That's fine. Then she can sit in the back of the cop car until she doesn't want to have an attitude with us. >> Car came and cut her off. >> Okay. >> And I seen when she swerve tried to dodge me. >> How did I failed the sobriety test though when I did everything? >> You racist. >> Mom, I I was literally >> on July 30th, 2022. Officers responded to an accident that just occurred. The caller stated that a vehicle flipped multiple times in front of her. The witness statement and the driver's statement weren't adding up. >> Hey, is anybody in the car? >> Um, she's right there. >> She's out. Okay. Are you involved? >> Um, no. I just witnessed the whole thing and get I had some water and my car, >> but it's her. Okay. All right. >> I know. Is that okay? >> Give me a second. Let me get your information just so we can get it for the witness statement, but then you'll be good. Okay. Are you okay, sweetheart? All right. >> I kind of like probably hit my knee or something cuz it's hurting pretty bad. >> Is that blood or dirt? >> That's dirt. It's dirt. No cut. >> Yes, it's dirt. >> Okay. >> I probably like my finger is swollen. This hurt so many. >> Oh my god. Sweetheart, let me just look at you. Too >> bad. Only Let me just look at I want to make sure. Okay. Do you need EMS to come look at you? >> I don't think so. Like I don't I didn't hurt myself. That's crazy. >> How about we have You don't have to go with them. How about we have EMS come look at you? >> That's fine. >> 73 Central 28. A white Chevy Malibu fire sensing. You got incredibly lucky. >> I got really lucky. >> What's your name? >> So lucky. Ashley. >> Ashley. Are you the registered owner? >> Yes, ma'am. >> I'm not with the registered owner. >> All right. Is your ID and everything in the car? >> Everything I don't >> Okay. All right. What happened? >> Um to be honest, somebody cut me off and I was like, I slurped a little bit and lost control. >> Okay. What lane were you driving in? >> This right here. >> This one. Okay. So, you were coming this way. Okay. All right. She's Yeah, she's right here. Let me get your information. >> Y'all did. >> What did you see, darling? >> Um, >> I don't really know. I had my Apple CarPlay up. I'm looking at my maple directions. Um, she kind of just went off the side and it flipped. >> Was there anybody in front of her? >> Um, I mean, there was a couple cars, but not to where >> anyone Okay. All right. What lane was she in? You remember? >> Um, this one. >> The innermost lane? >> Yes, ma'am. >> All right. What's your name, sweetheart? >> Um, legal. Yeah. >> Elizabeth. >> Elizabeth. Okay. Yeah. Whatever's on your ID. Da or FA? >> C. >> Okay. All right. Your date of birth? >> 03. >> So, she was in the innermost lane and you said you just saw her swerve off to the side. >> Yeah. >> Okay. But there was nobody else. As far as you could tell, nobody else was around her. >> Okay. >> No, ma'am. All right. >> The way I asked if she's like fine. >> I I asked her. She said she was fine, too. And I said, "Why don't we just have EMS and look at you?" And we're going to do it that way. Um, and then that way we can say she was looked at. She declined. >> I'm fine. Yeah. >> Thank you. All right. If um we have any questions, we'll give you a call, but you're good. Thank you so much. >> I think if you rush over, you can go after that car. >> Yeah. Thank you. >> She told me that there was somebody in the lane and cut her off and she veered over. Elizabeth said there were people around but not anywhere close to her and she just saw her drift over. >> Yeah. I didn't I to me based on that including way back here she was probably texted and not paying attention swerved over corrected and landed. >> Yeah, >> that's what it looks like to me. >> Yeah, her story sounds more plausible than somebody cutting her off. >> Yeah. So, >> I can stay here safe. >> I don't really need anybody else. I mean, it's pretty cut and dry. >> All right, >> I'm good. Thank you for coming. >> Yeah, >> thank you. >> 73 Central. Could I get a next in line, please? Also, make a note part of the guardrail is demolished. Miss Ashley, what's a good phone number for you? Five. >> Have you been drinking at all today? >> I had one at the bowling alley and that was it. >> All right. >> But other than that, >> I'm smelling alcohol coming from. >> How How far How long ago was that? >> Maybe like 10. We're literally like 5 minutes away from >> She was right behind me. >> Yeah. And when they cut me off, I swear that was all right. Well, because I'm smelling it, I I need to do fieldy to determine if you were safe to drive. >> All right. All right. Give me a second. Uh, this 73 central. Can I get another unit? I think it might be a signal one. Were you wearing your seatelt? >> Yes, ma'am. That's the only reason why. >> All right. So, honest with me. Were you wearing your seat belt? >> Yes, ma'am. I uncipped myself >> and fell to the [ __ ] to the top and then I pulled out cuz I smelled smoke. Okay. >> There was no way I could have lived through that. I smashed. Okay. All right. All right. All right. Were you on your phone? >> No, ma'am. >> No, >> my phone was on the other seat next to me. >> Okay. All right. When did you say your last drink was? >> No. No. Your last drink? >> Um, maybe about 20 minutes ago. 30 minutes. >> All right. And what was it? >> A Miller Light. >> Okay. Was it a can or a glass? >> It was a can. >> Okay. And you only had one, you said? So, what I want to do is I want to do some field sobriety test to determine whether or not you're safe to drive. Okay. >> You driving in the bastard? >> Uh, I was in 91. >> Oh, got you. That's your car up there. Okay. >> My knee kind of hurts. So, >> Okay. All right. Well, first thing we're going to do, we're going to do an eye test. Okay. So, do you have any medical issues with your eyes? >> Not that I know of. I've never Have you had any uh head trauma recently or any kind of head injury other than accident? >> Yeah. >> Okay. >> All right. So, first things first, I want you to stand, feet together, hands down by your sides. All right. >> She was right behind me. And >> did you see what happened? >> Oh, I was right in front of her. >> Yeah. >> And so I was just looking in my uh side mirror, make sure everything is dead, whatever. >> Yeah. >> And so a car came and cut her off. >> Okay. >> And I seen when she swerved try to dodge it. >> So what we're going to do is finger. Okay. The tip of my finger where that fingernail is, I want you to focus on that. What I want you to do when we start the test is I'm only going to move my finger. You only move your eyes. Do not move your head at all. You're going to stand completely straight just like this. Okay. >> Okay. >> And so I guess she she panic whatever. She hit a break soon. >> Hit the uh hit the guard rail. >> And I stop right there. Ran as fast as I can. >> Yeah. Good. I mean good. I'm glad she's all right. >> 73 central. Will you lose one check, please? >> Man, that's she's like be alive. >> Yeah. All right, the last one's going to be vertical. Okay, so same exact thing. Just focus on my finger and it's going to go up and down instead of side to side. Okay, so next is going to be a walk and turn test. Uh you said your knee's hurting a little bit. Do you think it would inhibit you walking in a straight line? I >> don't think so. I limp a little, but Okay, that's fine. As long as you can walk in a straight line. What I'm going to do is have you back up cuz I don't want you running into the car. You can turn around if you need to. So, I want you to come about right let's just say right here. So, what we're going to do, I'm going to put you in what's called the instructional stance. Okay? So, you're going to put your left foot forward. Put it on that line. You're going to put your right foot with your >> Now, we're going to get lucky. >> Your heel in front of your toes like touching your toes of your left foot. Okay? Then feet your feet stay like this. Stay on that line. Arms down by your side. Okay? So, stay in that position while I give you instructions. Okay? What we're going to do is a walk and turn test. What's going to happen, and I'll I'll um let show you what we're going to do, is we're going to take nine heel to toe steps forward. Okay? Um once we get to the end of the nine steps, you're going to take a series of small steps around and take nine more heel to toe steps at the uh uh back. Okay? You're going to keep your hands down by your side. I want you to count your steps and I want you to watch your feet. Okay? I'm going to show you how it goes. So, I'm in the same stance you are. Hands down by my side. I'm watching my feet. Watching my toes. And you're gonna take nine heel to toe. I'm gonna take three, but you're gonna take nine. So, Oh, no. Don't start. Yep. Don't start until I tell you to. >> All right. So, I'm taking three. >> One, two, three. >> Series of small steps around. Okay. And you're going to take nine back. One, two, three. Like I said, you're going to take nine. Okay. >> Okay. >> So, you can begin whenever you're ready. >> The next one we're going to do is a balance test. Okay. So, um I know you said your knee's hurting. Do you think you can balance on your other leg? >> Yes. >> I mean, >> maybe. Okay, we can try it. And if you can't do it, then we can stop. Okay. So, what I need you to do, feet together, hands down by your side. I need you to stay like that until I tell you to start. Okay. So, this is a balance test. What you're going to do is pick a foot. I don't care which foot it is, but you're going to raise it about six inches above the ground. Think like a coat can under your foot. What you're going to do is look at your toes. Keep your legs straight. No bending of the knees. Okay? So, you're going to watch your toes and you're going to count out loud. 1,00 1 1,002 1,003 so on and so forth. And when I tell you stop, you can put your foot down. Okay? Keep your hands down by your side. Okay? All right. You can start. >> Keep foot up. >> 14. >> Keep looking at your toes. You look at your toes. >> 2016. >> Okay. You can stop. All right. So, okay. Uh, I think they wanted to look at you real quick. She smells like alcohol. >> Yeah. Hold that marijuana. >> No. So, EMS hasn't looked at you. Why don't you have them look at you real quick? Okay. And then we can get them on their way if they need me. So, have you guys looked at her already? No. Okay. Yeah. So, >> it's just her medication. >> What is it? Have you taken your medication today? >> This morning? 5:00 this morning. Like work every day. >> Okay. So, her eyes were bouncing a little bit. >> I just sort of like I didn't see any of them. savage, but I was in absence. >> So, maximum deviation her eye, it would bounce back in. So, we got a couple of that. Um, >> she missed one kid in the toe coming back. She missed the improper turn coming back. So, >> yeah. >> Yeah. She only had eight steps going forward. >> Yeah. >> So, a couple of clues. So, I think it's signal. >> I would go alcohol multi. >> I'm going to do blood test. >> Yeah. Multi substance. >> She demolished this guard rail. Yeah, she told me that um there was a car traveling and they cut her off. >> So that's the same thing he told me. >> But I have a witness who said there were cars around but not anywhere near her and she said I wasn't really paying attention. I was watching I was watching my um my car or my phone and I look up and she's just beering over. >> How much did she say she had to drink? Did she tell you she had >> $1 20 minutes ago? I don't know if one Miller light would give you HGN. She annihilated this thing. She's lucky to be alive. Have you searched the car yet? >> Uh, no. All I saw was the phone, the uh medication. There's a couple things. >> Good god. >> Look, there's so it's so crumpled in there. I can't >> I mean, it reeks of weed. >> If it weren't flipped, I would >> make life a little bit easier, huh? >> I haven't even tried the driver's side. Nope. I mean, I can like crawl in here. >> Huh? >> If we need to. The only thing I really want to grab is her bag up there. See what's in that. >> When Logan gets here and they can flip it. >> True. >> I'll get in there. I'll figure out what we can see. >> Medication. Just fat burners. >> Just fat burners. Yeah. >> Okay. >> If she hit on the other side, it'll be whole story. >> That's what I'm saying, dude. I saw this. I was like, she's lucky to be alive. >> Thanks, Ashley. Take care. >> Thank you. I appreciate it. >> All right, Ashley. Have you even spoken at all today? >> I'm sorry. >> Have you even spoken at all today? >> I haven't right now. Haven't The last time I spoke was maybe like >> right before we went bowling. >> When was that? >> An hour or two hours ago. >> Okay. >> Cuz your car smells like marijuana. Okay. So, we do have to search your car just to make that aware. >> Yes, ma'am. >> Um I need you to put your hands behind your back for me. You're being placed under arrest for DUI less safe. >> Can I take off my um We'll take it off for you in a minute. >> Are you her sister? >> You're her sister. Okay. Do you want her to take >> No, she both. Both. You don't want the phone to jail with you? >> I'm sorry. >> Do you want to take the phone to jail with you? >> Do you have the like you? >> Okay. >> Um, >> you're her sister? >> Yes. >> Okay. Do you have a driver's license with you? >> I'm sorry. >> What's What's your name? Just so I can know who I'm releasing my property to. >> Catherine. >> Is that uh K? >> K E R. >> E R I N E. >> Okay. And your date of birth? >> 95. >> And a good phone number for you. >> Do you know which like precinct y'all will be taking her to? So, we're going to take her to the um Clark County Jail eventually. >> Yeah. Um >> from here. >> Okay. Yeah. Yeah. It depends on if she wants to take a blood test or a breath test. Um that's going to factor into how long until she's going to be there. If she takes a breath test, it's usually like maybe an hour. If she wants to take blood, it could be up to 2 3 hours. Um so, as far as when she's going to be there, I'm not entirely sure. >> Okay. So, what am I going for? >> DI less safe >> for drinking under the improvement. But I wasn't drinking >> for for drive. You said you were drinking and I smell alcohol on your So DUI less safe means that you were drinking and you were impaired to the ability that you cannot drive. So I need to turn around and face the car. >> But I wasn't though when I passed the soriety. >> That could be something. No test >> and then she'll make bond. Um that's going to be up to the jail. That's not >> that probably like not happen until >> I would. Yeah, probably Monday. So uh well today's Saturday. >> All right. Do you have anything in your pockets to stick or poke? No, I'm asking you. How am I going to jail if I pass the sobriety test? >> Because you did not. >> How did I not? >> Ashley, >> what did I fail though? Ma'am, I'm asking you a question though. But I'm asking you a question. >> Ashley, spread your feet. >> But tell me, how the did I fail my sobriety test when I passed it? You can get >> Sir. Sir, did I not pass my sobriety test? >> Can I ask you if I passed my sobriety test? >> I was not the one he >> But you saw me passing it though. >> It's not mine. It is not my investigation. saying that I failed it, >> but I passed it in front of her. How does that make sense? >> It's okay. >> So, um, yeah, I'm not entirely sure how long it's going to take. >> Okay. So, I've never liked what the process of this is. She'll just be able to call. >> Yeah. So, she if she does she have your phone number memorized? She said she did. Hold on. She's going to talk for throughout. >> So, you're not going to tell me how I I failed the test? >> You failed the eye portion of the test. How did I fail? >> Did I not follow the tip of your finger? >> Okay. >> Did I We'll >> discuss it in a minute. Okay. >> Once bail is posted, whoever wants to post her bail, um you can do that. Okay. >> Or if she doesn't make bail, then she'll hang in there till her court date. >> All right. I don't know if she has like her license and her stuff. >> So, when uh the tow truck gets here, it's going to it's going to get flipped over. I'm then going to search the car. Uh I do smell marijuana coming from the car, so I'm going to search the car. >> All right. How old are you? >> Did I pass the not? Did I pass the sobriety test? >> Okay. How did I fail that test? Tell me how the I failed at it first. No, >> not right now. >> Don't ask me no mother questions unless you're telling me how I failed. >> All right, let me read you something. The state of your privilege put me under my right arrest without reading my Miranda right. >> That's fine. Then she can sit in the back of the cop car until she doesn't want to have an attitude with us. determin right there. Got you. Close my mother. Your Georgia driver's license. She's going to go to jail. >> Can you please close my door? Cuz you did not. I I never failed a test and you never read me my Miranda rights. >> You never read me my mother Miranda rights. >> Get out of my face. That's what the need. >> Your Georgia driver's license are privileged to drive on the highways at the state. And how did I fail the sobriety test though when I did everything? >> You racist. Get the out of here. Close my car. >> You're good to get out of here, my man. You're getting You're going to roll today and from your own choosing. >> Well, you submit to the state administered chemical test of your blood. >> You didn't read me my Miranda rights and you didn't you you did the sobriety test and didn't even I didn't even fail. So, I don't know how the >> Okay. Where's your car at? >> Oh, right there. All right. You guys want to go hang out there? Uh, we're not going to have a whole bunch of people around here. All right. >> I didn't even telling me that I'm going to jail for failing a >> Will you submit to the state administered chemical test? >> No, I want you to leave me. >> Makes that easy. >> Yep. >> 7:30 Central. Will you make a note that she has declined taking blood or breath test? >> If uh if I find anything, I'll run it up to you at the hospital. What's up, man? How we doing? Yeah, they somehow walked away from this thing. Um, when you do flip it, I'm going to have to search it. I don't know if that has any play in how you flip it, but the grass is your oyster. >> So, I'm not going to the jail. >> You have to be medically cleared by the hospital before we go to the jail. >> There's nothing wrong with that. >> I still have to have you medically cleared before we go to the jail. >> So, how long is all this going to take for I'm going to make bail and go back home? >> It just depends on how long the hospital takes. Is there no way for y'all to see how much alcohol was in my system? Cuz she's trying to say that I failed a soriety test and >> I offered you the blood test and you declined. >> No, you did not. You never offered me nothing. >> While you were screaming at me rights, you didn't offer me nothing. >> I'm not going to argue with you. >> You didn't even give me help before you started a test. >> So I offered you hear your mouth. That's to be honest. I don't. >> So, you declined it. That's where we're going. >> I never declined nothing. I would really like to do a sobriety test. I mean, um, a blood test to see how much alcohol is in my system cuz she's saying I'm drunk and I failed the sobriety test, but I didn't. >> In order to get one on your own, you have to comply to the state's required one. >> So, if you would like to do a blood test, I will reread you the implied consent for blood. >> Blood test, please. >> Yeah. We're going to get you back here in just a minute. Get you checked by a doctor. Um, how did the car look? What What did >> It's totaled. >> Total. >> Yeah. On its top. >> On its top. Yeah. >> Did you have Did she have to get extricated from the car or >> No, I actually was I didn't hit nothing. I had my seatelt on. I undid my seat belt, fell to the top, and crawled out because I smelled smoke. >> I got you. Okay. >> This is a level two Toronto. >> Okay. >> All right. Thanks. >> Thank you. >> Is mom around you or did they leave early? Can I talk to mom? Yeah. I had denied to get checked cuz I know nothing's wrong with me. But um she still brought me here anyways. No, nothing. She didn't even want to give me a toxicology. Kept telling me no until I got here and told them to do it. >> 08 or more. Your Georgia driver's license or privileged to drive on the highways of the state may be suspended. failed theory test when I did the requested state. How about that? >> Or other bodily substances at your own expense and from your own choosing. >> Will you submit to the state administered chemical test of your blood? >> You didn't read me my Miranda rightites and you didn't you you did the sobriety test and didn't even >> for them to try to hit me with the DUI. There's no way. I wasn't drunk. I wasn't doing anything. Nobody's telling me anything at all. Like she's not telling me anything. She just brought me here. They did um a CT scan and all that. I'm guessing it's so I could sit here and then have to wait till Monday to even go to court and do anything. That's why. Yeah, that's exactly why she brought me here because there was no reason for for them to bring me here when I told the ambulance that I was denying that I didn't want to go with them. So, I didn't understand why I had to be brought here anyways, but of course to waste time. So, I couldn't postpone. >> Bond is done at the time you're at the jail. It has nothing to do with dates. You were brought here because the jail requires a medical clearance prior to being brought at the jail. >> Yeah, I'm pretty sure. Yeah, I think I messed up my knee. I can barely walk on it. It hurts. No, like won't tell me nothing. But she sat there and said that I failed my the sobriety test. I passed everything. She said it smelled like weed and then all of a sudden put me in handcuffs. So then hit me with that I failed the sobriety test. I had one beer. One. There's no way in hell that I could even fail the sobriety test. It's completely total. Mom, I I was literally driving 60 to 65. That car sped in front cuz I was on the left lane. The car sped in front of me, cut me off, and when he did, I panicked and I hit the brake. As soon as the wreck happened, the cops got there. The first thing she does is ask me to do a soriety test to walk the line after I just told her like my knee was messed up. I literally flipped the car like multiple times and then she's like, "Okay, well, you need to do a soriety test because I can smell the alcohol." I'm like, "Yeah, you can." Because I literally drank a beer like 30 to 40 minutes ago, right before we left the the bowling alley. We were literally on our way to go eat instead of me going out. Should have just stayed home and this is what I did. And then what am I going to tell my job? What am I supposed to tell them? Like the cop is trying to say that I have a DUI. And it's crazy. Like I wasn't allowed a phone call or to even tell y'all that anything happened. I had to ask the nurse for a phone here. No, that's why I'm Mom. I had one one drink and it was a Miller light. Like they were really trying to find anything to get me for and I passed everything and then when I come back from getting out of the ambulance it's like oh well we found this in your car so now you you got to go in. That had nothing to do with the accident. Like you just told me that it was because I was drinking, but then like after they found whatever in my car, she came back and told me that I I'm getting arrested for a DUI. How the hell can you arrest me for a DUI and I'm not under the influence of anything? >> Caught. I don't want you ripping your hair out. >> I don't know what's wrong with it. >> It's all tangled and it's tangled down here. There we go. So, >> sorry. The suspect was booked for DUI less safe and failure to maintain lane.
