Can I see your ID? >> Do you have your ID? >> He has it. >> He has everything. >> He had everything. He even took my money off my car. >> Whose apartment is it? >> His mother married. >> So, you're still trying to get everything out of her >> Arnold. >> Are you still trying to get everything out of there? >> I want my work clothes, my boobs, my clothes, my my social security card, my my credit card, all that. >> So, when are you trying to go do that? I showed you text message him sent to me and what I said. >> I said I'll be back. I'll be back with the police. >> Okay. >> And now I I sat up here until y'all came. >> You said he got away. >> I don't care where he got away. >> So, do y'all want to speak? >> Hold on. Hold on. Ma'am, do you live with Do you live over there? >> I was staying there. >> So, you've been living there? >> How long you been living there? >> Been over there more than 30 days. Two months. >> So, the state will press charges. I'm going to go see if I can make contact with him. >> Felony probation. I didn't want to do this. >> I will. >> I did not. >> Did you want to go with him to the hospital? Okay. >> Cuz I need a technical shot. He got me bad. I was going to go to work looking like this. I look pretty jacked up right now. I don't want to go to work, but I got points. >> You hear them? They say they going to lock him up. >> Well, I got to go talk to him, get his side, everything. I'll write a report and we'll see what we'll see where we go from there. Okay. and he hit his brother like his like he kept swaging over me hitting his >> go to the hospital with him, okay? So that you can get checked out. Let me go take care of this other half of stuff. Okay. >> Officers were not able to locate the suspect, but he was arrested 4 days later. A detective was able to interview him and get his side of the story. >> Do you understand each of these rights I've explained to you? >> Having these rights in mind, do you wish to talk to us now? >> Having these rights in mind, do you wish to talk to us now? I don't know what it mean. >> Like, do you want to speak to me now having been read those rights? Okay. All right. And do you know why you're here? >> Okay. Do you want to tell me about that? >> I mean, they said they belly. >> Okay. >> They said I b I don't recall it. >> Okay. Um, so what what's the last thing that you remember about that incident? >> I don't remember nothing about the incident. That's the whole point about it. >> Okay. Um, so you don't remember anything that happened on the 16th? >> I don't I don't remember nothing about >> Okay. So, how did the 16th start for you then? >> That was Sunday, right? >> Uh, I think so. Yeah, because the 17th was Monday. >> I was at home. We ain't hurting and I guess we were drinking a little bit alcohol and I don't know what happened after that. >> I swear to God. >> Is home. Okay. Um, and is it Ironicia? Is that your girl? >> Okay. Um, and who else was with y'all? My mom was there. >> Okay. What's your mama's name? >> Mary. >> What um were y'all drinking? >> Okay. How much would you say that you drank? >> Like a big over here. >> Was it like a big bottle, a small bottle, a handle? >> Big bottle. Guess I want to black out or something. Oh no in my life. >> Do you typically drink? >> I mean yeah sometimes like every weekend or something like that. >> Y'all get in altercations a lot when you drink or is this the first time? >> First time. days. I've never met a girl. >> Have you guys spoken since? >> Yeah. >> What was the last thing that you remember after drinking? >> I can tell you. Do you remember eating breakfast? >> Not yet. I can't remember. >> So, you can't remember any of Sunday at all besides the fact that you were drinking? >> That's all I can remember. That's why I even told nurse I think I might be coming down with the [ __ ] because my mom got it. [Music] >> I don't even know. >> Is there anything you think I should know about the case then? That's all I can tell you. I don't even know. >> I'm being so funny. [Music] >> Been crying all night because I >> cuz I can barely remember anything. Do >> you and your mama usually get along? You know, >> my best day was last July. >> Okay. Y'all getting like little spats or anything like that or is it just smooth sailing? >> Everything is smooth sailing. I never argue with neither one of them. I never blacked out ever in my life. My mama used to be on drugs and she had clean myself up. I got a priest. I need someone. So she let me come stay with her. And for me to come stay with I could have been paying all the bills by myself. And what hurt the most that I've been here? I can't help her cuz she going to have a job. >> Where you work at? >> I know. Um sometimes the jail can get you like a work excuse. That way at least when you if you get out, you can say, "Hey, this is where I was." Like they that way they can at least you'll be able to give that to them. I don't know if that, you know, changes what they're going to do with your job, but you'll at least be able to have something that says that that's where you were. You weren't just no calling and no showing. Do you have any questions for me about this? >> I mean, what is this for? >> So, the report that I have is from an incident from the 16th. It's a battery. Um, and all that we've got is that there was some type of altercation between you and your mom and it resulted in injuries to Miss and that you weren't there to be spoken to, which is why I'm here trying to get your side of the story. >> I was that I never my mom never opened the door. >> Open the door to what? The police. I think what she told her. I don't know. I know I was sleep. I guess my mama been sleep too cuz we wouldn't have not open the door and stop getting clothes. >> So where was um Miss when y'all didn't open the door? >> You don't know? You don't remember anything that happened, but you remember not your mom not answering the door? >> I don't remember cuz that's what she told. >> Okay. Did she tell you about anything else? >> She said the police was called that she charge that whole thing. Okay. >> So, the way that um family violence charges work is that if you guys have a family violence relationship, the state decides whether or not um to press charges and um >> so you and live together, correct? >> Like you guys stay in the same place. >> Okay. So, that's part of one of those relationships. The other part is whether or not you guys share children. And there's like a couple other relationships that qualify for you for that technical term. Um, and what happens is when we have we can establish that one of those relationships exist, by law, we have to take a report. If we're called to an instant where there's criminal allegations and then if we have probable cause, then we're then we're supposed to make the arrest. >> They cannot put it on a different level. So that that's one thing is like we we don't know that you were drinking. Like that's why I'm here trying to talk to you and get your side because I don't have half of the story. The patrol officers had probable cause which is why they signed the warrants. That's all that I can tell you about that because I wasn't the one that did it. I wasn't the one that responded to it. >> Probable cause. >> Probable cause is the level of proof that we have to work on. So when you are when somebody signs a warrant, that's probable cause. If you try to like loosely equate it to numbers, that's like a 40% chance that something happened. And then the court system works with beyond a reasonable doubt, which you're getting up until like the 90 95% sure that something happened. And when I say something, it's that specific thing. It's it's not we know something happened. It's this specific act happened. Do you have any history with family violence charges? >> No. >> No. I never hurt nobody in my life. >> Okay. Well, I will um document what you told me about drinking. And other than that, that's pretty much the only thing that I have left to do with this case. So, it'll be closed on our end once I document that. Okay. If you um remember anything or you want to talk further um you can let them know, okay? Cuz I'm Detective Nie. All right. You have any questions? Good luck to you. Okay. >> The suspect was booked for family violence battery and false imprisonment. Bond was set at $2,950. Nearly a year later on February 9th, 2024, prosecutors decided to dismiss both charges under a null proka, meaning the state chose not to pursue the case any further.
