rookie cops frequently overstep their legal mandate but what happens when these cops are put back in their place by educated citizens here are two cases where rookie cops got owned starting with a parking disagreement that escalated into a wrongful arrest in charges that were ultimately dropped I don't give a crap was [ __ ] 5 minutes bro I don't care you're breaking the law you're mad about it because your ego's too [ __ ] high I have no ego you know what I came here to do I came here to Simply go get a lunch that's all I came here for this is officer James cooch from the Orange City Police Department on the 8th of October 2023 officer cooch observed a vehicle belonging to a 19-year-old individual named Bryson early parked outside a grocery store in the fire lane officer cooch began to locate Mr early who was inside the grocery store premises watch how such a simple situation is about to escalate badly I'll make an announcement to have the uh [ __ ] that's parked in the fire lane uh you can say [ __ ] um over the interc you want I give you permission uh to move out of the fire lane with this big giant truck and boat okay I'll are you in the truck I'm moving right now okay license and registration and proof of insurance please take my truck okay well someone can get it for me what's the reason for that though cuz you're parked in a fire light and it says no parking oh my Lord have mercy [Applause] yeah well if there was a fire in this licker store where park at man uh I don't know out in the parking lot do you see anywhere in this parking lot to park out dude yep absolutely there's plenty out there not when I P my truck well whose truck is it it's his I just told you that dude ask me were you driving or was he driving oh he was well he was driving okay well then so give me your give me your license please sir it doesn't matter if uh it's his truck you were driving you need that yeah yes please do you understand why I'm frustrated right I work here I understand I just do there's nowhere to park and it's like I feel like there's a million things to look at you were Scout in the parking lot I knew when you were sitting right there you were going to get me when I walked in when I then why did you park here cuz there was nowhere else to go when I went in I there are plenty of parking spaces over there and you're getting loud with me write me a damn ticket then I will [ __ ] you little ego too high for that little fit you got on yeah okay what is your deal you you are in a parking spot that if there was a fire in this liquor store right now mil things be mad about I don't give a CRA [ __ ] 5 minutes bro I don't care you're breaking the law and you're mad about it cuz your ego's too high I have no ego you know what I came here to do I came here to Simply go get a lunch that's all I came here for give me a ticket I don't got to listen to you say that's f do me a favor roll down your front and back windows please do that buddy yeah you can we weren't driving it you gave us the tippet it's we sitting still isn't it nope I can go ahead and check this too oh my [ __ ] God where did you get your law degree from uh what was that where did you get your law degree from huh your law degree did you get one okay that's what I think so yeah go ahead and uh roll the windows down for me sir are inside this [ __ ] want to get it for anything you can you got [ __ ] tiny ass [ __ ] y That's good go ahead and roll this one down Bush dude don't [ __ ] you know that [Applause] officer cooch requested Mr early's license and registration citing a violation of the city ordinance prohibiting parking in fire lanes for those who don't know the city ordinance states that parking in a fire lane is prohibited and officers can issue a citation or require immediate movement of the vehicle however despite conveying the situation to Mr early he argues with officer cooch regarding the unavailability of parking for the grocery store observe what officer cooch is about to [Applause] do sit your ass over there now you're disturbing the pie bro get your hands off me bro bro you see this [ __ ] you see this you see this angry little look at him bro stop please stop your attitude caus this my attitude you're mad cuz I called your friend a [ __ ] bro my friend yeah yep you're mad bro that's all there is you're mad you have no right to arrest me right now for disturbing the peace right now how is that I have all these people right now that why don't you get him for walking up on your traffic stop then huh oh that's what I thought that's what I thought he he can walk up on a Travis toop all you want 112 can I get another unit to my oh God I'm sorry they're L I'm trying to but like he just needs to shut his mouth well you're letting him egg it on aren't you shut up n good and turn you H me [Applause] yep it ain't going to stick I don't care stop he nothing to stick [Applause] on right your feet I'm spread them a little farther 11 Alpha 82 Central I'm going on my boat what do you think I have no you're not going on your boat today you think this going to stick for real don't you it don't matter you're going to jail [Applause] tonight um he is getting I'm not I'm sorry no you've been cool the whole time I'm sorry I'm bleeding on this hand so I'm not no I understand oh with the T I get no he's the one that's driving it so all the tickets are going to him cuz he's the one that was driving the vehic so you said that he was driving he admitted to driving [Applause] so officer cooch arrested Mr early for disturbing the piece he informed the vehicle owner that Mr early would receive a citation for window tint violations as Florida law holds the driver accountable rather than the vehicle owner officer cooch explained that the arrest was warranted due to Mr early's disruptive behavior which included shouting and causing a scene in front of bystanders he was given the notice to appear for the disorderly conduct charge and subsequently was released for his recognizance the charges against him were later dismissed if you think this was the biggest mistake a rookie cop can make then you probably aren't aware of Corporal mcadam's case hey man let me talk to you a second go hang on hold on stop walking let me talk to you a second man sh okay uh what's going on tonight I don't know I got nothing to do with stuff put this is corporal McAdams from the Texana Arkansas police department on July 13th 2022 officers from the Tarana police Department stopped an individual named Reginal James who's a veterinary technician while investigating a shooting near his rental property they approached Mr James suspecting he could either be involved in or a witness to the incident observe how the encounter takes an unexpected turn make contact with that guy they're saying that this guy walking down the street right here is the guy that they were shooting at okay I've been seeing him over he don't live in here but I've been seeing him cross from back back behind us let's have a conversation with him saying one shot at okay hey man let me talk to you a second go ahead hang on hold on stop walking let me talk to you a second man okay uh what's going on tonight I don't know I ain't got nothing to do with y' stuff put I'm toare that with you to just investigate attention all right at this point you are not in any trouble not no you understand but we're being told by multiple people you were involved in all this that these dudes were shooting at you all right is that the truth I ain't got nothing to say to y y ain't got nothing to say to me at all okay that's all right go ahead and uh get his identification and everything we'll go ID in your pocket sir uh right here yeah okay there's nothing on you that's going to hurt me I don't know you don't know I'm going to pat you down for our safety then everybody else is safety is it going to cause you more trouble cuz they see you getting hammed up or is it going to make it look like you're getting treated like and you can actually talk to us later I really ain't got nothing to stadi I'm just trying to go home y'all stopped me for no reason uh no we stopped you for I'm I'm passing by and I'm fit a description uh you actually you point it out that's okay so that they may have all made a mistake when we'll work us out y'all Y up it's cool though how do I up because I ain't do you stopping me for no reason oh okay y'all going to figure it out I'm a college graduate I'm a homeowner that's my home right there that's my rent property on the corner okay well all you had to do is talk I have to talk to y'all I don't need to talk to y'all you got me sitting here detained from walking from the store coming home that appreciate it if we worked it out together but that's I'm trying to work it out I don't have to deal with y'all y'all don't understand that I don't at certain times you do have to deal with I don't have I me I don't have to deal with y'all at certain times you I don't have to deal with you Mr McAdams what's your name Sir Mr neon yes sir nice to meet you nice to meet you too so you say you don't know nothing about nothing you answering no questions bro I'm not answering any questions hey if you keep yelling like that you going to try to find the way to take jail we not that you're going to take me to jail then hey relax come talk thank tur from there but multiple people Point him out that's what I gotad that he was part of because you're I don't want to be bed I don't [Music] y9a open has he identified himself yet no he he allowed me to get Billo out okay well as of right now he's under restro conru did you you have to identify yourself he has my ID okay once we get to that point you ain't got to answer no question to me you ain't got to talk I said listen listen you ain't got to talk you ain't got to answer no questions you have to identify yourself all we're trying to do is figure out what happened here you're supposed to be the victim you're the one [Music] being let me do my job and I'll let you soad really yes really this house right here behind us on the corner and he is just destroyed up like that every time Mr James refused to answer the officer's questions leading to his detention and search even even though he asserted he had no obligation to speak he was made to sit in the patrol car for several minutes and was eventually arrested despite a statement from witness Ashley Clark confirming that Mr James seemed to be fleeing from the vehicle involved she suggested he was a potential victim rather than a suspect watch how the encounter ends he should have Assist up in his system Michael brownx did a report for shift one night over there cuz he was drunk and stupid with this guy drunk and stupid well all I care about is does he have warrants for his arrest and you showed be clear okay one he's now banned from housing banned him from housing I'm trying to decide if we're going to arrest him or not did he give you his wallet or did we take his wallet after we detained him after we detained him mhm we took his wallet he but he He Turned and said there it is but he got it doesn't matter it doesn't matter if if if he doesn't want to identify himself he's he's trying to walk away when we're have a legal reason to stop that's when you grabbed him man I thought he's fixing a run he he stays in that grey house I'm pretty sure do what he that one stays in the Greyhouse yeah he's a turge he's had a lot of work I mean he's hard to deal with at all times she said he was already up on his porch and all the cops are down doing everything thing and he jumped off his porch and left him one another way then he comes right back up through yeah to see what's going on since they're busy I'm going to get you to transport him do the arrest paperwork I'll do the narrative stuff on it hey you're talking to the lady in the red sh yeah I just got hers we got the witness that said he info so we can justify involved all that well uh this lady here mm usually gives good info he's in the back of the car yelling let's get him transported out of here and let's get him banned him out of here so we can finish just come back here just ban him give me a second I just threw I was moving stuff around just the gear in my back seat let me move it make room for P Mr James was arrested and taken to the police station he was charged with obstruction subsequently he decided to file a civil rights lawsuit against the officers involved and the police department the outcomes of both of these remain unknown are you googling the LW right now cuz that's really what she should be doing right now you okay with that yeah continue are you sure you're okay this is Joel Martinez a 19-year-old law student at New Mexico State University officer Perle approached Joel's dorm after the campus police received an anonymous tip that Joel was in possession of alcohol little did the officer know that Joel would not yield easily I'm sorry I can help you is there anyone else in here uh no it's just me okay you mind just opening the door that way I can see uh you trying to what you trying to look for I just want to make sure there's no one else in there start and then I'll talk to you there's no one in there right now okay come out here and talk to me then yeah so I'm going to be honest with you we got to report that um you were seen walking into your dorm with alcohol was there alcohol in there uh I don't answer questions what's your name and your badge number officer fle NMSU police title and name security officer oh security officer okay okay do you have an ID with you uh I do okay can I see it uh you suspect like me of a crime I do okay what crime and how can you articulate it minor imposition of alcohol we got a report that you were walked in so it's a hear that they say they said thing okay it's a yeah right it's like they said that he has and that that's how you're going to articulate it so we don't have to go down this route if you want to if you want to go down this route we can well I really don't but like you're I'm studying right now I'm doing homework get knocked on my door I'm out here I want to know what's on you say that they they said that there's alcohol in this room oh they saw me going into this room and that there's alcohol in there how can you articulate it though okay so that's why I'm here talking to you yeah okay so I still need ID you uh no and then we need to go from there you have to you have to suspect me of a crime I I do you you you realize that uh cops in New Mexico don't have qualified immunity right I do that I do that okay so from from here and on just let's just be careful in what what you about to do right now you're saying that you want my ID but right now you're not you or yourself can articulate a crime that I've committed okay for those who don't know qualified immunity is a court created rule that protects government officials against litigation it establishes that an official can only be sued where officials violate a clearly established statutory or constitutional right so so I already explained to you why I'm here why I need your ID I know what you're here but okay is myid going to tell you if there's alcohol in that room no but I still need to identify you my name is Joel Joel what Joel I need your first last name and your date of birth no you don't I do if you don't want to provide that you don't want to call officer Donovan or one of your supervisors here yeah I can get a sergeant over calling on because right now this is not what you want to do right now cuz this is a violation of my fourth amendment okay all right let me let me get a sergeant over here okay yeah 202 212 Square oh I'm yeah that's my room okay you want to just hang out out here then is he detained no that's fine I just don't want anyone going in the room you could go in then if if he's not detained he's free to go yeah he's free to go but he can't go in the room he can't no not at this time all right just just let it be bro just they someone called and said that they saw or me walk in there with the case of beer but that's all they have so so it's an investigation I'm talking to him he doesn't want to identify himself so until we get this figured out there's a sergeant on the way that's going to talk to him until this gets figured out I don't want anyone to go in the room you you're free to go anywhere else that's fine you're not detained or anything but that's what's going on all is anything going to happen if I don't identify myself you can be arrested for concealing identity yes so okay so you that's what you I want you to say if you don't ID to me right now if I don't give you my ID then you're going to arrest me I want you to give me that ultimatum so just hold on you want to wait you said you wanted to wait to speak to a supervisor so let's just do that okay then okay thank you and keep your hands out of your pockets for me this is when Sergeant Lovelace of NMSU gets there officer Perle explains to him what's going on and how he thinks Joel is being unreasonable and wants to go down this route whereas Joel is only trying to not get his constitutional rights being trampled by the cops hi name badge number please Sergeant John love my badge number is 212 212 all right thank you uh officer said here that if I don't ID I will be subject to arrest is that true it's possible yes possible yes or no I need I need that altimate them or else I won't get my ID okay so technically right now yes you could be arrested could I need a yes or no like I need you to tell me if you don't give me your ID right now I'm going to arrest you why why would I say that to you because I need that Al tomat cuz right now you're asking yes and I have the right to say no cuz you're asking you're not it's not a lawful order I need you to make it a lawful order being detained for sup of minor um in possession of alcohol mhm we need to see your ID okay and if not and if not you could be considered identity cuz New Mexico statute says that concealing of identity is a secondary charge I would have to have been arrested or suspected of a crime right now you hear just hear being arrested or suspected you're being suspected of having possession on what on what grounds okay so do you have any alcohol in your possession I don't answer questions on walk grounds okay so you don't have any alcohol in your possession on walk grounds I don't answer questions Joe's is technically right Reasonable articulable Suspicion of a crime cannot be established on the basis of hearsay if that were the case everyone would be calling anonymous tips on everyone else and innocent citizens would be subject to Illegal searches and seizures all the time yeah that's her room bro n it's her they're trying to go in bro they're trying to ID me but nah okay so who are you talking to I'm recording you you're recording at all if you want to hang out you can't that's fine uh so here's the deal by saying could what we are trying to do is we're trying to be cooperative with you and have you be cooperative with us and help us clear this matter up okay I gave them my name what's your last name you don't need my last name and you do not need my date of birth unless you want to run me for unless you want to run my name through your system are you trying to run my name through the system you have warrants for your arrest I don't answer questions I don't answer questions I'm asking questions I don't it's my fifth amendment is it or is it not okay so the question is is that like the officer told you you're being suspected of having possession of alcohol underage so in that case the easiest way to prevent this is for you to let us know either you had you got somebody saw you carry of case of beer you have case of beer in your possession I don't answer questions okay all right um so the other the next the next step in this process would be would you give us consent to check your room NOP to make sure that you have no alcohol in your POS I do not consent to any surges nor seizures okay very good all right um this is completely up to you how you want to play this you could get a warrant or you could so or you have probable cost right now we do have reasonable suspicion that possibly a crime had been committed we're trying to investigate that MH you're certainly welcome to refuse if you wish I know but we need to ID you or and if we do not if you do not present your identification you can face it a onra citation you're saying could I need you to say you will you I'm giving you the opportunity to no I need that ultimatum I will give you my idea if you say that I'm going to go get arrested if I don't give it to you so you'll give us if we say that if you say that yes sir cuz that's already grounds for me to set up litigation against you so you're threatening the sewers I ain't threaten nothing brother that's what you just said it's not a threat gives you grounds it's not a threat it gives me grounds does it or does it not telling a police officer that you will be pursuing legal action against them does not count as a threat it is a basic right of every citizen I don't answer questions okay so the easiest and simp solution to this is for you to tell us your name date of birth Joel Joel what Joel okay by just saying Joel there's a thousand Joels I need a last name of the date of birth for you going to run told conf you want my are for the report I need to have your name and I didn't even have to give you my first name for that report you could literally put the citizen or the or the guy or the suspect yes you can work like that yes it does I'm a law student here you're not going to come over here and try to violate my rights Sergeant LEL goes back and what he does next is very interesting scared of a 19-year-old with the phone bro well I'm not scared of a 19-year-old with the phone I have come on man don't do that okay seriously that's just do you see something in my pocket well we would like for you to do that for us just to be cooperative okay just to be cooperative like just like for you to say what you want me to do are you googling the LW right now cuz that's really what she should be doing right now all right okay with that yeah continue are you sure you're okay with that yeah I give you permission oh thank you very much yeah it's okay I appreciate it it is both scary and interesting to see a senior Sergeant having to Google the laws only if they were doing this more frequently during training innocent civilians would not not have to face police tyranny on a daily basis okay so here's why we need your name and date of birth and I'm going to read you the law because you are a law student okay according to New Mexico it's all being recorded yeah I know my body camer running so I'm I'm going use my my own so concealing identity consists of concealing one's true name or Identity or disguising oneself with the intent to obstruct the due execution of the law am I obstructing or yes technically you are with the intent to intimidate hinder or interrupt any public officer mhm or any person in illegal performance of his duties or exercise of his rights under the law of the United States okay so your investigation is investigating that I'm in possession of alcohol right that's exactly if I don't give you if I give you my IDs I going to tell you if I do or do not have alcohol in that room or is it just a way find me with something no the ID is so that we can identify who we are talking to if you wish to deny us access to that room that is totally within your rights I know but you refusing to identify yourself To Us by name and date of birth yeah full name date of birth that is concealing identity yeah okay okay so just tell me that if I don't give you the ID you're going to arrest me just say it show us your ID we need to see your ID or you will be arrested thank you yall got that right yeah yeah you got that pig for real why do you use that term cuz why the [ __ ] are you searching my sh like we're not searching your [ __ ] that's SE of my identification is it or is it not it's not a seizure it's a seizure of my identification yes or no we just need to see who you are in order to go in the investigation told you my name your legal name gave us your first name what is my Joel not the legal name or what Joel what he has my ID go look at it perfect that's all we thank you that's all we needed mhm let go down here real quick please officer Perle and Sergeant LEL huddle to decide what to do next they decide against charging Joel with obstruction or concealing of identity if we really wanted to push the issue we could stop and lock the room down and get a get a search warrant um but we have an anonymous complaint so it's really kind of really kind of one of those things that's up in the air we don't want to we don't want to do that are they oh wait they're right here hey bro I got to right here just listening yeah you're listening all right anything else I can help you guys with just stand around and get paid yeah sure you're just going to stand around and get paid brother yeah yeah like I think we just Prov some racist I'm going to get complaints on both of your ass and she found him and going to know about this because that he knows who I am chief Donovan knows you Chief Donovan knows who I am okay per all right D app it fck up for real have a nice day yeah and did you find anything with that ID brother did you find out if there's alcohol in here or not with that IDE you denied us consent so that's fine I didn't could you would so we're not going we're not going to argue with you have get the [ __ ] out of here well this is actually a common area so we're allowed to be here Fu out go work I pay you for something [ __ ] out of here yes I P you for something [ __ ] out of here cuz you got my ID for no reason brother okay get the [ __ ] out of here have a nice day sir thank you oh it is unclear if Joel lodged a complaint or followed up on this case but he surely made sure the officers did not intimidate him with their unlawful tactics if you think this was the only rookie cop who made huge mistakes wait until you watch this next case that see that's a problem listen listen because I'm doing an investigation you're not getting my ID buddy buddy buddy you're going you don't have aw for right my ID all right this is Officer Robinson of the Tampa Police Department on May 7th 2024 a First Amendment auditor named Jeff Gray visited the new Tampa community park and recreational center which is a public building a Park employee called the police to report the presence of Mr Gray he was seen holding a sign that said God bless the homeless vets and did not cooperate with the Park employee upon his request to exit watch how the encounter unfolds what spread the message God bless that's all oh okay yeah but why I here there's no one here uh there's there there's uh staff was coming earlier and there's been people coming well they they call cuz they don't feel comfortable with you here oh okay so unless you want to get trespassed that's up to you I'd find someone else to go I there's no one even here I'm cool right here man I'm going to stay right here for a while well no they want you gone you back to them it's not their not their decision it is because this is Tampa property yeah city of property it's no but they can trespass you for whatever reason they want to trespass me then they can trespass me but I have just right to be here to anybody else so you're trying to you're trying to make a point is that what you're trying to do yeah well now what's the point of that uh we'll find out all right I have just as much right to be here as anybody else yeah you have to understand trespass rules are just that take trespass I'll refuse to leave and you can take me to jail and we'll see where it goes there that's that's easy enough morning first I I just did they want me tres pass yep what happen if I leave if you don't if if you don't leave then I get them they're going to come out here and officially say you're not allowed here and then I have a chance to leave and then I say okay you need to leave of course I don't know why I have to go through all that but you need to leave and then once you do or don't then I write a trespass warning and then I give it to you and then if you don't I'm not going anywhere unless I'm trespassing okay um me I'll leave do you have your ID on you I do and I'm not giving that to you that see that's a problem listen listen because I'm doing investigation you're not getting my buddy buddy buddy you're going to you don't have aw for right to my ID all right it's a m sir it's fine it's okay I don't mind taking you to jail for a misdemeanor it's fine it just seems pointless for everyone's that's okay leave but I don't have to give you my ID that's okay hi can you come tell him he came back he's trying to make a point saying that you know whatever um so I just need you to officially tell him that he's not welcome here okay okay I don't know why it has to be this way but okay all right you don't have to get you don't just right here is fine okay hi so um the only thing you're not going to get any any help here because I just have little children coming in it's not like no his his stance is that he's not he's not begging his stances that he's trying to spread the word oh although that's it's convoluted either way it's better that you not because like I said I have small children coming in so all it needs to be is he's not you don't want him here anymore it's better if you're not here please okay well I'd rather stay here you don't have the authority to tell me not to be here so do you want him here yes or no I don't okay you're good all right thank you yes the situation intensified when the officers approached Mr Gray and requested his identification he confidently asserted his rights refusing to provide ID and emphasizing that he was not violating any laws despite this the officers persisted in their demand for identification stating it was necessary for their records or suggesting potential safety or security concerns Mr Gray remained Resolute pointing out that by law he was not obligated to show ID unless he was being legally detained or suspected of committing a crime watch how the interaction concludes wants to go yeah but he just he wants to play a game he has a sign that doesn't ask for money that just spreads the word of God bless homeless vets go uh he sits here he was in his car cool off and uh you know then he sees me and comes out I'm not leaving this can't you can't trespass me I said well actually this a city property and she came out and said it well I'm not doing anything so then he moved to the sidewalk okay and so now this is his car so I'm going to officially ride him a trash pass warning for this property okay what cuz he refused identification as well oh getting down but his far yeah sir all righty sir even' been trespassed from the immediate area I I don't want to really push it because I mean we have to start getting into what's property line what's not property line but this is a community center and that includes all the facilities here um so without making a big deal about it if you want to be here on the road that's fine you're not not soliciting technically but they don't want you on this property anymore so this is going to be your official trespass warning all right understood you have any questions for me I'm good all righty sir good luck to you Mr Gray was trespassed from the public property after he received an official notice for it he later filed a complaint against M Hall the lady from the park who got her trespassed the trespass warning against him was later dismissed the result of the complaint is unknown as of yet but if you think it was officer Perle and Sergeant Lovelace who got brutally owned by Joel wait till you find out about officer Gilpin watch him get humbled by a citizen who was well aware of his rights you pulled me over for that phone a single Lane you pulled me over for that phone and you were wrong and I corrected myself I told you but you still got to get that license it's like crack to you guys I don't understand that you got to have it let me have that license I don't want my as a as a citizen I don't want my information entered into a database any more than it has to be this is a citizen who goes by the name of last American Patriot on his YouTube channel he was stopped by Officer Gilpin of Midland Police Department on June 4th 2022 for the suspicion of using his phone while driving but as the situation escalated this citizen decided to firmly stand for his constitutional rights sir I'm officer Gil Millan Police Department sir ma'am and so the reason why you got pull over as you passed me I noticed you had your phone up no my phone's right here well maybe it was my mistake then then I st corrected have a good day no you're not pretty good you seem to be in a hurry sir was I speeding yes you were no I was not okay you you wer speeding no sir all right your license please do you have me clock for speeding or did you pull me over for that because that's the first time you told me yes you pulled me over for that now you're telling me speeding let me start over please do I said I noticed you with your phone you corrected me you said your phone was us up didn't have your phone your hand so I was I was mistaken I GL so then you got me for something else now yes sir okay you have a supervisor I do have a supervisor so your LIC please your license please what did you clock me at I sir I did not clock you exactly so I wasn't speeding because I saw you whenever I turned off A Garfield and I am obviously not going to speed past the cop whenever I passed you I was going 16 mph it's 25 on these Road 20 or 25 on Ro is quite a distance away I'm going to give you a warning and let you go you want to talk to my supervisor all right I'll call my supervisor so you're holding me here you ask for superv sir I'm because you're asking for my license for no reason because I wasn't speeding I'm not going to give you my license unless I was speeding all right so you want to so if you're good with it and I can drive away I don't need your supervisor but if you but if you want my license and you're going to violate my fourth amendment you're absolutely getting your supervisor you want me to call my supervisor are you do you want my license yes I want your license your supervisor officer Gilpin calls his sergeant and comes back to the citizen to tell him that he will have to wait because his Sergeant is quite far away it looks like officer Gilpin is is looking for a face saving out of this situation so those are F officers that not my super supervisor outside town so he's coming over okay great use resources there I'm sorry great use of resources there okay you again you asked for a supervisor something well because you're trying to violate my fourth amendment sir are you or are you not why do you need my license if I wasn't speed if I didn't commit an infraction why do you need my license visually you can't Pace from sitting still you cannot pay for I'm going argue with you okay well then prove your point so let me expl how do you know I was speeding I'll sit here and shut up you tell me you know I was speeding visually you came up rapidly behind me you were speeding my interpretation I didn't get you your radar so that is why I told you you were speeding okay you don't you don't know that so you don't get my license you don't have to give me a license you want a supervisor I asked you I was going give you a verbo let you go you want my supervisor my supervisor on his way so that's where it is no no no you wanted my license to give me a verbal this all would have been done if you would if you would have said you needed my license for nothing did you heard what I said that you don't know any violation and you wanted my license speeding I was not speeding that's your interpretation and my no that's truth cuz it said 16 mph on I'm telling the truth you don't you want to die me you you guys don't like it when citizens don't bow down to you so you don't have to bow down to me then let me be on my damn way without violating my fourth amendment you can you can argue and say what you want to say get out of my face dude why do you have me stop right now you want me to start over I and I will too and we can shake hands and be done I will calm down sir I'm cm two things to note here firstly the reason to pull over this citizen was his phone and not speeding if the driver was going over the speed limit why didn't officer Gilpin mention it when he first made contact secondly he says that he was driving behind whereas previously he said that he had noticed the citizens sped past him exactly sir so I'm driving I saw you behind me I saw the phone up I thought you had your phone in your hand okay so I pulled you over because of the phone when I came up to here you corrected me and told me and this you're right it's not it's on the mouth you said it was on the mou I said sir I stand corrected exactly have a good day you're on your way no and I said you were speeding you you said we're going to start over that's swe I'm we starting over but you're still wrong we can start over but I can be wrong you can be right we can all be going back and forth I'm just explaining you asked me start over so I said you were speeding you came up behind me I pulled over visually caught you speeding you said you weren't speeding okay that's your interpretation and you're you're the driver you you have the right to say what you believe is a truth the officer is in the wrong because although his own interpretation of the Citizen's speed could be subjective the citizen read the reading on the speedometer to be 16 mph which was objectively correct you're wrong right now buddy and I did not pull you're wrong right now you pulled me over for that phone it's a single Lane you pulled me over for that phone and you were wrong and I corrected myself I told you you right but you still got to get that license it's like crack to you guys I don't understand that you got to have it let me have that license I don't want my as a as a citizen I don't want my information entered into a database any more than it has to be and Sir okay you can say that I wasn't even going to enter I was going to look at the license give you R you don't but you don't get to do that unless I've done something wrong s my interpretation again you you so you think that how fast do you think I was going you're going over 10% over the speed limit you're out of your mind bro my inter you're out of your mind so if the speed limit here is is it 20 or 25 I was doing 16 is it 20 or is it 20 or 25 right here if you say you're doing 16 that is your interpretation is it 20 or 25 right here I don't know you tell me you don't know no you tell me you don't either way so if it's 20 10% over would be 22 if it's 25 10% over is 2.5 miles okay so 27.5 so you visually saw me going 27.5 milph you need to get your you need to get recalibrated man okay your interpretation of recalibration then it's fine you're in the wrong sir the we're going to argue and you're in the wrong there's no argument because you're in the wrong we're arguing right now we're talking there's no argument I'm telling you what the truth is I'm being molested by my government for doing nothing wrong because you have to have my ID cuz you violated a traic offense yes no I didn't and your interpretation you're a liar dude don't come back up to this car get your supervisor I'm not talking to not talking to you anymore you're a liar officer gilin without a radar was able to estimate that the citizen was going 10% over the speed limit without even knowing the speed limit on this road it is becoming clear that the speeding thing was entirely made up so that officer Gilpin could justify this traffic stop his ego is too big to accept that he has made a mistake and let the citizen be on his way after a while Sergeant will of MPD also gets there Hey sir sir how you doing what can I do for you man I'm wondering why I'm still here well apparently you called for a supervisor because he wants my license when I have committed no traffic infraction when your officer first got up to this vehicle he said he pulled me for this okay that's up there when that was wrong then he tells me that I'm speeding I know for a fact I wasn't I looked down at 16 the whole time I was behind him and past him I looked down I was 16 M hour okay but he wants to get my license he already told me he hasn't clocked me he estimated my speed from a standstill which you can't Pace from a standstill he says I'm going 10% over the posted speed limit okay from a stand still he knows this I'm not giving up my license unless I'm unless you're threatening to take me to jail okay I'm not the war you guys want right now with all y'all have going on I was going 16 miles but I'm not going to VI I'm not going to let him violate my fourth amendment when he was wrong okay so you just what do you want now what is the I want to be unmolested from my government and on my way okay it's not funny well I mean you sat here waiting for me when because he wouldn't let me go okay all he need to do is verify that you have a driver's license not going to do it he doesn't have a reason to see it well now yeah actually we do have a reason to see what reason is that because we can actually stop you to check your drivers we can not unless you not unless I've committed an infraction we actually can I I search the traffic code it'll tell you right there but that's all he wanted to verify he's going send you on your way no so according to him you can be randomly stopped and asked for your driver's license in the state of Texas in reality there are numerous Supreme Court rulings on this matter the Supreme Court has held that any motorist can only be asked to identify himself if there is at least a reasonable suspicion that he might be unlicensed or driving an unregistered vehicle go what you go go thank you very much what's your name Wilson Wilson badge number 330 thank you sir thank you still Sergeant Wilson does the sensible thing here and lets the citizen go this is a win for the citizen who held his ground the citizen later updated that he went back to find out the speed limit on that road and it was 30 mph which means even by Officer gilpin's estimate he was driving well under the speed limit it is refreshing to see law knowing citizens stand up for their constitutionally guaranteed freedom and rights if you think this was the last rookie cop who made huge mistakes then you probably haven't heard of this incident you want to hand me your driver's license no they're right here why won't you hand me driver's license because Texas law states I only have to exhibit them I don't have to hand them over well you want to hold it out so I can get your information it's right here right right against the window here this way so I can get your information this is Officer hanning from the Grayson County Sheriff's Office on April 26th 2017 a civil rights activist named Justin Turner was driving around Grayson County Texas when he was pulled over by deputy hanning and Deputy Barker 5 years earlier Mr Turner received a speeding citation which he did not pay the non-payment of the ticket resulted in the issuance of a warrant against him however after learning about the warrant 2 years later he paid the ticket to remove the warrant status watch how the cop are about to manipulate the [Applause] situation hey how are you you rote your window down a little bit more for me so me I can hear you uh that should be good enough you roll window down just a little bit more so I hear you I can hear you just fine I can hear you cuz all the traffic I can hear you just fine I I'll speak up a little louder so you can hear me speak up a little bit for behind Deputy H you gra insurance office your license got your insurance with you yep ask the uh reason for the nature of the stop I will after you hand me your license and insurance okay you hand me driver's license it's on this side here traffic's noise if you're if you're worried about the traffic you're on the same side as the traffic noise okay guys I can't hear you roll the window down just a little bit more for me okay you're worried about the traffic noise you're on the same size as of traffic over there so I'll go ahead and get the luxury of you to put my driver's license and my insurance on this side of the window here okay you want to hand me your driver's license no they're right here why won't you hand me driver's license cuz Texas law states I only have to exhibit them I don't have to hand them over well you want to hold it out so I can get your information it's right here right right against the window here this way so I can get your information I don't want to have to reach over there I don't want you to say I'm reaching for anything I want to keep my hands where you can see them everything right here that you need is right against this window here and I'm just going to remain silent for the rest of the traffic stuff okay I can help you hey Mr Turner still up same M your license I'm going to remain silent say again going to remain silent right you want to tell you why you got pulled over or do you want to remain silent I'm still waiting for that explanation can hear you speak up for me please still waiting for that explanation one more time still waiting for that explanation sir I can't hear you I can hear you just fine so I'm pretty sure I can hear you I can't hear you cuz of the traffic in you got this window R down like 3 in yeah sure you can tell me why you pulled me over okay do you want to know the reason I'm yes I'm still waiting okay hey did you happen to see me sitting on SOL the road back there a couple miles no I just driving on the road hey when you came by you came by in the in the left hand lane but you're following the vehicle in front of you about probably a car link car link the half back were you wor that you're going that close I have a dash cam right here I can't hear you I understand I know how far I was away from the vehicle how far were you what's that how far were you from the vehicle in front of you when you came by I know how far away I know how far away I was and that's all I'm going to say were you I have it on my dash cam that's all I'm saying you what I have it on my dash cam right right here which is recording all right and that's you're you're probably like carlink in half or so back from this person in front of you I'm going to say it's on my dash cam you it's on my dash cam okay hey do you know how fast you were going when you came by by chance it's on my dash cam how fast were you going it's on my dash cam you don't know how fast you were going it's on my dash cam okay all right hey when's the last time you got to take it Mr Turner when's the last time you got a ticket we remaining silent right now say again I'm going to remain silent you're going to remain silent okay all right hey I'll be right back with you okay okay Mr Turner chooses to stay silent as long as the encounter unfolds as per the law for those who don't know the Fifth Amendment of the US Constitution protects citizens from being unreasonably self- incriminated watch how the traffic stop ends hey roll that window down a little bit more check that t all right give one second is a little bit more go ahead put your camera up here that's fine just do a couple more inches for me okay there you go me hold the camera so you can get the reading uh I see it 29.7 29.7 all right so you live up here now Mr Turner you living up here now I'm not answer any questions say again I'm not answering any questions why don't you want to answer any questions because I'm exercising my Fifth Amendment right now okay all right you do this all the time I can give you a business card after we finish say again I said I can give you a business card after we finish please we're we're done we're done this is warning for the traffic stop what was the what was the warning for what did I tell you why you got Rec got pulled over for falling too closely I'm not sure you were asking me question so I'm not sure if that was the reason why you were pulling me over so you were asking me if I was falling Too Close you ask me how fast I was going yeah but I still don't know why you pull me over cuz you were following the vehicle in front of you too close so okay okay that's why I got pulled over if you have all that stuff on your dash camera you'll you'll know it okay sure so when you go back and look at you probably see my car parked on the side of the road so so you living up in this area now not going to answer any questions I get your a business card or anything like that I don't have any with me do you have a business card I have one of yours yeah sure uh can I get your name and badge number it's hanning number 18 and your name and badge number Barker 12 am I free to go am I still being detained oh you're free to go so where's this at Mr Turner was eventually allowed to leave after they issued him a warning for following a vehicle too closely the cops also left the scene without any further action it's surprising to witness officers making mistakes in a profession that demands Flawless Precision if you like this video be sure to leave a like And
