we're doing bloody a little muddy that's how it work is the blood on her yeah that's her blood you're not bleeding are you is after officer hop briefed him about the interaction Sergeant Philip metler stated that he would charge the suspect with resisting arrest and obstructing a peace officer regardless of of whether Walmart decides to prosecute her so let's examine the event that set this in motion Mrs Garner was accused of the attempted theft of Pepsi a candy bar a T-shirt and some shout wipe refills to the total sum of $13.88 she even offered her credit card but the employees refused to allow her to pay and tried to restrain her before calling the police once she was taken to the police station she was carried out of the vehicle and into a cell we got her that's okay we got you we got [Applause] you I was going to pay for it but you didn't a security camera later records officers Hops jalali and a Community Service Officer as they're reviewing the body cam footage they were bragging about the arrest and the injuries they had caused and even fist bumping each other later on all charges against missg were dropped but all the officers involved were in a world of trouble the family sued the police department and the four officers involved and the city hired a law firm to conduct a third-party investigation into the case as a result all of the four officers have resigned their positions while officers hop and jalali face criminal charges officer Hop was charged with second-degree assault an attempt to influence a public servant and misdemeanor misconduct officer jalali faces three misdemeanor charges Mrs Garner's family was given a settle in the amount of $3 million our next case looks like a scene straight from a Hollywood movie police in Charleston South Carolina had intercepted a FedEx package containing marijuana and it was apparently sent to the home of 42-year-old Timmy miles living in Somerville keep in mind that the package was addressed to an individual who did not live there but somehow this detail was overlooked it was just the first in a series of blunders that were about to take place someone had the idea to set up a Narcotics Sur surveillance operation and deliver the package to the address two officers watched the package which was delivered to the front porch but somehow they lost track of it that was blunder number two blunder number three was about to happen when Mr miles drove away and the officers decided to pull him over being sure he was in possession of the package the resulting traffic stop was initiated by Corporal Robert bareno uhoh I know what you picked up I know what you picked up over there okay what I picked up yeah get out of the I get out the car y'all tell me what's going on about to tell you what's going on come on out no bro what what what's going on throughout this conversation not once was Mr miles informed why he was being pulled over he's surrounded by policemen and is rightfully fearful even when he makes sure the cameras are on and tells the officers not to rip him out because he has back problems he's still afraid to step out of the vehicle but his ordeal is yet to begin going D come on out we'll explain it to you to tell you dude come on step out of the car if let me go no I'm not letting you go let me your last chance man get the out my god get on the ground get on the ground hands behind your back what's going on why you punch me in my face I don't know what's going on once he refused to step out Corporal Baro grabbed Mr Miles by the throat ripping him out of the vehicle and punching him in the face several times even if the suspect was wrong for not obeying a lawful order the use of force in this incident is not justifiable Mr miles is visibly shaken and hurt and he still has no clue why all this is happening and nobody's telling him at the moment the officers are busy searching his car and they soon realize the package is not there I'm tell you what's going on what's going [Music] on he was rapping up so gave the nose thing at the house yeah we need to go there now hey if we need to do for you yeah I show you I show you my face is hurt punch me I'm I'm a good citizen punch me still there got confir yeah we have to make sure if not we don't have anything this case is really nuanced even though in general officers are not always obliged to tell a suspect the reason they're being detained when it comes to arrests South Carolina code states that it's illegal for an officer to refuse to answer a question relative to the reason for the arrest this was not yet an arrest and officers were permitted to ask the suspect to exit the vehicle during a traffic stop but whether Corporal bareno had a justifiable reason to initiate a traffic stop remains questionable because he had to have a reasonable suspicion and at that moment the Reasonable Suspicion was still sitting on Mr miles front porch that follow phone not there they lost sight of the box and this car left we stopped it he didn't want to get out we had to extract them it's not there yep uh we got SN uh workers NZ NZ oh mother on the at this point the officers received information that the package was still at the house even after realizing their blunder and with all the Reasonable Suspicion G they still keep Mr miles handcuffed I mean after grabbing him by the throat and punching him they can't just let him go now can they so they try their best to find at least something still sitting um you want to search what this car yeah yeah yeah Contin search I mean I need everybody we'll get a dog get a dog cuz right now he's going to say no let I mean he didn't pick up the package so let's get a dog make sure this FR cause we search the car I already PP the trunk for safety but by this time Mr miles is realizing how wrong all of this is and he's getting visibly more frustrated by the second he's demanding cards from all the officers and at one one point he even confronts the officer who punched him with a sobering message you hey you you braid C with all you real braid to be punching on choking people man you wrong I'm tell you something and I'm Mar my word if you don't stop God going to get you bro I'm for real now if you don't slow down and do right God going to get you man I'm for real bro I don't care how much hatred you have against me you hating when you hate me you hate God too bro I'm telling you now we we might be different we deep down the side we the same mother Mr miles then explains that he would have complied If Only They had told him what was going on people are getting killed by cops in the street and once he was sworn by police officers he was understandably afraid to get out of the vehicle he called the officers ruthless and thuggish and after all that's transpired who can blame him moments later he refuses to allow the officers to search his car the way Mr miles was treated he now has reasonable suspicion that the officers might try to plant evidence on him even so the officers allow the K9 unit to sniff the car and again they come up with nothing however since Mr miles admitted to using marijuana for his back problem the officers decided to do a thorough search of the vehicle didn't admit to using marij oh he did is he saying it's might be in there still all right Mr miles was taken to the hospital by EMS and later arrested on two charges possession with intent to distribute marijuana and disobeying a lawful Order of Police both charges were dropped and Corporal Baro was fired 2 weeks after the incident the report stated that not only did he strike the defendant twice but that another detective could be seen grabbing Corporal barino's arm apparently preventing him from delivering Mor fist strikes to the suspect's face since Mr miles was only verbally refusing to comply which is considered a passive form of resisting and he posed no imminent threat of danger to the Corporal or other officers this use of force was excessive and not justifiable Baro was later arrested and charged with third degree assault in battery and he was sentenced to time already served Mr miles sued the police and the trial is ongoing but what bothers me is that none of the other officers have faced any reprimand for their complicit actions and continued to arrest Mr miles with no probable calls whatsoever I have no we have exent circumstances for a blood draw and a patient that's upstairs she is refusing and my lieutenant says that if she does Department are you with Salt Lake City police which I'm sure you'll get to meet my lieutenant soon and if I don't get to go get the blood I'm taking her to jail why are you so please sir you're hurting me then walk no I have no reason to walk stop you're hurting me and assulting me please I can't what what so we've seen an elderly person with dementia being arrested and we've seen an innocent man get arrested but in those cases You could argue that Mrs Garner did in fact shoplift and resist an officer and you could even say that misinformation led the officers to believe Mr miles did in fact pick up the package with marijuana but what you just saw here was a police officer arresting a nurse who refused to violate the rights of another person by drawing the their blood the incident occurred on July 26th 2017 after a fiery accident a suspect was fleeing from the Utah Highway Patrol when he collided with another vehicle the suspect did not survive the crash however the innocent driver of the other vehicle did and he was brought to Salt Lake City University Hospital unconscious detective Jeff Payne of the Salt Lake Police Department was asked to go there and retrieve a blood sample from the innocent driver and to check for any chemical substances he was greeted by by nurse Alex wobbles we have exent circumstances for a blood draw on a patient that's upstairs she is refusing and my lieutenant says that if she does Department are you with Salt Lake City police Lake which I'm sure you'll get to meet my lieutenant soon and if I don't get to go get the blood I'm taking her to jail I'd rather not do that i' rather not do the reason this is happening is that the patient is neither under arrest nor conscious to Mrs wubbles he's just a patient who deserves to receive the Best Care possible the situation obviously raises ethical issues of whether or not drawing blood violates the patient rights so the nurse decides to consult with the upper management of the hospital in the meantime the detective consults his superiors and calls for backup repeating his threats of arresting the nurse up P this young lady right here right now is not free to go about her business her watch command if she does not allow me to go get a blood drop from a guy up in the Burn Unit she she's going to jail okay her watch command and I'm just trying to do what I've been told to do by the where's the disconnect they don't want to abide by the implied consent law or exent circumstances they want it to be a search warrant now we'll get into the legalities of this situation in just a minute but have you noticed how the detective repeatedly points his finger at the nurse in a threatening manner even though he mentioned that arresting the nurse was his Lieutenant's idea it's clear that his ego was hurt by her refusal and he's getting more and more agitated by the situation and nurse wubbles even confronts him about it I wonder why you have to be so awful and threatening I'm not here to imp I'm just stating what is will happen we can both say that sir I'm just I'm just a nurse trying to protect the patients and do what my hospital has obligated me to do believe it or not I'm trying to protect him too I'm not trying to get him on criminal charger I didn't say you were I innocently what I'm what I've been told to do okay let's get back to the legal matters at hand the implied consent law found in the Utah traffic code states that any person operating a motor vehicle in Utah is consenting to a chemical test or a test of the breath blood urine or oral fluids to check for possible drug or alcohol use under the condition that the officer has reasonable suspicion that the driver was operating the motor vehicle while impaired which is not the case here the exigent circumstances refer to search and seizure which is regulated by the fourth amendment in the case of Missouri versus mcne the Supreme Court ruled that drawing blood from a patient in a criminal investigation was in fact a search for Fourth Amendment purposes in this case the detective once again lacked probable calls to suspect the patient was driving Under the Influence so the excident circumstances do not apply but let's see what nurse wubbles had to say in her defense so I have this it says obtaining blood sample for police enforcement from patients suspected to be under the influence okay this is something that you guys agree to with this Hospital the three things that allow us to do that are if you have an electronic warrant patient consent or patient under arrest and neither of those things the patient can't consent he told me repeatedly that he doesn't have a warrant and the patient is not under arrest so I'm just trying to do the what I'm supposed to do that's that's all so the situation couldn't be clearer the nurse is acting according to the agreement her hospital has with the police and the detective has no right to demand the blood sample let alone put her under arrest but that's exactly what happens next and when lieutenant James Tracy arrives he continues Bering the nurse and pressing her to draw blood from the unconscious patient in the Burn Unit when I'm telling you is we are not making a mistakes okay I've done this for 22 plus years I know what the law is when it comes to search and seizure all right and what you have done because your bosses are telling you to has been to prevent this officer who was called out to do a job to do his job that's obstructing judgment okay I understand you're not trying but you're succeeding that's what call okay after being detained and intimidated for about 20 minutes nurse wubbles was released without charges later that year she reached a half million settlement with Salt Lake City and the university hospital without even suing the police there was an internal investigation into both of the officers so they started blaming each other detective pay claimed he was merely following orders and the lieutenant claimed the detective withheld information such such as the lack of probable CS detective Payne was fired for violating department policies James Tracy was demoted to the rank of Officer whenever there's a possible firearm involved police officers are understandably on edge however in our next case the heightened state of alertness caused them to become extremely neglectful and leave a possibly innocent suspect in a life-threatening situation however considering the circumstances that could be the understatement of the century Pat car just hit by a train dis for us medical emerg the suspect was in the vehicle that was hit by the train let's rewind a bit it's the evening of Friday September 16th 2022 near Platville Colorado officers were dispatched to the scene due to a possible road rage incident involving a firearm an unknown off officer from Platville PD decided to pull over an SUV driven by a 22-year-old TSA agent named uren Rios Gonzalez he's soon joined by two more unidentified officers from the Lupton Police Department here we can see the second police vehicle arrive and notice Miss Rios Gonzalez parked right after the railroad tracks when the Platville police officer stopped right behind her the squad car was left in the middle of the tracks the three officers then exited their vehicles took a defensive position in case the suspect was armed and started shouting orders at the young woman hey Lift Your Hands Up Lift Your Hands Up okay turn around turn around turn around put your hands up higher I want you to set your phone down and there your drug you don't need it even though she can probably barely hear the commands from ongoing traffic The Suspect complies with the orders of the officer she's being held at gunpoint yet remains calm and Cooperative the entire time stop right there get down on one knee and then the other I got close goad good keep your hands above your head don't move what's going on why am I being we'll explain everything in a second can I get my cellone please no one else is in the truck sir can I please get my cell phone we'll get it for don't worry about yourself where are you taking we're taking you to the car come on yep you guessed it they're taking her to the very same car that's parked in the middle of the train tracks it's mindboggling that neither of the officers stopped to think about that as Miss Rios Gonzalez is being escorted to the squad car she keeps asking for her phone and why she's being arrested the officers however are preoccupied with searching her car and finding the alleged weapon the officer who first responded claims it took her a long time to pull over and that she might have tossed something through the window at that point a train can be heard approaching when I was behind her she was driving slow enough yeah so she could have tossed something but I lit toss it out the window she could have out that window but who is that heart no that's uh Tom attack oh my God oh my God 36 patrol car was just hit by a train dis us medical emerg the suspect was in the vehicle that was hit by the train the officers rushed to the vehicle and it's evident that it's completely smashed to Pieces just imagine being in that situation you're handcuffed placed in a vehicle and left in the middle of the tracks with no way of Defending yourself or exiting the vehicle none of the officers noticed the imminent danger until it was too late to act to make things clear even though it's pre prohibited to stop or park on railroad tracks a driver of an authorized emergency vehicle is allowed to do so when responding to an emergency call or when in pursuit of a suspect even so the driver is obligated to do so with due regard for the safety of all persons involved which was obviously not the case here not only when it comes to miss Rios Gonzalez but the passengers aboard the oncoming train as well there may still be a firearm in the vehicle I don't know if you guys have been through it yet you you got it I got a holster here no we not gone through we weren't we weren't sure if she threw it or if it's still hidden in the vehicle somewhere it took her a long time to pull over and Platville said did not see anything leave the vehicle right now I just need to find out who she is so we can de with that aspect of it it seems that Miss Rios Gonzalez did in fact threaten a motorist with a gun however she pleaded no contest to misdemeanor menacing that being said she's suing both cities involved here her injuries include N9 broken ribs a broken arm a broken leg a fractured sternum and brain injuries resulting in memory loss her claim is expected to be an excess of $5 million Jordan stanky the female officer involved was charged with reckless endangerment and third degree assault which are both misdemeanor in Colorado she was fired and got 30 months of probation the officer who parked the vehicle on the tracks was Pablo Vasquez and he's awaiting trial for reckless endangerment and traffic offenses officer Stein key took responsibility for her own actions although she stated that it was incredibly dark that night and she was certain that the evening would end in a gunfight for those reasons she failed to acknowledge that the vehicle was parked on the tracks do you think this alleviates her responsibility let us know in the comments below luckily not all encounters with police officers end in horrific injuries but some of them do end in a nice Payday on the day in question Alam County sheriff's deputies Steven Holland and Monica Pope we're investigating numerous reports of car burglaries near a Castro Valley Starbucks for some reason Deputy Holland thought that a mother with two daughters could be perpetrating these crimes hi Hi how are you hi what are you guys doing here uh waiting to go to Starbucks in a second why are we have is there a problem we can't can here well actually let me tell you why I'm here okay I've been having Auto break-ins in this parking lot every morning around this time so I've been so I've been driving around here okay and I noticed that you guys aren't doing nothing but hanging out the woman then explains that they just got here from Vegas and that she's been driving all night in fact we later found out that she was taking one of her daughters to a math test at Berkeley City College it isn't until the officer asked for her ID that the woman realizes something's not right here she even reaches for it but then it Dawns on her okay so wait a minute now why you ask me for my ID you just explained to me about the break in right but why did you explain to me about the um my ID what's that about what did I do what kind of crime did I commit what kind of crime did you commit yeah I'm asking you ask you for my ID yeah you have to give me your ID why do I have to give you my ID for a moment here we can sense that the deputy was set back a little as if he realized he was wrong in his assumptions but for some reason he keeps pushing if you've been following my channel you've noticed this happens in other cases some officers rather than admitting their mistake and letting things go double down on their error and in the end make it much worse so what you're doing now is leading me to believe that you might be doing something wrong no I'm not doing that so don't try to jump up no charges i i s like get your phone guys start recording start recording right now honey I S it i s um and I take um get onic on the phone get on it why why are you getting so worked cuz I got to have protection cuz I don't know where this is about to go I got to have protection well not going to go anywhere cooperate you can hear the distress in the woman's voice and it's completely Justified the truth is her name is AAL lerv Veil and she was taking her two daughters to Berkeley where one of them was about to have a math test she just realized that she was being approached by an officer who suspected her of being behind the car burglaries that had been going on in the area she obviously doesn't have confidence in the police force to protect her rights and rightly so considering what happened next the conversation gets heated Mrs Veil actually calls 911 to report being harassed by this deputy and the moment her daughters step out of the car they're threatened with being arrested okay they don't want to listen to us so let's go ahead and detain these two no no you're not going to detain them no you're not going to entain them we haven't did anything we haven't did anything we haven't we have not did anything I start the car get out of the car the window down run the window I'm run the window Deputy Holland tries to drag the woman out of her vehicle but she eventually gets out herself all the time trying to get help over the phone she's placed in handcuffs while her daughters argue with the second Deputy even though Mrs logger Veil is agitated and deeply distressed she tries to calm her daughter down explaining that they're going to the Sheriff's Office and that they'll get an attorney going to get fir you're going to get fir you're going to get fired you're going to get fired have we don't wor we got a lawsuit don't worry cuz we haven't nothing we got a lawsuit I hav we have a lawsuit don't worry we put your hands behind your back in the midst of all this other officers appear at the scene one of them helps escort the woman to the patrol vehicle and the other berates her daughters it seems like none of the officers care about due process they only care about their Authority being respected even if it is to the detriment of basic human rights right now you're not put your I'm asking following our instruction resisting I'm asking you a question why am I being arrested right now you're being arrested because you're not and there you have it in a nutshell while other officers are arguing with the three women deputies Holland and Pope execute an illegal search of their vehicle after they detained them for over an hour and almost 10 officers got involved the family was released they of course launched a lawsuit and they were awarded a huge amount as compensation for the ordeal according to California's Bane act damages are tripled if there's proof that there was a racially motivated crime the logger Dale lawyer claimed that the women were profiled on the basis of the color of their skin and said that if they were three white ladies the situation would have ended quite differently the judge seemed to agree with him as the court awarded the family A total sum of $8.25 million we end today's video with the insane case of Bethany Farber who got arrested just for having the same name as a wanted fugitive Bethany was arrested the moment she set foot at Los Angeles International Airport and then taken to jail instead of the officer quickly realizing their mistake and releasing her Bethany spent the following 13 days in prison and it must have been a scary ordeal when people are worried about leaving their homes and I'm you know thrown into a cell with people that are off the street you know just 14 violent criminals the ordeal started when Bethany decided to fly to Mexico to visit her brother and goddaughter little did she know that the TSA agents were waiting for her thinking that she was this woman the woman on the left is Britney Farber from Texas a known felon and a wanted fugitive this looks like a simple mixup that could have easily been resolved but like many of these botched arrests somehow it got out of hand they arrested me for a Statewide fugitive warrant I kept saying that you that they had the wrong person and to double check and they just said yep nope we have it Bethany Kaye Farber there were several fact actors that made all this possible first she was arrested on Friday which meant she had to wait until Tuesday for the court to open so she could see a judge but even then due to covid restrictions she barely had any contact with her attorney and there was not much she could do my lawyer decided to request an identity trial because that was really um what he believed the only way to navigate the situation she was then taken to the LA Community Detention Center in Lynnwood where she would be locked up until April 28th once released she was in for another shock her grandmother had suffered a stroke due to all the stress related to the arrest and she passed away several days later it's sad that it had come to this over something that could have easily been avoided and all this is done is because LAPD failed to check a driver's license a birth date a Social Security even the booking photo of the other Bethany Farber that you can see there's no relation they look nothing like like and I keep wondering why they didn't check her fingerprints not surprisingly Bethany Farber is suing the LAPD for her ordeal what would you do in this situation and how big of a settlement do you think she should get thank you for joining me on this ride to Justice do you think the victims of these cases were adequately compensated and that the perpetrators got what they deserved there's definitely a lot to talk about here so feel free to share your thoughts in the comments below
