Once he is secured and cuffed, this officer will tell you. Okay. >> Did y'all ask him what happened? Did y'all ask him for his statement? >> Obviously. Yes, ma'am. >> Did he tell y'all that that somebody ran him by? And then we also spoke to all the witnesses around. >> No, they asked me >> and found contradicting information. >> No, they was making sure to see if he wanted medical attention. >> Medical. Okay, they can take me then. Let me out the hand. They can take me. >> They can take me. >> They can take me. Let me go. They can take me. >> Nope. >> Too late. >> Too late. >> No. No. They asked me. >> We did give him an option. He walked out the back of the ambulance under his own accord. >> I I asked them, "Can I come see my kids?" They said yes. That's not what I was told. I was told you refused all the MS. You were getting out of the truck under your own power. He >> is custody. He cannot. >> NO, NO, NO. WHAT? THAT'S That's not right. >> I will explain all >> still. Y'all see still pulling on me, but it's still hurt though. We will take care of you. >> That's what he want. And then requested to give his stuff. Y'all supposed to say on my chill out, bro. Chill out, bro. >> Take him to the car. Let's do what we got. >> No. No. No. No. Man. No. No. No. Rich the car. No. No. You're going to walk to the car. >> It's that simple. >> We didn't want to. >> We didn't want to either, but he pulled himself over here and he he tied our hands. >> All right. So, I will tell you what's going on. You're his mom. Yes, ma'am. Okay. >> Okay. So, you saw how the car was. >> Do you want to You want to hear what's going on? Then you can come over here and be part of the conversation. Okay. Cuz I'm telling your mom now. All right. When we first got here. >> Hey, man. No. Give my mama my stuff. >> I will. We'll give her all her whatever you want to try. >> Excuse me. No, no, no. This lady, the same lady I was sitting there talking to. The same lady I was just sitting there talking to. What y'all doing for Cuz you are walking. >> I'm in pain. But y'all see it still. >> You went in too much cuz you got down. But >> no, cuz I'm just trying to see what's going on. >> He seat belted in the car. Obviously a bad wreck, right? I can tell you that speed is absolutely involved in this wreck. Okay. I was an accident reconstructionist for 11 years, so I am familiar with the dynamics of a crash and and what happened here. While I'm talking to him, I can smell the odor of alcohol on his breath. The officer that's working this wreck, I've informed him of this information and asked him to look into it as a possibility being under the influence based on the dynamics of the crash. Okay. He admitted to having alcohol about 6 hours ago is what he said. Had he chose to go to the hospital with EMS to get looked at, that's what we would prefer because he has been in a wreck. We are going to take him anyway and get him medically cleared because that's what's right. Okay. The way he is acting is not normal for someone that's not under the influence in my opinion. Okay. So, with that, he has now refused EMS transport. That's what the male EMT was talking to me about. Now, he's trying to get back over here. We can't let that happen. We have a suspicion that he's under the influence. We have to act on that. Okay. >> Okay. The reason we don't let people go digging into his pockets for things is cuz I don't know what's on his person. And you taking evidence off of him is bad. Okay, maybe he was texting on his phone, too, and we want to download that phone and get that information. You cannot be taking things off of him until we have done a complete search. >> Well, I'm sorry you don't care, but we are doing what's best and what is right. >> Can I talk to my mother, please? My mother right there. >> How many pairs of pants you got on? >> I got on a uh pair of draws, a pair of gym shorts, and the uh the the red pants. >> Your shorts got pockets in them. >> Uh yeah. And you nervous? You over here shaking like hell. What you shaking for? >> I ain't nervous, dog. >> No, you nervous as hell. You over here shaking like a mother. No, don't do that. No. But look, I just asked these people, bro. And they these people just gave me a chance. >> They just gave me a chance. >> You want just to go to your mama? I want to talk to my mama. I didn't ask if you wanted to talk to your mama. >> Well, you don't have a choice. >> Okay, they go with you then. Look, my mama's right there. And my kid standing right there, bro. Please, bro, let me just say, "Hey, there's something wrong to my kid." Please, bro. It was it just respect, bro. If I I it say the other way around, but I do the same thing for you, bro. >> My kid the whole time they sitting on the phone, they hollering my name the whole time. >> Your money's in your pocket. >> Can I talk to my kid? >> No. Can I come to the car? >> I asked you if you wanted to go turn your stuff over if you didn't want to. You You didn't You didn't offer me nothing. >> Watch your head. Get in. Sit down. >> Come on, man. I got to do stuff like that, bro. Why y'all think clock kind of up now? >> Three on the other >> hot right now. >> I'm not about to be. One second. >> It's not my daughter. >> Oh, okay. >> I'm sorry. >> I don't I've got kids, too. I would hate for my kids to have to see that. But when he keeps walking this direction and ignoring what we're telling him, he puts us in a position where we have no choice. I cannot let him get in the car. >> Right. And that's for our safety, this kid's safety, everybody. >> I know. I know my I know I know my rules and all this whatnot. I'm going to read you something. All right. >> Y'all ain't wrote me nothing. Y'all ain't Y'all ain't read me nothing yet. So give him my phone. >> He's just going to read you something. Listen. >> No. No. No. You should have did that before you put me in handcuff. No. You should have did that. No. No. I know the law. I do know the law. You should have did that before you put me in handcuff. >> Okay. Listen. >> No. I ain't know. >> Just read it. >> No. No. State of Georgia has conditioned your privilege to drive upon the highways of the state upon the submission to state of your blood, breath, urine or other bodily substances for sir. >> We put man handcuff no law. He just not read >> your Georgia driver's license or privilege to drive on the highways of this city. >> Will be suspended for a minimum of one year. >> Daddy, come here. Your refusal to submit blood or urine testing may be offered in into evidence against you at trial. >> Bro, you just >> if you submit to testing and the result indicates an alcohol concentration of 0.08 no why they walked up why you just told them back highways of the state minimum period of one year. >> Look sir sir excuse me. After first submitting >> Excuse me. Excuse me. EMS. >> After first submitting. >> He's just not reading the request. He's just not reading me this. >> You are entitled to >> Will you submit to the state administer chemical test of your blood? >> Huh? >> We need to go get him cleared. >> Yes. >> Come on now, bro. I've been in the car 20 minutes. >> He just needs a yes or no to his question. Sir, >> why got to be over there? >> I'm not. >> Yes, y'all is >> Why Why you think my mom just pulled off? Cuz y'all just >> I need a yes or no. Yeah. Yeah. >> Yes or no? >> Yes. No. For what? >> Will you submit to the state administered chemical test of your blood? >> Nope. >> Fair enough. >> What that mean? >> All right. Watch out. >> What that mean? >> We're done. Watch your head, sir. >> Come on. I have not did nothing wrong. Bro, >> if you would have cooperated, it wouldn't have turned out like that. >> No. No. I've been trying to make sure with my car like like y'all have told me where my car going as soon be on the way here. I could have already had that straight, man. If I was on my way to my kids, somebody ran somebody ran me off the road. >> What would have worked out better for your kids? You to comply and talk to me or >> I tried to talk to you. >> You didn't talk. >> What would happen if I >> It wouldn't have turned out like this. >> That can't >> If you would have talked to me, you would not have been arrested. >> Y'all can't sit here and run this. So, I can't sit here and run in the store and just see who ran me out the road. >> I'm in a right. People came to my car like, "Are you okay? Just wait on the police." Somebody called the police for me. >> I didn't call the police. >> We spoke to everybody. >> So, what did you say? >> You'll see that in the report. >> You see the report, but I'm getting arrested for what? >> You'll see that in the report. >> What? Can I see my citation? >> It's DUI to maintain lane too fast. >> No, no, no, no, no, no, no, no, no, no, no, no, no, no. That's what I just got charged for January the 4th. How you going to charge me with the same thing? Come on now. How you know? No. >> You got a DU on January the 4th? >> I just seen you just pulled everything up from January the 4th. >> I know. >> I just seen Bro, bro. No. Hell no. >> We're We're talking about what happened today. Okay. >> How you know what happened today if you can't prove what happened today? >> That's what we're doing here. >> I can't. >> No, you cannot. You ain't did it yet. So the point of me sitting here was >> That's what court's for. >> Yeah. >> That's why you have court. Why you think I'm getting footage from them from January the 4th? >> I don't even know what you're talking about. January >> January the 4th. I got pulled over. They I'm getting my footage now. >> You're getting what? >> My footage. >> Your footage? >> Yes. >> From January the 4th? >> Yes. >> Okay. >> So, my all my cases can get dropped. >> Okay. >> Just like today, somebody ran me off the road. Y'all ain't trying to check y'all footage or none of that. Y'all ain't trying to go across the street, sit at the gas station, and see what's went on. Somebody ran me off the road. But were you in the center turn lane? >> I was on the outside lane. >> On the outside? >> Yes. And somebody trying to get over in front of me. That's how I came around the tree. >> Okay. >> End of the day, >> you're driving while you're intoxicated. >> No. >> You told me you had been drinking. >> Oh, yeah. I have, but it was early in that day. >> That still doesn't mean you can get behind. >> This became I before I did before you guys >> just before I came down the road and jumped in that car. That's before I came down the road and jumped in that car. >> All right. >> I had just got there and put a motor in the car. >> Just going to go ahead and read you this if you want to keep talking. Okay. >> You have the right to remain silent. Anything you say can and will be used against you in the court of law. >> You have the right to speak to an attorney >> and to have an attorney present during any questioning. If you cannot afford an attorney, one will be provided >> knowing and understanding your rights as I have explained to them to you. You can stop. You can stop. Okay. But if I'm in handcuff, does he supposed to read what he just wrote me to? >> No, you read that. >> No. No. If I'm been under arrest, you supposed to read it to me first. >> If it's going to ask you any incriminating evidence questions that was asking for your state administered chemical test of your blood, you said no. >> Okay. After the afterwards, what they supposed came after? >> And then you we didn't ask you anything afterwards. Put you in handcuffs, put you in the car. >> So So after you put me in handcuff, don't you supposed to ring me my rights? Don't have to. >> You don't have what I'm sitting here for then. >> Why would I read you your rights if I don't ask you any questions? >> Are you going to listen if I read it to you again? >> No, sir. >> You don't want me to read it to you? >> Why? What's that? >> If I'm being under arrested. >> If I'm being arrested. >> You are arrested. >> But why would you wait till now? They ask me that. >> He's asking you questions about your earlier experience today. >> And you're in custody. >> That's not No, man. Thought you knew law. >> I knew.
