Oh, when we get here, he's showing out. He see people. I'm I'm knocking on people doors. I'm like, "Call the police." Because he's not leaving my house. He want to go bust in my house. He threatened my kids. He said he'll put his hands on my kids and I don't play like that. >> You're not going to threaten me or my kids cuz they ain't did nothing to you. >> Okay. >> Where did he hit you at? >> These folks out here don't seen and heard everything. I just want my bro. >> Okay. What road? >> This road right here. Yes, that road right there. And I'm like, just hurry and take me home, bro. Just hurry and take me home. Get me to my house cuz I got my own car. I don't have to ride with you to work. >> So when we get here, he's like trying to bust in my in my in my door. I have my key in my door. >> You're not hurt though. I mean, obviously. >> N she just hit me in my lip, bro. That's it, bro. So, I had to fight him off of me. >> So, that's what I did. So now he's out here talking about he going to call this person, come up, pull up on me and do this and do that. I'm like, calm him. Do what you have to do because the TV that's in my house, I went half on the TV. You're not getting that TV. You That was a gift supposedly, >> but now you want to take it back. We're not playing them games. I went half on it. You're not taking nothing. >> First question, how long he lived here? >> He ain't lived here. He just been here. >> How long does he stay here? >> He been here for like over a week. >> So that's it. >> Over a week. But me and him work together. So he just I don't know why he flipped out today for no reason. See where she at? >> She on the way. >> Tell her Tell her Tell her you're okay. You're safe right now. >> I'm good. Mom, >> what this all started off? You came over here to to get the >> We was on the way to work. Boom. Okay. Hold on, Mom. I get out to go to the store. I hear the phone keep going. So I look at the phone. I see the message like she texting a whole another dude. So I tell her I'm like, "Damn, you want to do this?" Okay, cool. I just gonna go home back and get out your house and I go about my building. She go peace for >> Yeah. She go acting crazy doing all this running to get the like come on. I just want my I go. >> It ain't serious. Like I move on. It ain't nothing. >> Come on now. You've been honest up to this point. All these witnesses, >> you threatened my kids. >> Well, that's fine. But we need to know the truth. >> My kids. Yeah. I'm going to defend my kids. >> Tell us what happened. I'm beating on my foot. >> You mentioned something about some food being thrown out the window or something. What? Did any of that happen or >> I threw the food out the window? Okay. I'm mad. >> That's nothing. >> I think the kids are hiding again. >> Where's it at? >> Right by the door where Nick is. And then there's a live round right here on the steps. >> Okay. Just like doesn't phase normal. >> And he walking away. And my guess is to check see where the guns are. So I think inside the door obviously I can go >> there's definitely a gun. Yeah. As far as >> preserving the evidence right now the kids out or um don't let them close the door. >> I'm not playing no games. I do this stuff by myself. I take care of my kid by myself and I'm not letting no or nobody come in my house and ruin everything I got going on. I work too hard, bro. I do. And he know that. And he that why I said you a snake, bro. you a snake and all that. Why I don't have people around me cuz they be hating so bad. What you mad for? What is you mad for? Really? I'm going to get blessed in your face, man. I know what my heart is. >> Don't worry about it. >> All right. So, let me read you something. Okay. This is just because you're in handcuffs. You're not under arrest. You're just being detained because the situation, bro. >> Okay. Okay, we'll get you some >> my nerve real real bad. And I'm going to protect my kid by any mean necessary. I don't give a damn. >> Okay. Is your name's Britney? >> Talking about you going to break in my house. Break in my house? Put your hands on who? Man, you crazy. >> Okay. What's your name, sweetheart? >> You take her over there for me. >> One of mine. >> All right. Come with me, sweetheart. Okay. >> Now, when she shot the shot, where was she where was she pointing the gun at? >> Want that, bro? Whoever called you and said she shot a gun, ask them, bro. I'm not I'm not into that. I just want my Okay. >> I just want my >> So, what you have is clothes and a TV? I got I got clothes. I got two back two TVs and my gas system. Okay. And I get the on. >> He already about to be on. >> What is your name? >> My name is Britney. >> OKAY. >> YOU WANT ME FIRED AND EVERYTHING? >> STOP. We're not going to engage. Okay. >> They said and she said she was just kind of pointing it in his face and then it just went off. >> He the one going to go to damn jail. He the one on the on the run, not me. I ain't got no criminal record. You do. Okay. >> Damn fool. >> All right, Miss Britney. I'm just going to have you sitting here. Okay. I just want to smoke. >> We'll get you sorted in a minute. Okay. So, listen. I just got to because you're in handcuffs. I just got to read you. Okay. You have the right to remain silent. >> I think the kid is hiding >> so my next thing for you or you or whoever was in I'm trying to preserve it. >> Do you having these rights in mind? Do you still want to talk to us about the situation? >> Yes, I do. Okay. So, just so >> he got my phone. He said he threw my phone somewhere and I want my phone. >> Where do you know? >> I don't know where he threw it at. Where was >> He had my phone the whole time. >> Where was the last place you saw it at? >> In his hand. >> Okay. Were you in the car? >> No. >> No. Okay. >> I was looking for another phone so I could call 911 cuz he would not leave my doorstep after I asked him numerous of times and he put his hands on me. What else am I supposed to do? He threatened my kids. >> Okay. No, I >> No, you're not going to. He said he'll kick my door down and and put his hands on all three of my kids and you've been around my kids for how long? >> Okay. All right. >> Oh, hell no. >> All right. So, let's just go through it again. Okay. show that two colors when they mad. >> Okay. So, you said you got out of work. What time did you get out of work? >> I'm on my way to work. You're on your way to work. >> I'm I ain't down there now. >> Okay. I thought you said you were on the way home from Okay. >> Where's that? Right there. >> On strength and spent. >> Okay. Hi, guys. It's Sergeant Cook with Al Clark County Police Department. Who's all in here? You and your sister? >> Yeah. >> No, me and my sister and three years old. >> Okay. Tell your sister. Come here. I want to tell you. How old are you? >> 10. >> 10. >> So, what time did you go? You were in the car with them and you were getting >> after four o'clock. I picked my baby up from school >> because you were doing the daycare pickup truck. Okay. Okay. So, you pick up the babies. You come back. >> And I and I took my my my three-year-old to Chick-fil-A. Got her some Chick-fil-A before I dropped her off with my oldest to before my sister gets here off of work. >> Okay. >> That's what I do. Okay. >> I take care of him before I go to work. >> Okay. Okay. >> He talk about why you texting Jay. I'm like, "What are you talking about? How do you even get through my phone?" First of all, second of all, this date on here, did you not look at the date? It says August the 17th. It's the 29th, boo. Okay. >> How many times you start arguments with me, you shouldn't be worried about how who I'm talking to in my phone. I'm not going through your phone. >> Okay. So, you guys, >> so he hit me because of that. >> Okay. >> So, first thing, tell me what happened from the beginning when he showed up and that kind of thing. And all I know what happened is she came over here and she dropped my little sister off from daycare and she was heading to work >> and then they came back like 30 30 40 minutes later and they was fighting and I heard banging on the door and stuff. I did not open it. I asked >> Okay. When you heard banging on the door, where was your mom? >> My mom was outside and they was fight she was fighting with her boyfriend. >> Okay. Did you see that? >> What was going on? They wanted like he was like hitting her and stuff and my mom was trying to like stop him and stuff, push him away and stuff. >> Okay, >> this is me. This this is this is >> she is she wild? >> No. >> No, >> I just moved here. We were in the house. I come down here and I'm trying to like, okay, y'all chill out. It's kids, you know, they still going on. That thing I know she got a gun and my baby was hiding behind the car and I was like, do not shoot that gun. My baby is behind this car. It was I said and shot the mother. Whoa. You don't aim at me and the man here at you. >> Me and man >> for what? Why she pointing? She mad with him. G mad with me. >> So she just waving around. >> Yeah. Wait. I can't play like that. My baby. I know. I can't get another one. D. >> Right. >> Like I can't I cannot. And I asked you not to do it. >> You folk down there >> all the way at the end heard me say do not shoot this gun. My baby right here. >> And then what happened? And then that's when they were like it calmed down for a little bit and then it rolled back up, but it got worse. And then my mom told me to get his stuff out the house. >> And then he was like, "No, don't touch my stuff. I'll knock all of y'all out, including this including the kid." >> Where were y'all at when he said that? >> Uh, we were in the house. >> Where was he? >> He was outside trying to bust the door. >> So he was here when he said that? >> He was right here and we was like inside the door. We was trying to like push him out. >> What do you mean we were trying to push him out? >> Like we were on the other side of the door trying to push him out with >> Who was all on the other side of the door? >> Who was on the other side of the door? >> Oh, me and my other >> Does that sound right? >> Yeah, that's right. >> How did that make y'all feel when he was doing that? >> I was scared cuz he's like strong. And >> how' it make you feel? It's okay to say how you feel, brother. >> You don't know? Okay. I need to know where that gun is. >> That gun. >> That gun. All right. Let me tell you how this is going to work, guys, because we got to get that gun because it's part of this what's going on. So, if y'all don't want to tell me where it is, that's fine. But I tell you what's going to happen. I'm going to have to have you all three children come out of the house. We're going to lock it down. I'm going to get a detective write a search warrant. And then we're going to have to search the house for the gun. And I do have the leak. Listen to me. I do have the And you may not. But if y'all don't know where it is, that's what I'm going to have to do. And that means that's going to take time. But I have I'm sorry. >> Just ask. >> Well, she's saying she doesn't know. So, from the placement of the bullets and everything, I'm thinking one of y'all might have tried to help her out and hide it for her. I'm just telling y'all how this is going to go down. Oh, no. No, no, no, no, no, no. >> Time to get it. >> Yeah. >> Tell me if you're going to go get it. >> I'm sorry. >> Okay. Well, y'all stay seated cuz until we find that gun, I can't let y'all roam around the house. I'm sorry. >> Let me go talk to her and see if she'll tell us where that gun went. >> So, just kind of like slapping at you. >> Oh, he had a a close face. >> A close fist. Okay, that's what I was trying to figure out. >> So, now at this point, I'm defending myself. Was it I don't want to touch it. Was it right here is where he was hitting you or was it like more chest pain? >> Yeah, on this side. Just on on my left side. >> Okay. Can I lift up your shirt to see? Okay. I just want to see if there's any marks on you. Make sure you don't need medical attention. >> No, I'm good. >> No. Okay. Does it hurt at all? No. No. Okay. >> I'm not hurt, but my definitely hurt because you've been around my kids for how long? And you've been thinking like this and you and you come this come out your mouth that you will harm my kids. I am going to protect them at any means necessary. >> Okay. >> Took one bite out my damn food and now it's all gone. >> How did it get on the ground? >> He took it. >> He took it. Okay. Did he take it while he was in the car? Did he get >> He took it while we were driving. >> Okay. Did he throw it on the ground or did it fall? >> No. He's like this with my food. >> So, he was just slinging it around >> and I'm I'm trying to hold on to it because I just damn bought it. I'm hungry. >> Okay. >> This ain't how life's supposed to be. Okay. >> All right. >> Scared to death. She done seen a lot already. You know what I'm I'm sorry, but this ain't how it's supposed to be. >> You supposed to You go to school today. You supposed to come home from school and enjoy your day outside cuz it ain't raining no more. >> My kid don't even come outside. They in the house on YouTube or Tik Tok or >> Boy, that's the day in life nowadays, isn't it? Boy, I tell you, I swear to God, I'm on TikTok. That what I was doing. I ain't hear none of these. >> I got a eight-month-old. There'll be toys all over the place. Everywhere, right? You got toys. You got like 10 of them. >> Second I pull my phone out. >> There you go. >> That's all he cares about already. My key was in the door. He tried to bust in my house and I to I tried to get my key out though. He tried to have the key stay in the door so he can go in there. >> So I managed to get my key out of the door. Okay. >> And I managed to go look somewhere. I went down the street and ask someone can I use the phone so I can call 911 cuz he had my phone. Okay. >> Who knows where my phone? I don't know. >> Where did the firearm come from? >> I'm gone. I would never. >> We got to figure it out now cuz a bunch of lines. >> Is one that you own or is it a neighbors? I I have a I I own mine. >> You own Okay. Do you keep that on you at all times or >> I do for protection of stuff situations like this? Cuz I don't even know if he would have got in my house and he would have put his hands on my children. This man was out right. I had to actually fight him off me. >> Okay. What happened with the firearm? >> I had my firearm in my hand. >> Okay. >> Did you shoot it? >> So why are we getting reports that >> Oh no. >> We have multiple witnesses out here. Okay. Britney, you've been honest with me so far. So, I just don't want I I don't want my I don't want my kids in jeopardy. He just told me that he was going to make sure I got taken away from my kids. He just told me that he wanted me to go to jail. >> I believe he hit her on the way here. Had >> arguing. He was trying pushing on the door with her telling him to stop. The kids said they were on the other side holding the door in. >> He was saying, "I'll beat all your including your kids." So, we got probably simple assault, some that around her, some domestic violence charges. >> Problem is, they separated. He's out here. She runs inside, gets a gun, and probably shoots it in the air. So, we got reckless conduct on her, but he needs to go for his DV charges. So, >> yeah, >> we don't know where this gun's at. You mind if I check you for that gun? >> I've had You don't have >> Hey, I've been right here to hold just turn around so I make sure it ain't in your waistband. Put your hands right here. All right, officer. Bob, you put handcuffs on him. >> Why don't you put handcuffs on me for just Oh my god. >> Oh my lord. simple battery, >> simple assault, and maybe one other charge. I got to think about it. She is probably going to be arrested for reckless conduct. >> Battery for what? >> Yep, >> bro. Hell no. >> This girl out here was out here the whole time. >> Do you know where this all started? >> Yeah, by the cell phone. He had her phone and went through her phone. >> But do you know where it started? >> No, I don't know that. I was out, but I >> So, let me tell you, there's some things that you you came in like halfway through. >> Okay. >> Right. This all started down the road. They came down here. He was trying to push his way in the house. >> He was threatening to beat all the kids cuz they were on the other side of the door pushing the door shut, trying to keep them from getting in. That's what originally started. The issue with her right now while she's in handcuffs is because when he >> What going to happen with the kids? >> We figuring out where Look, we going to leave the kids alone. >> That too much. >> We ain't going to say good luck. But look, take into effect if this was you, if you were her and your kids are inside and you got a dude pushing on the door trying to get in, what do you want us to do? >> You know what I mean? >> Was she in the house at that time? >> Yeah. >> Oh, okay. >> You see what I'm saying? Like, we got to take action and protect you and your family and your kids. >> And that's the same thing we got to do for her. Even though she made a bad choice, we got to make sure the kids are good for the future. So, that's why. >> Yeah. I had to kick my door in. >> I know that. And your kids have verified that. And you see he's in handcuffs. He's being arrested. >> I'm just trying to protect my family. That's all what I'm trying to do. Ain't nobody out here doing that. Everybody just pulling out their camera want to record it. Listen >> to me. Listen to me. He's being arrested for the family violence charges. >> I'm on my way to work. Bro, >> the reason you're being arrested, and I'm going to be honest with you, is because you separated yourself, went inside, retrieved the firearm, come back, >> and what? >> Threatening. >> I know that, but you could have locked the door, called the police. >> You chose not to do that. Either you fired at him or you fired in the air. And that's the difference in charges. I need to know what's going on. >> Oh my god. cuz I know you fired. There's a spent shell casing on the step. There's also another shell casing where you probably racked like you see on TV. I'm assuming in an effort to scare him to scare him away from my house straightening my chair. >> But I got to know exactly what you did so I know which charge you catch or if you catch a charge. >> I sure catch no dang. >> Well, but you're not being 100% honest with me, which I need you to be. I know you shot the gun, but here's what I need to know. I know you went inside. I know you got that gun. Tell me what happened after that. After that, I was I was telling him to please remove himself from around my porch. >> Okay. >> He would not leave. >> All right. >> So, I fired it in the air. >> Okay. >> Okay. >> Fair enough. All right. >> So, he could leave, but he said he wanted >> Okay. >> So, I said no. Better yet, I'm going to let you stay here and suffer because you're trying to tear me down. Why? I don't know. >> I believe every word you're saying from what people told me. I believe that is exactly what happened. That's exactly what happened. >> So, here's the here's what's good for you for being honest. That means you're getting charged with reckless conduct instead of aggravated assault, which reckless conduct is a misdemeanor. Okay. So, what I'm going to do for you now, I'm going to call Make sure your aunt comes over here to attend to your kids. Okay. Is this your aunt? Is she have bright red hair walking over here? Thick lady with red hair, maybe. >> No, that's not her. >> All right. You want I tell you what, let's walk her down. >> What charging right there? >> Well, we'll get to that in just a moment, ma'am. My kids do not damn deserted. I'm just mad because you not part of what what the hell we got going on. Did y'all call D? >> Yeah, D's on the phone right now. She told me to stay on the phone. Are you okay? >> No, I'm not okay, baby. Because I did not even intend for none of this stuff to happen. >> He just made been around too long. He's upset because I don't want to be with him no more. Obviously, I don't know why he look like that. We were just fine, weren't we? >> Yeah. >> To get ready to go to work. >> Well, what happened? Like y'all came back to my phone talking about I was texting somebody else and I really was not. >> Can I please have a black and >> No, I'm serious. >> We'll get you sorted in a little bit. >> Bren, where do you think your iPhone is? >> I don't know. He said he thumped it somewhere. >> You think he threw it somewhere? >> That's what he told me. >> What? Sweetheart, >> he threw >> my mama's phone. >> Yeah. >> Where did he hit you at? >> He hit me everywhere. >> Okay. >> He just I didn't let him get on me too good. I follow him off me. >> I got This one ain't got no scratches on it. >> That's okay. I just want to double check that way I can say I looked. Okay. My feet bleeding though. >> Yeah. >> Me out here sweating. >> Sorry. >> Baby glad I already ate. Boy, I'd be angry right now. Britney, >> I get trying to protect your babies, man. Why you getting wild, dude? >> Because he was sitting up there. He threatened my >> Hey, I got you, man. But >> did he not just say that to y'all? >> No, I Britney, I believe you >> Britney, I believe you. on my porch and he's about to bust in my door. I got a camera right there in my window. >> Sure. Thank you. >> Does it record? >> Yep. >> Where's the video? >> I need to find my phone. It's connected to my phone. He threw my phone. >> Hell, I'll find it now. >> He don't look like he can throw very far. >> Big doing all that talking without me. She would have been put out. >> And then after this, I don't want nobody else. I swear I don't. That's what we all say, bro. >> Two, three months later. >> Unless you don't ask me cuz two, three months later, you hear >> you say that Christ. >> But he's different. >> It's probably going TO BE WORSE, AIN'T IT? >> BUT HE'S DIFFERENT. >> I'm just trying to go to work, make me some money today. You talking about what's in my Zakari? You know, I said I don't want no man. This one's different. Go. Now we all >> What the heck is going on right now? >> Why can't we just have a good day? >> I don't look for your phone. Sweating. So you got an iPhone? >> Yeah, he threw it somewhere. >> Do you not have like a Is that iPhone? >> That's hers. >> Can you use it to find her? >> He just He just want to do all that tough stuff. >> Can you use her phone to find yours? >> You have to call it or find it. Track it. >> You have to find my phone thing. >> You want to be tough? Go to the damn army. If it does, then it'll show last location before it dies. >> I just want to make sure it's still here on the property. >> Somebody pick it up. >> Close. It's like somewhere. >> Can I see it? >> Mhm. >> Pretty please. >> I don't get that. >> Should have never put your hands on me, bro. Don't put your hand on a female. >> I didn't even hit you first. >> I can see if I would have put my hands on you first on me. >> Hold up. Now it's moving all over the place. Which one's me? >> That one is the phone. That one is out. >> So, I knew you was playing with my feelings, bro. I knew you was doing something. >> What? What are you talking about? >> He just jumping to conclusions. >> They've been doing this stuff since we first start talking. I I missed the red flag. >> Mama, you can't be doing that. >> I know I can't. I know I can't just trying to be a good person. >> Is pissing a bad word? >> What >> is pissing a bad word? >> Almost. Close enough. >> You probably get in trouble for school for saying that. I bet. Knock my car. >> Jesus Christ. >> This dupus is hitting the button. >> That's my fault. >> Yeah. Go put her in Tessy's car for right now. >> Yeah. Let me I'm going to go give it to him. >> Hey, you know what? >> This ain't yours, right? >> No, that's not mine. >> Okay, >> here you go, bro. >> You give this to your cousin. >> Where the hell is her? >> Huh? >> Where's her? >> I got it. I It's in my pocket. >> Okay. >> It was in my car. >> Thank you. >> Talking about he going to call somebody to come put their hands on you. Call somebody if you want to. >> Now that they know there was indeed a pistol involved, the officers interview her children again, but this time separately. >> So, you know what the difference in the truth and a lie is, right? >> Yeah. >> Okay. What's the difference? >> As a person that um tells like tells stories, >> okay, >> and doesn't tell the truth. >> So, we're deciding who gets in trouble here. Okay. Unfortunately, you know, sometimes adults make bad decisions. It's not the end of the world. We can move forward, but we need to be truthful about what happened. Okay. >> I'm here. >> Okay. Tell me what you saw. I looked outside. My mom had a gun cuz my mom's boyfriend kept on hitting her right in the car cuz like >> Okay. Did you see that or did you hear about it? >> I heard about it. >> Okay. Did you ever see him hit your mom out here? >> Yeah. >> All right. Tell me what you saw. >> Well, my mom told me to go take your monitor. He said don't touch my um he don't she said don't touch it. And then I went to go take it and then he punched my mom. >> Okay. Where was that at? >> Right here. The front yard. >> So you saw him hit your mom? >> Yep. >> Okay. How many times? >> Once. >> Just once. Where did he hit your mom at? >> Right here. >> In the arm. >> Yeah. >> Okay. >> I just stayed there. I'm like trying to wait till it calms down so I can open the door and ask what happened. But it never really ended up like calming down. It just got worse. I was just like stressed out cuz my baby sister's right there. My little brother's upstairs playing the game. And I'm like, >> "What do I do? What do I do?" Cuz I'm the only one downstairs trying to figure out what's happening. >> Okay. And I when it calmed down and everybody was away from the door, I opened the door and I looked outside and I asked what's wrong. She explained everything to me. They they was fighting because he thought she was cheating. And that's when he was like started like smiling when she got her gun and stuff. She was like smiling and talking about some shoot me and stuff. And I'm like, >> okay. >> So, um, you said when it settled down, you opened the door. Did your mama come in at that point or was she still outside? >> She came in one time and then she went back out with her gun. Okay. >> Did your chain come off? >> Yeah. >> And your tire's flat, too? >> I know. >> Did he really try to get in that door? >> Yes. >> Okay. Well, you didn't tell me about that long ago. Tell me about that. What happened? >> Oh, yeah. He tried to get in the door after my mom said go get his monitor. >> Okay. Tell me in the line of events of what you've already told me. >> Um, she's knocking at the door and then I look out the window to see who it is. I see Ren Dar and my mom about to fight. >> Okay. >> So, I open the door to tell him to stop. >> Okay. After that, he she hit him like, "No, no, no." They came over here. She He was about to hit him. She was about to hit him, but still she didn't cuz she had >> I couldn't hear you. >> And then she grabbed her gun cuz she thought she was she she said he was about to um get he said she was about to um blow all of us up. After that, my mom got her gun out our house and things. >> Well, you you left out the part where he's at the door. >> Yeah, he's at the door. You didn't tell me where he's trying what he's trying to do at the door. >> He was trying to like bust in the door cuz he didn't think it was locked. But we locked the top lock. >> What does that mean when you say trying to bust in the door? >> Like he was like banging on the door trying to like do that. >> Okay. How do you know he's done that? >> Because I I see him out the window and I hear a loud banging out the door. >> Okay. And when did he hit your mama during all that? >> After I went to go get his mother. >> Thanks. >> What was your mama saying? >> She was also cussing him out. Okay. And she was I I don't really remember much of what she was saying. >> Okay. >> She was just cussing him out. >> Okay. Okay. Um you said she had the gun. Was she holding it or was it in her pocket or do you know what she was doing with it? >> Um she was holding it and telling him to leave or was like she would have to call the police or something. >> Okay. Was she pointing it anywhere or was it just kind of pointed at the ground? >> It was >> at the ground. How did she shoot the gun? >> I didn't see I had went upstairs to go tell my brother what happened and when I came down I heard a big pop. >> Okay. And I look out the window. I don't see nothing happen. I just see her with her gun and it's still pointing at the ground. >> Okay. >> Yeah. I know he [Laughter] >> But no like that for real. >> Rand don't been around before. We f to fight somebody and he stopping and we get mad at him. We want to jump on him for stopping for breaking it up. He don't like confrontation. Period. >> I can see it. >> Here's what I want to clarify. I've got witnesses that saw you trying to push in that door. Why? Why was that happening? >> Who's trying to push in the door? >> You. >> I didn't never push in no door. >> Well, I've got multiple people telling me that you were. So, why would that be the case, >> bro? I never went I the first time when we first pulled up, we went on the doorstep. Boom. We thinking I'm thinking we going to go in the house so I can get We already agreed to that on the way here. >> Okay. >> So, when we get here, get on the doorstep. She go to yelling. Boom. She run down there, get on the phone. When she get on the phone, I get on the phone. Boom. Then when she when y'all say y'all was on the way, I called my cousin like pull up cuz I don't know what what's going to go on. She called the police. Then when she when she hear her say that she's on the way. That's when she's running in the house, grab her gun or whatever and come back outside and go to waving it. I tell like I'm like if it's that serious you going to try to shoot me, shoot me. I'm not scared to die. Shoot me. That's when she go to waving it and shoot in the air. And the girl right the lady right there tell >> I know that part. I feel comfortable with that part. Now, not now time have I tried. The door came open. The kids try to come out the house when she while we both standing right there. She go to pushing them in herself and trying to slam the door. The kids trying to come out. She's pushing the door in herself. I never touch that door. Not Not now time. I was on the phone with my mom the whole time. >> Okay. >> Well, you you on your phone with your mom later in the event. >> No, >> I'm talking about what happened before you were on not on your phone. >> Then nothing happened when we pulled up. She goddamn ran to the the lady house and called the police. >> Why did she run to the Why didn't she use her own phone? >> Cuz she didn't have the phone. Her phone was in my car. >> Phone's in your car. >> The phone was in my car. I just gave the phone to one of the police officers. >> So why did you have her phone? >> Her phone was under the seat. She didn't try to get her phone or nothing. >> She just jumped out the car cuz she's mad. >> Right. But you had the phone when we arrived. >> Yes. I got I went in the car and got the phone. Yes. >> Why would you go get her phone? >> It's in my car. I didn't want her back in my car. Even the folks phones she [ __ ] using even not to even seen like asking. >> Have a seat in there while we talk this over. Okay. >> We're just trying to figure it all out. >> All right. >> I will explain to y'all >> what we know and what we learned and what we're doing. I'm getting this way because I feel like I'm looking upstairs if I'm if I'm I'm already short enough. We got to go on the evidence. Okay. So, I'm going to tell you the story and then what supports both sides including y'all's testimonies, things of that nature. Uh, and I tell you this because your family and you wanted to know. Her story is that they're driving down the road. I guess he suspected her cheating, went through her phone against her will, found text, which apparently she admitted that to you and she was texting someone, >> which leads credence to me that that's probably what they were fighting about. That point she says he starts smacking her in the face. She says he takes her phone. I think that part is true because one, cuz he's saying, "No, no, I just got it afterwards out of the car." If it was in the car, cuz he's like, "She could have got her phone in time." there would be no reason for her run to the neighbors, bang on all the doors, asking to call police. >> Just reasonable. I think he was angry, lost control in that spec, took her phone cuz he's also admitted going through it >> to find the boy. >> Might be true. Take another. >> Correct. He says he never laid a hand on her right here. The problem we have is Jaws counts allstar after whatever first happened out of the car, >> right? She has multiple like it looks like she's been dragged across the cement like uh not bad but she definitely has marks on her legs and her feet. >> Is that fresh? >> They're definitely fresh. Yeah, they're bleeding. >> Uhhuh. >> Um so what that tells me is some sort of altercation occurred. >> Now if he said, "Hey, she was if she was hitting on me and I defended myself and she fell down, maybe that explains that away." You see what I'm saying? But with going, "Nope, never touched her. Didn't touch her at all." Doesn't make sense with the injury she has. Did you say he lived? >> I do. >> Okay. >> Yes. It sounds corny, but who caused the most damage? >> It's weird, but that's how the law works. In Georgia, you cannot lock up both parties. You have to find out who the predominant aggressor is. That's why domestic violence is very hard. >> Say it's a man. >> Not always. No. I've locked up plenty of women. I promise you. With his story, like I said, of I didn't touch her, her injuries. We're ruing him as the predominant aggressor. So, he's getting simple battery and criminal trespass. for trying to get in the house >> while the kids are pushing. I might pull the criminal trespass because he does live there. He's been living there for three weeks. >> You see how I think it as I as I go. So, he's definitely got simple battery. Her charge, she went and got the gun, shot it in there, reckless conduct. The difference why it's not aggravated assault, I heard you wanted more, is because both y'all stories, but especially your daughters, is she did bring the gun out. And you tell me if I'm wrong from your statement that flashlight that she is waving around, but she's more waving it up in the air when she's saying anything. She never points it at him. >> She did. See, she was dope behind his car. Skyler, by the time she seen his gun, Skylar had no d. >> So did. >> So by this time, she I have to go on the statements that were given to me. And the fact that she didn't shoot it at him, she shot it there. That would qualify as reckless conduct, not assault. So they're both receiving probably one misdemeanor charge. I don't like jail. He don't want to be in and out of jail. >> I understand. >> He just said he's on probation for high speed, chasing, drinking. >> Do you know if it was out of Alton Clark County or if it was a different county? >> From Monroe. >> Monroe. Okay. >> Can I talk to him real quick before I go? >> I don't have problem with that as long as >> No, you're fine. >> Right there. Did you drag that girl on the ground? >> That girl's a welder. She's getting >> Will you grab her Jordan bag out of the trunk? We're going to show it to him. Make sure it belongs to her. Then I wouldn't pound your car. I will get a search warrant and I'll make you get it that way. >> We want to play. LISTEN, I'M TRYING TO EXPLAIN TO you the TVs or joint property. I can't prove that. I can prove a bag belongs to her and her alone. >> I'm tow the car. Just going to tow the car then, buddy. >> I get it. >> Thank you. >> Please start your message now. Hey, my name is Britney. Calling because I'm not going to be able to show up today. Um, I have a situation that I just work for yesterday. So, I was just calling to speak with someone about that. Someone please give me a call back at 76. >> The male suspect was booked for battery family violence, criminal trespass, family violence, and disorderly conduct. His bond was set to $2,900.
