I don't want to >> While the suspect denied having sex on the beach, she refused to watch the footage. At one point, despite not having seen it, she claimed it wasn't her in the video. She was under the impression for some reason that they'd be allowed to leave without repercussions. >> Yeah, we'll be good to go as soon as possible, all right? >> Who? >> We'll be good as soon as possible to go. >> Will you be good to go soon? Uh, well, right now we're still investigating what I just told you. I was like, "What are you talking about?" You can't have dogs, you know? Okay. I don't know what he is saying exactly. >> As for the male suspect, he claimed he had no idea why the cops stopped them. At first, the cop tried to get a confession from him, then openly asked him if he did it, but the suspect here, Mr. Austin, wasn't going to fall for it. >> Let me Let me help you a little bit, Mr. Austin. >> I don't know. >> If If I was just over by White [music] Street Pier a few minutes ago and the person who called the police showed me a video on their phone of you and your girlfriend, what would that video be showing me? Sir, stay good to me now. Last time we >> I'm going to go to jail. >> No, stay right there. >> I got nothing to say, honestly. You know, I'm not trying to You wouldn't even help me if I was in trouble with you. But I ain't got nothing to Any questions? You got anything? I I don't have I know nothing about anything. Whatever they're saying You know, they could have been What did I don't know. I don't know. So, I I don't want to cause any trouble for nothing, but at the same time >> Okay. >> You know, I I'm >> So, you you failed to answer the question, okay? >> I'm not going to answer the question cuz I don't feel like I've done anything wrong. >> All right, so >> I didn't say you did anything wrong. >> What were you doing? >> Well, mister, I'm going to pat you down for weapons. >> I wasn't doing anything. >> Turn right around. >> I've been doing nothing. >> Don't cut me off. Keep your hands out of your >> I didn't I just turned around. You were told not to put your hands in your pocket. >> Turn around. >> No. >> Turn around and do not put your hands in your pocket. Put your hands on the hood. >> As the officer conducted a pat-down, he remembered the suspect had an outstanding warrant from South Carolina. The warrant was listed as non-extraditable, meaning that he wouldn't be transported out of state for the charge. >> Why is he arrested, do you know? >> Well, he's not in handcuffs right now. I know he's being searched. >> Oh. >> I can see that. >> Okay, he's just searched. We worked together together. >> What's that? >> Um I finished work today and we worked together. Nothing happened wrong. >> Okay. That's your boyfriend? >> Yeah, that's my boyfriend. After work, we just came straight to this McDonald's here. >> Oh, okay. >> We'll be just fine. I will We didn't know what not to do or not to do. >> Well, can I bring her over there with you guys? Go stand next to him. >> We think we'll be fine. Right? >> Yeah. >> I'm coming out of work. I'm not doing anything >> in trouble. >> You just had in front of a 14-year-old kid and a 15-year-old kid. >> Oh, what is going on? >> Come on. I just watched the video you think you just pointed out. Come on. This [ __ ] just got serious. >> Wait. What did you say? >> And you know what? And then the ignorance that you that you think that I have for you to sit here and lie to my face is pretty embarrassing. >> I really don't remember anything like that. >> That's That's real convenient. It's not out of respect cuz you're lying straight to my face. >> Under Florida state law, it's unlawful to expose or exhibit one's sexual organs in public. It's a first-degree misdemeanor punished by up to 1 year in jail and potential fines. As the suspects were being handcuffed, one of the cops noticed something unusual. >> What does that mean? >> Yep, we need a Got to first. You were having this bunch of kids I'll pick their ID up. Yes, we'll get all your stuff for you. Hey, move towards the car. Okay. Yeah, I got it. >> [music] >> He said in the groin area, might be something stuffed in there, just saying. >> Suspecting the woman had something concealed in her underwear, they called for a female officer to perform a search. And based on the suspect's reaction, it was clear the officer's instincts were right. >> Come on, 21's here. Do we have a female for a search? Please stay away from me. Please stay away from me. Oh, it's completely fair. It's not fair that little kids have to watch you have sex on the beach. It's It's It's visible from the place where 100 people are fishing. It's very disrespectful. You're right. Absolutely. >> a man. >> Yeah, and then multiple people came up to me describing both of you and I saw a video of you guys doing >> That's not fair. That's not fair. I would never be disrespectful to anybody. I'm always >> You did You definitely didn't hide well. I'll tell you that much. >> [music] >> I'm a respectful person. >> You might be a respectful person, but you messed up. You messed up. >> to the children. You have to be respectful to the children. >> According to witness statements, Mr. Austin arrived on a black bike with a pink blanket in front and the woman's bike was lime green. The officer then decided to ask them about it to see if the descriptions matched. >> Where's your bicycle so I can lock it up? Hold on. Keep your foot in the car. I'm just asking you. I'm trying to do you a favor. Where's your bicycle I can lock it up? >> If you go right there to the back of the pier, you go left. It's probably I believe either first or second gazebo. [music] >> Mhm. >> Okay, one has it's a black bicycle with a like a few bikes >> Okay. And you had a >> You're taking us to jail? >> Hold on a second. Where is her bicycle at? Cuz she's saying it just vanished. >> Is this my bicycle? >> No, this is Huntington Beach. So I'm trying to secure it. Where's Is her bike next to your bike? >> Yes, I believe. >> It's the lime green one. Is that right? >> Mhm. Yes. >> Okay. All right. >> No. >> Give me a second. >> I I I believe we're going to jail. >> Let me Get back in the car for a second. Let me just figure this out. What do you want me to help you with? You didn't help me. You weren't being honest. >> I don't know. >> Come on, man. >> Come on, you think I just popped up >> You think I just popped up today and said, "Man, I don't like that >> say something was wrong like what they think is >> There's video of it. There's video of it. You were hitting her from behind. >> No, there's no >> Come on. >> I don't know nothing about that. >> All right. Sit down. Sit down. We'll talk in a minute. >> Meanwhile, the female officer arrived to conduct a search. During the process, the female claimed she had a medical device with catheters down her pants, which helped her with her respiratory issues. However, the officer conducting the search knew what a catheter looked like. >> I've had a lot of catheters in my life. >> This does not look like a catheter. No, that's not my catheter. >> Why would you tell me this is a catheter? Especially when I just told you I have kidney problems. >> Who put it there? Oh, who put it there? That just ended up in your pants or not? >> That's not mine. This is not mine. >> Okay, turn around. >> I'm going home to jail. >> Stay right here for [music] me. Put your feet apart again. >> Dude, it's all hot. >> Do you have anything else in your vaginal region? And you realize if you go to the jail and you have something hidden inside your vagina, it's going to be a felony, correct? >> Yes, I agree. >> What? >> I agree. I don't have nothing. I'm supposed to be working a full-time job. Nothing in common with anything in trouble. Consider it. >> In hindsight, the man should have used at least one of those blankets on his motorcycle. Both suspects were arrested [music] and booked on indecent exposure charges and for disorderly conduct. According to court records, they were later released and paid over $500 in fines. On July 29th, 2024, in Flagler County, a deputy made contact with a vehicle matching the description of an ongoing investigation. Later that night around midnight, he encountered the very same vehicle again. This time, after observing the vehicle, he saw the couple inside engaging in sexual activity. >> Roll your window down. >> Roll my window down for what? >> IDs. >> You just saw us earlier, dude. >> I need your IDs. >> Okay. Cool. >> Both of them? >> Cuz it seems like you've you've just been after us all night, man. >> If I was after you, I would have stopped you earlier. >> Okay. >> Okay. I walked to your car to talk to you because [music] your car matched your description of something that was going on at a different incident. >> But I didn't >> And then I walked away, right? >> I didn't do it. >> Obviously, right now I'm talking to you because you sucking [music] your dick in a parking lot. Is that better? So, can I get your ID, please, ma'am? Like, you I told you guys go somewhere else, all right? >> Wait, wait, but dude, what am I doing over here? Like, I'm not doing anything. I didn't I'm not admitting to what you just said. >> Well, actually, I was down there in my car and somebody walked all the way down there and said they're having sex in the car down here. >> Who said that? No, they didn't. No, they didn't. >> Exactly. ID, please. >> As far as the officer went, he hoped he could handle things quickly and professionally. The female involved also wanted to resolve things quickly and leave as soon as possible. But as for the driver, he kept questioning the cop's integrity and that [music] was about to backfire. >> Like, I can push this to the limit of criminal if you want me to. Otherwise, I can just document >> I don't have to. >> I'm literally not doing I'm not affecting anybody right here. No. >> This is part of my job, ain't it? >> No, it's not. Your Your job is protect and serve. Is it not? >> So, if a kid walks over to your car and sees what you guys are doing, is that criminal? >> walking to my car? Why would there be a kid walking to my car right now? >> There's a dance studio right there. There's a gym right here with a daycare. I don't know. You tell me. >> Dude, it's 12:00 and you're pulling us over for nothing. >> I didn't pull you over. >> Well, you took my ID, so that means that's the same >> a lawful detainment [music] once a crime was committed. >> There was no crime committed. >> You've heard of the 48 statute reference exposure [music] of sexual organs. >> There was no exposure of sexual organs. >> Why don't we just go home? >> There was no exposure of sexual organs. Step out of the vehicle for me. >> For what? >> Cuz I asked you to. >> Well, for what, though? I I did nothing wrong, sir. I'm just trying to go home. >> The cop stayed perfectly calm and once again explained to them that it was already a criminal investigation for both exposure of sexual [music] organs as well as DUI. He then casually placed a terminator behind the front tires of the suspect's car. >> Sir, what is that? >> It's called a terminator. If you attempt to leave, [music] your tires will be flat. >> Listen. Sir, I'm not I'm not even trying to be combative or leaving or anything like that, but I don't think this is necessary. You're calling somebody else over here for a reason. >> There's nothing going on, dude. >> Obviously, I came over here because [music] I physically saw with my eyes her giving you a I also saw her sitting on top of you from over there. I drove my car over here. I made contact with you pulling up your pants. You're telling me it didn't happen. You're not going to admit to it. I witnessed it. >> on top of me illegal? >> Okay. >> I'm just asking though. >> Normal conversation to criminal investigation. You pushed it there. >> I'm not trying to push anything, dude. I'm just I'm trying to go home, honestly. >> Okay. Well, I'm going to be conducting a DUI investigation. Your eyes are watered over. You smell like alcohol when you speak to me and [music] you're sitting behind the driving. It's getting real in the park. >> I'm I'm completely fine. >> I'll be the judge of that. >> According to the deputy, these situations [music] usually end in a warning, but the suspect's attitude took things in a different direction. Also, there was one more issue for the cop to investigate. >> How was I not being compliant? >> I saw the car earlier. You didn't do that. It's like you're not under the influence. I've never seen anything like that in my life. >> Dude, I can't. That's over there in that door. Is it still there? >> Can Can you move your right arm for me, ma'am? >> Sure. >> The magical alcohol can I was seeing in that door when I walked up initially is now gone, which is why I'm doing the DUI investigation. >> There's a There's a >> Where did the can go? >> It's hand sanitizer. What are you talking about? >> go? >> What can? >> Do you know that moving evidence is a is a crime in and of itself? >> Moving evidence, what are you talking about? >> Okay. >> Dude, we're just we're just existing in a parking lot, bro. >> Well, now you're existing with two law enforcement officers. >> I feel so lucky. >> Trey, you need to car in neutral. I'm going to remove you. >> I don't I don't That's fine. I have no problem. >> Thank you. >> I have no problem getting out. >> Put your hands on top of the vehicle. Back away from the car. Put your weapons on you. All right. Go sit in my driver door with this deputy. >> The officer then asked the suspect to do some field sobriety tests. The suspect here, Trey, was a little hesitant at first, but after some persuasion from his girlfriend, he agreed. The walk and turn test went pretty well, but the one-legged stand test proved to be difficult. >> All right, you may begin. >> 1,001, 1,002, [music] 1,003, 1,004. >> Okay, a little bit higher and parallel to the ground. >> 1,007, 1,008, 1,009. >> Not like that. Straight. Straight leg. >> 6 1,007 Dude, this is impossible to balance on. >> You just watched me do it. >> 1,008 No, not for this long. 1,009, 1,010 1,011, 1,012, 1,013 >> All right, you can stop. >> According to the officer's report, he noticed multiple indicators of impairment during the test. When it was over, he decided to give the man one last chance to come clean about throwing out that can of alcohol. >> I'm going to ask you one more time. Before I ask you, I'm going to tell you this, okay? Honesty matters, and I'm not blind. >> [snorts] >> How'd that can get right there? >> I don't know. This is a pavilion. People are walking over here all the time. >> Put your hands directly on it. >> Am I being arrested? Why am I being arrested? Why am I being arrested? Please, please, why am I being arrested? >> Trey, listen, okay? You're being placed under arrest for tampering with evidence and suspicion of DUI. All right? I'm not blind. I can see the can in your car. I walked back up, can's no longer in the car, okay? >> How can you just blame a random can on me? >> A random [music] can? >> Yes, a random can. >> Walked up, I saw it in your car, then I saw it on the floor next to your car. >> After Trey was secured in the squad car, the deputies then had to determine whether his girlfriend Erica was the one who thrown the can out. She already seemed ready to cooperate, but that added pressure made her confess that she and Trey were having an affair. >> Erica? >> Yes, sir. I don't want to go down the same path, please. >> Well, the thing is, right? The can was on your side of the car. >> It wasn't mine. >> I saw it in your door. >> It wasn't mine. >> I just want to know how it got outside. Did you reach over and grab it, or did you throw it yourself? >> Honey, I didn't do it. >> Well, until I can prove who did it, it's on both of you. That's my thing, right? >> I didn't do it. >> Cuz it's sitting right next to you. >> I understand. >> So, a reasonable person in my shoes would say you threw it from the car, so you were tampering with evidence. >> I didn't do it. >> Did you throw it on me, right? >> It It wasn't me, okay? >> [music] >> I just want to go home to my kids, please. I'm going to go home and I'm going to send proof >> All right. >> Just send me back home. This is not my boyfriend. This is fine. I I really can't, you know, afford to to do all of this or something like this. Please, just send me back home. >> Well, if some of the cops tells you not to do anything in the parking lot, you should listen and do what someone else says, all right? Cuz I can clearly see through your windows. >> And things have got to change. >> Mhm. >> The real reason Erica wanted to get things over with and as soon as possible was that she was afraid her boyfriend would find out she was cheating. The cops decided to let her off with a warning. As for Trey, he wasn't that lucky. >> You're being placed under arrest for DUI [music] and tampering with evidence. >> How much is >> What evidence? >> When you decided to throw that can out of the window. >> I didn't throw a can out of >> I gave you every opportunity to be honest. >> I didn't throw a can out of >> Okay, if you were honest with me, you probably would not be taking this ride right now. >> I did not throw a can out of the >> Sorry, that can is cold with condensation on it in the dirt [music] right next to your car. When I walked up the first time and asked what you guys were doing in the car and asked for your IDs, I clearly saw the can in your door and didn't say anything about it. I'm not blind. My job is to look in cars and observe what I can, right? >> Okay. >> I was not going to do anything with alcohol related to your vehicle and you personally until you started giving me attitude and made me look harder into your car. >> I wasn't giving you >> Once I walked back up and you started giving me attitude, I could see that the can was no longer in door. >> Sir, I was not giving you attitude. My arm and leg was now blocked >> I was not giving you attitude. >> Okay. >> [music] >> I was not. >> Okay. >> I was not. I was trying to have a civilized conversation. >> Right to the very end, Trey remained uncooperative, so the deputy gave up on him and decided to let the judge deal [music] with him. They arrested the man and he was charged with DUI and tampering with evidence. After receiving complaints of inappropriate conduct at a public swimming pool, deputies responded to the scene and interviewed multiple witnesses including visitors and the pool manager. >> So you guys had a little sounds like a little show. >> Oh, thank you. >> Um so who so who exactly saw these um actions? >> Um the resident right around the pool. She come out and met me outside and I said I already I just I just before she saw me, I had went to the pool because they sent me these photos. >> Wow. >> Yeah. And she said >> Wow. >> ladies Ladies, this is a family ran and operated complex. >> Wow. >> And they said I said I got pictures of you doing so I committed so I acted with each other. You. And they said it's weird you take pictures. I said >> That is that's that's >> is that you don't have enough sense to know >> in a public pool. >> public place and we're And she's like "Will you please tell people to delete our pictures?" I said "Not really. We do things over here." >> Yeah. >> Kind of. >> So you witnessed you witnessed you witnessed their um >> They had this on their cell phones on my phone. >> You found them? >> I witnessed them they they were um and they said "Well, we got our swimsuits on now." And I said "Well, I appreciate that, but I've got the photos from the residents that feel very very offended." And so I'm asking you to >> After reviewing photos taken by a staff member, the cops were still having trouble identifying the suspects. As a matter of fact, one of the suspects was leaving the pool area as an officer continued interviewing the family involved. >> Y'all just got out from the pool? >> No. >> Huh? Come here. >> I'm called up here. >> Okay, you don't want to get arrested, huh? >> Arrested for what? >> Huh? I'm here to do an investigation. I told you to come here. >> I don't know why I'm arrested for what. >> Told you to come here. >> Arrested for what? >> I told you to come here. If you're not going to listen to me >> I'm here for a legitimate reason. >> Lewd and lascivious behavior. Back up. In the car. So I'm going to go get these other girls since you guys want to play like this. >> What's the what's the issue? >> Sit. >> I'm I'm sitting, sir. What's the issue? >> You didn't tell me what's the issue. >> Get in the car. >> Nor did YOU READ ME YES, YOU DO. NOR DID YOU READ ME MY RIGHTS. BABE! BABE! BABE! BABE! >> [screaming] >> THIS AIN'T EVEN RIGHT, BRO. >> THAT IS NOT HOW IT WORKS. >> Like that's my girlfriend in there. Like I just don't >> They're over here in the pool eating each other out, bro, in front of kids. I got pictures of it. So, that's a wrap, man. >> Both men were clearly taken aback by the situation. One minute they're out buying groceries, and the next minute their girlfriends are getting arrested for doing inappropriate things in the pool. That being said, they didn't argue or object or impede the investigation at all. >> Was there anybody else in the pool? Was there kids and just kids? >> Kids? I got several witnesses. I got the property manager, I got a maintenance man, I got two little kids. I got their parents. I mean, >> I need your first name. >> Why do you need my first name? >> Because I'm going to identify you. If you don't want me to give your identification, then I'll charge you with another charge and won't get out of jail. >> What am I even getting charged with? >> Right now, resisting arrest. >> How am I resisting arrest when I didn't give [music] you an issue? When you grabbed my arms, I didn't give you an issue. How was that resisting arrest? >> If I tell you to come here, and you just keep on going, >> sir. >> Okay, I'm not fighting with you. You're going to give me your name or not? >> Juliana. >> Juliana's boyfriend was hoping that things would get cleared up and she'd be allowed to leave. But when he tried talking to the deputy again, all those hopes disappeared. >> Hey, you you I'm I'm just I'm just going to keep be keep it real with you. Hey, she's done. That's it. That's the end of this. She's done. What I just witnessed So, It's walls like this and it's just like it's like all hearsay, but just about but I that is Yeah, that's that's that's not cool. That's not cool. I'm also She showed me the photos. Yeah. Yeah, that's Yeah. And that person has the original >> Do you know where the other girl stay or anything? >> They're with her. That one is a resident. The other two are there. >> She is the resident? >> They're probably in an apartment. >> Do you know >> one she's in? >> Um what's her last name? Um actually she's had a lot of complaints. She's new move-in, new room move-in, and my my assistant I just sent a group text asking if anyone recognized one of these girls and what's the address. She said 751. >> Okay. >> The manager explained that while Juliana was always nice and respectful to them personally, there were multiple complaints about her behavior and the cops had had to intervene several times. Here's what one of the neighbors had to say. >> building over here, a lady and her her husband or something. Anyways, their dog got out and they came running over here and then so I was, you know, I stuck my head out. I mean I took pictures but I stuck my head out. My girl's like this. >> That's crazy. I saw him like, "Yeah, there's kids out here, you know." >> Like any other type of environment? Absolutely. Like I say nothing. >> Yeah. >> But a family environment during the daytime. >> Yeah, it's a little bit bold. >> She going to town, though. But somebody didn't believe me that I that, you know, cuz they're like, "Oh, that wasn't your pool." And so I had my girl But but yeah, I mean they're all naked. And like I said, normally I mean I don't I don't give a but it's the fact that [music] there's families Some people would have had a hell of a bigger problem than that. >> Yeah, I mean it's it's going to be a problem. >> I mean people like making out on laps, dry rubbing. I don't I mean that was full >> That was full-on pornography. >> That was full-on uh >> Jesus Christ. >> The deputy explained that the majority of the complaints lacked any substantial evidence. That's why he was so surprised to see such overt and explicit sexual conduct happening in full public view. When he went to look for the other two suspects, he instead found Juliana's mom. >> Yeah, where is the other two? I'm trying to talk to them as well. >> What are they doing? >> What? >> What are y'all doing? >> Uh What's her name? I'm sorry. I just wrote it down. >> Juliana? >> Yeah. She's going to jail. >> For? >> Uh lewd and lascivious. >> Call your daddy. She needs an attorney. >> Her and her friends decided they would engage in lewd activities in the pool out here in front of the building. Lewd and lascivious. >> [snorts] >> Who what? >> Do you want to talk to her? >> Yeah, I'm willing. What's she going to learn? >> Apparently, the hard way. Who's about to can't stay here with your kids in trouble? You're not good friends. Who's here right now? Who? Who always shows up? Who? Who do you not going to listen to? So, go to the office manager that came to me. She lives in the apartment. >> Juliana, I don't care where she >> No! No, I'm not about to do this with nobody, Mom. I'm not. >> Clearly, you want to. >> That man just said that there was kids there and there was no kids there. >> Juliana argued that the office manager could not have taken the video from her apartment. She also argued that there were no kids present, which really didn't make a difference. So, the deputy had to reason with her one more time. >> So, ask them where the kids are at, okay? Ask them where the >> Okay. That's only If there's kids there, it makes it worse. If there's not kids there, you still get charged >> Why am I the only one being charged? >> Cuz they are I can't find them. I can't kick in the door. >> Those are your friends. Where's my phone? >> I don't know where your phone is at. >> Here, step out. She's not allowed to get out of here if you're standing out here. >> I can't get out. I'm stuck to the chair. >> Before being taken to jail, the deputy let Juliana's mom take her jewelry She was compliant, but still acting arrogant. For some reason she believed that the witnesses would have to erase all the footage of her and her friends. >> And the lady who came to me, I told her to delete it, too. But no cop No cops? No cops verified the deletion off that phone? >> No, they didn't. I watched them. Take this Take my earrings out. Hey, you dropped my ring. >> But unfortunately, if you do expose yourself up from other people, it does open that door. Does Is this your first time getting arrested? >> Bro, no. I have a case that's open. I cannot be charged with nothing right now. I can't. Mom, I cannot be charged with nothing right now. Oh, baby. This whole program. Wow. >> At the end [music] of the day, I'll make sure you get into a few programs. >> Get my stuff. >> A better attitude would go a very long way. What? >> I'm not saying nothing. Listen. Don't even say nothing. But are you listening? Did you hear what he just said? Cuz as of right now, he's not a cop. >> [music] >> You are. >> The deputy had a hunch that one of her friends was still at her house, but Juliana wouldn't give them permission to go in. Juliana was taken to jail and charged with resisting without violence, indecent exposure in public, and with sexual offense, unnatural and lascivious act. On the 8th of April, 2023, a patrolman stopped in a parking lot after seeing something suspicious in a vehicle. And when he got a little bit closer, he realized the people inside were having an intimate interaction. The officer asked them for ID and told them to get dressed. >> You guys about dressed yet? You dressed yet? I'm talking to her. You dressed? >> [music] >> All right, hop out with me. Appreciate you. Just stand right here for me. Stand with your feet together, hands out to side just like this. I'm going to look at your eyes really quick. Don't move your head, just follow with your eyes, all right? Okay. >> [music] >> Have you been drinking at all? >> We both had a couple of drinks earlier. >> Let me look Let me see your eyes real quick. Go ahead. All right, you're free to leave. I wouldn't recommend you drive though, okay? >> [music] >> Cuz if you get in your car, I'm going to arrest you for DUI. Okay? Understand? So, good. If you want to get on your phone and go ahead and start calling somebody, go right ahead, all right? Ma'am, right now I'm going to conduct a DUI investigation to determine if you're impaired to the point your normal faculties are being affected. Do you understand that? >> The officer explained that since the woman was in control of the vehicle, she'd be investigated for possible DUI. He also casually mentioned the fact that he'd seen them doing the deed. >> All right, even though you weren't driving, you're sitting in the parking lot, you're in the behind the driver's seat, your vehicle's on, it's running. You were going to drive after you had with this this young gentleman, okay? Do you have diabetes? >> No. >> Do you have epilepsy? >> No. >> Okay, perfect. Um just stand right over here for me and face me. There you go. What I want you to do is I want you to stand with your feet together, hands out to side just like this, okay? I want you to remain in that position till I tell you to move. Do you understand? >> Yes. >> Okay. What I'm going to have you do is you're going to look at my pen and you're going to follow it with your eyes and your eyes only, okay? During that entire time, I don't want you to move your head, I just want you to follow with your eyes, okay? Except follow with your eyes, okay? I'm going to go up, same thing, follow with your eyes, don't move your head. You're okay. >> You're okay. >> [music] >> All right. You're fine. Go and get back to this position. Hands [music] down to your side. Hands down to your side. Okay. All right, do you see this line here on the ground? >> As she performed the field sobriety tests, the female suspect slowly began to unravel. As she struggled to fight the tears back, she failed one test after another. It was clear she was physically impaired and therefore in no shape to drive. >> I'm sorry. >> 16 steps. Just continue how I have instructed you. 17. 18. 18 steps. 19. 20. 21. 22. Do you remember how many steps I told you? >> You said nine. >> Okay. How many steps have you taken? >> I've taken two. >> You've only taken two steps so far? >> Yeah. >> Okay. Let's Let's go Hold on. Hold on. Let's come back over here. >> After instructing the woman to finish the exercise, the officer then directed her to do the one-legged stand [music] test. After that, he asked her to wait for his command, then touch the tip of her nose with the tip of her finger using the hand that he specified. >> Right hand. >> Right finger to brain. >> Right hand. >> Right finger to nose. >> Okay. You can open your eyes. What's the highest level of education do you have? >> Yes, yeah. >> Okay. >> I'm about to graduate in August. >> Okay. So, you're about to be a graduate. Okay. Do you understand the English language? >> I do. >> Do you understand the alphabet? >> I do. >> Okay. What I'm going to have you do is I'm going to have you recite your alphabet, okay, starting from the letter D as in dog, ending at the letter Q, as in Quebec. Okay? All right, close your eyes. Tilt your head back. Okay. Now, what I'm The last thing I'm going to have you do is I want you to imagine 30 seconds inside of your mind, okay? >> The last of the exercises focused on the perception of time, which can be distorted by alcohol. The officer asked the woman to close her eyes and count to 30 in silence. He then waited for over two full minutes for her to finish. >> Okay. Now, how much How long was that? >> I would say 55 or a minute. >> Okay. And what was my instructions? >> 30 s. >> Okay. How did you count that? >> Uh 1,000, 2,000, 3,000, 4,000, 5,000. >> How much have you had to drink today? >> Uh I had two drinks here. >> What two drinks? >> Uh I [music] had Captain and Coke. >> Captain and Coke. Were they singles, doubles? >> Singles. >> Okay. Were they talls, shorts? >> Uh they were talls. >> Okay. So, single talls, Captain and Coke, two of them. What time did you start drinking? >> Uh around around 10:30. >> Okay. [music] And what time did you end drinking? >> Around 11:30. >> 11:30. What time do you think it is currently? >> Um like I don't know, like 1:30. >> You think it's about 1:30 right now? Okay. Um [music] on a scale from 0 to 10, with 0 being completely sober and 10 being fall down drunk, how would you rate yourself currently? >> I would rate myself around three. >> In the police report, they documented balance issues, counting errors, and difficulty following instructions. The woman, however, said she felt no impairment whatsoever. The officer then asked the woman for her account of what was happening in the car before his arrival. >> And just to confirm what was going on when I first arrived. >> Um it was the first time I'd ever met him and I was just kind of I liked him and I was attracted to him so I wanted to >> [laughter] >> I wanted to like be attracted to him. >> Okay. >> But >> Is that why your pants were off and his pants were off? >> Yeah. >> Okay. And after you all finished that, what were you going to do? >> Absolutely nothing. I was going to go home. >> You're going to go home and where's home? >> Uh I'm in Alafia. >> [music] >> Alafia? Okay. Just going to take a quick picture of you, okay? >> Why? >> Just look at me real quick. >> All right. >> And then your tattoos. >> Why? >> What's that? >> Why? >> Because that's what my sergeant requires. >> Why? >> What? Why? >> [music] >> Yeah. >> I have no idea. You're going to ask him that. >> [laughter] >> I have no idea. >> Why does he want >> What's that? >> Why? >> Well, right now you're going to be placed under arrest for DUI. Go ahead and turn around for me. Place your hands behind your back. >> Before handcuffing her, they allowed the young woman to remove her watch and her jewelry. It's a logical step to prevent injury to the wrists. But at that point, she suddenly started arguing. >> Who is turning Yeah, turn around. Place your hands behind >> Why are you arresting me? What am I being arrested for? >> [music] >> Arrested for DUI. >> For what? >> For DUI. >> What did I do? >> I just told you. Go ahead and turn around. Ma'am, [music] listen. >> Tell me again. >> Yeah, you're under the influence of alcohol to the point your normal faculties are impaired. >> just pull me over? >> First of all, if you don't turn around, we're going to take you >> So why did you pull me over? I'm just wondering. >> Because you're having trouble parking lot. >> Why [music] did you pull me over? >> I just told you. Because you're having trouble parking lot. >> Why are you guys here? >> I just told you. Turn around. >> Why? >> Turn around. >> I'm not going to play with you. This isn't how it goes. We're not doing a roadside >> Roadside I told you multiple times already. >> So why did you guys come? >> Because it's my job to patrol >> Why did you stop? >> So, >> why did you guys stop? >> Right up to the moment they started taking her pictures, the woman had been cooperative, but she was somehow triggered and got agitated, which led to her physically resisting the cops. >> [snorts] >> What if I'm in jail and I don't have the money to get out? >> Huh? >> [snorts] >> What if I'm in jail and I don't have the money to get out? >> If you want to sit there and drink your bottle of wine. The bond's going to be only $50. >> [snorts] >> So, like am I going to be there like forever? Like what am I being charged with? >> You're being charged with DUI. No, you [music] will not be there forever. >> Okay, so what the [ __ ] does that mean? >> What is What is your name? >> [snorts] >> So, what am I being charged with? >> DUI and resisting officer without violence. >> [snorts] >> What is your name? >> Do [music] you understand that? >> No. >> If you don't cooperate with these simple things, you're not going to be able to leave here, right? And you're going to be here all night. This isn't the end of the world, okay? You made a mistake tonight. It's not that big of a deal. >> What mistake? Why was I Why was [music] I here? >> She ended up being charged with DUI, resisting an officer without violence, and a fraud charge for providing a fake ID. She was sentenced to 9 [music] months probation, as well as DUI school, a victim awareness program, community service, as well as fines. On October 21st, 2023, in Chamblee, Georgia, an officer was patrolling at 3:00 a.m. He saw a vehicle parked in a closed public park, noticed commotion inside the vehicle, and found two young adults engaging in sexual activity. >> Turn the car Turn the car. Turn it off. Okay. >> 39 on the radio. We'll be out with a Toyota RAV4. >> Or going to be [music] blue in color. I thought what? Go ahead and put some clothes on. The park is closed and y'all in here having what? sex intercourse [music] >> I'm so sorry. >> sex intercourse in a in a closed park clear Step out, sir. You don't got your clothes put on. Like [music] >> I'm so sorry. I don't have a license. I'm 18. I just turned 18 in December. >> You're actually 19. >> almost 19 >> From the moment she stepped out of the vehicle, the female started rattling off excuses. She did seem apologetic, but some of the things she was saying just didn't make sense. >> I have a valid license. >> I can't believe this. >> I have a valid license. That's >> That's fine. Yeah, our park is closed. Like That's so crazy. Yeah, let me let me get your name. Let me get your information. You got a picture of her license? >> Yes, ma'am. >> Let me see it. >> I'm so sorry. Can I talk to you for a minute? >> I mean, that's fine. >> Okay. No, I'm not I'm [music] sorry. I don't That's fine. I do I just um No, um I don't know what to do. >> Have you been drinking? >> I have. [music] >> You have? >> And I'm in rehab. And I don't know what to do. >> How do you get liquor in you like under 21? >> Because I've been with him for a while. >> He gave it to you? >> Yes. >> It sounded like the woman wanted to confess something and she asked to step aside and speak to the officer in private. She explained to the officer that she was in an abusive relationship and that none of this was actually her fault. >> Ma'am, I just want to explain this. I've been with him for 2 years and it's been abusive and I've been in rehab. And every time I go to rehab, he buys me everything and he comes home and he fights me and I relapse again and I go to rehab again. I get blamed for everything and I feel I'm just so scared and that's why I'm with him tonight because every time I say no, I'm tired or or I can't tonight, I get accused, I go to bed and I can't do it. I can't. I can't and I wish I was lying but I'm not. Like I'm so sorry. I'll sit right here and like I just I don't know what to do. >> While clearly she was accusing her boyfriend of abuse and of providing her with alcohol, the officer stated that she was there on her own will to [music] which the woman agreed. At that point, they instructed the suspect to call her mother. >> So, she told me she was drinking. >> Yeah, there's a a bottle right there in the car. >> Got it. So, you bought the bottle and you you gave him the alcohol? >> No. No, you're going to lock yourself in jail with what you got there. So, you better be 100% honest. >> Go ahead and book me. >> Orange >> Yeah. >> He wasn't at a public place. >> I'm I'm not drinking. I can [music] breathalyze me everything. It's not It's breathalyzed. Breathalyzed. I'm not from here. I just came here. That's why my English is kind of bad. >> You're from Louisville. That's what you said. So, obviously you're not from Chandler. >> I used to live here. I'll show you my order. This is my order. You want to see? Yes, I'll I'll show you my order, you right? I've just got >> Oh, man. What are you going to do? Search your bag. >> Sir. >> The young man admitted that they'd both been drinking, but claimed that he wasn't drunk. They searched the man and put him in the back of a squad car, and simultaneously, it seemed like his girlfriend was having a panic attack. >> I'm just I was just I'm sorry. Yes, yes. I didn't I didn't do You just took away the day. Stand up from the car. >> I'm being honest. >> Come on, stand up. >> Thank you. Come on. >> Go ahead and stand up. You're going to have to get Go ahead and search your purse. I need to get some light. You got anything on you? I >> No. >> Nothing on you that's going to poke or stick me? >> You can talk to me. >> I'm asking you. >> I don't have anything. That's what I'm saying. Good person. >> Breathalyzer officer. How do you get breathalyzed? >> Being breathalyzed doesn't have anything to do with it. >> Would you provide alcohol to a minor? It's a crime. >> I didn't provide her alcohol. >> Okay. >> Did you But you allowed her to consume it. >> [clears throat] [snorts] >> She said it. >> According to the officers, they found some traces of marijuana in the car, but the teen claimed it was just a tiny amount. Once they were both in the car, the officers then called Elizabeth's mother to inform the woman about what was going on. >> Drinking or day? >> No, I didn't have my bill on. Like, literally, I just >> So, what are we doing? >> the front seat. We was literally was just You woke us up. We had to sit down. Everything. >> Landy? >> Yes. >> Hi, this is Officer Worth with the Shamblee Police Department. >> Hi. >> Hi. So, I'm out with your daughter right now. She's in handcuffs. Potentially going to jail. Um her and the male she was with. Um What what what is the situation with these two? >> Man, is she okay? >> She's fine. I mean, she's a little intoxicated, but she's fine. >> She's okay? She's Um she I was trying Please don't put her on speaker. Please don't put her on speaker. Please don't put me on speaker. Please please Please don't put me on speaker. Am I on speaker? >> Yes, ma'am. You're on speaker. >> Please don't put her on speaker. Um I'm concerned for her safety. >> [laughter] >> Elizabeth's mother was clearly on her daughter's side. While the young man she was with was clearly a bad influence, the more troubling fact was that at just 18 years of age, she'd been in and out of rehab multiple times. >> He has been abusive to her in the past. >> Is that the boyfriend? >> [gasps] >> Or is that just some random guy? >> No, yes. It's a guy that um It's It's not a random guy. It's a It's a gentleman that um he has known for a while and she can't seem to get to leave her alone. >> Okay, so did she willingly leave with him tonight? Did she willing Did she willingly get into his vehicle and drive to from Roswell to Chamblee on her own? >> Put her on speaker. >> She She She got into his vehicle, but when she got into his vehicle, she had thought >> She willingly got into his vehicle without his She She This is what she wanted to do. She wanted to get So, she did He didn't make her. He didn't pull her into the vehicle say, "Hey, you you ride with me." She got in. He called her, "Hey, I'm outside. Let's go to the meet up at the park." Because she [snorts] can go. I mean >> As a friend, you should be ashamed. You should be ashamed. >> She was drinking. I mean, she had her clothes off. He had his pants down. So. >> Despite all the facts, the young man was claiming they'd just fallen asleep and that they'd been accidentally undressed. And for the remainder of the night, he tried desperately to get off the hook. >> Ma'am, what the It's There's no way you can just take me. Like there's We were just literally sleeping. I would It's 3:00. It's 3:00 a.m. How? Like we we can't even sleep in a park. How? Like it's just really 3:00. What? >> First of all, the park is closed. >> Ma'am, it's closed. We understand. We I'm so sorry. We were closed. I didn't even know there was no closed sign right there. That it's closed at 11:00 or whatever. So, what's going to be What's going to happen to me now if if I'm asked I'm so sorry for being rude to you everything. Since we're going to jail, let's be realistic. There's no hating on you just doing your job. >> The suspects were taken to the DeKalb County Jail to be further processed. They were both charged with public indecency and the boyfriend got an additional charge for possessing alcohol as a minor. Engaging in explicit behavior with your girlfriend is one thing, but if you're doing it by yourself inside a police department lobby, no less, it's beyond comprehension. On the 17th of December, 2023, Andrew Capper, a 25-year-old, walked into the lobby of the Lake City Police Department, sat down to charge his phone, and started pleasuring himself. >> What's going on, man? >> I was charging my phone. >> What else were you doing? >> I was charging my phone. >> What else were you doing? What else were you doing? >> Nothing. I was >> You still got the evidence. Your pants are still unzipped. What else were you doing? >> I was thinking about going to the bathroom. >> Thinking about going to the bathroom. You know you're in a police department, right? >> Yes, sir. >> So, you know there's cameras everywhere, right? So, you want to tell me again what were you doing? Well, I just put you in handcuffs and take you to jail for jerking your in my lobby. >> Yes, sir. >> The man couldn't find a way to explain what he was doing as there was no reasonable justification for his actions. So, instead of explaining, he did the next best thing and remained silent. >> It's not rocket science. What's your name? >> Bear. >> Bear? >> Yes, sir. >> Like B E A R? >> Yes, sir. >> Bear, what's your last name, Bear? You sure that's your name, Bear? You sure that's your name? >> Yes, sir. >> So, your name is not Andrew? Do you not recognize me? >> Yes, sir, I do. >> So, why are you going to lie to us and tell us your name is Bear? >> Well, that's what I go by. >> All right, so what's your government government name, Andrew? >> Andrew. >> Andrew what? >> Caffrey. >> Why would you decide to come to the police department to relieve yourself? >> After trying to fool the cops about his identity, he was once again at a loss for words and went silent. It wasn't until the cops told the man that he was being arrested that he stated that he just wanted to leave. >> All right, stand up and put your hands behind your back. >> I'm sorry, sir. I I can I mean to leave now? >> You're going to stand up and put your hands behind your back. Put your Put your hands behind your back. Now, unfortunately, I have the task of reviewing video to see whether or not you're actually going to jail. You're just You're just detained right now. So, what was going on? >> I had sleep paralysis. >> You have sleep paralysis? >> Yes, sir. >> So, what does that have to do with what's going on right now? >> I was just really confused. I was kind of lost track of time. >> Okay. >> I didn't see >> You didn't see anyone? >> I was asleep. >> You fell asleep, and what? >> I don't know. I woke up when y'all got here. >> The man hoped that his sleep paralysis story might help him out, but the officer confronted him about playing with his phone just prior to the incident. Just a few moments later, the second officer came back into the lobby nodding his head in disbelief. >> And what do you actually What's going on? >> Full brains. >> Anything on your person will be considered contraband in county jail. >> [music] >> Anything in your bags will be considered contraband in county jail. You told me you lost your wallet. You told me it got [music] stolen. So, what happened? You just been lying to me all day? >> I don't remember doing what you said. >> Well, you've been lying to me since I met you earlier, so >> [music] >> you don't have anything on you? So, do you have an ID in your wallet? >> Yes. >> [music] >> You do. Andrew Pepper. That you could have given to me earlier when I asked you for your ID. >> It It out he was lying about plenty of things, that still didn't explain what possessed the man to do what he did. He had to have noticed the cameras on the ceiling as they were pretty darn obvious. >> You don't have anything in your shirt? >> [music] >> Well, I think it's going to be a little bit wild before we make it to Neptune, don't you think? >> I just wanted to get a ride there. >> Mhm. >> [music] >> Now you can get a ride to the county jail. >> [snorts] >> I have a Uber ride on the way. >> It's tough. >> [music] >> You see these cameras? They caught you what you were doing. You don't Do you have anything in your shoes? >> No, sir. >> Is this your charger, Andrew? >> Yes, sir. >> They arrested Andrew and he was charged with indecent exposure, which under Florida law is considered a first-degree misdemeanor. He faced up to a year in jail or 12 months probation with a $1,000 fine. Everybody knows that by having sex in an airplane toilet, you join the so-called Mile High Club. That being said, one couple on a flight into Florida decided to take that idea to a whole new level. >> What happened? >> Uh couple on 26A and B got >> It's with the appropriate face. You know, not for boyfriend or husband, whoever he is. Uh a lot of customers complained. >> [music] >> We tried to get her to just like sit up in passenger seat so we could wait. There's a lot of kids back there, so we tried to not make any big issue about it. Uh but they continued. So >> Were there any children around them? >> Yeah. The family, they're in 26A and B. Uh the kid is in 27. >> Did you actually see it? I just need you to write it down for me what you saw. >> Yeah. And then, uh, lady with her kids went after it as well. >> And he's done? >> Uh. >> Cool. >> Hello. >> Hey. >> How do you spell >> Hello, sir. That was there? >> Yeah. Hold on one sec. >> I got to talk to you guys. >> Okay. >> This story just got even stranger. Not only did the couple dare to do something like this in their seats, but when they got caught, they kept doing it. When the officers finally confronted the couple, they denied everything. But then it got even worse because their [music] kids were right behind them. >> What happened on the plane? >> On the plane, yeah. What do you mean? I was [music] sleeping on him. >> Okay. >> Uh, it was reported that you you both were having, uh, ass ass on board. >> We were having, I'm sorry, what? >> Ass [music] uh, sex on board. So, they were reported by the captain. So, it is an unaccep- it is an unaccep- what you do on board. >> We >> You didn't have >> We didn't have it. >> I I don't know about that. That's That's why they were reported to us. >> Okay. We I was sleeping >> [music] >> on him for half of the flight. >> I slept the entire flight half asleep. >> So, >> So, while >> While the While the inside reported [music] that even you guys were having >> I mean, I I laid on him for half of the flight while we were sleeping. My my my daughter >> Your girls are right there. >> My daughters were right behind us. >> Of course. >> Like, really? >> The cops then tried a different approach and asked whether any of the staff members had approached them with requests. Once again, the couple [music] had their own version of events, and it was somewhat different from what the staff said. >> I was laying down at one point and the stewardess from the front, the male said, "Excuse me, ma'am, you have to turn around and put your seat belt on." But I was like in fetal position, like laying down, like actually sleeping. >> Okay. >> That's the only thing and he was like really, really rude about it. >> Basically I was [music] asleep. I never watched the movie, I never turned on the TV. I was asleep. >> The only thing that I can think of was that male stewardess when I was laying down and he came over and was super super rude and was like, "Turn around and put your seat belt on." He was sleeping. I was like I had my legs up, like almost like a fetal position, like I mean he was had his arm wrapped around me and that was it. I mean we don't we didn't have any like blankets or anything. This >> crazy >> crazy >> I don't understand what's happening. >> Wow, that was why they required as a TSA I have to follow up with you guys because I wanted to go to the side any kind of act like that. >> I can't believe you're saying that. And listen, if I was going to do that, I would It's right behind you. >> Behind you? All right. >> I have two teenage daughters. >> They asked the couple to provide ID, which they did without issue. But when they were asked to go to the office, it became apparent the situation was far from over. The officers took the matter seriously and wanted to make sure to question other witnesses. >> Hi. >> What did you see happening? >> Okay, when we got the fake call she was she not [music] coughing and she I come with my kids, one 11 years old and another 14 years old and she [music] was watching that my kids was watching on them and she didn't stop. And I was like I didn't want what to do because my little one was like, "What are you >> your identification?" >> Neil Gaiman. >> Okay. Hey, listen, [music] you want to step over here for whatever reason. Did you actually see his sexual organs or anything or >> I mean I couldn't see his organs because it was the way it was angled in there. It was a little hard to see, but >> So, you were asked them to stop? >> We won't We tried not to because that way if we did, you know, we were going to cause a problem and it was early in the flight, so we had about an extra hour and a half, I want to say, of the flight. >> [music] >> So, >> How long did it go on for? >> [snorts] >> That's a good question. >> In the meantime, they separated the couple and they were interviewed by different cops. As part of standard procedure, they were handcuffed and they were informed they were being detained till the investigation wrapped up. >> What is going on? >> What's that? >> So, my heart is like beating out of my chest. >> Well, we're >> Okay. >> There were reports on the plane that you you were performing acts. [music] Is your husband on the plane? Public. >> We weren't doing that. I was like [music] sleeping all over him, yes. And we were like like giggling and joking when we first got there because it was such a show up morning. But I slept on him almost the entire time and then when the flight attendant said, "Turn your light on and put your seat belt on." Like I sat up and then he remained sleeping and then laid on me for a little bit. And then that was it. Like this is kids are being I wouldn't do anything with my [music] children right there. Like this is insane. >> Again, we are we have to do the investigation. So, right now you guys are detained until the full investigation is done. So, right now we're we're we're getting statements from a lot of people. We We'll We'll sort it out, okay? >> After getting official statements from the witnesses, they arrested the couple and they were taken to jail. Despite that, the charges were later dropped, likely due to the fact that there wasn't enough evidence and nobody actually saw any exposed private parts.
